( james ) our top story this morning... an east bay community is mourning after a teenager is shot and killed by a b-b gun antioch police are calling the incident a tragic accident. kron4's ella sogomonian spoke with the friends who tried to save the teens life. a tragic start to summer vacation. 15-year-old marcos garcia was shot once in the chest by a friend with a bb gun rifle at his antioch home. it happened at the corner of palomar drive and point sal court just before 10 thursday morning.the kids panicked then brought marcos to their next door neighbor of 13 years for help. sot: jorge duran,

neighbor//"and i tried to feel his pulse if he was still alive. i felt a pulse but he was unconscious, he wasn't breathing, his lips were white."marcos later died at an area hospital. the freshman and a group were said to have come to his home unsupervised after they were let out early from deer valley high school to enjoy the first official day of summer. marcos's neighbors didn't make it yet. sot: aaron duran, friend//"he was like a best friend, he was like a brother to me. then when i found out that he got shot, i just got in shock and didn't know what to do."best friends aaron duran and chaz meyers who live and grew up on the same block with marcos say things will never be the same. sot: chaz meyers, friend//"movies, everything, we were three best friends and now it's only two."antioch police say this was an accident. chaz said the 15-year-old who shot marcos meant no harm and doesn't think he should be punished. sot: chaz meyers, friend//"i want to talk to him, comfort him and let him know it's okay because accidents happen." we are expecting to hear from the wife of one of the men facing charges in the deadly ghost ship warehouse fire. derek almena was the master tenant of the builidng. he made a brief court appearance yesterday but did not enter a plea. he is one of two men facing manslaughter charges for the fire. max harris, the other suspect, has now been booked into the alameda county jail. prosecutors say he organized the dance party the nght of the fire. we talked to the attorney for derek almena who says his client is ánotá the one responsible.

( james ) fired fbi director james comey testified for nearly two and a half hours about his conversations with president trump, his firing and the russia probe. among the revelations he outright accused the president of lying. and described the awkward relationship between them. comey also said the president demanded loyalty if he wanted to stay on as the fbi director. the president has denied that accusation. mister trump's attorney reiterated that as well. and comey said he fully believes he was fired for his refusal to drop the investigation into michael flynn.and his ties to russia. ( james ) comey would not say whether he thought the president obstructed justice. comey was critical of president obama's attorney general, loretta lynch, for her efforts to downplay the

hillary clinton email investigation. the president has not personally responded. instead letting his personal attorney say mister trump feels vindicated after hearing comey say he did tell the president three times that the president was not being personally investigated for having ties to russia. ( james ) earlier this morning president trump has responded to fired f-b-i's director james comey's testimony. he said in a tweet "despite so many false statements and lies, total and complete vindication...and wow, comey is a leaker" ( james @ landing ) happening today... its game 4 of the n-b-a finals. and the 1st opportunity for the dubs to close out the clevland cavaliers and win a 2nd n-b-a championship in 3 years. so far the team is a perfect 15-and-oh in the post season. kron4's mark carpenter is in cleveland and talked to the players ahead of tomorrow's game against the cavaliers. ( james ) a woman accused of her five-year old daughter in san now faces a felony charge of child police say patton is accused of her child near the san francisco zoo evening. the 22-year- old suspect is now in custody. paramedics in the area witnessed her leave the child near the intersection of the great highway and sloat boulevard.was unhurt. the 5-year-old girl and a boy are now in the custody of child services. ( james ) a car crash in the east bay has claimed a third victim . the horrific accident happened on memorial day. kron'4s hermela aregawi spoke with loved ones of victims and has the latests. the may 29th crash leaves three young people dead.the latest 22 year old sergio garcia of hayward.17 year old briana ortega died at the scene.and simon sotelo was pronounced dead shortly after. terina sotelo/victim's mother: that was my clown. that was my baby.for the sotelo's tragedy struck twice in two years.they also lost simon's older brother in a car accident. terina sotelo/victim's mother: it hasn't even been two years since we lost my oldest and now my baby. it's very hard. manuel rubio/victim's uncle:

kerman reports there is now a picture of a suspect on one of the fires. this person in the jacket and hood, with a backpack and riding a bicycle is the prime suspect in last months construction site fire on san pablo avenue in emeryvillesot jill snyder/atf special agent 11-16the video showed a suspect canvassing the building and then entering before the fire.at a news conference thursday afternoon, investigators with the bureau of alcohol tobacco firearms and explosives announced the fire was intentionally setsot arson is a crime, it's a dangerous act of violence this is our community and these acts will not be tolerated. this is the second time this construction site has gone up in flames. it first happened in july of 2016, and authorities have announced that too was arson though it's unknown if the same person is responsible. nor can they say why this building was targetted twicesoti cant speak to any possible motives

( james ) police are searching for new leads in a double shooting that left one person dead in sunnyvale. the shooting took place around 2 a-m in the parking lot of fair oaks plaza strip mall. a 21-year-old man was found dead at the scene. and a 24-year-old man remains in critical condition. no arrest have been made. ( james ) now to baseball... the giants trying to split the series with the brewers before heading back to san francisco giants went into the ninth with a 2-run lead. but closer mark melancon struggled up on the hill. travis shaw hits single bring in the tying-run at third. game tied at 5 then in extras, the giants offense put this game away. scoring four runs in the inning. giants win 9-5 ( james ) as for the team

( james ) in san jose... arson investigators are looking into a six different fires. they broke out early yesterday morning. every incident within a two mile radius from one another. five of the fires were set in dumpsters between two and five a.m in the area around clark street and dorothy avenue in the city"s willow glen neighborhood. in one incident flames jumped to a nearby grocery store which ended up sustaining considerable damage. ( james ) no one was hurt in any of the fires. last month a fire that damaged a nearby church was also determined to be suspicious. but so far it has not been linked to the fires yesterday morning.

different for bay area agriculture this spring and summer. and anytime something affects crops differently, grape growers and wine makers pay attention. to see what this year's changes mean for napa valley's most famous export kron four's spencer blake headed north with quad copter four to castello di amorosa. (pkg)the vineyards at castello di amorosa in calistoga are green and growing. check out the lush landscape as seen from quadcopter 4.they'd be doing that even in a dry year, but 2017 has changed the workload and the strategy of those working among the vines. "if anything we're going to have too much growth. that's one thing you run into in a wet year is that the vines will tend to grow a little bit too wild."winemaker peter velleno (vuh-leen-oh) says that can negatively affect the quality of the wine.but don't go worrying about your vino adventures getting ravaged.the experts here have ways of getting the vines back into

problem causes a nationwide recall on mibelas birth control tablets. the pharmaceutical company lupin says the expiration date on the box is no longer visible. this can cause problems from contraceptive failure and unintended pregnancy. anyone who encounters the contraceptive is asked to notify your doctor. ( james ) a cupcake is at the center of an investigation at a connecticut high school. the deceptive deserts were passed out around school only to find out they may tainted with 'bodily fluids' courtney zieller reports. (courtney zieller)this is the cupcake -- senior lena teixeira says she ate yesterday while waiting for the school day to start.she says a student in her class made about two dozen to give to seniors.lena teixeira, student: "she had made cupcakes i was assuming for the class of '17, that's what the 17 was for. i thought, we all thought, it was a nice gesture."but she quickly heard - half the batch was tainted with bodily fluids.and that's the cupcake she ate.lena

teixeira, student: "i feel violated and felt like they took something away from me and i don't know what i did for them to have done that." lena says at least three students are involved.this happened at the gilbert school in winchester.lena says the cupcakes that were tainted were marked.others were not. the school sent this statement saying in part... "our students' safety is our highest priority - if these allegations are found to be true, we condemn this behavior, and will take any and all appropriate actions to protect our students."the school is working with the police department - one cupcake was sent to a lab to be tested.lena teixeira, student: "we don't understand why they had to do something like that. there is 2 weeks til graduation." by police officers. this was the end of a police chase in jersey city. the man was driving home from work when his car was hit by the vehicle the police were chasing. at least one is seen kicking the man in the face or head area. miguel feliz suffered burns on 30 percent of his body. his face is swolen and his brother says he had surgery yesterday. he's currently in critical condition and "not doing well." the jersey city mayor wants the officers held accountable. police union says the officers were helping put out the flames. and get everyone out of harms way. it is not clear whether they knew he was an innocent bystander or thought he was the suspect they were chasing. ( james ) take a look at this -- a warning about always being aware of your surroundings. a 67-year- old nejersey woman remains hospitalized after falling 6- feet through an open cellar door while walking. this surveillance video shows construction workers going down the cellar to do some work. moments after the woman who was distracted on her phone falls down head first. fire crews were able to rescue the woman and carry her out of the basement. ( james ) not many dogs get to be firefighters, police k-9's and electricians. but that's just part of the experiences one man arranged for his beloved dog as he and his family prepare to say goodbye. tim griffin created a bucket list for his 12-year-old dog, molson after he was recently diagnosed with cancer-- and given only months to live. molson has gone from being an honorary firefighter to becoming sergeant molson with the pennsylvania state police. molson even got married. the wedding complete with a flower girl, ordained minister and a bride of course. two webpages are set up for mister molson. one where you can follow his adventures and another where you can donate to canine cancer research. you can find the links to

( darya ) a third person has died after a car crash on memorial day in the east bay. 22-year-old sergio garcia died of complications from injuries from the crash in alameda. 17-year-olds briana ortega and simon sotelo also died in that crash. the accident involved a minivan and a truck with six people in it. friends and family gathered at straw hat pizza in hayward yesterday for

accidentally shot and killed by a pellet rifle... and his friends tried to save his life. it happened yesterday morning in antioch. 15-year-old marcos garcia was shot once in the chest by a friend while they were playing with a pellet rifle. the freshman boys from deer valley high school were at marcos' house for their first day of summer vacation. they tried to get help when he went unconscious, but he later died at the hospital. we spoke with marcos' friends about the loss. ( darya ) antioch police say it is a tragic accident. friends of marcos say they don't think their friend who shot him should be punished because he didn't mean any harm. ( mark ) a former employee

( mark ) breaking news out of oakland where a car slammed into a home causing a gas leak. it happened around 3 this morning in the eastmont neighborhood. police say the driver crashed into a car that was parked in a driveway and then that car slammed into a home. crews quickly capped the leak and no one was injured. no word if the driver was found. the deadly oakland ghost ship warehouse fire. derek almena was the master tenant of the builidng. he made a brief court appearance yesterday but did not enter a plea. he is one of two men facing manslaughter charges for the fire. the other suspect, max harris, has now been booked into the alameda county jail. prosecutors say he organized the dance party the night of the fire. 36 people died in the december fire. we talked to the attorney for almena who says his client is ánot the one responsible.

( mark ) u-s regulators want a drugmaker to stop selling its opioid painkiller. the f-d-a said it has asked "endo pharmaceuticals" to stop selling its extended- release painkiller, "opana e-r." it is the first time the f-d-a has asked for the removal of an opioid painkiller. endo had touted the painkiller as abuse- resistant, but the f-d-a stopped the company from marketing it that way. the f-d-a says it is seeing a

( darya ) happening today... the alaska man charged in the deadly shooting at the fort lauderdale airport is set to appear in court. 27-year-old esteban santiago will attend one of several hearings about his health status. five were killed and six were injured in that shooting in january. santiago has schizophrenia, but his lawyers say he is fit to stand trial. he could possibly face the death penalty. santiago reportedly told the f-b-i he acted under government mind control. ( mark ) in the east bay... a teenager is accidently shot and killed by his best friend. they were playing with a pellet gun on the first day of summer vacation.( darya ) kron four's ella sogomonian has the story. a tragic start to summer vacation. 15-year-old marcos garcia was shot once in the chest by a friend with a bb gun rifle at his antioch home. it happened at the corner of palomar drive and point sal court just before 10 thursday morning.the kids panicked then brought marcos to their next door neighbor of 13 years for help. sot: jorge duran, neighbor//"and i tried to feel his pulse if he was still alive. i felt a pulse but he was unconscious, he wasn't breathing, his lips were white."marcos later died at an area hospital. the freshman and a group were said

( mark ) police are searching for the gunman in a double shooting that left one person dead in sunnyvale. we first told you about this story yesterday on the kron 4 morning news. the shooting took place around 2 a-m in the parking lot of fair oaks plaza strip mall. a 21-year-old man was found dead at the scene. and a 24-yearld man remains in critical conditn. the shooter is still on the ( mark ) a bicyclist suffered minor injuries in a crash with a self-driving vehicle in san francisco. the crash happened last month but the d-m-v has just released its report. the report says the car had to make a quick stop and the bicyclist...did not have time to stop...causing the rider to hit the back of the car. this is the forth accident involving a self-driving car in san francisco this year. ( darya ) jurors in the bill cosby rape trial heard the comedian's admission that he did give andrea constand pills before having a consentual sexual encounter. the prosecution read the transcript of an interview cosby gave police in 2005.

( darya ) a higschooler in los angeles is taking a stand against racism after her classmates posted a picture of her with a noose around her neck. 15-year-old aina (i-na) adewunmi (add-a-won-me) saw the picture posted in a chemistry chat room for her school. she transferred to the school just a few months ago. she says three boys used racial slurs before posting it online. the boys apologized and were suspended for a few days, but the girl's mom says that was not enough.
