the east bay. someone shot at a statue of a catholic saint. and now police are investigating it as a possible hate crime. kron four's spencer blake shows us the damage from san leandro. "it's just a shame, sad."a deacon at saint felicitas catholic church and school pointed out to kron four the several places where bullets damaged this statuealong with a flagpole and the roof over a breezeway."it's saddening and it's frightenening, but it makes us aware of what kind of world we're living in today."a neighbor heard the shots as they rang out saturday afternoon, and was even able to give a description of the suspected shooter to police. officers found the man who met the description, but he wasn't ready to go quietly."we gave him commands to comply with us, which he refused. shortly thereafter a wrestling match ensued between him and the officers. during the wrestling match it was discovered he had a gun in his waistband." finally police arrested the man, whose name and mug shot they've chosen not to release

while the d-a reviews the case. back at the church, parishioners were almost lining up to see the damage on the sculpture representing a second-century christian martyr.this man wasn't really interested in seeing the marks left by eight bullets up close. "i think from a distance is enough. it's kind of sad to see, just ya know i've seen enough."police want to figure out a motive - to see if it would qualify this case as a hate crime, though parishioners told me they've never felt oppressed as catholics in this area."it's kind hard, hard to guess if it's religious, 'cause we're very diverse here; we have vietnamese, hispanic, white, every nationality comes here so it's kind of hard to figure out what the motive was."the deacon i spoke to doesn't have a damage estimate, but he says church staff will be meeting to decide whether to repair, replace, or leave the statue as is.(looklive)"after first getting news of the violent vandalism, about 15 people from the church prayed around this statue.and even prayed for the shooter who caused them so much emotional pain.in san leandro, spencer blake, kron four news.

( james ) the alameda county sheriff's department needs help finding a man who went missing in lake tahoe. deputies say dan pham got in his kayak last thursday at lester beach and has not been seen since. his brother is a sheriffs deputy in alameda county. search efforts by the el dorado county sheriff, the u-s coast guard and state agencies were unable to find him. ( james ) attorney general jeff sessions has reportedly agreed to appear before the senate intelligence committee. sources say that sessions sent a letter over the weekend offering to testify tomorrow. it's not clear whether it will be a public hearing or conducted behind closed doors. the panel will decide. sessions recused himself from overseeing the federal investigation into possible collusion between the trump campaign and russia back in march. this after admitting he met twice last year with the russian ambassador to the u-s.

a school district superintendent is apologizing to a student who was denied the chance to walk at graduation... for wearing his military uniform. 18-year-old harland fletcher from brentwood is a u-s army reserve medic for the state of california. fletcher wanted to wear his military uniform to graduation at liberty union high school... something he says he discussed in advance with several school officials. but because he did not wear his cap and gown over his uniform.. he says the school did not allow him to cross the graduation stage. it is against military uniform code to cover a service uniform. but this morning.. the district's superintendent is responding to the incident. writing..."on behalf of the liberty union high school district, i publically apologize to him and his family for this incident. no slight was meant to harland nor to the u.s. army." fletcher will be allowed to pick up his diploma later ( james ) happening tonight: game 5 of the nba finals. the warriors have

off-duty bartender was beaten to death by a person who had recently been kicked out of a popular san joaquin county bar. that victim's friend is speaking out about the incident this morning. doug johnson has the story. a man died after being beaten by a patron who had recently been kicked out of a lathrop pub, according to a friend close to the victim. robert crabtree, an off-duty bartender, hit his head on the pavement outside of the fireside inn when he was allegedly assaulted by michael west. at the hospital, his family chose to take him off life support when his brain stopped functioning following surgery, according to co- workers.west, 37, was booked into san joaquin county jail thursday on several charges including involuntary manslaughter, battery against an emergency person and assault with a deadly weapon. crabtree had already called police to get west thrown out of the bar for stealing other people's drinks and taking money left for bartenders. people at the fireside inn believe that west came back to start a fight specifically with crabtree.patti deangelis was close with crabtree. she said he had worked in lathrop for over 20 years and was well-known in the town.west's first court date is set for tuesday.

( james ) the weather caused a major problem for athletes competing in the "escape from alcatraz" tri-atholon. for the first time in history, the swimming portion of the competition was canceled because of dangerous currents in the bay. kron four's averi harper has the story. many racers traveled thousands of miles to be in san francisco for the epic race...they had to make the best of it after the most iconic leg... the swim from alcatraz to marina green was canceled."little sad that we won't get to swim but i think my stronger legs are the bike and the run it will be an advantage for me i guess i'm super excited i get to start the bike without being tired from the swim."thousands of participants....from all 50 states and around the globe were here.even seven olympians who competed in rio suited up for the event.all the training didn't go to waste.... this triathlon turned biathlon was still a tough course.18 miles biking... lots of it a grueling trek uphill.followed by an 8 mile run through the city!before the finish at marina green."nine months of

( james ) happening today... bill cosby's defense lawyers will begin calling witnesses in the commedian's rape trial. the prosecution rested it's case on friday. cosby was originally ánot going to testify in his high profile sexual assault case, but his lawyer says that is now a possibility. the 79-year- old faces possible prison time if convicted of drugging and molesting andrea constand at his philadelphia home in 2004. cosby's defense team says he only gave the victim benadryl and that the sexual encounter was consensual. ( james ) eighteen members of a penn state fraternity will be in court today to face charges in the hazing death of a pledge. 19-year-old tim piazza died in february. authorities say he appeared to be heavily intoxicated as he fell several times, including down a set of stairs. the hearing will determine if prosecutors have enough evidence to send the case to trial. security video from

after staying at a las vegas hotel. uests were diagnosed with what's called legionnaires disease - a form of lung disease, which can be very dangerous depending on who gets it. and because it can just look like pneumonia, health officials are concerned there are more people out there with the disease. kron4's hermela aregawi explains. the southern nevada health district says the bacteria that causes the disease was

found in water at the rio hotel.two guests that stayed there one in march.. and another in april showed symptoms after returning home - sparking an investigation late last month.mark bergtholdt/southern nevada health district: "its actually one of the most undiagnosed diseases we have because it presents as pneumonia and doctors dont test for legionnaires."legionnaire's is a lung infection. it can be dangerous for the elderly.... smokers... or anyone with a weak immune system.mark bergtholdt/southern nevada health district: thats one reason we issued the press release, were concerned there may be people out there who come down with pneumonia and may not be diagnosed. we're trying to identify how large this cluster is."the rio hotel says it's taking aggressive action.out of an abundance of caution, the hotel has moved guests from the areas where the bacteria was found - and are flushing the system with chrlorine.(hermela aregawi) symptoms include fever, cough, chills or muscle aches. and show up within 2-10 days of exposure.

( james ) a pasedna boy remains missing this morning. more than 150 people went out over the weekend to search for five-year-old aramazd andressian. alys martinez has the story. a five-year-old boy has vanished after a trip to disneyland. . the search resumed this morning for aramazd andressian junior over 150 people are currently searching a 20-mile radius of santa ynez.... to find the five-year-old. aramazd has been missing since last month. he was last seen leaving disneyland with his father who is in a custody battle with his mom. aramazd's dad was later found drugged and passed out without his son. aramazd's dad was arrested after his son disappeared, but was later released. however...he is still a person of interest in the case.

( james ) uber is discussing the fate of its c-e-o today. uber management has been accused of turning a blind eye to harassment, discrimination and bullying. the accusations are being investigated by former attorney general eric holder. the board met yesterday to consider recommendations made by holder. the meeting comes days after the company fired 20 employee for bad behavior. the board is considering asking c-e-o travis kalanick to step down amidst all the controversy. ( james ) san leandro police arrest a man for shooting at a church statue. police are now investigating it as a possible hate crime. this happened saturday afternoon at the saint felicitas (fell-iss-it-uss) church. church members have since lined up to see the damage left by eight bullets hitting the statue of a catholic saint. police found a man who matched witnesses' description of the gunman shortly after the shooting. there was a struggle during the arrest and police found a gun on his waistband. parishioners spoke to kron four about his possible motive for the shooting. ( james ) police have not yet released any information about the man they arrested in connection with the shooting.

( james ) there are new efforts in the fight to keep the raiders in oakland. a

( mark ) the average price of dropped less than a penny per gallon over the last three weeks. the national average of regular gasoline is now at $2.40 per gallon. analysts say that gas prices in the coming weeks may decline unless crude oil prices rebound quickly. taking a look at gas prices around the bay area. in oakland and san jose it costs $3.13 for a regular gallon of gas. and in san francisco it will cost you $3.24. that is the highest average price in the ( mark ) happening today... crews in contra costa county will begin fixing alhambra road... months after it was washed out during severe winter storms. the

repairs will happen between the intersections of castro ranch and pinole valley roads. officials say the work will include the installation of a 60-foot long bridge that will have shoulders for bicycles and pedestrians. construction is scheduled to be finished by the end of september. ( james ) attorney general jeff sessions has agreed to testify before the senate intelligence committee. it's not clear whether it will be a public hearing or conducted behind closed doors. the panel will decide. sessions recused himself from overseeing the federal investigation into possible collusion between the trump campaign and russia back in march. this after admitting he met twice last year with the russian ambassador to the u-s and not disclosing those meetings when he received his security clearance.. sessions will likely face questions from senators not only about those meetings... but also about his involvement in the firing of f- b-i director james comey. theatre" in new york city over an assassination scene with a president trump look-alike. bank of america and delta airlines pulled their support from the theatre over its rendition of shakespeare's "julius caesar." their version includes a gory assassination scene and a ruler who resembles president trump. it features a julius caesar who has blonde hair and wears a suit and long tie rather than a toga. delta said it pulled its sponsorsihp because the play crossed the line on the "standards of good taste." the play officially opens tonight. ( mark ) there are new efforts in the fight to keep the raiders in oakland. a news conference will be held later this morning to address the raiders move to las vegas. the group "stand with oakland" is now working with several sports lawyers to fight the nfl's decision to move the oakland raiders to las vegas. the group says their focus is on keeping professional football in oakland. ( mark ) puerto rico voted to become the 51st state, but it is up to congress to make the final decision.

97-percent of voters chose statehood in a non-binding referendum. the governor of puerto rico is heading to washington to lobby for statehood before congress and the white house. the island is billions of dollars in debt and struggles with high poverty rates. u-s congress has the final say on any changes to the u-s territory's political status. ( james ) the next lyft car you book may soon be a jaguar or a land rover. the british company behind the two car brands is investing 25- million dollars into lyft.

( james ) today marks the one year anniversary of the deadly pulse night club shooting.( mark ) and early this morning a large crowd gathered outside the night club to remember the 49 people killed.( james ) andrew spencer has the story. staring at the candles... at the memorial outside the pulse nightclub... brought many people back to last year's shooting.linda stewart / florida state senate: "when you remember the tragedy that did happen, there's no way around it; there's gonna be tears."for about an hour, overnight, people dressed as angels stood somberly outside the shuttered orlando nightclub......the formality of the ceremony helping them deal with the gravity of what

( mark ) police have arrested a man they say burglarized two businesses in martinez. police responded to reports of a burglary yesterday morning at an antique store on main street near ferry street. investigators say the man was gone by they police arrived so officers viewed the surveillance footage of the burglary. police received a report of a silent alarm had been triggered at a business less than a mile away. when officers arrived, they found the man from the earlier surveillance video. police arrested stanley holton who they say was already on probation for assault with a deadly weapon. ( mark ) the search continues this morning for a 5-year-old boy who vanished after a trip to disneyland. aramazd andressian is from south pasadena and has been missing since april 22nd. he was last seen leaving disneyland with his father. police say the man is currently in a custody battle with the boy's mother.

she reported her son missing after his father did not bring him home. police say his father was then found drugged and passed out in a park near solvang. he told police that he could not remember what happened to his son. he was arrested and later released, but is still a person of interest in the case. ( james ) eighteen members of a penn state fraternity will be in court today to face charges in the hazing death of a fraternity pledge. 19-year-old tim piazza died in february. investigators say he appeared to be heavily intoxicated as he fell several times, including down a set of stairs. the hearing will determine if prosecutors have enough evidence to send the case to trial. security video from inside the frat house that night will play a big role in the hearing. piazza's parents say their son was murdered.
