( marty ) the first criminal case against bill cosby has ended in a mistrial. after deliberating for six days, the jury could not reach a verdict. scott mclean has more from the prosecution who says they will seek a re-trial. scott mcclean:"despite their best efforts the seven men and five women of the jury were not able to reach a unanimous verdict in the bill cosby trial. but cosby is not off the hook there will be a retrial. for the thousands of

( marty ) in davis... a woman is being sentenced to five years of probation after vandalizing a mosque back in january- lauren kirk quell-low vandalized the city's islamic center. the video shows broken windows, and damaged property she also placed bacon on the door handles - a way to antagonize muslims who don't eat pork. kirk-quell-low - who was diagnosed with bi-polar disorder -- plead guilty to felony charges. a civil rights attorney, spoke about the sentence the woman was given. fire northwest of los angeles. it broke out near a lake yesterday afternoon firefighters say the flames are not threatening any homes right now. no injuries have been reported as a result from ( marty ) 62 people are dead after a wildfire spread to a small town in central portugal. the government say some villages are "completely surrounded," by the fire. officials say there are not enough firefighters to combat the flames in the area. three of the victims died from smoke inhalation and 16 others burned to death inside their cars while trying to get away. ( marty ) we've learned the bodies of seven u.s. sailors who went missing after a ship crash, have been found. the sailors were on board this heavily damaged navy destroyer. the ship were on collided with a huge container ship in the pre-dawn hours saturday. the uss fitzgerald is now back at its home port near tokyo. the

bodies were recovered on board that ship. the navy says the fitzgerald was damaged above and below the water line. experts say the collision raises serious questions. ( marty ) the investigation now focuses on how the navy ship managed to collide with a cargo ship more than four times its size. ,

muslim community is trying to move forward after this attack. they gathered in the islamic center to begin their fast during the month of ( marty ) in national news... the russia probe is adding to tension among top justice department officials. deputy attorney general rod rosenstein could end up recusing himself from the russia investigation... this comes two months after taking over the role of "overseeing" the investigation from attorney general jeff sessions. elise labott reports, it may have something to do with rosenstein's role in the firing of f-b-i director james comey. the deputy attorney general could be the next department of justice official to recuse himself from overseeing the special counsel's russia investigation... which rod rosenstein himself set the possible move in motion by hiring robert mueller to lead the probe.rod rosenstein/deput y attorney general:"director mueller is going to have the full degree of independence that he needs to conduct that investigation appropriately."

rosenstein's role is under scrutiny now that it appears mueller's probe could broadened to investigate obstruction of justice - which could include the president's firing of f-b-i director james comey.rosenstein played a role in that decision - his memo critical of comey - was initially used by the white house to justify the termination. vice president mike pence:"president trump made the right decision at the right time to accept the recommendation of the deputy attorney general and the attorney general."the president later admitted he was going to fire him anyway: president donald trump:"oh i was gonna fire regardless of recommendation."today, a justice department spokesman told cnn, this about rosenstein's future - quote "if there comes a point where he needs to recuse, he will... however nothing has changed." questions about his recusal come after this strange statement late thursday... in which rosenstein himself referred to recent media reports about whether trump was being investigated, saying quote... allegations."that drew concern from democrats like diane feinstein, who sits on the senate intelligence committee - that trump was not only considering firing mueller, but rosenstein as well. in a statement calling such a move a "blatant violation" of the president's oath of office, feinstein warned quote - "if the president thinks he can fire deputy attorney general rosenstein and replace him with someone who will shut down the investigation, he's in for a rude awakening."if trump does fire rosenstein - or he recuses himself, mueller's investigation would be overseen by associate attorney general rachel brand... who the senate confirmed in may to be the third highest ranking official at the justice department. brand previously served at d-o-j under president george bush.rachel brand/nominee for associate attorney general:"if confirmed, i will strive to undertake my roll with integrity, independence and fidelity to constitutional principles and the rule of law." ( marty ) another big story we are following this morning... a black lives matter rally in oakland organized by a teenager... kron4's ella sogomonian reports, local demonstrators

are refusing to accept the final verdict of the minnesota police officer who shot and killed philando castile during a traffic stop. (nats: when i say black lives you say matter, black lives matter. black lives matter." around 200 enraged protestors met peacefully in front of oakland city hall saturday night. a 16 year old girl organized the event within 24 hours of learning minnesota officer jeronimo ynez was found not guilty for shooting and killing philando castile during a traffic stop.sot: lucy siale, organized protest//"for the past couple of years we've been telling black folks and black children to keep doing the right thing. keep being respectful keep doing that. and philando castile was doing the right thing. he was sitting in his car innocent and when he was still murdered and when the police officer who did that, the murderer who did that got away with it that's what really triggered all of this." castile's girlfriend recorded

police say the 58 people missing from this week's apartment fire are believed to be dead. and now the fatal fire is causing those who lived in the high rise to question the safety of the building. in the past, officials told residents to stay in their units, rather than evacuate. unless the fire is on their floor. but that strategy failed on wednesday during the massive fire. police have confirmed 30 others have died in the blaze. fire experts still say the best advice in these situations is to "stay put" in that kind of situation as long as the apartment building has a working sprinkler system and fireproof doors. ( marty ) 62 people are dead after a wildfire spread to a small town in central portugal. the government say some villages are "completely surrounded," by the fire. officials say there are not enough firefighters to combat the flames in the area.

three of the victims died from smoke inhalation and 16 others burned to death inside their cars while trying to ( marty ) another big story we are following this morning... we've learned the bodies of seven u.s. sailors who went missing after a ship crash, have been found. the sailors were on board this heavily damaged navy destroyer. the ship were on collided with a huge container ship in the pre-dawn hours saturday. the uss fitzgerald is now back at its home port near tokyo. the bodies were recovered on board that ship. the navy says the fitzgerald was damaged above and below the water line. experts say the collision raises serious questions. against bill cosby has ended in a mistrial. after deliberating for six days, the jury could not reach a verdict. scott mclean has more from the prosecution who says they will seek a re-trial. scott mcclean:"despite their best efforts the seven men and five women of the jury were not able to reach a unanimous verdict in the bill cosby trial. but cosby is not off the hook there will be a retrial. for the thousands of cosby accusers there is still

hope for justice. for cosby himself, another chance to restore his reputation, at least in the eyes of the law". bill cosby left the montgomery county court the same way that he walked in -- a free man.after more than 50 hours of deliberations over six days, the jury in the indecent assault case told the judge they were deadlocked for a second time -- this time hopelessly -- forcing the judge to declare a mistrial. kevin steele, district attorney: "we're disappointed that the jury was not able to come to a unanimous verdict in this case."kevin steele, district attorney: "we had to overcome a number of obstacles put in our way."the prosecution is promising to seek a retrial on behalf of the plaintiff, andrea constand, who accused cosby of drugging and assaulting her back in 2004.dozens of other women have come forward with similar stories.the lawyer for many of them says this is not over.gloria allred, attorney:
