( marty ) in the east bay. a man is shot and killed in front of a popular movie theater in concord. police say they now have the suspect in custody. kron four's philippe djegal explains what happened and spoke with the father of that murder suspect. (philippe) brad jacobson lives in the home behind me here on teresa lane... where the concord police department executed a search warrant early in the morning, just hours after a homicide was reported in concord outside the brenden theater. the police department confirms that this investigation is connected with that homicide. brad says that his son is who police are looking for... but during the process of the police department executing the search warrant... brad, his wife and daughter were detained.brad jacobson/suspect's father-

"traumatized. i'm devastated. i'm fááááág, fááááág livid." jacobson says his 26- year-old son was not home when police showed up early in the morning. he says despite telling officers that... police still shot tear gas into the home and destroyed several windows and other property while serving the warrant... in addition to shooting and killing his blue-nosed pitbull.brad jacobson/suspect's father- "(philippe) why'd they shoot your dog? (brad) uh, he came outside and got off the leash and he went after their dog. but normally, where i've ever been, you get a dog into a dog fight, you break them apart. they're grown fááááág men. you don't have to kill it. (brad) it was one dog, yeah." admittedly, jacobson says his son has had several run-ins with law enforcement in the past, but not at this scale. it appears his son is a suspect in an early morning homicide in concord. just before two o'clock in the morning... concord police say a man was shot to death on salvio street near adobe street. he passed away on the sidewalk. brad jacobson/suspect's father- "(philippe) have you heard from your son? (brad) no, i havent, yes, i did -- he called me. (philippe) what'd he say? (brad) he didn't know nothing. he said he didn't know anything about it and i told him to call the police. ( marty ) in davis... a woman is being sentenced to five years of probation after vandalizing a mosque back in january- lauren kirk quell-low vandalized the city's islamic center. the video shows broken windows, and damaged property she also placed bacon on the door handles - a way to antagonize muslims who don't eat pork. kirk-quell-low - who was diagnosed with bi-polar disorder -- plead guilty to felony charges. a civil rights attorney, spoke about the sentence the woman was given. ( marty ) in national news... the russia probe is adding to tension among top justice department officials. deputy attorney general rod rosenstein could end up recusing himself from the russia investigation... this comes two months after taking over the role of "overseeing" the investigation from attorney general jeff sessions. elise labott reports, it may have something to do with rosenstein's role in the firing of f-b-i director james comey. the deputy attorney general could be the next department of justice official to recuse himself from overseeing the special counsel's russia investigation... which rod rosenstein himself set the possible move in motion by hiring robert mueller to lead the probe.rod rosenstein/deput y attorney general:"director mueller is going to have the full degree of independence that he needs to conduct that investigation appropriately." rosenstein's role is under scrutiny now that it appears mueller's probe could broadened to investigate

( marty ) the first criminal case against bill cosby has ended in a mistrial. after deliberating for six days, the jury could not reach a verdict. scott mclean has more from the prosecution who says they will seek a re-trial. scott mcclean:"despite their best efforts the seven men and five women of the jury were not able to reach a unanimous verdict in the bill cosby trial. but cosby is not off the hook there will be a retrial. for the thousands of

( marty ) in california news... police are searching for whoever is responsible for the murder of two people in modesto. the bodies of a woman and two children were found inside a home. a man was also found injured outside the house. he was taken to the hospital for treatment. police are still investigating the homicide ( marty ) a wildfire in southern california has now burned over 550 acres at least nine aircrafts are fighting the fast-moving brush fire northwest of los angeles. it broke out near a lake yesterday afternoon firefighters say the flames are not threatening any homes right now. no injuries have been reported as a result from the blaze. police say the 58 people missing from this week's apartment fire are believed to be dead. and now the fatal fire is causing those who lived in the high rise to question the safety of the building. in the past, officials told residents to stay in their units, rather than evacuate. unless the fire is on their floor. but that strategy failed on wednesday during the massive fire. police have confirmed 30 others have died in the blaze. fire experts still say the best advice in these situations is to "stay put" in that kind of situation as long as the apartment building has a working sprinkler system and fireproof doors. ( marty ) 62 people are dead after a wildfire spread to a small town in central portugal. the government say some villages are "completely surrounded," by the fire. officials say there are not enough firefighters to combat the flames in the area.

three of the victims died from smoke inhalation and 16 others burned to death inside their cars while trying to ( marty ) another big story we are following this morning... we've learned the bodies of seven u.s. sailors who went missing after a ship crash, have been found. the sailors were on board this heavily damaged navy destroyer. the ship were on collided with a huge container ship in the pre-dawn hours saturday. the uss fitzgerald is now back at its home port near tokyo. the bodies were recovered on board that ship. the navy says the fitzgerald was damaged above and below the water line. experts say the collision raises serious questions.
