( james ) our top story this morning... the sweltering temperatures today could spell trouble for firefighters battling a brush fire in the south bay. they have it about half contained right now... and also have stopped its forward progress. the fire is burning in east san jose near quimby and mount hamilton roads. kron 4's hermela aregawi has the latest. (hermela aregawi)fortunately, no injuries and no evacuations at this point. when this fire started just before 6 oclock this evening - it was about 30 acres.now it is at 54 acres. but fire officials tell us it is 70 percent contained at this point.and it is not spreading.we're told there are

about 130 people working this fire.and that they'll be here through the night and into tomorrow morning.we spoke to with people who live nearby.. some couldn't even get to their homes.and they shared with us their concerns.. let's take a listen.peter david/can't get home:obviously i couldn't make it home, but my wife was 10 minutes ahead of me and she made it home without seeing the fire. she's reporting that choppers are coming over dropping water on the farms.steve coates/lives nearby:we've probably had 8 or 10 fires. we've lived here for 44 years. my life was born here a lot longer than that and calfire has always done a good job for us. we've never lost a structure. the fact that it's not windy now is a really good sign for everybody. if it was windy i would be very concerned but since it's not i think they're in the mop up phase.now the concern is temperatures tomorrow.it's going to be very hot and if the wind picks up, this may continue to be a problem. ( james ) the heat is being blamed for at least two

deaths in the south bay. 72-year-old dennis young and 87-year-old jordan setsu both died monday in san jose. the coroner confirms both deaths were heat-related. cooling centers have been set up at the santa clara valley medical center... as well as at public libraries and several community centers throughout the south bay. ( james ) the hot weather is not only proving deadly... but also dangerous for drivers. several roads in the north and east bay have buckled in the unrelenting heat. kron4's jr stone explains. take a close look at this section of westbound i-80 in vacaville near alamo drive. crews spent several hours tuesday repairing what was a road buckle here.meaning the pavement expanded in the hot weather and grew out of place putting thousands in danger. sot it's highly unusual in the bay area but the heat wave has been unusual so it's an unusual circumstance.tuesday there were two sections of i-80 that buckled in vacaville. the second section

was here near lagoon valley road. that's not all.this past weekend a section of highway 50 buckled as well. and in santa rosa this sidewalk buckled. sot usually it happens on older roadways so even the smallest crack that happens over time that can lead to some buckling.this is how bad a roadway buckle can look before it's fixed. it happens when there are extremely hot temperatures often after periods that have left the ground moist. cars have even been known to ramp off buckles in some cases.sot it won't melt your tires but what it does actually your car could bottom out so you might scrape the roadway.slow down drive with caution and do what measures you need to take and call 911. ( james ) breaking news from overnight. police in brentwood are investigating a double homicide that happened late last night on birch street. that's where officers found two men suffering from gunshot wounds. both died before they could be taken to the hospital. no one else was injured. police are working to identify the shooter. ( james ) police have arrested a fourth suspect in connection with the brutal beating of a lyft driver in san francisco. 25-year old quintrell anderson was taken into custody monday and charged with assault with a deadly weapon. three others were arrested last

week... and have all pleaded "not guilty." police say all four were part of a group of dirt bike riders involved in a sideshow on highway 101 back in march. the attack happened after a lyft driver tried to pass them. investigators say the riders boxed him in and began hitting his car, then beat him when he got out to confront ( james ) kron 4 has learned that the albany school board has voted to expel a student over racist posts on an instagram account. some of the posts targeted other students... and one faculty member. more than a dozen students were disciplined including several who liked or commented on the images. officials say the student can appeal the expulsion to the county education department or appeal in court. ( james ) santa rosa police have released a sketch of a man suspected of sexually assaulting a woman during an attempted robbery. take a look. the suspect is described as a white male in his 30's. last seen wearing a white sweatshirt and carrying a backpack. the incident happened june ninth on south e- street. police say the suspect pushed a

female victim agaisnt the wall and attempted to grab her purse with one hand and touched her under her clothing with the other. the woman was able to fight him off and he has not been seen since. ( james ) police have arrested a san mateo county massage therapist they say sexually assalted a 40- year-old woman. police arrested this man. he is 51-year old shidong li. he was arrested in millbrae. police say the alleged sexual assault happened tuesday. it happened at the four seasons foot spa on 106- park place. there the woman told authorities she was touched inappropriately during a massage by li. police are asking any other potential victims to come (james) coming up.. the oakland police department is under fire again. why the are being accused of mishandling the investigation into a sex abuse scandal involving its officers. and... an east bay p-e teacher shot dead. how his students are mourning his death this morning.(rebecca) and after the break a look at your hot forecast.

they are now being accused of mishandling the investigation into sex abuse scandal involving its own officers. the jasmine abuslin case sparked attention across the bay area... now a report by the federal monitor which is overseeing the department says, if the feds had not gotten involved, no one may have been disciplined. kron 4's dan kerman has reaction from the mayor and the city's new police chief. this woman jasmine abuslin was at the center of an oakland police department investigation into allegations of sexual misconduct by its officers. but a new report by the federal monitor overseeing the department says opd's investigation into these allegations was wholly inadequate and the mayor and city administrator did not do enough to determine why the department had not investigated the case more thoroughlysot libby schaaf/oakland mayor 25-32we appreciate the report from mr. swanson and we are completely prepared to implement all of his recommendationsthe report says former chief (sean) whent sent an unmistakable signal

weekend. 31-year-old carlo tateo from oakland, was shot during an argument early sunday morning. it happened near the corner of folsom and 11th streets after leaving a business in the area with a group of his friends. tateo worked at skyline high school coaching the varsity football team. kron 4's alecia reid spoke with players who are mourning his loss. the varsity team is still in shock, and they're trying to make sense of it allpkgthe coaching staff at skyline high school is doing their best to get players back on track.it hit us really hardjoe bates / head football coach - it's a humongous, giant loss. giant loss. we were so looking forward to him helping these teens transition into adulthood news of coach carlo tateo's untimely death spread within hours of the sunday morning shooting in san francisco's soma neighborhood.enrique rodriguez / junior - it hit me hard. i didn't want to believe it, and as soon as i found out it was true i busted into tears darnell hardeman / junior - it was very heartbreaking to hear

that uhhhh. i just couldn't believe itplayers from the varsity football team remember him as a counselor that was caring who made it a point to help everyone.kids who did pretty bad stuff, he would try to create a bond with them so they start maturing and going in the right pathhis colleague, head coach joe bates says tateo has always been known for stepping in to help whenever there's an altercation.with a street team, walking through some of the worst neighborhoods. he was breaking up fights as he did when he passed awaytateo loved working with students from his alma mater. he also couldn't get enough of his 2 = year old daughter ... who he referred to as the reason to keep fighting. a go fund me has been set up to help his daughter and girlfriend in their time of grief.the team pledges to carry tateo's legacy both on and off the court. it's gonna hurt a lot but he'd want us to push through and stay strong and finish strong. standupso far police have not made any arrests or released a description of reporting in franciso.

( james ) now to baseball... the giants had another rain delay in atlanta this one 50-minutes but once things cleared up, giants pitcher jeff samardzija could have had better luck in this one. let's jump to the 7th where the braves were up 2 to 1. that's when tyler flowers drives one down the left-field line off samardzija. it hits the top of the wall and bounces back in. and after a review it is rules a home run. 3-1 braves but in the top of the 9th, the giants tied the game up with a solo shot by hunter pence. but the giants would go on to lose in extras when matt kemp hit a 2 run heart breaker. final score 5 to 3 braves. this is the giants 8th loss in there last 9 games. (philippe) since the november election... the alameda unified school district says it has responded to at least five-hate related incidents at it's schools. susan davis/ausd- "in some cases, it's been things like swastikas painted, or spray- painted on school property. we have had some threatening emails and texts and some

threatening texts in texts, which were, um, between students." in this most recent case... a teacher at edison elementary school called police saturday after walking by this message we've blurred out. it was found on the ramp leading up to the school office. it references hitler in quote used in a popular sitcom... and, also appears to make a threat to who alameda police say is an 18-year-old man who lives nearby. the message has since been removed. police have investigated the incident and say, without bringing charges, the case is closed.susan davis/ausd- "i can't stress strongly enough, how um, distressed we are that these incidents are happening in our community and how strongly we denounce them." susan davis, who speaks for the school district... says the administration is looking into expanding the anti-bullying curriculum.susan davis/ausd- 'its serious because of what's happening nationally now. so, we view any kind of anti-semitic or bias-related hate speech as painful to our community and

( james ) some controversy over the color of a k-f-c in the east bay. this is the k-f-c on encinal avenue in alameda. it recently got a new paint job. and it's too much for the city of alameda. the restaurant is now being forced to repaint. we visited the location and couldn't find anyone that had a problem with the color.

( james ) the bay area heat wave has claimed the lives of two local senior citizens in santa clara county. now, medical experts have some tips on how to protect your health in this extreme heat. those experts say hydration is critical. water is always the best choice. but sports drinks can also get the job done. the pool is a fun and easy way to stay cool on these hot days as well. something to keep in mind. some people such as children are more at risk than others when the temperature goes up. so make sure they take breaks from playing in the shade or in air conditoning during the heat wave.

last night it was at 30 acres but it quickly spread to more than 50 acres. at last check it was 55 percent contained and firefighters had stopped the fire from advancing. there is some fear that with the hot temperatures expected today that fires may continue to be a problem all across the bay area. ( mark ) caltrans officials are urging you to be careful on the roadways with all the hot weather... several roads have buckled in the north and east bay this week. crews were out repairing part of westbound i-80 in vacaville near alamo drive after the road buckled. that is when the pavement expands in the hot weather and gets out of place putting thousands in danger. it happens when there are extremely hot temperatures. repairs are also needed on another part of i-80 near lagoon valley road, and part of highway 50. caltrans says the buckling roads can severely damage your car.

a report by a federal monitor overseeing the department says o-p-d's investigation into the allegations was inadequate. the report also says mayor libby scaaf and the city administrator did not do enough to determine why the department had not investigated the case more thoroughly. mayor scaaf says she will implement the recommendations from the court- appointed ( james ) oakland police chief anne kirkpatrick says she will work to repair the shortcomings of top city and police officials. mayor schaff says her focus shifted from the sex scandal investigation in december to the deadly ghostship warehouse fire. the attorneys who filed the police misconduct lawsuit say they want the

( mark ) students are mourning the death of a physical education teacher in the east bay. 31-year-old carlo tateo worked at skyline high school in oakland. he was shot during an argument early sunday morning in san francisco's south of market neighborhood. it happened near the corner of folsom and 11th streets while he was with a group of his friends. tateo also coached the varsity football team at skyline. players remember him as a counselor who was caring and made a point to help everyone. ( mark ) so far police have not made any arrests in the shooting. ( james ) police have arrested a san mateo county massage therapist they say sexually assaulted a 40- year-old woman. police arrested 51-year old shidong li. he was arrested in millbrae. police say the

released a sketch of a man they say sexually assaulted a woman during an attempted robbery. the incident happened on june 9th on south e- street. police say the man pushed a woman against the wall and tried to grab her purse with one hand and touched her under her clothes with the other. the woman was able to fight him off. ( mark ) anti- semitic graffiti is discovered at an elementary school in the east bay.( james ) this is the most recent hate-related incident that the alameda unified scholl district has had to deal with in recent months. kron 4's philippe djegal has the story. district says it has responded to at least five-hate related incidents at it's schools. susan davis/ausd- "in some cases, it's been things like swastikas painted, or spray- painted on school property. we have had some threatening emails and texts and some threatening texts in texts, which were, um, between students." in this most recent case... a teacher at edison elementary school called police saturday after walking by this message we've blurred out. it was found on the ramp leading up to the school office. it references hitler in quote used in a popular sitcom... and, also appears to make a threat to who alameda police say is an 18-year-old man who lives nearby. the message has since been removed. police have investigated the incident and say, without bringing charges, the case is closed.susan davis/ausd- "i can't stress strongly enough, how um, distressed we are that these incidents are happening in our community and how strongly we denounce them." susan davis, who speaks for the school district...

( mark ) animal shelters in the east bay are getting ready for the 4th of july holiday by offering free adoptions. the contra costa county animal service waving all adoption fees on cats and dogs. officials say that some of the shelters are nearing capacity and they need to make space before the 4th of july holiday. they say that is the largest day for animals to runaway and become lost. all the dogs and cats have been spayed or neutered. they also already have their shots and have been microchipped. the free adoption is happening

storm cindy has made landfall. ( james ) the storm touched down on the gulf coast early this morning. millions of people are in the path of this storm. reid binion has the latest. turf was too hot for children to play on. they say playing on the hot turf can increase the odds of heat stroke and heat exhaustion. ( james ) more adults are avoiding large crowds in case of a terrorist attack than any time since right after september 11th. that is according to a new gallup poll. it found that 38 percent of americans are less willing to attend events that have large crowds. that percentage is even higher than it was after nine-eleven, when 30-percent of americans said they were reluctant to be in big crowds. the uptick in fear comes after four terror attacks in london this year including a suicide bombing at an ariana grande concert killing 22 people. 46-percent of americans now say they are less willing to travel overseas. ( james ) santa rosa police have released a sketch of a man they say sexually assaulted a woman during an attempted robbery. the incident happened on june 9th on south e- street. police say the man pushed a woman against the wall and tried to grab her purse with one hand and touched her under her clothes with the other.

the woman was able to fight him off. ( mark ) the albany school board has voted to expel a student over racist posts on an instagram account. some of the posts targeted other students and one faculty member. more than a dozen students were disciplined for the posts including several students who liked or commented on them. school officials say the student can appeal the expulsion to the county education department. ( mark ) this morning we are learning details about the jury deliberations that led to a mistrial in the bill cosby rape case. 10 out of the 12 jurors thought cosby was guilty but they could not change the minds of the other two. during an interview, one of the jurors who wanted to remain anonymous talked about how the jury was held in a small room during the deliberations. this juror says some grew so frustrated with the process that they actually punched walls and started crying. the prosecution has said that they plan to retry the case. ( james ) the flu vaccine was ineffective in protecting people 65 and older this last winter. u-s health officials say the vaccine did an average job overall..

( james ) a u-s air force drone caused a small wildfire after crashing near mount whitney. the unmanned drone was making a routine trip to an air force base when it crashed yesterday afternoon. the inyo county sheriff's department says the crash caused a small wildfire that was quickly under control. the surveillance aircraft provides weather intelleigence to the air force. no injuries were reported. the cause of the crash is under investigation. ( mark ) one california county is turning wastewater into drinking water.( james ) it's called "toilet to tap." orange county has had a plant that purifies wastewater and pumps it back into the groundwater supply for about a decade now.( mark ) now the county is working to convince the public that the water is indeed clean and safe to drink. the orange county water district set up a stand in hollywood to give away free ice-cold bottled water.( james ) they had a little trouble giving away their product to some... but others had no problem trying it.

( mark ) and the hot weather has forced the alameda county fair to cancel its horse racing event. the fair will still be open from 11:00 a.m. to 11:00 p.m. for the rest of the week, ( mark ) california's heat wave has also turned deadly in sacramento. the deaths of three people are being blamed on the heat. one of the victims was 88 years old. the other two were both under the age of 50. police say those two were found outside after being exposed to the heat for an unknown amount of time. city and county officials are now asking people to keep an eye on vulnerable neighbors. ( mark ) anti- semitic graffiti is discovered at an elementary school in the east bay.( james ) this is the most recent hate-related incident the alameda unified scholl district has had to deal with in recent months. kron 4's philippe djegal has the story. (philippe) since the november election... the alameda unified school district says it has responded to at least five-hate related incidents at it's schools. susan davis/ausd- "in some cases, it's been things like swastikas painted, or spray- painted on school property. we have had some threatening emails and texts and some threatening texts in texts, which were, um, between students." in this most recent case... a teacher at edison elementary school called police saturday after walking by this message we've blurred out. it was found on the ramp leading up to the school office. it references hitler in quote used in a popular sitcom...

( james ) the beginning of summer is a good time for parents to talk to their children about gun safety. the alameda county district attorney's office is partnering with multiple police departments in a new gun safety campaign. officials say one in three u-s homes have a gun inside. authorities say everyday eight children are shot in unintentionalshootings which experts say could be prevented. police say parents should not be embarassed to ask other children's parents if they have a gun, and if they are
