"kate's law" would 'increase' maximum penalties for undocumented immigrants who enter the u-s illegally after being deported. both bills are now headed to the senate. ( james ) san francisco is arguably the most famous sanctuary city and now it's poised to pay an undocumented immigrant nearly 200-thousand dollars. and it's all because of violating its own policy. kron4's maureen kelly talked to the man's attorney who says his client was turned over to ice by s-f-p-d. back in 2015 pedro figueroa zarceno showed up to the police station to recover his stolen car.instead of a getting his ride back..he was turned over. < about how was

was lead to ice.>his lawyer says this all stemed because he had a civil warrant issued by an immigration judge on his recordnot a criminal warrant. the asian law causus says the city has admitted they violated the spirt of their sanctuary city policy and have agreed to pay the el salvador native 190-thousand dollars. speaking through his attorney the san francisco resisden t says what happened to him was an injustice.his attorney says while she is happy for this settlement today she is unsettled by today's votes in congress cracking down on the undocumented and the santuary cities that shield them.bite the board of supervisors are expected to vote on the settlement next month.maureen kelly kron4 news.

( james ) another big story we are following this morning... a fire came dangerously close to homes in east san jose.. residents say they saw the flames outside of their homes around four oclock yesterday afternoon. after calling 9-1-1 they took matters into their own hands and quickly jumped into action doing everything they could to keep the fire from destroying their homes.

coming.gian paulino/fought fire with garden hosei saw fire in the field so i just grabbed another hose from one of the houses and started spraying at it. >( james ) the fire burned about 80 acres.. fire fighters were able to put out the flames pretty quickly. no one was injured and no structures were damaged. ( james ) wildfires are burning across the west coast... in colorado one home was destroyed and at least 150 others evacuated.. the fire has grown to 360 acres. it started wednesday night and is about 25-percent contained. in arizona a fire north of phoenix has burned roughly 21- thousand acres. the governer has declared a state of emergency for yavapai county.. crews say the high temperatures and strong winds are keeping the fire going. it is now 43- percent contained. and in utah the fire out there has burned more than 55 thousand acres destroying 21 homes.

it started almost two weeks ago and is only 20 percent contained. ( james ) and in california fires are burning across the state. there are at least eleven active wildfires up and down the coast.. now california senator dianne feinstein is warning this fire season could be more severe than last year. this winter's heavy rains spawned heavy growth. which has now dried out after an early summer heat wave. combine that with millions of trees that died during the drought and we have what she calls a potentially catastrophic situation. so far this year: 30,000 acres have alreaday burned. ( james ) the latest now, on an attack on bart that happened the same day new security cameras were installed on trains. it happened around 11:15 wednesday night on a train bound for dublin. bart says a passenger was punched. then four people believed to be under 18 grabbed the victims phone and ran out of the east dublin station. bart police say they are still reviewing the video. the new cameras come more than a year and a half after it was discovered bart had been using some decoy cameras on trains. ( james ) in the north bay... a petaluma man has been arrested and accused of multiple sex crimes involving a young teen. as kron4's philippe djegal reports

investigators say the suspect met the victim through a popular dating app. (philippe) 23-year-old alex battaglia was arrested at his home in petaluma wednesday afternoon. randy says he's lived next door to battaglia and his family on sequoia drive for 13-years. he says he knew battaglia is gay... noting he recently broke up with his boyfriend... but couldn't imagine battaglia, who works in retail and studied cullinary arts, would have ever been accused of having sex with an underage boy.rand/neighbor- "i'm blown away here. i never thought that he would go that way, with the minor kids." petaluma police detective sergeant paul gilman says battaglia has been charged with mutiple sex crimes against a minor, including sodomy. gilman says battaglia's victim is a 15- year-old boy he met through the smartphone dating app for gay men called, grindr.paul gilman/petaluma police dept- "they, uh, chatted through that app for a while. they

exchange some sexually explicit material and they ultimately met for, uh, what they determined to be a date." gilman says battaglia may not have been aware that the boy was a minor the first time they met. but adds they got together two more times, and on both of those occasions, battaglia knew the boy was underage. to create an account, the grindr app requires an email address, password and date of birth . but there's no mechanism to actually verify a member's true age.paul gilman/petaluma police dept- "we do know that, uh, people under the age of 18 can lie about their age to get onto the app." in this case, the victim's mother found out about the relationship and called police. the investigation spanned about six months before battaglia was arrested. and, police say battaglia has admitted to exchanging sexually explicit materials with up to a dozen other minors. gilman says parents should keep a close eye on their kids' online activity, to get ahead of situations like this.paul gilman/petaluma police dept- "kids nowadays can be far more savvy than their parents. uh, we need to have those

conversations so we know where to look and how to look." neighbor randy says battaglia has had a rough go of it recently. his father passed away last year and he was recently arrested for d- u-i.randy/neighbor- "i'm, i'm shocked to say the least." battaglia is currently being held at the sonoma county jail. his bail set at 51-thousand dollars. he is due in court friday. in petaluma, philippe djegal, kron four news. the penninsula... there's been another mountain lion sighting. the big cat was spotted around 10:00 yesterday morning near interstate 280 in san carlos. it was roaming right near crestview drive and tulip lane. mountain lions are frequently spotted in this area and don't usually pose a threat to humans. but if you see one with cubs nearby experts say do not approach it. ( james ) three northern california planned parenthood's are closing their doors and they are all in the bay area. the clinics in pittsburg, richmond and vacaville are all shutting down due to limited funding. this comes as a wave of clinics are closing across the country. planned parenthood officials say a mix of old and new problems are causing the closures. ( james ) clinics in fairfield,napa, vallejo and woodland are expected to help absorb those patients. but

they too could face cuts. ( james ) university of california officials have imposed new systemwide procedures to combat sexual harassment... among the new procedures investigations will be completed within 60 business days and decisions on discipline within 40 days after that. the new frameworks will also provide clear roles and responsibilities. for title nine offices and other offices involved in the discipline of the cases. the university says the new procedures incorporate recommendations by the joint committee of the administration and the academic senate. the new procedures will be implemented at all u-c locations by september first. ( james ) a 9-month old puppy found badly injured and wandering the streets of east palo alto is making a full recovery. someone had appears to have tied the pup's muzzle shut. leaving her with deep scars and a swollen face. she was brought to the penninsula humane society in burlingame. she was named gabby. and now the

staff is hoping to find her a new home.

the san diego based judge says the law would have made criminals of thousands of otherwise law-abiding citizens. the law would have gone into effect on saturday.

pets especially dogs can be frightened by fireworks. every year around this time the humane society sees a dramatic increase in the number of dogs being brought- in off the street. these are usually pets that were left in a backyard which got scared and ran off when they heard fireworks. the humane society suggests keeping dogs indoors avoid taking them to public fireworks shows and if needed, talk to a veterinarian about giving dogs sedatives or tranquiliers to help them relax. and 46-year-old untwan smith were arrested for child endangerment. both are from arkansas. phakhin's 3-year-old girl was found dead on wednesday. the two adults and little girl had been living out of their car near sacramento since february. police still don't know the cause of death, and say there was no visible trauma to the toddler's body. hundreds of military and local firefighters are trying to get control of a massive wildfire near camp pendleton. the fire has spread over seven-hundred and 60 acres. it is threatening homes and an animal shelter near san clemente. crews have been working through the night. the fire is 70 percent contained. ( darya ) and actor johnny

galecki is reaching out to firefighters after his ranch was destroyed by the hill fire burning near san luis obispo. "the big bang theory" actor posted this picture on instagram showing himself hugging firefighters while standing in the charred remains of his house. he also thanked firefighters for putting their lives on the line to keep people safe.

( mark ) happening tomorrow... two bay area cities will be raising their minimum wage. in san francisco minimum wage will go up to 14 dollars per hour. the increase was approved by voters back in 2014. the ballot measure called for the minimum wage to reach 15-dollars an hour by next year. and also beginning tomorrow... minimum wage workers in san jose will be making 12 dollars per hour.

that city is trying to reach a 15 dollar minimum wage by 20-19. ( darya ) a big win for gun advocates in california. a federal judge in san diego blocked the state's ban on high capacity magazines. the law was passed by voters in november. it would have barred anyone from possessing magazines that hold more than ten bullets. the law was set to go into effect tomorrow. the judge ruled the law criminalized law abiding citizens... and takes away second amendment rights. the case was brought on by the nra-- and the california pistol and rifle association. some gun store owners celebrated the judge's ruling. ( darya ) gun control advocates plan to appeal the judge's decision. ( mark ) in the south bay... police say an argument between two close friends turned deadly with one woman running down the other

with her car in campbell.( darya ) kron4's rob fladeboe has the details. friend of victim"....i just cant believe it, i was with her a couple of weeks ago and now she's gone..."a close friend of the victim spoke to me after stopping by the scene of the crime here on montemar lane to pay her respects. friend of victim "....i did not see this coming, no one did, they were best friends, one of those two friends, 23 year old elsie de la rosa, of san jose, is now in jail, accused ofmurder after allegedly running down her friend after the two had pulled over and were seen arguing in the street before de la rosa got back behind the wheel says campbell police captain gary berg.capt. gary berg/campbell police"...it looks like there was some sort of altercation in the car and they ended up stepping into the middle of the street and that led to the suspect getting back in the car and hitting the victim with the vehicle...."the next day, with the help of witness accounts,

de la rosa was arrested here on macarthur avenue near valley medical center where she had apparently gone to find out what had happened to her friend, only to learn that she had died. campbell city councilman rich waterman praised his neighbors vigilance. victim's friend"....for her to do something so heartless, i just can't believe it...i just can't ut the pieces together to see what was so bad that they were fighting about to end her life....."

( darya ) florida police say tennis star venus williams is responsible for a deadly crash earlier this month. (áááboxesááá) witnesses told investigators that williams ran a red light in her suv, causing a crash that injured a 78-year-old man who died two weeks later. williams told investigators she had entered the six-lane intersection on a green light but was forced to stop in an intersection because of traffic ahead of her. she told officers she did not see the the other car when she crossed into their lanes. williams has not been charged or cited in the case. police say the crash is still under investigation. ( mark ) a warning for people on the penninsula after another mountain lion was spotted.( darya ) it happened yesterday morning near interstate 280 in san carlos. somebody who lived in the area says the mountain lion was roaming near crestview drive and tulip lane. mountain lions are frequently spotted in this area and don't usually pose a threat to humans. but if you see one with cubs nearby -- do not approach it.

( mark ) police had their hands full rounding up several snakes and a baby alligator after a crash in texas. it happened yesterday a few miles from san antonio. police say a truck carrying the reptiles rolled over along an interstate after one of its tires blew. most of the thirty snakes were found, but some are still on the loose.

( rebecca @ land ) alex battaglia was taken into custody at his home on sequoia drive. police say a six-month long investigation revealed battaglia met his victim on a gay dating app. police say it is possible the victim initially lied to battaglia about his age. investigators say the two met up at least three -times and on the last two encounters... battaglia knew that the boy was under- age. ( rebecca @ land ) police say they were eventually tipped off by the victim's mother. they say the suspect may have exchanged sexually explicit material with up to a dozen other boys. battaglia is being held at

the sonoma county jail. ( mark ) a man has been arrested after trying to move into a house in san rafael that was still up for sale.. deputies with the marin county sheriff's department say that a realtor called them .. reporting two suspicious people trying to move into the house.. when police confronted them one man... now identified as francisco reyes... ran away. deputies learned reyes was also wanted out of sacramento for a probation violation. deputies say the people in the area helped them track down reyes and he was taken into custody. ( mark ) university of california officials have imposed new procedures to combat sexual harassment... investigations will now be completed within 60 business days and decisions on discipline within 40 days after that. the new procedures will also provide clear roles and responsibilities for offices involved in the discipline following the investigations. the university says the new procedures incorporate recommendations by outside groups. the new procedures will be implemented at all u-c locations by september first. ( darya ) this morning wildfires are not just a

problem here in california. in colorado one home was destroyed and at least 150 others evacuated.. the fire has grown to 360 acres. in arizona a fire north of phoenix has burned roughly 21- thousand acres. the governer has declared a state of emergency for at least one county.. crews say the high temperatures and strong winds are making it harder to fight, and in utah... a wildfire has burned more than 55 thousand acres. it has also destroyed 21 homes. it started weeks ago and is only 20 contained. ( mark ) the white house is now taking a more active role in the negotiations over health care. both vice president mike pence and senior advisor kellyanne conway making trips to capitol hill to work with senators. this as senate republicans hammer out changes to the currently stalled healthcare reform bill. so far 9 republican senators have come out against the healthcare bill in its current form. despite the g-o-p divide there has been no outreach to

democrats to join the conversation. senate majority mitch mcconnell leader is warning conservatives to build consensus.. he says if democrats join the negotiations the bill will be less conservative. ( mark ) and activists in modesto held a mock funeral to protest the republican health care plan. people dressed in black, carried a coffin and read eulogies outside representative jeff denham's office. they are upset with his support to repeal obamacare. other health care protests are planned at upcoming fourth of july events and parades in modesto. ( mark ) the house of representatives has passed two controversial bills aimed at stopping illegal immigration.( darya ) rebecca strom is here with a closer look at "kate's law." rebecca? ( rebecca ) that law is named after kate steinle who was shot and killed two years ago in san francisco by an undocumented immigrant. the law would increase maximum penalties for undocumented immigrants who re-enter the u-s illegally ... after being deported. critics of the bill say it criminalizes 'all' un-documented immigrants. aarti kohli, executive director asian law caucus. " it's been a long standing policy of anti-immigration legislators. an attempt to criminalize everyone who is undocumented and then say oh we're deporting criminal immigrants. it's tragic case,

this bill wouldn't change anything that happened." ( rebecca @ land ) the other bill that was passed allows the government to deny federal money to 'sanctuary cities' that do not cooperate with immigration officials. both bills now move to the senate for approval. neither are expected to pass. ( darya ) the city of san francisco will pay an undocumented immigrant nearly 200-thousand dollars because it violated its own sanctuary city policy. in 2015 pedro zarceno showed up to the police station to recover his car that had been stolen. that's when he was turned over to immigration police. his lawyer says it happened because he had a civil warrant issued by an immigration judge on his record. the asian law caucus says the city has admitted they violated their sanctuary city policy. they have agreed to pay zarceno 190-thousand dollars. the board of supervisors is expected to vote on the settlement next month.

( darya ) president trump's controversial travel ban is now in effect and opponents are making their voices heard. the ban limits travel from six muslim majority countries. it requires travelers to provide proof of a relationship with a family member in the united states. immigration attorneys were at s-f-o last night giving out their contact information in case anyone may need legal help. a small group of protestors gathered to share their outrage over the law. ( darya ) the travel ban does not apply to refugees who were already granted asylum and on their way to the u-s before the ban went into effect last night. ( mark ) this morning

wildfirescontinue to burn across california. there are at least eleven wildfires up and down the coast.. now california senator dianne feinstein is warning this fire season could be more severe than last year. this winter's heavy rains spawned heavy growth. which has now dried out after an early summer heat wave. combine that with millions of trees that died during the drought and we have what she calls a potentially catastrophic situation. this year... 30-thousand acres have already burned. ( mark ) and a fire comes dangerously close to homes in east san jose. it broke out yesterday afternoon near the penitencia creek trail. neighbors called 9-1-1 and then used garden hoses to keep the fire from spreading to their homes.

(áááboxesááá) witnesses told investigators that williams ran a red light in her suv, causing a crash that injured a 78-year-old man who died two weeks later. williams told investigators she had entered the six-lane intersection on a green light but was forced to stop in an intersection because of traffic ahead of her. she told officers she did not see the the other car when she crossed into their lanes. williams has not been charged or cited in the case. police say the crash is still under investigation. ( darya ) take a look at this... a wild police chase across two states... it started in louisville, kentucky where police tried to stop a man wanted in connection to a string of purse thefts. he led them to indiana, even going through the indiana university campus. more than dozen officers swarmed on the man as he tried to exit the truck with his hands up. he was eventually arrested. police say they found dozens

of purses in the truck. ( darya ) police had their hands full rounding up several snakes and a baby alligator after a crash in texas. it happened yesterday a few miles from san antonio. police say a truck carrying the reptiles rolled over along an interstate after one of its tires blew. most of the thirty snakes were found, but some are still on the loose. ( rebecca @ land ) alex battaglia was taken into custody at his home on sequoia drive. police say a six-month long investigation revealed battaglia met his victim on a gay dating app. police say it is possible the victim initially lied to battaglia about his age. investigators say the two met up at least three -times and on the last two encounters... battaglia knew that the boy was under- age. ( rebecca @ land ) police say they were eventually tipped off by the victim's mother. they say

the suspect may have exchanged sexually explicit material with up to a dozen other boys. battaglia is being held at the sonoma county jail. ( mark ) a man has been arrested after trying to move into a house in san rafael that was still up for sale.. deputies with the marin county sheriff's department say that a realtor called them .. reporting two suspicious people trying to move into the house.. when police confronted them one man... now identified as francisco reyes... ran away. deputies learned reyes was also wanted out of sacramento for a probation violation. deputies say the people in the area helped them track down reyes and he was taken into custody. ( darya ) university of california officials have imposed new procedures to combat sexual harassment... investigations will now be completed within 60 business days and decisions on discipline within 40 days after that. the new procedures will also provide clear roles and responsibilities for offices involved in the discipline

following the investigations. the university says the new procedures incorporate recommendations by outside groups. the new procedures will be implemented at all u-c locations by september first. ( darya ) this morning wildfires are not just a problem here in california. in colorado one home was destroyed and at least 150 others evacuated.. the fire has grown to 360 acres. in arizona a fire north of phoenix has burned roughly 21- thousand acres. the governer has declared a state of emergency for at least one county.. crews say the high temperatures and strong winds are making it harder to fight, and in utah... a wildfire has burned more than 55 thousand acres. it has also destroyed 21 homes. it started almost two weeks ago and percent ( mark ) the white house is now taking a more active role in the negotiations over health care. both vice president mike pence and senior advisor kellyanne conway making trips to capitol hill to work with senators.

( darya ) sean livingston and zaza pachulia surprising boys and girls at a warriors basketball camp in monterey. 150 kids attended the overnight camp held at cal state monterey bay yesterday. the warriors are hosting 26 basketball camps this summer for kids ages 7-15. but only one overnight camp. the warriors stars say the camps are a great way to build a strong relationship with fans.
