( james ) happening today. the man accused of abandoning his new born baby will make his first court appearance. it happened outside a suisun city strip mall and that newborn remains in the hospital this morning.( tiffany ) kron four's j-r stone has the latest on the investigation including reaction from witnesses who found the baby. 18 year old daniel mitchell is behind bars right now after police say he left his 16 day old baby ma'kyhe mitchell in a suisun city parking lot.sot we're now learning new information about where daniel mitchell went after leaving his boy in the parking lot. he eventually ditched his car in this fairfield neighborhood near fairmont memorial cemetary a mile and a half from the shopping center where he left little ma'kyhe. witnesses tell us it was obvious he had crashed into something prior to that. the tires were blown out and there

was damage to the car. in fact one woman tells kron 4 news she watched as mitchell got out of the car, went back inside to get something then took off running down this street. sources say he left his wallet and id inside his carsomething that helped police identify him, catch him, and link him to multiple felony crimes and a misdemeanor possession of possible cocaine. sotthose who know mitchell say he has been on a downward spiral ever since his mom committed suicide.. officers were back in this area tuesday and witnesses tell me they found the magazine to a gun in someone's yard. no word yet if that magazine came from mitchell or if that clip was with mitchell when he was with ma'kyhe.

( james ) breaking overnight. a grass fire in san jose damages at least one building. this is video of the fire sent to us by a kron 4 viewer. it burned about 5 acres near old quarry road. one barn was damaged but no homes were threatened. nobody was injured. ( tiffany ) a san jose high school employee is in jail accused of sexually assaulting a developmentally disabled woman. now investigators think there may be more victims. 42 year-old anthony valerio was arrested on monday but police are just now releasing the information. authorities say valerio was the 21-year old victim's "life coach." he works at calero high school in san jose... although police have not said where the alleged assault took place. valerio was booked into the santa clara county jail. he is being held on 200- thousand dollars bail. ( james ) palo alto police arrest a teacher accused of

sexually abusing a minor. 35 year-old john patrick root worked as a music teacher at "the school of rock." the underage girl was one of his students. police say the alleged assault did not happen at the school. officers are now following up to make sure there are no other victims. root is facing four felony sex abuse charges this morning. ( tiffany ) the brutal assault of a man near the richmond bart station last week is now under investigation by richmond police. bart has turned over surveillance video of the attackers to richmond officers. but that video is not yet being released to the public. richmond mayor tom butt -- who witnessed the attack and called 9-1-1 -- has been highly critical of bart's initial response. we talked to him yesterday after he watched the surveillance video. lt. felix tan/richmond

blue-green algae in the east bay. regional park directors are meeting to find ways to fight the toxic bacteria. it was recently found in lake anza in berkeley and lake temescal in oakland. exposure to blue- green algae can result in rashes and eye irritation and other allergic reactions. in extreme cases at higher levels - people can become very sick and even die.. pets are also at risk. park directors say they are desperately searching for solutions. ( tiffany ) health experts warn people to stay away if the water has a lot of algae or scum floating on top. in the north bay, at least two dogs have died from the toxin.

( james ) recreational marijuana use was passed by california voters last november... once it is officially legal next year, one of the biggest issues facing california is the potential for an increase in drugged driving.( tiffany ) a bay area company says they've developed a breatherlyzer that can help law enformecent detect whether or not someone is driving while high. kron four's maureen kelly has the story. curve up ahead, whoa, hee hee that's a sharp turnthe woman behind the wheel is helping the oakland based hound lab test it's new breatherlyzer. she and two male test subjects drove freeway speeds on the 1 mile course on alameda's naval air station. obstacles added meant to mimic the challenges of highway driving. they all first drove sober with no problem, and then were asked to toke up.and a half hour later they were tested with the device that detects the levels of thc, the mind altering ingredient in pot, in people's breath.the er doctor

behind the testing ended up with a dented car and some scary test results. even the drivers with thc levels on the low side made fatal mistakes on the roadway.what was most compelling and frightening frankly is that all three drivers hit in the bicyclists in the construction zone. they would have killed that cyclist the company says they plan to conduct more tests to try and narrow down what level of thc in the breath makes stoners unsafe to drive.they are planning to have the hound breathlyzer ready to roll out for commercial use at the end of the year. maureen kelly kron4 news.a bay area company that says they've developed pot breatherlyzer puts their product to the test. ( james ) in the bay area. looks like humpback whales are back at it again, swimming under the bay bridge. this is video sent in by a kron four viewer. it is typical to see two to three whales swimming together this time of year. however, people are reporting seeing as many as 18 at one time. experts say, the whales are attracted to the high tide in the bay at this time of year. ( tiffany @ bam ) a new study which looked at the brains of former n-f-l players shows a stunning 99- percent of them had c-t-e... a debilitating brain disease. the study includes more than just áprofessional football players' brains, too. kron four's spencer blake spoke with a local sports medicine specialist to better understand the gravity of this latest information. footballthen you should hear the latest research about chronic traumatic encephalopathy, or c-t-e. researchers looked at the donated brains of 202 former football players - more than half of them played in the n-f-l, and others only had high school or college football careers.177 of them had c-t-e, including all but áone of the n-f-l players in the study."that's a scary number at the nfl level." doctor david goltz, a sports medicine specialist who treats many athletes who have concussionssays the study is definitely concerning."i wouldn't say that it's highly reassuring that american football is safe for preventing brain injury."but he also says there's a lot left unanswered.for example, this study doesn't include football players who ádidn't have c-t-e symptoms during life, nor does it include athletes from different sports. but goltz still sees the alarming report as a springboard for further research."how many concussions are too many? and this study certainly doesn't answer that question and that's a big one, i think, for parents." certified athletic trainer kit

police are searching for two men in connection with a deadly shooting in san francisco's marina district. the shooting happened in may on alhambra street and police are now releasing the surveillance images of the men they are looking for. 32-year-old kelly freeman was found dead from a gunshot wound to the head. police say these two men are considered persons of interest in the case. ( lydia ) 42-year old anthony valerio worked here at calero high school in san jose. the investigation into valerio began when the parents of a 21-year-old woman who is developmentally disabled reported that their daughter had been possibly sexually assaulted.(take pic) valerio was allegedly the victim's "life coach." sheriff's officials did not disclose where the alleged sexual assault occurred. valerio was arrested monday and booked into the santa clara main county jail, where he's being held on $200,000 bail, according to jail records. school officials are cooperating with the investigation.(oncam) investigators are trying to determine if there may be more victims. anyone with information is asked to contact the santa office's. reporting live in san jose, lydia pantazes kron4 news. ( mark ) a fourth person has been arrested in connection to the murder of an elderly san jose woman. johnny brown faces murder, robbery and elder abuse charges. the victim -- flo douglas also known as "miss flo" died in september after being brutally beaten in her own home. zachary cuen has also been charged with her murder. his girlfriend...jennifer jiminez was arrested in march. she's accused of hiding evidence related to the murder. perla arre-loa was taken into custody after police say she also tried to hide evidence. ( darya ) we are now hearing from the man who was shot at while driving on highway 242 in concord. police are still searching for the shooter. joe cerletti was heading home to pittsburg when the shooting happened on saturday night. as he was approaching the 6-80 -- 242 split, a car pulled along side

him and cut him off. cerletti pulled along side the car and starting talking with the driver. he says the driver swore at him and then began shooting. daniel mitchell is behind bars after police say he left his new born baby in a strip mall parking lot on monday. he then drove off and left his car in fairfield about a mile and a half away from the strip mall. witnesses say his tires were blown out and there was damage to the car. police say he left his wallet and i-d inside the car, which helped to later identify him. those who know mitchell say he has been on a downward spiral ever since his mother committed suicide.

recorded a man's death and taunted him as he is drowning....could now face jail time. florida police say they are now recommending that charges this is video of the incident on july 9th. the recommendation for charges will be handed over to the state attorney's office today. the teens posted the video to youtube showing 31-year-old jamel dunn drowning in a pond. in the video you can hear the boys laughing as the man drowns. police initially said they couldn't charge the teens because florida doesn't have a law that requires people to call for help for anyone in distress. now they are using a law that says it's the duty of any person to report a death. ( darya ) a group that wants california to secede from the united states can now start collecting signatures for a ballot initiative. the state attorney general approved their request yesterday. the campaign can now start collecting the more than 585-thousand signatures it would need to qualify for the 2018 ballot. the initiative would form a commission to recommend ways that california can pursue independence. this is the second attempt to get the measure on the ballot. an earlier attempt was withdrawn in april. victim was one of the man's students. 35 year-old john patrick root worked as a music teacher at "the school of rock." police say the alleged assault did not happen at the school. police are now concerned that there could be more victims. police are searching for two men in connection with a deadly shooting in san francisco's marina district. the shooting happened in may on alhambra street and police are now releasing the surveillance images of the men they are looking for. 32-year-old kelly freeman was found dead from a gunshot wound to the head. police say these two men are considered persons of interest in the case. ( darya ) a san jose man is rescued by a police helicopter after he crashes his motorcycle in the sierra. he was riding near cody lake in el dorado county monday night when the california highway patrol says he hit a tree and was badly

(tiffany) the baby is in critical but stable condition this morning. 18-year-old daniel mitchell is behind bars after police say he left his newborn baby in a strip mall parking lot on monday. he then drove off and left his car in fairfield about a mile and a half away from the strip mall. witnesses say his tires were blown out and there was damage to the car. police say he left his wallet and i-d inside the car, which helped to later identify him. those who know mitchell say

"miss flo" died in september after being brutally beaten in her own home. zachary cuen has also been charged with her murder. his girlfriend...jennifer jiminez was arrested in march. she's accused of hiding evidence related to the murder. perla arre-loa was taken into custody after police say she also tried to hide evidence. ( darya ) we are now hearing from the man who was shot at while driving on highway 242 in concord. police are still searching for the shooter. joe cerletti was heading home to pittsburg when the shooting happened on saturday night. as he was approaching the 6-80 -- 242 split, a car pulled along side him and cut him off. cerletti pulled along side the car and starting talking with the driver. he says the driver swore at him and then began shooting.

( mark ) the brutal assault of a man near the richmond bart station last week is now under investigation by richmond police. bart has turned over surveillance video of the attackers to richmond police officers. but that video is not yet being released to the public. richmond mayor tom butt -- who witnessed the attack and called 9-1-1 -- has been highly critical of bart's initial response. we talked to the mayor after he watched the surveillance video.

the subpoena was withdrawn after manafort agreed to turn over documents and set up an interview with the committee. donald trump junior was also removed from the list of witnesses scheduled to testify at today's public hearing. the committee wants to talk to both manafort and trump junior about a meeting they had with a russian lawyer during the presidential campaign. that lawyer had promised them damaging information on hillary clinton. ( mark ) one of the most senior figures at the vatican has pleaded not guilty to multiple charges of sexual assault. cardinal george pell was in an australian court earlier this morning. this was his first court appearance since the charges were filed last month. several people have come out and accused the cardinal of sexual assault. he has denied all the charges against him. pell is the most senior cardinal in the history of the catholic church ever to face criminal charges. defending a teenage girl who lost control of her car while live streaming on instagram, killing her younger sister in merced. yesterday we heard from her father, now we are hearing from her youngest sister. 18-year-old obdulia sanchez is suspected of driving drunk or drugged during the crash on friday night. the middle sister, was ejected from the car and killed. obdulia's youngest sister says she found out

about the crash after seeing the video on instagram. it wasn't until the next morning that the family got a call from the coroner's office confirming that their daughter was dead. the youngest sister says there is nothing obdulia could have done to prevent the crash and that she stands with her sister. ( darya ) the middle sister was only 14-years-old when she died. obdulia remains in jail on 300-thousand-dollars bail. ( mark ) we are learning new information about the truck carrying dozens of undocumented immigrants in texas. it passed through a border patrol checkpoint about two hours before being discovered outside a walmart. ten people were found dead in that big rig and dozens others were injured. the truck that james bradley junior is charged with driving cleared the checkpoint

saturday night. officials are not sure whether immigrants crossing into the u-s illegally boarded the truck before or after it passed the checkpoint. bradley has been charged with knowingly transporting undocumented immigrants. ( mark ) a group of teenagers who recorded a man's death and taunted him as he is drowning....could now face jail time. florida police say they are now recommending that charges be filed. this is video of the incident on july 9th. the recommendation for charges will be handed over to the state attorney's office today. the teens posted the video to youtube showing 31- year-old jamel dunn drowning in a pond. in the video you can hear the boys laughing as the man drowns. police initially said they couldn't charge the teens because florida doesn't have a law that requires people to call for help for anyone in distress. now they are using a law that says it's the duty of any person to report a death. ( darya ) a warning if you're headed to the beach this weekend. the national weather service has issued a "large wave" and "rip current" warning from friday

( mark ) and there is now also an effort to rename s-f-o's terminal one in honor of slain supervisor harvey milk. the oldest passenger terminal in use at s-f-o, and is undergoing a more than two- billion dollar renovation project. a san francisco supervisor introduced the legislation yesterday. he said the renaming would send a powerful message to the world, that the city honors gay people and their achievements and sacrifices. 35 year-old john patrick root worked as a music teacher at "the school of rock." the underage girl was one of his students. police say the alleged assault did not happen at the school. officers are now following up to make sure there are no other victims. a new warning about blue-green algae in the east bay. regional park directors are meeting to find ways to fight the toxic bacteria. it was recently found in lake anza in berkeley and lake temescal in oakland. exposure to blue- green algae can result in rashes and eye irritation and other allergic reactions. in extreme cases at higher levels - people can become very sick and even die.. pets are also at risk. park directors say they are desperately searching for solutions. police are searching for two men in connection with a deadly shooting in san francisco's marina district. the shooting happened in may on alhambra street and police are now releasing the surveillance images of the men they are looking for. 32-year-old kelly freeman was found dead from a gunshot wound to the head. police say these two men are considered persons of interest in the case. ( mark ) the fourth and final wife of entertainment legend frank sinatra has died. barbara sinatra passed away tuesday from natural causes at her home in rancho mirage, california. the sinatras were married for 22 years until frank sinatra's death in 19-98. with her husband's support, barbara sinatra launched a namesake children's center in rancho mirage to help the youngest victims of abuse. the center's director says it has helped more than 20-thousand children. barbara sinatra was 90 years old. ( mark ) a new study looking at the brains of former n-f-l players found that 99-percent of them had
