18 year old daniel mitchell made his first court appearance wednesday only still cameras were allowed in court as he plead not guilty to child endangerment, child abandonment and possession of cocaine.authorities say on monday he left his 16 day old son in this barber shop parking lot in suisun city. police have obtained surveillance video which they say shows mitchell leaving the child in the parking lot in his child safety seat. the child was eventually taken to children's hospital in oakland where he is now in stable condition for an unspecified condition.during wednesday's hearing mitchell broke down in tears when the judge issued a restraining order preventing mitchell from getting anywhere near his baby. that however seems unlikely as mitchell's bail is set at a half million dollars.

(grant)angry reaction to the latest early morning tweets from the oval officepresident trump tweeted, "after consultation with my generals and military experts, please be advised that the united states government will not accept or allow transgender individuals to serve in any capacity in the u-s military. ( )the announcement came out of the blue ... and landed like a bombshell.( )even the pentagon seemed to be caught by surprise.catherine heenan is here to sell us about it. (catherine) the head of the senate armed services committee, john mccain, called it "yet another example of why major policy announcements should not be made via twitter." the transgender decision is being slammed by everyone from san francisco mayor ed lee, to some of the most conservative members of congress. "mr. president, how did you decide your policy on transgender people in the military?"'she's very rude,'
5:07 pm
the president left it to his press sceretary to explain why the military should be barred to transgender individuals. "this is a very disruptive and expensive policy and based on consultation he's had with his national security team, came to the conclusion that it erodes military readiness and unit cohesion and made the decision based on that."an extensive rand corporation study for the pentagon came to just the opposite conclusion. it estimates that there are between 1,000 and 7,000 transgender service members on active duty out of a total of 1=point=3 million in uniform. the increased medical cost, primarily gender reassignment, would amount to at most a little over one tenth of one percent of the pentagon budget. and based on experience in foreign countries, allowing transgenders to serve openly would have a minimal effect on morale and readiness."i was shocked."retired united states navy seal kristin beck says the ban may backfire."i think all the lawsuits and the contracts he's gonna break and eveything else may wind up being more expensive for someone like me who has cost the taxpayer zero dollars.it's still unclear whether transgender members of the

military serving in afghanistan and elsewhere will be removed from their posts. that's something the white house and the pentagon will have to work together as implementation takes place ... this is a military decision about military readiness.lbgt activists are gearing up for a battle ... in court.we deserve the rights to fight for what we love. as a trans service member, i have fought very long and hard to be my authentic self. no one is going to take that passion, or my love for my country, away from me."" a pentagon spokesperson responded in a statement..saying they haven't received any formal guidance...and are referring all questions on the policy move, to the white house. grant? (grant) in response to president trump's transgender military ban... several protests are scheduled for
5:09 pm
tonight. there's one happening right now in oakland... where protesters are gathering at 'the port bar' on broadway. then at six o'clock tonight - a big protest is planned in san francisco's castro district. demstrators will gather at the harvey milk plaza... where more than 9-hundred people have indicated they will attend on the facebook page event. (vicki) another big story we're following out of the white house tonight... the senate has rejected the g-o-p proposal to repeal obamacare... ...making it the second setback republicans have suffered this week in trying to roll back obama's 2010 statute. some conservatives have embraced the effort to repeal the law without an immediate replacement. but the g-o- p worries it would anger voters who believe that congress would fail to enact a replacement... leading to millions of people left without health insurance... (vicki) president trump is not letting up on attorney general jeff sessions criticism... he took to twitter earlier today... complaining about why sessions didn't replace the acting f-b-i director, andrew mccabe... even though it's up to the president to hire - and fire - the bureau's chief.
5:10 pm
the president claims mccabe was "in charge" of the f-b-i's hillary clinton email investigation, and received thousands of dollars for his wife's political run from hillary clinton... but mccabe says trump is misstating facts... saying his wife ran for the virginia senate in 2015 and received donations from a clinton friend and ally... before the f-b-i says mccabe was promoted to deputy director. what the city is doing about it. rob? (rob live) i'm here in the burbank neighborhood near buena vista park and this is a typical example of what you'll see on the streets here. neighbors tell me the city sent a couple of trucks out here recently and they picked up a lot of stuff but there is plenty more still here. take a look. it's not clear if the latest clean up missed these items or if they were dumped within the last couple of days but i counted at least a dozen mattresses and all manner of other furniture and trash on and around douglas and willard avenue. residents are sick of it.annaliasa sullivan/resident ".....you go the homeless people leaving their junk and people moving out are just leaving their stuff on the streets and it's jus a mess....."this is surveillance video that shows how someone brazenly unloaded a cart load of junk on the street in broad

5:16 pm
takes a long time, sometinmes as long as three weeks and we're concerned about sanitation especually with all these mattresses...." (rob live) the city says the trucks are coming by more often than that and that scheduled pickups have increased by 400 percent in the past two years. the city will soon be rolling out a new smart phone app where people can report illegal dumping and upload photos of the stuff and where it can be found. live in san jose rob fladeboe kron 4 news (vicki) in palo alto... police are warning people about a phone scam that involves your children and kidnapping.(vicki) police

5:23 pm
they aren't aware of anything being taken from the restaurant. (grant) the explosion of amazon and online shopping has also created new opportunity for crooks. when one victim checked her security camera in hopes of catching a package thief... she saw a little more than she bargained for. cherish clinton received a notice that her amazon package had been delivered. but when she got home there was not package in sight. when clinton watched her the video home security camera she saw the post man drop off her package. about an hour later ... someone else shows up and swipes it from her porch. the thief exposed himself in more ways than one. (cherish clinton/homeowner): "at first i was shocked. i went oh my god in broad daylight! how could that happen.... and then when i saw him bend over, i thought it was kind of funny. he was baring his rear end." when salinas police zoomed in on the video they noticed the thief was wearing a patriot motorcycle club t-shirt and had an emblem on a hat that they recognize. those clues, caught on camera, could

be just what police need, to crack this case. (vicki) an outpouring of support -- for a street vendor at the center of a video that's gone viral. the clip shows a man overturning the vendor's cart after an argument. the incident sparked outrage among many who've seen it. as tom wait shows us, since the video surfaced, the community has rallied around the vendor. an ugly argument with a dog walker and a food vendor ended with a man's temper boiling over and the man's business in disarray - and it was caught on tape. in the meantime the vendor has gotten an outpouring of support from people all over the world since the video went viral.on tuesday night a huge crowd came out to support the vendor where he works at a hollywood street corner.a man walking his dog did not want to go around a food cart and got into a spat with the vendor.in the video, the street vendor tells the man with the dog to pass - in spanish.the man says to the vendor "are you going to move the cart? or i will."

(vicki) these are pictures of nearly 600 pounds of methamphetamine seized in a raid last week. kron4's maureen kelly reports that the alleged scheme involved one of the suspects flying the drugs across the pacific in a single engine plane. it's a bizarre story and it reminds me a lot of the movie dumb and dumber and this one would be entitled dumbest ever. robert nicolas of propjet aviation says he meet the suspected drug runner when he helped broker his purchase of a modified cesna p2-10. this is a picture of the man he knew as john gorman. he says the 72 year old only told him he wanted to fly the plane from santa rosa across the pacific back home to australia. nicolas says he only found out about the scheme when his hanger at the santa rosa airport was raided by dea agents a few days after they'd uncovered the massive amounts of meth at a santa rosa warehouse. there's just no way. no way this is real.nicolas says he still finds this story surreal, not only because gorman didn't seem like the type to smuggle drugs with a us street value of over 200 million
5:30 pm
dollars.but also because the alleged plot was so ill conveived.he was the worst pilot i ever flew with ever. ever.the man who trained him on this model plane says they they tried to talk him out what they assumed at the time was a bucket list trip.i wouldn't fly across the ocean in us in a single engine airplane it's not very smart but while much of this alleged scheme doesn't make a lot of sense to the folks here at prop jet aviation they say one of the biggest head scratchers is how with the suspect would have been able to fit all those drugs in this little planethis is a plane similar to what was seized by the feds. except the seats were taken out to fit all the fuel he's need to make it to hawaii. after we found out about the extra cargo he was putting on. the plane would've never gotten the air he would just crash and burn right here at the airportthe man they knew as john gorman was arrested along with two other suspects in australia were arrested for conspiracy to smuggle drugs and money laundering. maureen kelly kron4 news.

(grant) the man accused of starting that huge fire in utah last month is now facingcharges....(vicki) catherine heenan is back with more on the charges - and the initial 9-1-1 call.... (catherine) the man who started the fire had been burning weeds...he didn't mean to start a wildfire - but he did. and it was huge. he's now facing two misdemeanor charges....one for 'reckless burning' andanother for not notifying officials. he accidentally sparked one of the biggest fires in utah history...the 'brian head' fire destroyed dozens of homes and burned through 71-thousand
