let's go back to the mug shot now of the suspect. he has been identified as 21 year -oldmuni-un-mee hendrix, of san jose. police tracked him down to merced where he was arrested without incident. to be charged with homicide, muniumnee is being held in the santa clara county jail without bail pending his arraignment next week. let's go some video now from last monday night when the suspect is alleged to have walked into a liquor store on at quimby and white road in east san jose. police say the suspect demanded money from store owner charlie ly. when ly refused, muniunmee shot and killedhim. he then pointed the gun at ly's wife and threatened to kill her too as she dialed911. in the end, the till was never opened and muniunmee fled the store with no money and then became the object of a manhunt that eventually led police to merced. here's more on the arrest now from san jose police chief eddie garcia. this is a photo of the

victim, charlie ly. by all accounts a beloved figure in the community he serves. customers have been stopping by his store all week to pay their respects. his brother told will tran earlier this week that ly had survived several robberies and attempted robberies over the years.(rob live) the arrest of his alleged killer comes as charlie ly is set to be memorialized this evening at his store at 2860 quimby road. the memorial

this is happening near lake berryessa - at highway 128 and sage canyon road. the fire broke out around one this afternoon and has already burned around 100 acres. mandatory evacuations are in effect for turtle rock to sommerton vineyard. the fire is only 10-percent contained at this time. we will continue to monitor this fire - and bring you updates as soon as we learn more. (steve) atf investigators say they can not determine the cause of this massive fire - that destroyed an oakland apartment building that was under construction. this happened back in july - on valdez street. investigators say they examined all the evidence - and were unable to determine what sparked the massive fire. the july 7th fire - forced around 700 nearby neighbors to evacuate. no one was injured. the building was slated to house 196 families... and be completed next spring. federal authorities say three earlier fires in the area were arson... and local developers believe the july 7 fire was linked. oakland mayor libby schaaf said at a news

conference last month - that the string of fires in oakland was hurting a city in the middle of a housing crisis. (vicki) another bart passenger is attacked and robbed... and the suspect remains at large. it happened around 9:30pm thursday in berkeley at the ashby bart station parking lot. police say two men attacked the male victim from behind then robbed him of his backpack, wallet and wristwatch. bart passengers are concerned that they are now being targeted at the ashby station carl andrews/concerned bart passenger: "yeah it's extremely unfortunate that we don't have a safe way to get ourselves to work and back" marcus murphy/ashby bart passenger: "i am not really knowing berkeley to be like that but, i mean like oakland, but berkeley? i guess berkeley is changing?"diallo mclinn/ashby bart rider: "but usually around ashby bart it is just folks who work, some millennials, some local folks but i have never really heard of anything like that happening"(vicki) the victim had to be taken by ambulance to a local hospital for his injuries. bart police investigators say they have

way someone can drive through the city without passing one of it's highway 4 cameras and those cameras - specifically its license plate readers - are being credited with a significant weapons seizure. kron 4's dan kerman is live at police headquarters in pittsburg to explain. dan? pittsburg police are chalking up the seizure of this cache of stolen weapons to its cameras to read every license plate of highway 4police say about 330 friday morning one of their highway 4 license plate readers identified a stolen vehicle heading eastbound into the city dispatchers notified patrol officers, who caught up with the vehicle near loveridge road. a pursuit followed the suspect eventually abandoned the vehicle and took off on foot near contra loma boulevard. he was eventually

of electricians earlier this week in laurel heights was unearthed after the homeowner's decided to give it away. it took about two hours to get it out. the owner of lowes electric says the headstone weighs about a ton. his crew just so happened to come across it while upgrading the underground electrical panel in this garage. rob lowe says he's going to keep the headstone, bring it to his home in the north bay and study it's history. rob lowe/lowes electric- "i have, um, shovel collections, uh, old old fire hydrant from the, uh, early 19, 1950s or something from the city. one of the workers gave it to me, so that's up there too."(vicki) the oldest date on the marble headstone is 18-13. it's one of several that have been found over the years in laurel heights. the neighborhood used to be a cemetary.. before it was moved the city of colma. back then, the caskets and urns were taken to the new location... but the san francisco medical examiner's office says many of the headstones were left behind and used as landfill. (steve) thousands of

dollars worth of football equipment - stolen from a high school in fremont. now the school is asking for the public's help replacing the stolen equipment. the incident happened at washington high school sometime in july, but the school just reported this week. the burglars stole about 9-thousand dollars worth of equipment. about 15 helmets and more than 35 shoulder pads were taken from the football team. the upcoming football season could be in jeopardy because they might not have enough equipment. a go-fund-me account has now been setup to help replace the stolen items. you can find a link on our website kron four dot com. the bay area remains one of the top spots in the country wherepeople are looking for homes -- somewhere else. catherine heenan is here with the latest 'migration report' from the real estate website 'redfin...' "it's been a huge community effort. from volunteers, from corporate groups doing drives to us all the supplies that we need. and for the 7th to 12th graders, that list has increased from 10 items in their backpack in 2005 to 21 items in their backpacks." this year sacred heart gave away about 3,300 backpacks! you have to

trusted these people. i trusted them with him all school year. and i trusted that they wouldn't hurt my child."(steve) both instructors have been put on paid leave. the county prosecutor reviewed the case and decided it does not meet the bar for child endangerment charges. the village prosecutor will now look at the case and consider pressing misdemeanor charges. (steve) the former mayor of stockton-- anthony silva-- plead no contest to providing alcohol to minors. silva entered the plea in amador county court today. the plea settles charges including allegations that he secretly pre-corded underage camp counselors playing a strip poker game in 20-15. silva faced four misdemeanor charges for that indcident. the former mayor says he accidentally recorded the game. he has been ordered to perform 40 hours of community service. silva is still charged with stealing hundreds of thousands of dollars from a youth club in san joaquin

county. ( steve ) a major weapons seizure in the city of pittsburg tonight and the city's highway 4 license plate readers being credits for the recovery of every stolen gun and rifle. kron 4's dan kerman is live at police headquarters in pittsburg to explain. for a little over a year the city of pittsburg has had 14 cameras and six automated license plate readers along highway 4 tracking vehicles that enter the city. friday police say those cameras are responsible for the seizure of these stolen weappons. police say about 330 fridsy oring one of their highway 4 license plate readers identified a stolen vehicle heading eastbound into the city dispatchers notified patrol officers, who caught up with the vehicle near

(catherine) an oxford university financial officer accused of stabbing a chicago man to death was in a san francisco courtroom today... andrew warren - a british national - acknowledged today that he's the suspect that authorities in illinois had been looking for.... and has agreed to return to chicago to face charges. he surrendered peacefully in san francisco last week - after being on the run for 8 days with a second suspect. warren is accused in the brutal stabbing of trenton cornell-duranleau.the victim was a hair stylist - whose body was found july 27th in a chicago apartment. he'd been stabbed dozens of times.... authorities haven't revealed a motive for the killing. the attorney representing warren talked to reporters today.. defense attorney - mr. warren is agreeable to transferring to chicago. he wants to get the process started. i want to remind everyonethat he's presumed innocent. and his agreement to go there is where we are now. the other suspect who

has surrendered to police -- wyndham lathem - a former northwestern university microbiologist... he and warren both face first-degree murder charges. lathem surrendered to authorities in oakland... warren turned himself in to a police station in san francisco.... ( catherine ) the search continues for the suspects in a triple shooting at dolores park. it happened last thursday - and san francisco police increased foot patrols in the area.. they say they're now looking for as many as five suspects in the shooting. investigators say it wasn't a random shooting -- and it apparently happened after an argument. ( steve ) a former oakland police officer is going to face charges again related to a prostitution case. a judge today ruled alameda county prosecutors can refile two charges against ryan walterhouse. he was arrest in october of last year... accused of hiring the prostitute and then tipping her off about police sting

operations. two of the charges against him were dropped in june after poresectors refused to name a confidential informant. they then refiled them in july.. but walterhouse's lawyers challenged them. today, the headstone we told you about this week that was discovered buried under a garage in san francisco's laurel heights neighborhood -- was pulled from the ground. (steve) and, as kron four's philippe djegal reports... removing it was no easy task. (philippe) talk about a real struggle...rob lowe/lowes electric- "really tough. i -- i envisioned it being a bit easier." it took two hours, three guys, and an engine hoist to pull this headstone from the ground. it was buried about four and a half feet in the earth. rob lowe, the owner of lowes electric says he was determined to get it out.rob lowe/lowes electric- "i have a great team. they work hard together. get things done and this is the first time i've ever come across one of these." lowe estimates the marble headstone weighs about a ton.

his crew discovered it on tuesday, while upgrading an underground electrical panel. the san francisco medical examiner's office says it was left behind around the start of world war two... when the old laural cemetary in laurel heights was moved to the city of colma. caskets and urns were taken away back then, but some of the headstones were left behind and used as landfill. initially, the homeowners were going to keep the headstone underground... but then had a change of heart.rob lowe/lowes electric- "i got a call from breda last night. she knows, she knows that i, i collect stuff, and, and she knows that it'll go to a good home. (philippe) you live in the north bay -- you're going to keep this as a collector's item, huh? (rob) yeah, i'm going to put it on the property -- probably next to my vineyard. ( steve ) a court has temporarily halted the campaign seeking to oust judge aaron persky... for a light sexual-assault sentence he gave a stanford athlete. the court today stopped signature-gathering efforts to determine whether the campaign to recall the santa clara county judge should be a state... or county question. persky sparked the recall effort when he sentenced former stanford university swimmer brock tuturner to six months in jail for sexual assault in july 20-16. plunging seven stories off the side of a parking garage. it happened last month in austin, texas. you can see a s-u-v driving slowly through an alley when it comes to a stop. then, all of a sudden, a b-m-w falls on top of it....landing on the roof of the s-u-v. the woman driving the b-m-w was seriously injured. police say she somehow stepped on the gas instead of the brakes... and crashed through the parking garage barriers. that garage was cited by austin officials last september over unsafe barrier cable systems. the owners now say they're considering re- desiggning the entire cable system. ( steve ) a couple of swimming spots in the bay area are reopening this weekend after being closed due to toxic algae. the water has finally improved at lake temescal in oakland. it has been closed since the end of june due to blue-green algae. the algae can make people sick and can kill pets. it is found in just about every body of water... but thrives in warm conditions. ( steve ) and the quarry lakes in fremont are also reopening this weekend. they had been shut down since february because of the same algae. officials had to wait for the levels to be deemed safe. (catherine) problems continue to mount for banking giant wells fargo. the latest controversy concerns

"while the construction is happening most of the west wing staff is working across the street at the eisenhower executive office building, that's because inside the west wing, renovations are happening from top to bottom"but that's not stopping some people from taking behind the scenes photos.presidential advisor dan scavino snapped these photos from the oval office.. the famous "resolute desk" is in storage for safe keeping. workers are re-painting and replacing carpet all over the west wing.the paint project costs taxpayers $275,000. but this isn't unusual.the government says this renovation is in line with what the past three president's spent on upkeep.at the white house, i'm mark meredith.

and a 49ers division rival made a move to bolster its roster today. the los angeles rams have acquired bills receiver sammy watkins...in exchange for cornerback e-j gaines. the trade is a surprise considering watkins is buffalo's top receiver... and was the team's 4th overall pick in 2014. but, buffalo is trying to rebuild with its new head coach and general manager. the addition of watkins provides another target for rams and former cal qb jared goff. elsewhere around the nfl- - big news out of dallas... as cowboys running back ezekiel elliott has been suspended 6-games for violating the league's substance abuse policy. the punishment is the culmination of a yearlong nfl investigation...into domestic violence incidents between elliott and his ex-girlfriend. the nfl says it has evidence of multiple instances of physical confrontations, which took place last summer. this suspension comes despite the fact elliott hasn't been legally charged. his representatives plan to

file an appeal. finally, we have an update to report in the story of the cat that ran onto the field of a recent cardinals game. you may remember this video from the other night. a kitten...somehow gets loose and runs free during the royals-cards game in st. louis. it's wandering out there until someone picks it up. turns out, that after the feline was saved, it got loose again and went missing in a park. thankfully, it was found last night by a rescue group...and identified as the 'cardinals rally cat.' ( steve ) even with all the great back-to-school deals... getting all the supplies students need to start the school year off right can add up. today-- sacred heart community service in san jose held it's 15-th annual "pack-a-back" program. the programs helps low- income families get their student's geared up for school.

students have to register for an appointment at the facility about a month in advanced. sacred heart officials say that parents are expected to supply their students with more and more gear each year. they have even seen families leave the area because families can no longer afford the essentials. "it's been a huge community effort. from volunteers, from corporate groups doing drives to us all the supplies that we need. and for the 7th to 12th graders, that list has increased from 10 items in their backpack in 2005 to 21 items in their backpacks." ( steve ) this year sacred heart gave away about 3,300 backpacks! you have to register for the event about a month in advanced... so be sure to put that on your calendar for next year if your student could benefit from this program. you can find that info on our website - kron four dot com.
