trump continues to face criticism for his delay in condemning white supremacists and other hate groups. this despite his more pointed remarks yesterday. ( darya ) and a berkeley restaurant worker resigns after he is exposed for taking part in saturday's white supremacist rally in charlottesville. ( mark ) this morning - it's raising questions of whether an employer can legally fire someone for their involvement in a hate rally. kron four's spencer blake has the story. (pkg)anti-semitic chantsnazi salutesand other racist, hateful remarks filled the air at the rally in charlottesvill e virginia over the weekend. yet police and the state were constitutionally obligated to allow the rally to happen. "it's incidents like this that really throw into sharp relief what kinds of protections the first amendment provides." david snyder is the executive director of the first amendment coalition in san rafael.he, along with presumably the vast majority of americans, is horrified by the actions of the k-k-k, neo- nazis, and white supremacists,
6:06 am
and strongly disagrees with them.but he points out that this is exactly the type of speech the first amendment is designed to protect."if minority viewpoints aren't protected, that means all of our speech, all of our ability to speak is limited."granted, there are some exceptions, like speech that incites violence.but those exceptions are very narrowly defined, legally, and don't include general or abstract calls to rise up and fight.though the litmus test would have to be applied on a statement-by- statement basis, snyder suspects the constitution would protect ámost of what was said at the rally, meaning the ágovernment cannot do anything about it.take, for example, what a public university president said after learning one of his students participated in the rally.marc johnson: "we definitely do not support the content of his (peter cvjetanovic) message, but we have not constitutional or legal right to fire him from a job or expel him from the university."but the first amendment doesn't limit what
6:07 am
non-government employers do. "a private employer can fire someone for their speech - and there may be other reasons that that firing is improper, but from the constitution's perspective, the constitution is irrelevant."snyder says he supports a principled stand of free speechciting examples of the a-c-l-u defending the rights of neo-nazis to march. (flashcam)one other important note i learned from snyder -- in california, an employer cannot fire someone soley based on their political affiliation. ( darya ) and our coverage of the violence in charlottesville continues on the web. we recently posted a story with a local expert who talks about the moment the rally turned into domestic terrorism. it's all on kron-4-dot-com. ( mark ) this is just the latest in a string of shootings to happen on bay area freeways. there have been a total of 99 shootings since november of 20-15 six people have died and 36 others have been injured. so far this year, there have been 29 shootings on bay area freeways. in many of these cases, the c-h-p has said the shootings were targeted or gang- related. ( mark ) the two people accused of killing a man at twin peaks in san francisco last month plead not guilty in court. 19-year-old lamonte mims and 20-year-old fantasy decuir have been charged with the murder of ed french. french's family wants to know why mims was not behind bars at the time of the murder. two weeks before the shooting-- mims was charged with felony possession of a firearm. he was on felony probation for car burglary in san mateo county and misdemeanor probation for receiving stolen property in san francisco. public defender jeff adachi says the judge in that case followed protocol.
