(tiffany @ landing) our top story this morning... a white nationalist group has been denied a rally permit in berkeley. but organizers say they'll still show up sunday at civic center park. this is deof violent protests earlier this year. city officials say the permit was denied because the organizer's application was incomplete and was filed late. they also say it lacked any explanation of security arrangements at the event. kron4's philippe djegal has the details. (philippe) racial justice and anti-facist organizers say they intend to counter protest a white nationalist rally scheduled sunday at martin luther king junior civic center park .dan siegel- "my point is that fascist do not have free speech rights to incite violence or to urge people to genocide." berkeley councilmember ben bartlett says he sides with the anti-fascists... but

hopes the dueling protestors remain peaceful.ben bartlett/councilmember- "we owe it to our children and our community to stand-up against hate and we are the home of social justice. and, while we respect free speech, we are going to stand-up and fight hate everytime." though some racial justice organizers have called on mayor jesse arreguin to prevent the white nationalists from holding a rally in the park... he says they have the right to peacefully assemble.jesse arreguin/mayor- "we just voted on friday on an emergency ordinance to give our police the power to confiscate weapons, um, outside of the park." he says hopefully that will prevent a repeat of the violence carried out at several other rallies in berkeley earlier this year. jesse arreguin/mayor- "what we do not tolerate and what we will not allow is violence by anyone. left or right." in berkeley, philippe djegal, kron four news. (tiffany @ landing) san francisco is also bracing for potential violence. this after a pair of counter demonstrations are being planned more than three miles away from the right wing event at crissy field. the first of which is happening this afternoon at civic center

plaza near city hall. then saturday at noon, at the same place another counter protest at civic center. those gatherings are meant to oppose what's happening at crissy field which is the main white nationalist event on saturday. the city is staging the coutner protests at civic center in hopes to prevent violence between the two sides. at least four counter protest groups are planning to end up at crissy field saturday. and even though it's national park land, guns and other things that could be weapons will not be allowed. there's an anti-hate banner that will be unveiled at ocean beach saturday. several businesses and roads will be closed in the presidio and along crissy field. the golden gate bridge parking lot in the city will be closed as well.. all the details on groups demonstrating and traffic impact can be found on our website, kron4.com. attempted rape suspect wanted for an attack in el cerrito. police are searching for mario hills. they feel he maybe using bart to get around. the crime happened tuesday night on stockton avenue and balra drive. kron4's haaziq madyun talked to the man who helped the woman who was attacked. it was the voice of a woman being attacked allegedly by the man you see in this surveillance photo according to brett guest. it happened tuesday just before 7am near the driveway of his home on stockton avenue at balra drive in el cerrito. guest when he came outside to see what was going on...

-years ago a 6-point-0 earthquake struck southern napa and surrounding areas. killing one person and injuring hundreds more. the quake also caused hundreds of millions of dollars in damage to homes, businesses and infrastructure across the north bay. kron 4's charles clifford was in the city of napa where some repair work is still on going. the south napa quake hit around 3:20 on the morning of august 24th 2014. jennifer king lives near downtown napa, she was home asleep at the time.sotit was powerfull.when the sun came up the next day, the damage was devastating. jennifer couldn'tsotmany of my friends were hit extremely hard. the entire contents of their homes spilled onto the floor. it was ferocious. following the quake, the repair work kicked into high gear and within a year much of the damage was repaired.standup but in the two years after that the work slowed down as it became harder to secure funding for some of the bigger jobs.three years after the

quake, several buildings including the old county courthouse and the library are still being worked on. city officials said on thursday that those projects could take another year to complete. jennifer isn't worried. she says downtown napa is thriving with new construction and she's confident the quake damage will soon be a thing of the past.soti think in many ways it motivated downtown to become something extraordinary. we see new building going on and refinement to older buildings. i think it's really amazing how we have emerged from the quake so to speak. in napa, charles clifford kron 4 news. (tiffany) we are hearing from an 87-year-old woman who fought off a man who tried to sexually assault her. the attack happened wednesday in stockton. the criminal got into her apartment by cutting through a screen. reporter rowena shaddox has the story. 87-year old mary kerr reliving terrifying moments... after she says a man broke into her stockton apartment - and sexually assaulted her. it was just after five wednesday morning - when police say the suspect cut through the screen on kerrús patio door... kerr says -- she continued to

try and fight off her attacker... eventually - she grabbed her walker - and used it to fight him off. it was her screams that got the attention of a neighbor.... the knock on the front door was enough for the suspect to get spooked and finally leave. despite her harrowing ordeal... kerr áwanted to tell her story... and show that youúre never too old to fight. (tiffany) no arrests have been made

in the attack. police have not yet released a detailed description of the suspect. (tiffany) a study by housing advocates shows one- in -three californian's use half their paychecks for rent. that means less money for food, health care, child care, and more. flanked by affordable housing advocates, state treasurer john chiang says lawmakers need to pass a housing bond measure. doing so would raise six- to nine- billion dollars to build affordable housing units.

from "zumper" here is a look at the averages. san francisco rent fell 30-dollars since last month to just over 34-hundred dollars a month. mountain view is number two at 32-hundred. redwood city was third with just over three-thousand dollars. and here's a look at the least expensive. vallejo was the least expensive at 13-hundred a month. santa rosa had the second least expensive city at just over 15-hundred. napa was third with 16- hundred. this report looked at active listings that hit the market in july this past year. (tiffany) another big story we are following this morning... a judge has ruled a california based company must comply with a warrant to hand over information about an anti - trump website. but there are conditions. the judge said he had to balance the needs of law enforcement with people's first amendment rights. alexandra limon was at the court hearing and tells us whose information the government will be looking at.

this website, disrupt-j-twenty dot org helped organize protests around president trump's inauguration. now the government is suing for information about anyone who visited the site, saying it could lead them to people who illegally caused damage on inauguration day.but lawyers for 'dream host' the californai company that hosts the website argued the search warrant violates user's first amendment rights.the judge ruled with the government allowing an ammended warrant raymond aghaian / lawyer, dreamhost :33- :40what remains problematic for us is that the government is in possession of this information. and that government is sifting through and reviewing this information. initially the justice department asked for all data related to the website.. which dreamhost says mcourt:eans handing over the ip addresses, names, phone numbers and data of 1.3 million people.after the riots on inauguration day, a grand jury indicted about 2- hundred people, 19 of them plead guilty. but

(tiffany) san jose police are launching a campaign to recruit members of the l-g-b-t community. it features a series of ads showing the actual families of three officers. here's a portion of one.

eddie garcia of the san jose police department and we're hiring. and i want your family to be part of our police family.">(tiffany) the other two ads feature the families of a heterosexual couple and a gay male couple. chief garcia says the department created a new role dedicated to addressing crime and police concerns within the l-g-b-t community. he says many crimes against the l-g- b-t community go un-reported. according to county figures, just one in four l-g- b-t domestic violence victims reports the abuse to police. (tiffany) a disturbing attack on a san francisco street all caught on camera... a woman is punched, knocked to the ground and when she calls out for help, the suspect comes back and hits her again. it happened two weeks ago on sweeny street. just off san bruno avenue in the portola neighborhood. kron4's maureen kelly reports police believe this attack was unprovoked. when we first see the suspect on this surveillance camera footage from august 10th at 8pm, he looks like any other person out for an evening stroll on san bruno avenue. because this is an ongoing investigation by san francisco police, we've agreed to blur out his face, and that of the female victim.but as after she walks thru the frame on another camera on the unit

block of sweeny..he can been seen running her down.when he catches up to her police say he struck the 31 year old victim on the back of the head, and punches her several times on the face until she falls to the ground.this doesn't appear to be an attempted robbery, since he didn't take her handbag or the shopping bag she was carrying. if this attack wasn't cowardly enough, once she starts yelling for help, he comes back and hit her again.a neighbor who saw the video says their neighborhood has it's ups and down in terms of crimes, but in the 20 plus years she's lived here, she's never seen anything like this. i've never seen something or someone would just come out of nowhere and hit a woman and she falls to the ground and then he comes back. it was like it wasn't enough so i'm horrifiedi normally walk with my grandson my parents were elderly i walk with my kids now you got to start thinking i got a wash my back check the backseat was walking behind me because i'm not scene this ever since i've been living herethe victim was treated for her injuries at california pacific medical center.when asked if the suspect is tied to any similar crimes, the sargent assigned to the case said she could not comment, due to the ongoing nature of the investigation.maureen kelly kron4 news

(tiffany @ bam) a big story we are following this morning... hurricane harvey has the potential to be the first natural disaster of donald trump's presidency. the white house downplayed any concerns about their preparedness. karin caifa (kay-fuh) explains how the calm response comes despite the absense of a permanent homeland security secretary. warnings, preparations and evacuations -- along the texas coast, as hurricane harvey moves closer."bottled water, flashlights, generator..."the white house said the president is monitoring the weather situation, and a message on his twitter account thursday urged those in the storm region to plan ahead.the president will weather the storm without a permanent head of homeland security. former secretary john kelly, is now his chief of staff.white house press secretary sarah huckabee sanders downplayed concerns about the administration's readiness, expressed confidence in the department's

in the outfield is having a seagull swarm him, or "go to the bathroom," on him. you've probably seen the birds hover over a-t-and-t park in the late innings. and it's not just in san francisco. the oakland coliseum has the same problem. the a's have actually put in a pair of falcon-shaped kites to keep the birds from flying into the stadium. in 20-12, the giants added a hawk nicknamed "bruce lee" to solve their seagull problems. bruce has since left his post. (tiffany) perhaps coming soon to a starbucks near you a sushi burrito. it's being test marketed at two starbucks locations in chicago. it's actually called a chicken maki roll. the company describes it as a classic california chicken burrito with a twist. it's rolled in sushi rice and wrapped with nori. the roll is filled with slow cooked, shredded chicken, salsa, fresh cucumber and

the alum rock section of san jose is having a problem and it's not just one spot its multiple locations but all in close proximity to each other this is rinehart near jackson street, where 1000 dollar fine for littering are up and down the block . signs which are clearly ignored . things like this walmart shopping cart filled with who knows what nats: ambiance on mckee road there is a different pile, a pile which basically covers most of the sidewalk there is also a man there who was wearing a walgreens smock but he didn't appear to work for walgreens nats: ambiance if you happen to exit interstate 680 at mckee you will see trash up and down the off ramp in fact is you look closely there is an encampment hidden in the bushes you will also find trash if you exit the berryessa off ramp and yes that is a toilet nats: ambiance on some neighborhood streets you might find a mattress here or there . but what i also noticed was this area has a fair amount of no dumping signs . nats: ambiance which brings me there this sign its reads warning restricted area but then there is a code to back it up except there doesn't appear to

(tiffany) fresh off calls for unity and healing wednesday.... president trump took to twitter going on the offensive against some of his biggest supporters in congress. sara murray, with our partners at c-n-n, has the president's latest online attack. president trump taking to twitter to get several things off his chest today.. first going after paul ryan and mitch mcconnell, for not attaching controversial debt ceiling legislation to a "popular v.a. bill (which just passed) for easy approval. they didn't do it so now we have a big deal with dems

holding them up (as usual) on debt ceiling approval. could have been so easy-now a mess!" congress has until the end of september to raise the debt ceiling or potentially cause the u-s to default on its debt. but cnn has learned it was the house republican freedom caucus that scuttled attempts to tie that legislation together - not gop leadership. white house press secretary sarah huckabee sanders says she's confident congress will raise the debt limit in time. sarah huckabee sanders/white house press secretary"it's our job to inform congress of the debt ceiling and it's their job to raise it. and congress and the previous administration have obligated trillions in spending and we need to make sure we pay our debts." the president also upping the ante in his own ongoing feud with mcconnell for failing to pass the obamacare repeal legislation last month -- tweeting "the only problem i have with mcconnell is that, after hearing repeal and replace for 7 years, he failed. that should never have happened!" their relationship soured after a tense phone call following the healthcare

(tiffany @ bam) bay area tech company apple is expanding but not here. the company's new data center will be build in the medwest. c-e-o tim cook and other officials made the announcement. the one- point-three billion dollar facility will be located about 20-minutes away in waukee. the data center will create 50- permanent jobs and it will help run apple's app store.

iowa's governor praised the decision. the construction is expected to get under way next year. and the center should be up and running by 20- 20. to park in certain areas ahead of the protest tomorrow. the fencing already started going up at crissy field. guns and other things that could be used as weapons or safety gear will not be allowed in the designated protest area. there are at least 4-counter protest groups expected to end up at crissy field saturday. there will also be closures around the golden gate bridge during the rally. only tour buses will be allowed in the parking lot north of the bridge. no personal cars will be allowed from 11am to 5pm. all of the parking lots south of the bridge will be closed.

the fencing already started going up at crissy field. guns and other things that could be used as weapons or safety gear will not be allowed in the designated protest area. there are at least 4-counter protest groups expected to end up at crissy field saturday. there will also be closures around the golden gate bridge during the rally. only tour buses will be allowed in the parking lot north of the bridge. no personal cars will be allowed from 11am to 5pm. all of the parking lots south of the bridge will be closed.

( darya ) facing a budget crisis... an east bay school district is considering laying off staff. the newark unified district says it is dealing with a decline in student enrollment. over the last five years... it has lost over 600 students. it says an independent analysis recommends slicing 5-million dollars from the budget over the next two years. salaries and benefits eat up a big chunk of its general fund. the superintendent says that translates to having to reduce the number of employees. ( darya ) four people have been arrested after police in san mateo found more than 11- thousand marijuana plants. police say the grow sites were well hidden. the plants ranged from two- to ten -feet in size and are worth around 22-thousand-dollars. the

suspects are facing a string of charges related to marijuana cultivation and environmental violations. ( darya ) hundreds gathered to remember a modesto police officer killed by a suspected drunk driver. sergeant mike pershall was riding his bike near his home when he was hit and killed. a vigil honoring pershall was held yesterday on a baseball field in modesto people who attended held candles and wore san francisco giants gear. pershall was known as a big fan of the team. ( mark ) the california supreme court approved a measure to speed up executions in the state...while also implementing a key provision. voters approved proposition 66 last november... the measure aims to speed up death sentences by setting a five- year deadline on court appeals. the supreme court ruled that the deadline be a recommendation, ánotá mandatory. proposition 66 beat a competing initiative that would have abolished the death penalty. there are nearly 750 inmates on death row in california and only 13

new york community have come together to help a paralyzed man get a ramp for his backyard. wayne nelson was in a motorcycle accident five years ago. he has been bound to a wheelchair since then. a man saw nelson in a facebook post sitting on his back porch. he learned from that post that nelson did not have an easy way of getting into his backyard to do yardwork. the man decided he wanted to build a ramp for nelson. he posted about it on facebook and other people also want to help with the project. the group is planning on building the ramp for nelson on sunday.
