(grant) state senator scott wiener from san francisco released a firery statement a short time ago. "today the right-wing extremist group patriot prayer - with a history of violent rallies - showed its true colors by canceling, at the last minute, its permitted rally at crissy field... and scheduling an illegal, unpermitted rally at alamo square. they did this after the national park service correctly placed significant security conditions on the permit, including not carrying anything that could be used as a weapon. patriot prayer is not interested in simply exercising free speech. rather, patriot prayer wants to create a volatile, chaotic, violent tinderbox. this rally in alamo square is illegal... and in the heart of a residential neighborhood... and i am deeply concerned it will lead to violence, particularly given how close alamo square is to the counter-

despite the city of berkeley denying a permit for a "no to marxism" rally this weekend... alt-right groups are still planning to show up at civic center park sunday...(vicki) and, as kron four's philippe djegal reports... counter protestors say they'll be there too. (vicki) bail is set for the far-right activist who was arrested for causing violence during a pro-trump rally in berkeley earlier this year. this is video from the violent protests at the "march for trump rally" back in march. police say kyle chapman was swinging a wooden stick at people during the rally. a judge set bail at 135-thousand dollars. the judge said that if he makes bail he should stay at least 300-yards from civic center park in berkeley during the rally this weekend. chapman heads back to court on september fifth where is expected to enter a plea. (grant) the woman at the center of the east bay police sex scandal has now sued the contra costa county sheriff's office. jasmin abuslin...who's also been known as "celeste guap"...

accuses deputy ricardo perez of having sex with her multiple times starting when she was 17-years-old. abuslin says he also shared lewd photos of her with colleagues at the sheriff's office. she says that she viewed the relationship as an exchange... for protection. abuslin's attorney, john burris says perez's conduct was despicable. (grant) perez is one of seven current or former law enforcement officers who've been charged with crimes connected to the scandal. perez has pleaded not-guilty. he'll be back in court in october.

hurricane harvey is getting stronger... it has just been upgraded to a massive...category four hurricane. one person had to be rescued in texas after their car was stranded in the flooded waters. winds are as a high 145-miles-per-hour. (grant) the eye storm is

expected to make landfall in south-east texas late tonight. martin savidge... reports on the scramble to get ready...and get out. the national hurricane center says hurricane harvey has strengthened to a category 4 storm.the center says harvey has sustained wind speeds of 130 mph (209kph) as the powerful storm churns off the texas coast. forecasters are labeling it a "life- threatening storm."the storm quickly grew thursday from a tropical depression into a category 1 hurricane, and then developed into a category 2 storm early friday. by friday afternoon, it had become a category 3 storm before strengthening to a category 4. it's forecast to make landfall in texas late friday or early saturday.the storm is 45 miles (72 kilometers) east of corpus christi.hurricane harvey looks to hit about the same area as one of the strongest and deadliest hurricanes to ever smack the united states: the indianola hurricane of 1886. the national hurricane center says the indianola hurricane ranks as the fifth strongest

hurricane to make u.s. landfall, behind the 1935 keys hurricane, 1969's camille, 2006's katrina and 1992's andrew. about 150 people died, putting it in the top 25 most fatal hurricanes.mit meteorology professor kerry emanuel says indianola was a thriving city before it was struck and it never came back. according to texas escapes magazine, it's now pretty much a ghost town.emanuel says that harvey "is going around the same place."more than 15,000 people aboard three carnival cruise line ships scheduled to return to galveston, texas, this weekend face delays or detours due to hurricane harvey in the gulf of mexico. the port of galveston was closed friday amid the hurricane threat.a statement friday from the miami-based cruise line says the carnival freedom and carnival valor were at sea and would remain a safe distance from the hurricane. both ships were originally scheduled to dock in galveston on saturday but will instead stop replenish supplies.the carnival carnival valor each carry about 4,800 passengers statement says they'll resume their return to soon as possible.the carnival scheduled to return to galveston on spending friday night in cozumel, mexico. that ship 6,000 on board. the carnival statement said the ship would depart saturday for texas to be in port of galveston reopens. a heat advisory

(grant) san jose police are releasing the identities of two suspects arrested for a fatal shooting that took place nearly two months ago. isaac brown has been booked on two counts of attempted murder. raymond estrada...booked for assisting in the crime. police say the pair shot two victims near the area of south 11th street and east san antonio street on june 28. both victims died from their injuries at a hospital. both suspects are at the santa clara county jail. (grant) first - organizers for the patriot prayer rally... which was scheduled for tomorrow at san francisco's crissy field. the orangizers citing - safety concerns... instead - they plan to host a news confernce at san francisco's alamo square - which is not permitted. the patriot prayer group then said they've be attending a similar rally planned for this sunday in berkeley... which has also just been cancaled. this is all still developing and we will have more at 6 pm (grant) and in anticipation of tomorrow's rally - which has now been canceled... hundreds of people gathered outside san francisco's city hall... today for a unite against hate

rally. kron four's terisa estacio - has more on today's peaceful rally and the message. terisa estacio, live, passions ran high today as city officials, community members and bay area residents joined together to speak up about the patriot prayer event. at the time of the rally, no one had any idea that the event was going to be canceled so they spoke from the heart about their hope to bond together and send out a message to the group that was expected to come to town. to a story we brought to you yesterday... the man accused of sexually assaulting a woman in el cerrito... has been taken into police custody... the attack happened near stockton avenue at balra drive tuesday morning. the woman was being sexually assaulted near the driveway of brett guest's home. when a good samaritan heard her scream, he went outside and chased the man away. (vicki) today - officer announced they have arrested - mario hill. he now faces charges of attempt to commit rape. (grant) happening tomorrow... a memorial service for oakland firefighter jake walter will be held. walter was shot and killed last week in san jose - while he was off duty. oliver junio is accused of fatally shooting

the 30-year-old jake ... and injuring another firefighter. the shooting happened in downtown san jose, near 9-th and taylor streets -- at the gordon biersch brewery - last friday. as a recent academy graduate, walter was one of oakland's newest firefighters. junio has now been charged with first degree murder - and attempted murder. the memorial is set to start - tomorrow morning at the oakland scottish rite center... on lakeside drive in oakland. (vicki) breaking news from the white hosue. another one of presidents trump's top advisors sebastian gorka has resigned. gorka was allied with steve bannon who also recently resigned. gorka was the deputy assistant to the president. he was also been a lightning rod for controversy because of his association with right wing groups.more on this story at kron4.com (vicki) another big story we are following tonight... president trump has signed a directive - banning transgender troops from serving in the military. the new approach is based on formal guidance the pentagon expects to receive soon from the white house. the guidance - appears to be less rigid than the complete ban that president donald trump announced last month in a tweet. he said the government "will not accept or allow" transgender individuals to serve "in any capacity" in the military. the official said the new guidance was

officials in denver are on administrative leave over a cheer-leading controversy. newly released video shows a teen crying ... while a coach and teammates hold her down to perform the splits. we do want to warn you - the video is very disturbing... in the video - you can hear the girl repeatedly asking her coach... to "please stop." seven other girls were also pushed into the splits... while being held down. the videos were shot by two teammates... and were sent anonymously to a local news station. the girl's mother says, somebody should have stepped in to help her daughter. county sheriff's office is being sued by the woman at the center of the east bay police sex scandal. jasmin abuslin...who's also been known as "celeste guap"... accuses deputy ricardo perez of having sex with her multiple times starting when she was 17-years-old. abuslin says he also shared lewd photos of her with colleagues at the sheriff's office. she says that she viewed the relationship as an exchange... for protection. abuslin's attorney, john burris says perez's conduct was despicable.

law enforcement officers who've been charged with crimes connected to the scandal. perez has pleaded not-guilty. he'll be back in court in october. in the south bay: san jose police say two men are under arrest tonight for a killing last summer. the shooting happened last june.. not far from the san jose state campus. one man died and another was wounded. police say it took them nearly a year to identify suspects in the case. 25-year-old isaac brown and 29-year-old raymond estrada are both in the santa clara county jail. police say they have had the two in custody for a while... they just wanted to wait to make sure they had the right men behind bars. a motive has not been released. ( pam ) tomorrow is the funeral for an oakland firefigher who was shot to death in san jose. jake walter had recently graduated from the academy and had started with the department a few months ago. he was off duty at the time and with another firefighter at the time. that firefighter was wounded and is recovering.
