( james ) breaking news this morning... authorities in mexico say they are evacuating residents in puerto madero in chiapas as a precaution due to a tsunami alert put in place after a major earthquake struck the country. at least five are dead after what mexico's president called a massive eight point two magnitude earthquake that struck off the coast of mexico earlier this morning. the quake struck 74 miles off the pacific coast. it could be felt as far as mexico city and guatemala city. this earthquake is the strongest earthquake mexico has had in a century.

up. i was frightened. i didn't know what was going to happen to me.">( james ) another big story we are following this morning... people in florida are now bracing for irma. this as yet another hurricane forms in the caribbean.(tiffany) hurricane jose is following in the path of irma. 185- mile per hour winds devastated resort islands. more than a dozen people died on saint martin, barbuda, tortola and saint thomas. catherine heenan has more on the deadly storm. heavy rains are now drenching haiti ... as irma moves toward the u=s mainland. "this a powerful, strong, almost a nuclear hurricane." businesses and homes boarded up from key west to homestead. "today is really the deadline. people are gonna get caught on the turnpikes, they're gonna get caught on the roads, they're gonna do that last minute panic and try to get out of here, it's gonna be too late." mandatory evacuations now

include downtown miami as well as miami beach. "miami-dade will have major hurricane impacts with deadly storm surge - deadly storm surge and life threatening winds." "i cannot stress this enough, you don't wait to evacuate."thousands of mobile home residents in south florida have been ordered to find a safer place to ride out the storm."it is what it is. these are not structural, sound buildings."broward county's animal shelter evacuated more than 175 of its residents by plane in order to make room for displaced pets during the storm. natand a new sight on florida highways: state police escorting convoys of fuel trucks "one of our top priorities right now is fuel availability.drivers have lined up for hours to buy gas, only to find the pumps were dry. "people - they're running out in their cars. they can't get it at the gas stations."the new normal in florida tonight: ... crowded highways ... crowded supermarkets.and crowded airports."i'd like to leave today. tomorrow nobody will be working here."

( james ) two bay area airports are sending tsa workers to assist in reopening florida airports after hurricane irma goes through the area. roughly 250 t-s-a workers from oakland international airport and mineta san jose international airport will be pre-positioned at airports throughout the sunshine state. the federal agency is expecting hundreds of employees in florida to be busy dealing with the storm's aftermath when airports in the region resume operations. airports in sacramento and los angeles also plan to send tsa workers. (tiffany) another big story we are following this morning. about 143 million americans are impacted by a data breach at equifax. the credit reporting company says the breach compromised the personal information of nearly half the people in the country. the breach happened mid-may through july but was just made public now. charels clifford has the details. varun badhwar is the founder and ceo of redlock, a menlo

park based cloud security company. he says that the hacking of equifax should concern almost every american, even if thehave never personally used the company's services.soti think at some point almost every consumer has gone to equifax and pulled down a report. if you haven't directly, one of your banks of financial instates had.in the wake of the hack, he also warns there's not much consumers can do to be proactive about protecting themselves. its extremely hard, if not impossible, to change things like social security numbers, drivers license numbers or birthdates. he says the best people can do is to closely monitor their credit.sotmonitor credit activity. look for instances where you're seeing someone nefarious trying to open up accounts on your behalf because they have all the information required to do so. equifax is offering free credit monitoring for year to anyone who's concerned that their information many have been compromised, but badwhar points out that that is something of a catch 22.sot youre going to have to go back

to equifax and give them your information all over again and hope and trust that you don't lose it again.he also says that the size and scope of this hack should be a wake up call to how vulnerable our personal information is.sotif we can't trust credit monitoring service providers then i'm not sure who's left that our data is secure with. in menlo park charles clifford kron 4 news. (tiffany) in the past few years...dozens of companies including target home depot and linked-in have suffered data breaches. if you're among the millions of people who have been exposed in a data breach, there are things you can do to minimize the chances of becoming a victim to identity theft or credit card fraud. change your account passwords if they are compromised. you should not share the same password with multiple websites. but if you do then you should change those passwords immediately. check your statements for any unauthorized changes. and you can set up a freeze on your credit report. doing that will alert you if someone is trying to run a check and

can flag that you did not request it. (tiffany) four of california's 'urban search and rescue' teams have received the call. and they are heading to florida to deal with hurricane irma. among those teams is task force 3 out of menlo park. kron 4's dan kerman has more on the deployment. within an hour of arriving back in menlo park from hurricane harvey, members of california's urban search and rescue task force three, were getting their gear cleaned their boat motors checked and their cars serviced because now the team has been called to florida for hurricane irma sot harold schapelhouman /menlo park fire chiefthe team members that just returned from harvey won't be going, but the new members will include search and rescue personel, hazardous materials and communications specialists, structural engineers , doctors, and dogs and dog handlerssotover the

next few hours team members will begin arriving and loading the gear on these semis which will be driven out to florida to meet the teamstand up dan kerman/menlo park 58-103104/std ( james @ landing ) a teenager who was driving home from work last week lost control of her car and crashed. she was instantly killed when her car hit a concrete pillar. and now an east bay community has come together to remember her. kron4's hermela aregawi spoke to some of the teen's family members. she was almost halfway home. but kirsten yalda never made it.samuel yalda/victim's father just the sweetest, most caring girl, she loved everybody, always tried to help people out. everybody loved her. always tried to help people

out. everybody loved her.her father describes getting the devasting callsamuel yalda/victim's fathershe said she was in a car accident last night. i was like okay tell me what's going on and she said she didn't make it. and right then i just hung up i couldn't handle it. it was last thursday around 4 in the afternoon.kirsten was on her way home from work police say her car veered off highway 580 eastbound and slammed into a pillar.she was pronounced dead on the scene.samuel yalda/victim's fatherit's just a senseless accident, maybe careless driving but her autopsy and everything there's no alcohol or drugs nothing like that and so we're still kind of torn about what happened. its just questions we may not ever have the answers to.14 jamba juice locations including thisone where kirsten worked for the last five months came together to raise money for the family. tara lindstrom/franchise owner the people she was close with said she was just a great spirit, always willing to help others and just seemed like a really good kid. obviously very responsible, worked

(tiffany) students at a middle school in pacifica gathered for a memorial for their music teacher who was killed in an accident. jerry downs was the band director for 15- years at 'ingrid b. lacy' middle school and at 'ocean shore' elementary. he was somehow hit and killed by his own car near the corner of palmetto avenue and surf street wednesday morning. last night some former students, now in high school, came to comfort each other and put flowers near the parking lot where the accident happened. one parent spoke to kron four about what the loss means for students in the district.

(tiffany) in the east bay... an oakland police officer has been arrested on suspicion of driving under the infulence and resisting arrest in dublin. it happened wednesday night. officials say officer bryan budgin posted bail and is out of jail. the oakland police department released a statement saying it is aware of his arrest. but they have not said if he is still on active duty. ( james ) days after the decision to end daca all eyes are now on another controversial immigration measure called - s-b-54.

it is also refered to as the 'california sanctuary state' bill. karma dickerson has the details. live intro:many told us they see this bill as a necessity after learning daca protections are in jeopardy ((pkg))sot- the governor's house that's rightthe fight over sb54, also known as the california values act has been playing out in the legislature since one month after presidnt trump"s election. but thursday advocates of what others call the "sanctuary state" bill took the battle to the governor's mansion. sot-stacy suh- the governor has yet to make a strong commitment about the ca values actsb54 would restrict using state resources to enforce immigration law. sot- it creates safe spacesbut one of the most controversial provisions of sb54 would restrict jails in many cases from notifying ice when a prisoner wanted for immigration violations is released. advocates say it's needed now more than ever sot- carlos amador/ca immigrant policy center- whether it's pardoning the racist sheriff

for the storm as evacuation orders are underway. people are not the only ones getting out of the state... dozens of adoptable animals were evacuated from the shelters and flown here to the bay area. this will help clear the shelters in florida to make room for animals displaced during during hurricane irma. as kron four's gabe slate reports the animal rescue foundation in walnut creek is where some of these animals will be housed. 92 cats and 62 dogs arrived on the tarmac of the hayward airport this afternoon coming from broward county humane society in florida. the shelter there wants to be empty in preperation for all the displaced animals that may need help after hurricane irma. these dogs and cats will be separated between 3 shelters here the east bay spca, berkeley humane society, and at arf, or the animal rescue foundation in walnut creek. that's where i captured these images of the dogs and cats arriving thursday evening arf is taking in 40 cats and 25 dogs. broward

( james @ bam ) a captain with the oakland fire department is behind bars and accused of possessing child pornography. this is surviellance video of the moment he was arrested. kron four's haaziq madyun reports on what led to the arrest. oakland fire captain richard chew has been arrested and charged for one count of possession and one count of distributing child pornography. kron4 obtained this surveillance video of chew's arrest wednesday at his home in lafayette. his next door neighbor saw lafayette police serving the search warrant

pornography. the investigators say they found up 600 child pornography videos and images allegedly in the oakland firefighters possession.on thursday richard chew was arraigned in martinez at contra costa county superior court.richard chew's bail was set at $200-thtousand dollars. if convicted he could face a maximum of five years in state prison...in martinez haaziq amdyun kron4news ( james ) an east bay

judge ruled that jahi mcmath may still be technically alive. she is the teen that has been declared brain dead for more than three years. the ruling allows a lawsuit by jahi's family to move forward. they are suing children's hospital in oakland for botching a routine tonsillectomy for the girl. she was 13 at the time. the lawsuit also demands the hospital pay for jahi's future care. and demands a ruling be made that she is alive. the alameda county judge will leave that up to a jury to decide. if the jury rules in favor of jahi's family it could increase the amount of damages in the lawsuit. (tiffany) santa cruz authorities say a brain surgeon and two nurses already in jail awaiting trial for operating a child- sex ring caught on video may now face more charges. this comes after investigators discovered additional video footage. dr. james kohut, rashel brandon, and emily stephens are each charged with sexually

assaulting multiple children. police took seven children ages three to 13 into protective custody. kohut's attorney says his client denies the charges. brandon's attorney says she was exploited by kohut. and stephen's attorney did not comment.

agentcy's join force to crack down on traffic violaters.( james ) stanely roberts shows us on this edition of people behaving badly. i got caught baving badly .. that phrase was uttered by many drivers in pittsburg during a traffic crackdown which involved antioch police, brentwood police, and yes pittsburg police but even before we could get to the location this driver was using the center median to pass (sound of siren)you're being stopped because you were driving down the center medium. im riding with sergeant terry of the pittsburg police department . we ended up on san marco blvd why? i'll let a resident explain they come through they turn right in the left-hand turn lane like this red pickup. however, he was greeted by one of the officers some drivers were doing other things as well like illegal u-turns take a right turn .. so he gets to have a chat with an antioch police officer any particular reason you turned when you know you couldn't ther freeway is backed up i

officers are recovering after a shootout that ended in the death of a homicide suspect in sacramento. it happened at around 11:00 yesterday morning. police were trying to stop a car driven by a man wanted in connection with a double -homicide. one officer was shot in the chest. but the bullet ricocheted off his bullet- proof vest. the other officer was hit in the leg. both are expected to be okay. the man wanted for the double homicide was killed. his identity has not yet been released. (tiffany) in the east bay... a woman in union city says she was sexually battered along a walking trail.( james ) it happened monday morning on the union city walking trail off union city boulevard at kohoutek (kuh-who-tech) way. as kron four's philippe djegal reports investigators say the victim has seen the suspect before. (philippe) seconds after a woman stepped foot on this trail monday...carmen robinson/works nearby- "very frightening." and, not long after she had a trail of her own. an alleged sexual predator, who would soon

pounce.rubi myrick/works nearby- "very concerned. we take walks on that trail sometimes." the alleged attack happened at around 6-30 that morning. the woman who police say was sexually battered was alone at the time. the victim helped investigators develop this composite sketch of the man. carmen robinson and rubi myrick work nearby and often take walks in the area on their lunch breaks. they say this man does not look familiar.rubi myrick & carmen robinson/work nearby- "we'll keep our eyes open." sergeant steve mendez with the union city police department... says that this was actually the ninth time that the victim had encountered the suspect on this walking trail. in the eight previous occasions, she tells police that he walked up to her and asked her to "be his friend." she denied him and then he walked away. this time, mendez says that he groped her. sgt. steve mendez/ucpd- "she was able to call 9-11 on the cellphone because she felt that he was either going to attack her or grab her, which he ultimately did and as the attack occurred, the 9-11 dispatcher was able to to ask her questions and we believe that because she had the

dispatcher on the phone, he was scared away." sergeant mendez says the victim believes the man is either hispanic or filipino. standing five-foot-seven, with a stocky build. always seen by the victim wearing a t- shirt, basketball shorts and tennis shoes.sgt. steve mendez/ucpd- "our detectives are currently looking into local, uh, sex registrants and, um, you know, checking up to see if any of them match the description that was provided with the victim."rubi myrick/works nearby- "most of the time, i always walk in pairs or a group of people." as should anyone visting this trail, until the groper is caught. in union city, philippe djegal, kron four news. (tiffany) in national news... the scope of president trump's travel ban is narrowing. a federal appeals court has rejected the trump administration's limited view of who is allowed into the country the court ruled that grandparents, cousins and other close relatives of people in the united states should not be prevented from coming into the country. the court also ruled refugees accepted by a re-settlement agency should

not be banned. there is no word from the white house about whether an appeal is planned. (tiffany) the trump administration announced plans to replace another obama administration policy. education secretary betsy devos says any new policy on investigating sexual assault on college campus must balance the rights of victims and the accused. this replaces an obama administration guidance that outlined guildlines for schools on how to handle sex assault allegations. devos called it a failed system and says the rights of all parties must be taken into account. she says the current policy denies due process to indivuduals accused. (tiffany) devos says they will seek public input in

developing a new policy for sex assault on college campuses. ( james ) in dubs news... back in june during the parade celebrating their 2nd nba title in 3 years warriors owner joe lacob told the crowd the team would pick up the tap for the entire celebration as a gift to oakland. the only problem is according to a report the city of oakland still has not revived payment of almost $816,000 it says the warriors owe. adding the team also owes it $244,000 from the 2015 parade turns out the warriors had some questions about some of the charges. and are working it out with the city. oakland officials say they don't expect any problems collecting the money. predicted six more weeks of summer. that's according to residents of belfast, maine. the entire town gathers at the pier near the lobsters home for an annual ceremony. the group watches passy pete the lobster as he picks a scroll to determine whether maine will see an extended summer or be greeted by winter. pete's been right the past two years. here is a map showing exactly where the quake hit. it was originally reported as an 8-point-0 but it has been upgraded to an 8-point-1. you can see it was centered just off the coast but it was felt in mexico city... which was about 600 miles away from the epicenter. mexican oficials say 23-thousand people likely felt the violent shaking. this is video of the rescue efforts this morning. you can see crews digging through the rubble. two of the people killed... died when their house collapsed on top of them. the death toll is expected to rise as crews continue to sift through the rubble. i will continue to follow the latest developments and bring you updates through out the morning. back to you. fire in the 100's block of sylvia dr in pleasant hill . fd arrived on scene to find a garage with smoke and flames visible. there were two occupants a male and a female that live in the residence. the male was showering for work when he heard loud booms towards the front of the house. he opened the garage door to find heavy flames. male shut the garage door and was able to get the female half out of the residence. at some point the woman went back in the residence and had to be rescued by fire. she was transported to a local hospital and was unconscious. her condition was not further known. fd was able to knock the fire and is now in the mop up stage. they will be on scene for a little while fd says. there is heavy damage to the garage. the home sustained some smoke damage. under investigation, no further at this time. ( darya ) a captain with the oakland fire department has been arrested for possession of child pornography. kron4 obtained this surveillance video of 58-year-old richard chew being arrested yesterday at his home on harper court in lafayette. chew was arraigned in contra costa county superior court. he is facing one count of possesion and one count of distributing child pornography. ( darya ) on august 19th the contra costa county internet crimes against children task force launched an investigation into chew's alleged involvement with child pornography. his bail has been set a 200-thousand- dollars. ( mark ) students at a middle school in pacifica are holding a memorial for their

music teacher who died in an accident. jerry downs was the band director for 15- years at 'ingrid b. lacy' middle school and at 'ocean shore' elementary. he was somehow hit and killed by his own car near the corner of palmetto avenue and surf street wednesday morning. last night some former students came to comfort each other and put flowers near the parking lot where the accident happened. one parent spoke to kron four about what the loss means for students in the district. ( mark ) grief counselors have been brought in to help the students and the staff cope with the teacher's ( mark ) in the south bay... police have identified a man who was killed in a shooting tuesday night. officers say

39-year-old cesar paguada of san jose was the victim of a shooting that happened on story road. the gunman is still on the loose. ( darya ) kids playing with fireworks caused a 130 acre fire in gilroy....known as the bally-bunion fire. police say four teenagers... all 14 and 15 year olds... were playing with illegal fireworks over the weekend when the hillside went up in flames. police cited the teenagers who have been released to their parents. firefighters have now fully contained the fire. ( darya ) two police officers are recovering after a shootout that ended in the death of a homicide suspect in sacramento. police say they were trying to stop a car yesterday morning being driven by a man wanted for a double homicide. one officer was shot in the chest but the bullet ricocheted off his bullet- proof vest. the other officer was hit in the leg. both are expected to be okay. the man wanted for the double homicide was killed. his name has not been released. ( darya ) that shootout came... as hundreds of law

enforcement officers were in nearby roseville for the memorial service for sacramento county sheriff's deputy robert french who was killed in the line of duty. french's killer... 32-year-old thomas littlecloud from castro valley died from his injuries after a shootout with police. another suspect in the case...23-year-old priscilla prendez of oakland is in jail this morning for vehicle theft and felony evasion. ( mark ) the trump administration announces plans to change the policy on sexual assaults on college campuses. education secretary betsy devos says any new policy on investigating sexual assault on college campus must balance the rights of victims and the rights of the accused. this replaces an obama administration policy that outlined guildlines for schools on how to handle sex assault allegations. devos called it a failed system and says the rights of all parties must be taken into account. she says the current policy denies due process to individuals accused of assault. the exact details of the policy have not yet been released. ( darya ) team members will be heading to florida as soon as their equipment is loaded up and ready to go. ( darya ) dozens of adoptable pets are now in the bay area after they were evacuated from florida animal shelters ahead of hurricane irma. 92 cats and 62 dogs

landed at the hayward airport yesterday afternoon. they will be put into three shelters...the east bay s-p-c- a, berkeley humane society or the animal rescue foundation. florida shelter officials say they are clearing the shelters for animals who might be displaced from hurricane irma. they reached out to bay area shelters to see if they could house the animals. ( darya ) the cats and dogs will be available for adoption next week. ( mark ) santa cruz prosecutors say a brain surgeon and two nurses already in jail awaiting trial for operating a child- sex ring will now face more charges. investigators say they have discovered additional video of alleged child abuse. dr. james kohut, rashel brandon, and emily stephens are each charged with molesting multiple children. police took seven children ages three to 13 into protective custody.

kohut denies the charges against him. ( mark ) an oakland police officer is in trouble with the law. officer bryan budgin was arrested on suspicion of driving under the influence and resisting arrest on i-580 in dublin wednesday night. budgin is out on bail this morning. the oakland police department released a statement saying it is aware of his arrest but they have not said if he is still on active duty. ( darya ) just days after the trump administration announced the end of the daca program - the president is trying to reassure undocumented immigrants brought to the u-s as children. we showed you the president's tweet yesterday telling people affected by daca that they have nothing to worry about. kron 4 spoke to people at the immigration rights network about the president's tweet. most of the people we spoke to say they are weary of what the president ( darya ) house

( darya ) in national news... police in wisconsin are calling it one of the worst cases of child abuse they have ever seen. a 9-year-old forced to stay in a dog kennel for 12 hours a day. the cage had carboard on the floor... a couple of blankets and it was padlocked. now the girl's grandmother is in jail after a teacher reported the child abuse to police. the grandmother had custody of the girl and

an 8-point-1 magnitude earthquake hits mexico and the death toll is rising this morning.( darya ) tiffany mcelroy is here with the latest. tiffany. ( tiffany ) at least 5 people are dead after the earth quake hit just after midnight this morning near the mexico-guatemala border. here is a map showing exactly where the quake hit. it was originally reported as an 8-point-0 but it has been upgraded to an 8-point-1. you can see it was centered just off the coast but it was felt in mexico city... which was about 600 miles away from the epicenter. mexican oficials say 23-thousand people likely felt the violent shaking. this is video of the rescue efforts this morning. you can crews digging through the rubble. two of the people killed... died when their house collapsed on top of them. the death toll is expected to rise as crews continue to sift through the rubble. i will continue to follow the latest developments and bring you updates through out the morning. back to you. ( darya ) kids playing with fireworks caused a 130 acre fire in gilroy... known as the bally-bunion fire. police say four teenagers... all 14 and 15 year olds... were playing with illegal fireworks over the weekend when the hillside went up in flames. police cited the teenagers who have been released to their parents. firefighters have now fully contained the fire. ( mark ) governor jerry brown has declared a state of

emergency in three counties... because of wildfires that have burned thousands of acres and restricted access to yosemite national park. the declaration covers madera, mariposa and tulare counties... where four different wildfires are burning. cal fire says more than 16- hundred firefighters are battling the wildfire in tulare county. the pier fire has burning more than 24- thousand acres and now 35- percent contained. ( mark ) two police officers are recovering and a suspect is dead after a shootout in sacramento. this happened yesterday morning. police were trying to stop a car... driven by a man accused of killing two women. one officer was shot in the chest... but the bullet ricocheted off his bullet- proof vest. the other officer was hit in the leg. both are expected to be okay. police say the suspect -- eric arnold -- killed erica wallace and her 17-daughter. wallace's family says this outcome is both relieving and frustrating. ( mark ) four search and rescue teams from california are now heading to florida to help deal with hurricane irma including a team from menlo park. the teams got the call an hour after another team from menlo park returned home from hurricane harvey. officials say it will be a different group of people heading to florida. the new team includes search and rescue personnel, hazardous materials and communications specialists, doctors and rescue dogs. ( mark ) team members will be heading to florida as soon as their equipment is loaded up and ready to go. ( darya ) santa cruz prosecutors say a brain surgeon and two nurses already in jail awaiting trial for operating a child- sex ring will now face more charges. investigators say they have

discovered additional video of alleged child abuse. dr. james kohut, rashel brandon, and emily stephens are each charged with molesting multiple children. police took seven children ages three to 13 into protective custody. kohut denies the charges against him. ( mark ) an oakland police officer is in trouble with the law. officer bryan budgin was arrested on suspicion of driving under the influence and resisting arrest on i-580 in dublin wednesday night. budgin is out on bail this morning. the oakland police department released a statement saying it is aware of his arrest but they have not said if he is still on active duty. people in florida are bracing for the storm as evacuation orders are underway. people are not the only ones getting out of the state... dozens of adoptable animals were evacuated from the shelters and flown here to the bay area. this will help clear the shelters in florida to make room for animals displaced during hurricane irma. as kron four's gabe slate reports the animal rescue foundation in walnut creek is where some of these animals will be housed. 92 cats and 62 dogs arrived on the tarmac of the hayward airport this afternoon coming from broward county humane society in florida. the shelter there wants to be empty in preperation for all the displaced animals that may need help after hurricane irma. these dogs and cats will be separated between 3 shelters here the east bay spca, berkeley humane society, and at arf, or the animal rescue foundation in walnut creek. that's where i captured these images of the dogs and cats arriving thursday

( mark ) parents of one boy are now searching for answers after he was burned from his school lunch. the boy was carrying beef stew that was too heavy for him. it tipped over and spilled all over his arm. he got second degree burns from the stew. the school has reached out to the boy's parents, but his mother still wants answers.
