(grant) irm'a eye has finally left florida and exited the state as a weak tropical strom - with 50 mile per hour wind speeds. rescue efforts are currently underway for those who stayed to wait out the storm. and for those looking to return to there homes in florida... can't get home due to flooded streets and bridges. the miami international airport remains closed today - but hopes to tomorrow. the cost of hurricane irma has yet to be one estimate already showing it will top hurricane katrina... kristen holmes is standing by live in naples, florida... where people there are now starting to clean up after irma. as florida assesses the extensive damage from irma... residents are still facing a

two-front threat. first, the storm surge remaining a major issue for parts of the state. jacksonville faced severe flooding as the city was pounded with unforgiving rain and wind. officials warning residents that even as the storm clears... dangerous conditions remain. lenny curry/jacksonville mayor: "we had mandatory evacuations in a, b, low-lying areas. mobile homes, manufacturing homes. recent data shows even more significant surge, which results in more flooding."and millions of residents throughout the state are still without power, including a large portion of miami.gov. rick scott/florida: "just because the storm passes, it's not safe. we have power lines down, we have debris all over the state. we're going to rescue everybody, we're going to try to get everybody back to normal as soon as possible, but everybody's gotta be patient."further south in the keys, officials say the priority now is supporting the

have arrested several people accused of looting stores and homes left empty during hurricane irma. nine people were arrested for allegedly stealing footwear and other items from a pawn shop... and sporting goods store in fort lauderdale. a news crew was able to capture the thieves on video - which helped police identify the suspects. and earlier that day - two men were arrested for allegedly ransacking six houses. as of today - police in fort lauderdale have arrested a total of 19 people for burglarizing businesses and residences during the storm. several arrests were also made in miami - as a group of suspected looters stole from a miami foot locker. our coverage of tropical storm irma continues online at kron four dot com. there you can find ways to help those who lost everthing during the storm. also - make sure you have the kron4 mobile app - and be the first to know about breaking news when it happens. has sparked a public outrage. bystander: "people can drink during the football game but a hard working man selling hotdogs gets his money taken away and a ticket. officer: "he doesn't have a permit" bystander: "wow."(grant) this is video of the incident that happened on saturday - during a cal football game. in it - you can hear a bystander questioning the officer's decision to confiscate sixty dollars in cash. the officer says the vendor was operating without a permit. after the video was posted on social media... it went viral. an online fundraising compaign for the vendor was created and has raised more than 36-thousand dollars. a u-c police sergeant - says the officer took 60-dollars that the vendor was suspected of having earned áillegally... and booked the money into evidence. the hunt is on for an arsonist and possibly more than one person. this after a string of fires since sunday - including a fire at a local church. kron four's terisa estacio is live in antioch - with more on what investigators are trying to zero in on. terisa estacio live, antioch the damge caused by this fire is in the back of this church - you can see right over there - it ran up and consumed a section and raced into the roof. contractors were here today trying to shore up the building. the pastor has said he is in shock about why someone would do this investigators say this suspicious fire is just one of 8 since sunday. (estacio reporting) pastor x says he can't understand why anyone would set fire to his church. pastor. and this fire - is just one of 8 since sunday in antioch - and that has fire investigators extremely concerned. robert marshall. it is hot and even with this changing wind, it could be a recipe for disaster. marshall. they were generally right here in the center of antioch. robert marshall - the fire marshall with the contra costa fire protection district says the fires including this one

off of sommerset place behind a home were purposely set. investigators are now zeroing in evidence to try and find the person or persons responsible. marshall. it is hard, because there doesn't seem to be a pattern right now. fortunately, no one has been hurt. and most of the fires small, with fire fighters able to get them out quickly. this fire took place off of bigelow by a school.marshall. arsonist have all different kinds of reasons for doing what they do. (grant) california is taking action -- against president trump's plan to end the "daca" program. the obama-era program protected young undocumented immigrants brought to the u-s as children from being deported-- and allowed them to work and or go to school.(grant) today california's attorney general announed he's suing the trump administration. several

berkeley's police chief wants to change the city's

policy on police use of pepper spray during violent protests. (grant) this comes after several clashes between groups this year and another ápossible angry confrontation coming up this week. kron4's maureen kelly has more on what's behind this proposal. here are scenes from the most recent clash in august when nationalists tried to hold an anti marxist rally.which drew hundreds of black masked counter protestors. police say they trucked in shields and weapons, ignited smoke bombs and attacked some in the crowd.in april.there had been more brawling.and bloodshedpolice say the masked extermists used chemical sprays, sticks bats, bike locks and more sheilds against their opponentsand police.the berkeley police chief used examples from those violent clashes and others to recommend in this report that the city cross out it's two decade ban on police using pepper spray for crowd control. the chief saying using pepper spray would allow

them to directly target on specific attackers. they are allowed to use tear gas, but that can also impact peaceful demonstrators. the chief is also asking to add language to the non lethal policy forbidding the use of pepper spray to disperse peaceful demonstrators using passive resistance. such as what happened during the 2011 incident at an occupy protest at uc davis.the request comes right before a planned speech thursday by right wing talk show host ben shapiro. police both on and off campus are gearing in case that event draws more violence. a member of refuse facism.org, which is planning a non violent speak out event in sproal plaza that evening says it's shameful that berkeley wants to further clamp down on protestors.we need much more resistance to facism we have a facist regime in the white house, we have facists rallying from charlottesville to berkeley and we have facist intelectuals targeting this campus. it is absolutely right to stand up and say no to all of that.the berkeley city council is going to hold a special meeting on whether or not to allow the police to change their pepper spray policy. that meeting is to be held at 3pm on tuesday.maureen kelly kron4 news

approach firefighters have for each other(asst chief siragusa-we are all connected it's like a dna connection)in san francisco will tran kron 4 news (vicki) in union city... dozens gathered at (vicki) in union city... dozens gathered at the flight 93 memorial to honor the people onboard the plane that went down in shanksville, pennsylvania. union city was the first city in the united states to create a memorial specifically for the heroes of flight 93. the plane was originally headed to s-f-o... but terrorists hijacked the plane and rerouted it to washington d-c. the people onboard had

learned about the attacks on the twin tower from phone calls from family and friends. that's when several people decided to take back control of the plane. 40 passengers and crew were killed when flight 93 crashed in a field outside shanksville, pennsylvania. "in union city for the last 16 years, every september 11th at 10 o'clock in the morning we come together and at 10:03 we have a moment of silence because that we the time the plane crashed into the ground and everybody's life was lost." the name of the 40 people who died that day were ready during the ceremony. the memorial ended at the circle of hope where hand-painted tiles from local children represent a more hopeful future. carolina are feeling the power of irma. the atlantic ocean is pouring over sea walls and into homes and businesses. and jacksonville's mayor says the worst may still be ahead. if you need to get out please put what represents a white flag, anything white somewhere on your house that can be viewed visibly from outside. jacksonville has never seen flooding like this before.the saint john river is three feet over flood stage and expected to rise at least another foot. videos posted online show the storm at its peak.natthe water came up so fast overnight that one couple had to be rescued by a television news crew.the water is up past the waist out here folks. this is not the time to get out here and drive around.in daylight, you could see the destruction in the town of san marco, outside jacksonville. natchainsaws at work throught the state,irma's winds toppled power lines, leaving two=thord ofthe state in the dark tonight."it's going to take us a long time to get power back."the wind too much for three construction cranes in miami. much of the city is under water, but the mayor says the roads will dry soon.miami

beach is still closed to residents, while crews clean up debris.we didn't dodge a bullet. we dodged a cannonjust one death reported ... rescue crews credited saving two people who tried to ride out the storm on their sailboat. . and a scuba diver -- his life dangling by a rope -- was pulled to safety near west palm beach .and a coral springs emergency crew was called out to help deliver a baby at the height of the storm.they used their armored vehicle to navigate through strong winds and high water. "when we got there, she was pretty much, almost all the way out. the mother of the person is labor was actually pretty much delivering the baby in the bathroom on the floor. i've never seen such a calm scene in the chaos that was going on outside." (catherine) just one death has been reported in florida .. two so far in georgia, and within the hour, south carolina recorded its first storm related fatality. hurricane irma is also being blamed for killing 36 people in the caribbean.

(catherine) people are calling it strange - partly because it came as a complete surprise.... partly because of the way it targeted concentrated pockets of the bay area and

beyond. the first gusts roared through pebble beach around 2 a- m....then moved northwardinto south bay cities including los gatos, campbell and san jose. there were also reports of some wind gusts in san francisco and marin... this is the college park area of san jose -- one of the spots where trees were blown over and power lines brought down. at the height of the wind storm - roughly 11- thousand customers were without power. a lot of people were awakened by the winds - and didn't realize at first what they were hearing.. san jose resident - i heard a lot of wind whipping around and it was very loud. and i became very concerned because thingsbegan flying around. and i heard a loud noise like a gunshot - a big bang. then a bunch of car alarms going off. when we came out this morning it looked like a major tree branch had fallen into the street. the unsettled weather lasted about two hours... meteorologists say they're baffled and there was nothing

to suggest that there wouldbe significant wind gusts. workers at the national weather service office in monterey say they're trying to figure it all out.. at last word - there were only a few south bay customers still without power. vicki? a kitten left in a dumpster at a menlo park gas station is looking for a "forever home." workers at the gas station heard a cat crying... when they looked inside a nearby dumpster... they found this three-month old calico kitten... due to the height of the dumpster... it is most likely the she did not climb in there herself. the kitten... who is being called prudence... had no collar or microchip. prudence was taken to the peninsula humane society and spca in burlingame where she examined. the kitten has been fixed, vaccinated and is now looking for a loving family. video showing the aftermath of the encounter. reporter chris guardaro has more. nats9-1-1 calls lead police to this southeast albuquerque parking lot, where they see four football players holding a man halfway out of an suv's window.natsthe man is in bad shape - he has a bloody and swollen face.police say the four boys beat up angelo martinez.natsan officer searches his pockets and finds a sharpie, ski mask, glove, and a note.chris guardaro reporting: "police say that note they pulled out of martinez's pocket said 'get out of your wip and nobody get hurt. i know where you live, so don't make me kill." the boys tell police martinez asked them for a ride after their football practice.they let him in the truck. and, he pulled out a gun, and told them to get out.but they say the accused thief dropped his gun in the driver's seat, giving the football players an opportunity.they took it ... punching and holding martinez down to prevent him from reaching for his gun or the knife at his side until police arrived.martinez is taken to u-n-m-h where an investigator asks him about his suspicious belongings.natsthe 20-year-old

says his four captors planted evidence on him.officers found out martinez's gun was fake, and they arrested him.nats (vicki) martinez has a criminal wrap sheet that includes car theft and shoplifting. he is charged with four counts of aggravated assault with a deadly weapon and an attempt to commit a felony. (pam) irma may no longer be a hurricane... but the storm is still hitting the southeast hard. if it isn't the wind... it is the storm surge. the water is rising and setting records.(pam) good evening... i'm pam moore. (steve and i am steve aveson. it has been well over 24 hours since irma first made landfall in florida... and the storm keeps on churning. it is the flooding right now that is the biggest problem. several cities are dealing with storm surge ... some seeing record levels. irma is also being blamed for at least four deaths tonight in the united states. it is no longer a hurricane... but it is tracking across the southeast... dumping large amounts of rain.( pam ) irma is still packing some serious winds. trees have been toppling over ... falling trees are being blamed for at least two deaths already in georgia. another concern is tornadoes. the storm is spawning funnel clouds ... a waterspout was seen right near

charleston, south carolina.( steve ) millions of people remain without power. in florida alone the current count is 6-point-5 million people without electricity. georgia reported well over half-a-million homes and businesses without power. irma is tracking toward alabama right now and expected to be downgraded tomorrow. natasha chen with our partners at c-n-n is in jacksonville florida tonight... where they are dealing with record-setting flooding... natasha?

as florida assesses the extensive damage from irma... residents are still facing a two-front threat. first, the storm surge remaining a major issue for parts of the state. jacksonville faced severe flooding as the city was pounded with unforgiving rain and wind. officials warning residents that even as the storm clears... dangerous conditions remain. lenny curry/jacksonville mayor: "we had mandatory evacuations in a, b, low-lying areas. mobile homes, manufacturing homes. recent data shows even more significant surge, which results in more flooding."and millions of residents throughout the state are still without power, including a large portion of miami.gov. rick scott/florida: "just because the storm passes, it's not safe. we have power lines down, we have debris all over the state. we're going to rescue everybody, we're going to try to get everybody back to normal as soon as possible, but everybody's gotta be patient."further south in the keys, officials say the priority now is supporting the residents who did not

evacuate. as the storm slowly moves out of florida... georgia, alabama and the carolinas are already feeling irma's impactvoice of mayor john tecklenburg/charleston, south carolina: "the breached, and many of our low-lying areas are experiencing flooding right now."tropical storm warnings and the potential for flash flooding over the next 24 hours have residents and officials on edge... as irma continues to wreak havoc throughout the south east ( steve ) while the storm did not make a direct hit... historic savannah georgia is another city that is getting slammed by irma. the savannah river overflowed... sending water into the downtown area. making matters worse... the flooding hit during high-tide. the surge of water submerged parking lots and even some cars. one of the places in florida being blasted by irma - jacksonville, florida.where they're setting the kind of records no one wanted to see... catherine heenan is here with more on the fact that flood waters there ... are at their highest levels ever... (catherine) jacksonville was braced for flooding of course....but it's even worse than expected... it's at the mouth of the st. johns river....which is basically swallowing the

downtownarea and beyond. storm surges are pushing four to nearly six feet above the normal high-tide levels.. the banks of the river aren't even visible anymore - and forecasters say the water will just keep rising. jacksonville's downtown is heavily flooded....and the levels have smashed all records going back to 1864. roads and parks and other open areas are underwater...... .with much of the city looking as thoughit's an extension of the river. people had been told to get out - but the city's mayor says there are still those stuck in buildings needing help... jacksonville mayor - if you need to get out please put what represents a white flag, anything white somewhere on your house that can be viewed visibly from outside. we have search and rescue teams ready to deploy. we have state assets coming in. i spoke to the governor this morning. fish and wildlife are sending in people. we want to make sure that everybody gets through this safe. there have been a

number of injuries from trees crashing through homes.... downed trees and power lines have been a problem throughout the city.....like otherareas of florida. authorities are frustrated that people are still being spotted driving around...despit ebeing told to stay inside and get to the highest levels of buildings.. several people have had to be rescued from cars... roughly 50 people have been pulled out of flooded homes....with an unknownnumber still stranded. pam and steve? ( pam ) nasa has put together an incredible look at hurricane irma. it condensed the storm's ten-day path.... into about 30 seconds. you can see the storm roll through the atlantic ocean ... sweep over the caribbean... brush by puerto rico and cuba... and then make its turn toward florida. irma set a record with its winds. the storm had sustained winds of 185- miles an hour for 37- hours...

that is longer than any other hurricane on record. ( pam ) this is video from one of the caribbean islands that got hit ... when irma was a category - 5 storm. you are looking at the french- side of the island of saint martin. the storm blasted through last wednesday, and many people on the island are still without water or electricity tonight. the storm is blamed for numerous deaths on the island. french president emmanuel macron is supposed to visit saint martin tomorrow. ( steve ) we have our own wild weather here in the bay area. take a look at this video that just came into the kron four newsroom about 30 minutes ago... that is lightning in los gatos.(pam) let's get our first look at the four zone forecast with meteorologist lawrence karnow... we are also hearing reports of rain in san jose. lawrence karnow: irma is now a tropical storm. heavy rain and gusty winds are now affecting georgia, alabama, and south carolina. flooding rains continue and a storm surge along the southeast coast.

viral video showing a u-c berkeley police officer taking money as evidence, while citing a street vendor.... is sparking outrage. the vendor was cited for selling his hot dogs without a permit. ( steve ) but as kron4's haaziq madyun found out from a lawyer... as offensive as the video comes across to some people... the police officer likely did nothing wrong. "walk 200-feet and you will see people drinking in public but a hard-working man gets his money taken away?"this is cellphone video of a uc berkeley police officer giving this hot dog vendor a citation for selling hot dogs without a permit on the uc berkeley campus during saturday's game. the voice you hear questioning the officer as he confiscates the vendor's money is matrin flores. he recorded the video

martin flores: "that's not right man, that's not right"uc police officer: "the judge can decide whether or not it is right"martin flores: "you're going to take his hard earned money"uc police officer: "yup" however criminal defense attorney steven clark says the law may actaully be on the uc police officer's side in this caseclark also questions the officer's actions in terms of community policing

(steve)an east bay pastor is trying to figure out why his church would be the target of an arsonist. since sunday, there has been 8 suspicious fires. (pam) although most of the fires have been small, as kron four's terisa estacio reports, investigators are very concerned that whoever is setting these... could do some substantial damage. pastor efraim cascante was near tears when he spoke with me about racing out to his church early monday morning

and finding it engulfed in flames. pastor efraim cascante. i am upset, yes. it is tough. the pastor of first baptist church here on lone tree way in antioch says the damage impacts children and two congregations. pastor. yes. it is where the children's sunday school is and where the adults congregate. robert marshall. "it is happening all here in this 3 mile radius near downtown. ro bert marshall with the contra costa fire protection district says they are dealing with 8 suspicious fires since sunday. marshall. it is alarming, especially with conditions. one fire happened hear behind a school, the other near a home. fortunately, no one has been hurt, but fire investigators are concerned. marshall. the coditions are ripe for worse fires. estacio. through the day, church members have been coming out, and saying condolences. in antioch, te

(pam) two bank robbery suspects are under arrest in the north bay ... one of them is a woman. the sonoma county sheriff's office released this surveillance photograph. the department says, the woman you see pictured... is 34-year-old catrina hockney of napa. a vallejo man is accused of being an accomplice. the robbery happened on saturday at the wells fargo branch in sonoma... and the suspects

were caught just blocks away. according to investigators.... the two tried to pull off robberies in napa as well. another mountain lion another mountain lion sighting on the peninsula to tell you about tonight. a big cat was spotted early this morning in san mateo county... not far from interstate 280 and highway 92. the person saw the animal roaming near polhemus road and ticonderoga drive. mountain lions are frequently seen in this area... especially at dawn and at dusk. while attacks on humans are rare, if you see one, do not approach it. other inmates at the santa rita jail in dublin. one of them is also accused of choking an inmate until he was unconscious. during a court appearance this morning, lawyers for sarah krause and stephen sarcos ... asked that their cases to be split off from the other two deputies ... since they face only one - count. justin linn and erik mcdermott each face multiple charges in the case. all four are out on bail... a judge is reviewing the request and may make a ruling during the next hearing. it is scheduled for october. ( steve) the state of california has made it official: it is suing the trump administration over ending daca. the white house announced the end of the program last week... and attorney general xavier becerra said the state would take legal action. the deferred action on childhood arrivals program has about 800- thousand people. california makes up a large number of the dreamers as they are known... with over 200- thousand. maryland, maine and minnesota also taking part in this lawsuit. it is separate from another lawsuit

filed last week by 15 states and washington d-c. the university of california filed its own lawsuit last week. it became the first college system to take legal action over the ending of daca. ( steve )( steve ) another big story tonight: america pausing to remember the september eleventh attacks. a large crowd gathered where the twin towers once stood... a memorial now marks their footprint. as is tradition... the names of each person who died in the attack are read out lod and a bell is rung in their honor.

moments of silence for when each tower was hit by a plane.... and then collapsed. nearly three thousand people died in the attacks 16 years ago... the deadliest act of terrorism on u-s soil. ( pam ) at the pentagon ... the president and first lady took part in a wreath- laying ceremony. 184- people died when a plane crashed into the building on 9- eleven.. there was a moment of silence along with the reading of the names killed. earlier in the day, a giant american flag was unfurled there. this is a flash back to what happened 16 -years ago... when a massive flag was unfurled just to the right of where the plane crashed. one of the bay area cities where people faithfully mark the 9-11 anniversary every year -- is union city. catherine heenan is here with details of today's (catherine) union city was one of the first places to make a point of honoring thevictims and first responders of 9-11....with a focus on flight 93. a tradition they take very

seriously... on this 16th anniversary, members of the military, the police and the boy scouts were part of the ceremony. it was happening near the flight 93 memorial in sugar mill landing park in union city...flight 93 of course was headed to san francisco....and many of the victims were from the bay area. the city's mayor says this is a special way to make sure that people do not forget... union city mayor - september 11 2001 our world changed. flight 93 crashed in shanksville pennsylvania and union city became the first landmark for that tragic day. for the last 16 years every september 11th at 10 in the morning we come together and at 10:03 we have a moment of silence. because that was the time the plane crashed into the ground and everybody's lives were lost. there's always a military presence.....and every year flags are placed to honor the law enforcement

members killed during the attacks.. the mayor says she wants to make sure that 9-11 never becomes just another day on the calendar... steve and pam? for the 16th year in a row the san francisco firefighters also honored the victims of 911 especially the 343 first responders who died that day the fire department rolled out their trucks, then the firefighters read the names of the first responders who died on 911they also raised the flag and lowered it to half staff to honor the victims and it will remain that way throughout the dayin san francisco will tran kron 4 news here in antioch - fire officials say they are dealing with 8 suspiciuos fires and now they are looking into whether they are dealing with a serial arsonist one fire happened here at this church first baptist in antioch off of lone tree way. investigators say they are looking at the evidence and trying to piece all of these fires together and figure out
