(grant) an update on big story from over the weekend... at least one person is under arrest... accused of running over two east bay police offices. the incident happened last night outside the safeway store on lewelling boulevard in san leandro. officers were called to the store because of reports of a shoplifter. police say... when the officers went to arrest the suspect... he managed to run off to a car... and then drive off... striking the two officers. the suspect has been identified as 57-year-old terry gordon - who was arrested this morning in oakland. one of the officers remains hospitalized tonight ... but is expected to be ok. (vicki) police in the

south bay ... say the suspect fatally shot by a san jose officer last week... was a norteno gang member who was wanted in connection to a string of violent crimes. kron4's maureen kelly reports that the suspect's relatives say he was a family man who had turned away from a life of crime. this is 33 year old jacob dominguez in pictures provided by his family. they admit he had a criminal history, but say that was behind him. that he had turned his life around, getting involved in church, and taking care of his wife and three kids. police say dominguez was a verified member of the norteno street gang with a long rap sheet of voilent crimes. and that he was wanted in connection to a series of crimes starting september 6th.the individual was tied into a possible drive-by shooting officers on view this individual committed an armed robbery i mean at some point we need to make sure this crime spree ended unfortunately it ended with a tragic consequencespolice chief eddie garcia says dominguez's alleged accomplices in the september 12th armed robbery have been arrested. sjpd tried to take dominquez into custody before but he eluded officers more than once with erratic and dangerous driving that threatened to put the public at risk.investigators

developed credible information that dominguez knew the police were looking for him, was carrying a handgun and he would shoot it out with police if need beso at 7p friday night at penitencia creek road and north white road undercover officers conducted a high risk traffic stop. dominguez seated in the driver seat of the vehicle initially raised hands but then yelled at officer's with expletives and challenged them to shoot him. dominguez then disobeyed officers by lowering hands out of sight in a reaching motion to the front drivers floorboard the officer felt dominguez was reaching for a weapon and discharges weapon at dominguez striking him at least one timedominquez was pronounced dead at the scene. police say they found a knife and drugs in the car but no gun. the cop who fired the fatal shot, officer mike pina, an 11 year veteren of the force, was put on routine paid adminstrative leave. police say there is some body cam video but that won't be released until homicide and the da's office complete their investigation. maureen kelly kron4 news (vicki) the san francisco sheriff's department is reporting - that a deputy's gun was stolen from a parked vehicle. sheriff vicki hennessy says the deputy was off-duty at the time of the theft - and reported it missing yesterday afternoon. the gun was apparently stored in the truck of the vehicle - however it was not secured in a lock box...

(vicki) the san francisco sheriff's department is reporting - that a deputy's gun was stolen from a parked vehicle. sheriff vicki hennessy says the deputy was off-duty at the time of the theft - and reported it missing yesterday afternoon. the gun was apparently stored in the trunk of the vehicle - however it was not secured in a lock box... which is a violation of the sheriff's department policy. the deputy remains on duty - pending the investigation... and just last month - a san francisco police officer had his personal weapon stolen from his personal vehicle. that gun was used in deadly shooting - that claimed the life of 23-year-old abel esquivel junior. three people have now been arrested in that incident. (grant) another big story: a controversy brewing at uc berkeley - on one side, organizers of the upcoming 'free speech week' event...are

accusing the university of not playing fair... and trying to block their attempts to hold a week long symposium. (vicki) yet, the university is firing back, saying they have tried to work with the group. kron four's terisa estacio has been in the middle of the fight and joins us live from the cal campus. this is really a war of words that is heating up today - with both sides pointing the finger at each other, possibly putting free speech week in jeopardy. on one side. milo yiannopoulous. "they do not want us on campus, the administration has tried everything to derail free speech week." milo yiannopoulous - the british political commentator - author and alt-right activist as well as financial contributor for free speech week released this on you tube monday in response to a growing controversy on the upcoming event at uc berkeley. he along with the student group berkeley patriots say they have attempted to meet the

universities demands and contract requirements for the upcoming event planned to kick off on sunday.berkeley patriot. and on the other side dan mogulof. "the university is ready, willing and able to accomondate mr. yiannopoulous." dan mogulof is the spokesperson for uc berkeley. mogulof. says the university has been clear from the beginning. they want free speech week, but are not granting the group including milo any special accomondation s. here's what is the heart of the matter - a contract to hold speeking events at the universitites two large indoor centers, zellerbach and wheller hall. the university says, the group missed key deadlines, and did not pay the fees. milo and the student group says they had questions about getting a refund - incase ther eis a cancelation out of security reasons, such as what happened back in february, when a protestors turned violent causing hundreds of thousands in dollars of damage to the university and city. for the university, there is no controversy. they don't

offer refunds to anyone. mogulof. it is a standard contract. no one gets to add. milo yiannopoulous. " they have refused to answer our phone calls. mogulof. we have been working since mid julty with this group. we offered others free of charge and they said no. so what happens next? the group has secured an outdoor venue, and the university is getting ready to gear up once again, to take security measures to make sure that this event is safe for everyone more on that coming up at 6 pm. a big question right now is who is coming to this free speech event. the university says a list has not been provided yet. milo yiannopolus has said he plans to come as well as other high profile names like ann coulter and steven bannon, more on that at 6 as well. democratic leader was barely able to speak... over the chorus of young immigrants... protesting her recent coversations with president trump on immigration policy. the group could be heard shouting "undocumated and unafraid". at one point... pelosi said "just stop it." this happened in the hunters point neighborhood... as she was holding a press conference to call for legislation that would protect young immigrants brought to the u-s illegally... as chidlren. president trump recently announced plans to halt daca...the program which grants young people temporary legal status. he's since been holding meetings with pelosi and other top democrats. the democrats say a deal has been reached, but the white house denies it. hour... and - there's another hurricane that's threatening the east coast. let's bring in chief meteorologist brittney shipp who is tracking these storm's for us tonight. brit? a series of storm systems will push inland to our north through the week resulting in cooler than average temperatures and breezy northerly winds. look for mostly dry conditions aside from a slight chance of rain showers over the far north bay tuesday night into wednesday morning. temperatures will trend downward late in the week with much cooler overnight conditions ahead of a warming trend this weekend.

william turner was arrested back in june for trying to feed an unknown liquid to at least three children - without their parents consent. turner was arrested for annoying or harassing children... and later pleaded guilty to a lesser offence and was released. as a term of his probation - turner was ordered to stay away from all parks and schools in alameda county. however, he was arrested again this month - when an officer spotted him near berkeley high school. he again, has been released from custody... and tonight, berkeley police want the public to be aware of turner as he may pose a threat to the community. (grant) a man in texas...is being charged for the death of an 83-year-old san lorenzo woman in july. authorities say sean wallace assaulted ru feng at her independent living facitlity on kent avenue. she was found unconscious on the lobby floor of the facility. feng was taken to a hospital where she died two days later. authorities originally thought feng suffered a medical episode and fell on the floor. surveillance footage later showed wallace

attacking feng. wallace was arrested in texas and extradited back here. he is now in custody at the santa rita jail where he is facing murder charges. (grant) president trump has returned to his hometown of new york for the united nations general assembly. (vicki) gathered world leaders will get a front row seat to the "america first" president's evolving opinions on the united nations. stacey cohan reports. entering the iconic united nations building in new york, president donald trump returns to his hometown for a critical week of foreign policy. president donald trump: "this will be a great week, we look forward to it."it's unclear if world leaders share that sentiment. candidate trump blasted the united nations, and his america first platform continues to stir international unease. his first remarks at monday's u-n reform meeting reinforcing his rhetoric. president donald trump: "we encourage all member states to look at ways to take bold stands at the united nations toward changing business as usual."u-n

down a young man seen in a series of videos - beating people... one of the victims - a homeless man in bakersfield.(vicki) catherine heenan is here with details...and a look at the troubling video... (catherine) there are three videos - which have sparked outrage on social media.. this is part of the first one - which shows what appears to be a random attack on a homeless man.it shows a teenager throwing something heavy at the man's head. in another set of videos, police say it appears to be the same young man, now involved with a group, hitting and kicking another teenager. the victim doesn't fight back. at least one of the teens has now reportedly been identified as a student at a bakersfieldhigh school. the school in question - centennial high - says it knows about the videos and police are investigating. as for the homeless man, an executive at a local shelter says he recognizes the man... mission at kern county executive - the man has stayed here at the mission at kern county in the last couple of weeks and when i see that, he

was doing nothing to these kids. and they felt they can just toy around and thrown something at him and hurt him. he says that it's not the first time that the homeless community in bakersfield havebeen targets of senseless violence. and calls them 'easy victims.' bakersfield police are only saying that they've contacted one of the teenagers...and at lastword no arrest has been made yet. vicki? (vicki) a minnesota high school student asked another student to homecoming in a way that many are considering racially offensive. the sign says... "you may be picking cotton, but i'm picking you. homecoming?" it suggests the young woman said yes to the invite. the picture of the sign went viral... and has been shared more than a thousand times. some say the invitation from a white man to a woman of color was a joke and the two are good friends. still ... several students at the high school find the sign quite upsetting.

violent. protesters toppled large planters, broke windows and threw things at officers. more than 123 people were arrested - yesterday. protests began friday night after a judge found officer, jason stockley, not guilty in the 20-11 deadly shooting of 24-year-old anthony lamar smith. demonstrators have been on the streets now four four striaght nights. a life threatening situation for a child and a ride operator on a day at the amusement park. a young boy was on a ferris wheel in greensboro, north carolina when there was a malfunction - and it caused him to swing several feet in the air. cell phone video shows one of the workers climbing the ferris wheel to get 5-year-old hunter roach and another child to safety. but as one worker climbs the metal framework... he loses his footing... and falls. fortunately... he walked away with only a broken finger.

(grant) the u-s house takes the first step to punish daycare centers where rule violations leave kids

(vicki) it comes after a five year old alabama boy died when he was left in a daycare van in the middle of summer. kron four's washington correspondent drew petrimoulx reports the bill is opening up a larger discussion about regulation of child care facilities. take pkg the new amendment blocks federal grant funding to child care centers with a history of injury or death resulting from health or safety violations. rep. terri sewell, d-birmingham:"we should be rewarding good actors not bad actors." democratic congresswoman terri sewell filed the legislation after the august death of a five year old mobile, alabama boy named kamden johnson. he was left in a hot daycare van for hours in august. rep. terri sewell, d-birmingham: "what's really tragic is not only that kamden johnson died but that his daycare still is eligible for federal funding." drew petrimoulx, reporting: "sewell's legislation was attached to a spending bill that passed the us house last week. it now heads to the senate for consideration. but it's also sparking a larger discussion about the regulation of child care facilities."alabama is one of seven states that allows religious child care facilities to operate without a license. sewell says ending the exemption will make daycares safer.rep. terri sewell, d-birmingham:"the person who was driving the van had an extensive criminal

history."eric johnston, attorney for religious daycares: "the church wants to avoid regulating its ministries and how it does its ministries."eric johnston is an attorney for religious daycares. he says bad actors are using the exemption to turn a profit while avoiding regulation. but he says subjecting all religious daycares to licensing requirements creates an unfair burden. eric johnston, attorney for religious daycares: "the 130 something pages of regulations they use that covers everything from the size of the sinks to the number of spoons you use to everything else. those type of things are just unnecessary." the religious exemptions are a state issue and alabama lawmakers are promising to introduce legislation ending them next year. for now, representative sewell says she wants to make sure there are consequences when negligence leads to children getting hurt. in washington, i'm drew petrimoulx (vicki) the surprise fees - airlines are not telling you
