she leaves behind a ten- year-old son and a thirteen- year-old daughter. so far, more than 160-thousand dollars has been raised. . (robin) also we are learning the heartbreaking details of another bay area woman's final moments. san jose native michelle vo was a new fan of country music. she had decided to attend her first country music festival on her own. she met a man there named kody robertson from ohio. when michelle was hit by gunfire that man stuck by her side to the end. and now, kody shared his story with michelle's older sister. bay area is denise cohen. she's from san ramon. she posted photos of her weekend vegas trip on facebook. even writing about the great time she was having with her boyfriend at the jason aldean concert. (robin @ bam) among the people that made it out of the concert alive... two north bay couples that found themselves right near the stage when the gunfire broke out. kron 4's dan kerman has their story of survival. north bay residents jennifer mcgrath and her husband and kim schubert and her boyfriend joel wahl had been waiting to hear jason aldeen all weekend.. . sunday night they got their chance.. at 953 this shot was taken of the two friends minutes earlier schubert took this shot of the

mandalay bay resort thinking how beautiful it looked, and not realizing what was to come sot kim schubert/survivor 27-32 sot jennifer mcgrath/survivor 32-42the couples seperated, but instead of running for cover, they went to aid the wounded as the volley of shots continued.sotat a certain point schubert got seperated from the rest, and found herself undersome bleachers being riddled with bullets that's when she thought she was going to die, so she pulled out her phonesotbut she survived, in fact both couples survived and were reunited hours later standup dan kerman/petaluma 156-206

(robin @ bam) security was out in force in santa clara for the cold play concert in the wake of the the las vegas shooting. this as the band was also up against a strict 10 p-m curfew. kron4's charles clifford has more. natsthrough out the day wednesday and into the evening hours, security was very tight in and around levis' stadium. natspolice from several local departments kept a watchfull eye as people arrived at the concert. security guards with the stadium were also spread out watching for problems. for security reasons, authorities are not saying

exactly how many officers and guards are here tonight. sources have told kron 4 that there are also spotters on several of the tall buildings around levis stadium.goers we talked to said they appreciated the extra security. sotafter an event, security is usually heightened, so it's probably safer that normal. these coldplay fans also said they didn't want to let the tragic events of this past weekend to deter them from coming tonight.soti think if you live in fear it's not really going to do anything for you. it's just a matter of praying and being aware. i wasn't really concerned about it. i don think it has made me more heightened of my awareness. of course you never know what's going to happen. (robin) coldplay did end up going over the 10 p.m. curfew at levi's stadium. adding to the fight between santa clara city officials and stadium management about time limits on concerts. the director of corporate communications for the 49ers and levi's stadium said in a statement that the teams top priority is the safety of guests. and the team will "defer to the local enforcement and public safety authorities to determine all matters related to abruptly stopping a show with tens of thousands of people present." 49ers president al guido says the team is concerned that concerts may not come to levi's stadium again unless the music ban is resolved in a way that works for everyone. (robin) another big story we're following this morning... a desperate plea from police and family members after a murder in san francisco one year ago has not been solved. 26-year-old john sanyalu, from stockton, was killed outside a nightclub at sixth and harrison streets

last october. the soma shooting which also injured two of his male family members followed an argument with other people inside the club that involved some of sanyalu's female friends. a press event was held asking witnesses to come forward. police do not have solid descriptions of the killers. but are confident that people saw what happened and are just not talking. (robin) a warning if you use your laptop at coffee shops... police are seeing more and more of them stolen from people across the bay area. in alameda, 11 snatch and grab laptop robberies, or attempts have occured over the last few months. the latests incident there happening around noon yesterday. police say two suspects hit the starbucks store on blan- ding avenue. 10 minutes after the initial robbery attempt, the duo walked inside another starbucks, this one on park street. there they each stole two laptops before running away on foot. (robin) one arrest has

been made from a prior incident. police are hoping by releasing this surveillace video they will get more leads. (robin) police have released surveillance video of the man who robbed a danville drug store last month. it happened at the walgreens on san ramon valley boulevard. the man enters the store wearing a surgical face mask, a beanie, a grey hoodie and black pants. he walked straight to the store's pharmacy and put some items on the counter. he slips the pharmacy worker a note demanding prescriptions pills. the man then takes a gun out of the pocket of his sweatshirt and put it on the counter after getting a bag of pills he walks off. no one was hurt. (robin) after a second incident in two weeks at an east bay middle school. at least one parent says administrators are ánotá doing enough to protect her child. this time a mom says her daughter was in need of help and was locked out of school before the day was over.

kron 4's hermela aregawi has the story (hermela aregawi)the parent i talked to tells me it was sometime around 1:30 this afternoon.. so most kids were still on campus...so she's upset that school officials refused to let her daughter into the bulding after she was harrassed. parents and students say the school bell had just rung. anochiko justin/studentit was a short wednesday so we got out of class a little bit earlier than normal and then the bell rings. everyone just comes out of their class. there has to be about over 200 students coming out of class at once. yokisho justin says a classmate threw water drenching her daughter... but a school official refused to let her daughter into the building when she asked for help. yoshiko justin/parent approaching the school i see that my daughter was being consolsed with her friends. i see that she looked upset. i see that she's drenched and covered with water. i go to the office and true enough there is a staff member blocking the door, shooing

students away. parents say this is particularly concerning because last week, a student was brutally attacked,.. after a teacher left the classroom. yoshiko justin/parent: i said you are really locking the door with a key. like these students out here. things are going on. clowning are coming and scaring children. there was someone being beat down last week. and you are locking the door and these kids are on your premises... if something was too happen. they need to be able to come into the office. that's their safety haven. that's where they need to be. (robin) two weeks after hurricane maria struck puerto rico most residents are still without food, water and power. volunteer teams are working to deliver supplies to the island and evacuate people it's an emergency mission. but it's not organized by the u-s government. it's all volunteer. officials with puerto rico's " pals-sky hope disaster relief"

actually reached out to filmaker tyler perry for a plane filled with food, clothes and supplies.,. senator's democratic colleagues are on board with the proposal. but the measure has no formal republican support. (robin) a former bay area resident is being credited with saving the life of a man wounded during sunday's shooting massacre in las vegas his name is james larson. he is credited with rushing to help a man who was wounded. larson grew up in concord, graduated from ygnacio valley high school in 2006. his grandmother still lives in the east bay. she did not want to talk on camera. but told kron-4 that she's proud of what her grandson did. his long time neighbor says she feels the same way.

high school teachers also said they're very proud of him.

a traffic crackdown produced some intresting interactions for officers. stanely roberts shows us on this edition of people behaving badly. at a california highway patrol pop up commercial inspection stations, all types of vehicles get waived in like this tractor which turned out to be a city of sunnyvale vehicle nats: ambiance so a santa clara count sheriff deputy who is also working the inspection station has a chat with the driver since there are no plates on the tractor it needs to be on a flatbed nats: ambiance this big rig had some issues that need to be corrected for the truck could take off if appears that the nut has come loose off the u-bolt that holds the air tank now you know the danger of that right absolutely what is it the air line could come off

(robin @ landing) we are hearing from two fremont couples who survived the las vegas shoting. they were celebrating wedding anniversaries... they shared with kron4's terisa estacio - what got them through the terrifying experience. one of the members of this group i spoke with today is a fire fighter earlier this afternoon, i sat down with fire fighter david eastin and his wife and friends they told me they started planning back in may to celebrate their wedding aniversiares together.. but never did they think this would happen.this is the happy group a short time before the gun fire started raining down on them - killing and injuring people so close to them. britni eastin. we like to do things together, but this i never thought would be one of them. the couples have been friends for awhile. their anniversaires days apart. they both hae children the same ages. also along that night was jacquelines brother who had begged to tag along as you can hear and see in this video - as shots ran out, people were running wildly. the couples got separated, but were both determined to make it out alive. david easton. we just ran. jacqueline. we

did what ever we could, i saw people falling, smoke rising from the bullets. now sitting together they are trying to take it all in and deal with the trauma of it all. but a feeling of gratitude is something they all are embracing. we all feel lucky and fortunate. they say not going to busy places for awhile. they say not going to busy places for awhile. ( mark ) our top story this morning... investigators in nevada are working to piece together events that led to the deadly mass shooting in las vegas. now police say the shooter may have had help. ( darya ) 58 people were killed in the shooting and overnight authorities dropped the number of injured to less than 500. and 300 of the people injured have now been discharged from the hospital.( mark ) las vegas police found 50 pounds of explosives and 16-hundred rounds of ammunition in the car that the shooter left at the mandalay bay. authorities also say that stephen paddock may have had help planning the shooting. he killed himself in his hotel room as police were moving in. police say paddock's girlfriend the shooter's girlfriend, marilou danley, is cooperating with authorities and has spoken to the fbi. the police have said she is not a suspect. investigators also say there

is indication paddock had planned to survive and escape. ( mark ) breaking overnight... after years of legal battles the billionaire owner of property on martin's beach is now granting access to that beach.( darya ) will tran is live at martin's beach in half moon bay this morning with the details. will. ( will )the owner refused to open a road to a popular beach despite a court order to do so.

the venture capitalist purchased the 53- acre property in 2008. he then blocked off the only road leading to the beach. an appeals court has ruled he is breaking the law by blocking public access to the beach. california's coastal regulator orderd him to unlock the gate blocking access to the beach and remove all "no trespassing" signs. that gate was opened last night. accused of killing jose escobedo last month in pittsburg's city park. police say munoz and escobedo knew each other and had several confrontations in the past. but they have not said what specifically led up to the ( darya ) a judge in redwood city wants doctors to determine if the man accused of stabbing a police officer at s-f-o is competent to stand trial. dooris johnston is charged with attempted murder after an officer was stabbed several times at an s-f-o terminal last month. johnston was in court yesterday. he said he wanted to act as his own attorney but after a brief conversation with the judge... the judge questioned whether johnston was competent enough to stand trial. the case has been delayed until next month. etcheber.( mark ) stacee is from novato and was killed in the shooting. now her parents... who live in chico... are describing the moment they learned that she did not survive.( darya ) mike mangas has their story. natsgreg and linda rodriguez just got back from a trip they would give anything not to have had to take.their daughter... stacee etcheber... was one of the 59 people killed.stacee lived in novato... in the bay area... with her son and daughter and her husband vinnie... a san francisco police officer.her parents went through quite a roller coaster ride as they tried to find stacee in las vegas.after checking all the hospitals... vinnie reluctantly went to the morgue. greg rodriguez/victim's father: "he was able to get in to, personally get in to the coroner's office. there was one jane doe left, he went and described her, told her about the tattoo on her neck. guy went back, came back, says 'no, she's not here.' so a lot of relief went in there, so but we had exhausted all the efforts. we were up to almost

midnight going from hospital to hospital. and then vinnie not wanting to do it said, 'get me back into the coroner's office' and we went back to the coroner's office. we went in to the office with the lady, sat down. lady said describe her. he said she has long brown hair, she has this tattoo of this creature on her back from a storybook."linda rodriguez/victim's mother: "where the wild things are..." greg rodriguez/victim's father: "and the lady put her pen down and said i'll be right back. she knew. she knew. she went back. she came back with a picture of stacee and it was just-- it's heart-wrenching, it was really, really heart- wrenching." ( mark ) now to a story you will see only on kron 4. a second incident in two weeks at an east bay middle school has one parent claiming administrators are ánot doing enough to protect her daughter. this happened at dallas ranch middle school in antioch. the mother says her daughter was being harassed and the school refused to let her back into the building after school was let out. yokisho justin says a classmate threw water on her daughter but a school official refused to let her daughter into the building when she asked for help.

wharf has closed after 17 years in business. it's the second restaurant to shut it's doors in wharf in the last two months. kron 4 reached out to the restaurant's management who said the landlord opted not to renew the rainforest cafe leases. nearby business owners say they were told that rainforest cafe was trying to work a cheaper rent agreement with the building owners but were unsuccessful. joe's crab shack along the wharf also closed earlier this year. ( darya ) there's a new policy for police handling drunk people in san jose. they will now be taken to a new "sobering center" instead of jail. the new mission street sobering center is just up the street from the santa clara county jail. officials say its a safe alternative for drunk people to sober-up and get substance abuse and mental health treatment. the sobering center is also expected to end unnecessary trips to emergency rooms. it will be open around the clock - seven days a week. s army commandos are killed after being ambushed by al qaeda terrorists in the african nation of niger. two other soldiers were injured. u-s forces are there to train the nigerian military. the two soldiers who were wounded are in stable condition this ( darya ) dispensaries will begin selling recreational marijuana in california at the start of the new year but some doctors say marijuana use can make people more violent. a study found that marijuana users were more likely to commit violent crimes. doctors who did the study say they were able to link pot use to assaults... rapes and attacks with weapons. four other states including california have legalized recreational marijuana. ( mark ) dynacraft is the truck's manufacture and they issued a recall earlier this year for a problem with the truck's acceleration pedal that could cause crashes. the recall did not mention any potential problems with the toy bursting into flames. ( darya ) a former bay area resident is being credited with saving a man during sunday's massacre. james lawson rushed to help a man who was wounded. lawson grew up in concord and graduated from ygnacio valley high school in 2006. his grandmother still lives in the east bay and told kron4 that she's proud of what her grandson did. his long time next door neighbor says she feels the same.

( mark ) in the east bay... alameda county is being sued after a three-year-old foster child died after ingesting methamphetamine. the family's attorney says county workers missed obvious signs that the girl was in

danger. the lawyer says the child had already been taken to the hospital once for consuming the drug. less than two weeks later... she died after ingesting methamphetamine for a second time. it is not clear how it happened. ( darya ) police have released surveillance video of the man who robbed a danville drug store. it happened at the walgreens on san ramon valley boulevard last month. the man wore a surgical mask. he walked straight to the store's pharmacy and put some items on the counter. he slips the pharmacy worker a note demanding prescriptions pills. the man then takes a gun out of his pocket and puts it on the counter. after getting a bag of pills he walks off. no one was hurt. professor has died following complications from the west nile virus. doctor kimberly kennard came down with flu like symptoms during the fall 2015 semester. she was in and out of hospitals with no diagnosis until february 2016 when kennard was finally diagnosed with west nile at u-c davis medical center. friends say she spent a lot of time outdoors which is where they believe she was bit by the mosquito carrying the disease. < to see the deterioration of her health it was quite sobering and alarming for us > kennard never went back to teaching after coming down with symptoms in 2015. ( mark ) novato police have arrested a man they say repeatedly harassed a 14-

year-old girl. police she the girl would be waiting at the bus stop on grand avenue when the man would approach her in his truck. officers say he would offer to drive her around and buy her coffee. the teen told police it happened several days in a row. police performed a steak-out at the bus station and caught the man. he is 28-year-old cirilo perez-lopez. he was arrested and charged with annoying a child. ( darya ) today is the last day daca recpients can renew their permits. if they miss today's deadline they could potentially be forced to leave the country. congress now has six months to permanently fix the problem. if they don't, daca recepients will no longer be protected from deportation. both democrats and republicans are now working on legislation to protect dreamers.

with their own solution for dreamers that could offer a pathway to a green card and then citizenship. but getting a greencard would take 15 years.that bill also includes other proivisions for dealing with border security. forcefully removed from a southwest airlines flight says she was the victim of racial profiling. the plane was heading from baltimore to los angeles. a lawyer for the woman said the incident was motivated by an anti-muslim bias. the woman had originally complained that she had allergies to dogs and that there were two of them near her. she says that she told the flight crew that she would be fine as long as she was separated from the dogs. but the airline said since she didn't have a medical certificate... they could deny her request. police were eventually called in to remove her from the plane. she claims she was treated roughly because she is muslim. southwest airlines says their employees did nothing wrong. by herself. while she was there she met a man named kody robertson from ohio. and after michelle was hit by gunfire... kody stayed by her side until help could arrive. now he is sharing his story with michelle's sister. ( darya ) and denise cohen from san ramon had posted photos of her weekend vegas trip on facebook. she even wrote about the great time she was having with her boyfriend at the jason aldean concert. ( darya ) and the third bay area victim is stacee etcheber. a gufund me page has been setup to collect donations for her family. the novato woman was a mother

of two young kids, and a wife to a san francisco police officer. she leaves behind a ten-year-old son and a thirteen-year-old daughter. so far, more than 180- thousand dollars has been raised. if you would like to donate, we have a link on our website at kron-4 dot com. and coming up in about 15 minutes we will hear from stacee's parents for the first time since the shooting. ( mark ) among the people who survived the shooting are two north bay couples who were near the stage when the gunfire broke out. justin and jennifer mcgrath... and kim schubert and her boyfriend joel wahl had been waiting all weekend to see jason aldean perform. these pictures were taken just minutes before the shooting started. during the gunfire, the two couples were separated and they tried to aid other victims. eventually schubert ended up under some bleachers that were being riddled with bullets. that's when she pulled out her phone and made an important phone call.

( darya ) and last night's coldplay concert did go past the 10 p-m curfew set by the city of santa clara. the

city denied an extension of the curfew for last night's concert. the 49ers who manage the stadium say they are afraid that concerts may not want to come to levi's stadium. last week ed sheeran cancelled his upcomming concert because of the curfew. the 49ers say a big concert can bring in up to 800- thousand dollars and that the city benefits from that money. right now it is not clear if coldplay will be fined for violating the curfew. ( mark ) breaking overnight... after years of legal battles the billionaire owner of property on martin's beach is now granting access to that beach.( darya ) will tran is live at martins beach in half moon bay this morning with the details. will. ( will )the owner refused to open a road to a popular beach despite a court order to do so. the venture capitalist purchased the 53- acre property in 2008. he then

blocked off the only road leading to the beach. an appeals court has ruled he is breaking the law by blocking public access to the beach. california's coastal regulator orderd him to unlock the gate blocking access to the beach and remove all "no trespassing" signs. that gate was opened last night. thanks will. we will check back with you through out the morning.

( mark ) police in the east bay have made an arrest in a deadly shooting in pittsburg. 19-year-old juan munoz and a juvenile are accused of killing jose escobedo last month in pittsburg's city park. police say munoz and escobedo knew each other and had several confrontations in the past. but they have not said what specifically led up to the shooting. ( darya ) there have been more laptop thefts in the east

bay. police say this is part of a spike across the bay rea. the latest theft happened yesterday in alameda. two people walked into a starbucks store on blanding avenuepolice say they tried to steal a laptop ...but failed. this is surveillance video of those two men. then ten minutes laterthey went into another starbucks...this one on park street. police say each man stole a laptop before running away. hospitals... vinnie reluctantly went to the morgue. greg rodriguez/victim's father: "he was able to get in to, personally get in to the coroner's office. there was one jane doe left, he went and described her, told her about the tattoo on her neck. guy went back, came back, says 'no, she's not here.' so a lot of relief went in there, so but we had exhausted all the efforts. we were up to almost midnight going from hospital to hospital. and then vinnie not wanting to do it said, 'get me back into the coroner's office' and we went back to the coroner's office. we went in to the office with the lady, sat down. lady said describe her. he said she has long brown hair, she has this tattoo of this creature on her back from a storybook."linda rodriguez/victim's mother: "where the wild things are..." greg rodriguez/victim's father: "and the lady put her pen down and said i'll be right back. she knew. she knew. she went back. she came back with a

school has one parent claiming administrators are ánot doing enough to protect her daughter. this happened at dallas ranch middle school in antioch. the mother says her daughter was being harassed and the school refused to let her back into the building after school was let out. yokisho justin says a classmate threw water on her daughter but a school official refused to let her daughter into the building when she asked for help.

of jail. the new mission street sobering center is just up the street from the santa clara county jail. officials say its a safe alternative for drunk people to sober-up and get substance abuse and mental health treatment. the sobering center is also expected to end unnecessary trips to emergency rooms. it will be open around the clock - seven days a week. ( darya ) the well known rainforest cafe restaurant on san francisco's fisherman's wharf has closed after 17 years in business. it's the second restaurant to shut it's doors in wharf in the last two months. kron 4 reached out to the restaurant's management who said the landlord opted not to renew the rainforest cafe leases. nearby business owners say they were told that rainforest cafe was trying to work a cheaper rent agreement with the building owners but were unsuccessful. joe's crab shack along the wharf also closed earlier this year.

( mark ) five former presidents will all take part in a benefit concert later this month. they're raising money for hurricane recovery efforts in texas, florida, and the caribbean. the october concert is a continuation of the "one america appeal." that's when the former presidents filmed this video... urging people to help after hurricane harvey caused tremendous damage in texas. since filming that video, the five have since continued the effort, extending it to those affected by hurricanes irma and maria. ( darya ) a former bay area resident is being credited with saving a man during sunday's massacre. james lawson rushed to help a man who was wounded. lawson grew up in concord and graduated from ygnacio valley high school in 2006. his grandmother still lives in the east bay and told kron4 that she's proud of what her grandson did. his long time next door neighbor says she feels the same.

he is one of the people who stepped up and helped out his fellow man. you know because he is a person of character and you know, um. very proud to hear he's done this.">( darya ) james' former teachers at ygnacio valley high said they're also very proud of him for risking his life to save others. ( mark ) there have been three threats of violence against bay area high schools in less than a week. the latest one happened on the peninsula. police determined san mateo high school was safe yesterday after staff members discovered a threatening note written on a bathroom wall. and on monday in danville, there was a graffiti threat aimed at monte vista and san ramon valley high schools it had been spray-painted on a footbridge near old blackhawk road. investigators say there was no evidence it was a real threat. and last friday at redwood high in larkspur police investigated a graffiti message that threatened a shooting. ( darya ) in the east bay... alameda county is being sued after a three-year-old foster child died after ingesting methamphetamine. the family's attorney says county workers missed obvious signs that the girl was in danger. the lawyer says the child

had already been taken to the hospital once for consuming the drug. less than two weeks later... she died after ingesting methamphetamine for a second time. it is not clear how it happened. ( darya ) police have released surveillance video of the man who robbed a danville drug store. it happened at the walgreens on san ramon valley boulevard last month. the man wore a surgical mask. he walked straight to the store's pharmacy and put some items on the counter. he slips the pharmacy worker a note demanding prescriptions pills. the man then takes a gun out of his pocket and puts it on the counter. after getting a bag of pills he walks off. no one was hurt. today is the last day daca recpients can renew their permits. if they miss today's deadline they could potentially be forced to leave the country. congress now has six months to permanently fix the problem. if they don't, daca recepients will no longer be protected from deportation. both democrats and republicans are now working on legislation to protect dreamers.

( darya ) a modesto junior college professor has died following complications from the west nile virus. doctor kimberly kennard came down with flu like symptoms during the fall 2015 semester. she was in and out of hospitals with no diagnosis until february 2016. that's when kennard was finally diagnosed with west nile at the u-c davis medical center. friends say she spent a lot of time outdoors. < to see the deterioration of her health it was quite sobering and alarming for us > ( darya ) kennard never went back to teaching after coming down with symptoms in 2015. ( darya ) novato police have arrested a man they say repeatedly harassed a 14- year-old girl. police she the girl would be waiting at the bus stop on grand avenue

when the man would approach her in his truck. officers say he would offer to drive her around and buy her coffee. the teen told police it happened several days in a row. police performed a steak-out at the bus station and caught the man. he is cirilo perez-lopez. he was arrested and charged with annoying a child. ( mark ) the woman forcefully removed from a southwest airlines flight says she was the victim of racial profiling. the plane was heading from baltimore to los angeles. a lawyer for the woman said the incident was motivated by an anti-muslim bias. the woman originally complained that she was allergic to dogs. two were sitting near her. she says she told the flight crew that she would be fine.. as long as she was separated from the dogs. southwest says because she didn't have a medical certificate... they denied her request. police were eventually called in to remove her from the plane. she claims she was treated roughly because she is muslim. southwest airlines says their employees did nothing wrong.
