returned.today a lawsuit was filed on behalf of the ruiz family, and two others in the same neighborhood who lost it all in the fires, blaming pg&e for starting the fire, despite the fact an official cause has not been released.we're suing pacific gas & electric company for their failure to protect the public putting profits before safety profits before people that they failed to maintain their equipment there powerlines they also failed to keep the brush in the trees and the bushes trimmed as they're required to do by law attorney mary alexander also says pg&e knew a windstorm was forecast and should have shut off power proactively.and we do why are people without power but this is far worse and cut it off so if lines fall they don't start ignition of the firethe plantiff's attorney believes all the fires that ravaged the wine country, killing over 40 people and destroying over 3000 homes, are connected and expects more affected families to join the lawsuit.the attorney says she's filed the lawsuit here in san francisco, rather than in mendicino because this is where pg&e's hequarters are, where decisions were made that she alledges makes them accountable.maureen kelly kron4 news

(grant) p-g-&-e has responded to the lawsuit. saying "nothing is more important to us than the safety and well-being of our customers and communities we serve. our thoughts are with everyone impacted by these devastating wildfires. we are aware that lawsuits have been filed. beyond that, we're going to be focused on doing everything we can to help these communities rebuild and recover." there are at least 2 other lawsuits that have been filed in addition to the one filed today. (vicki) the wildfires have left thousands of people desperately seeking housing as the bay area faces a housing shortage. and no surprise here-- the bay area also faces some of the nation's highest rents and real estate prices. many fire victims have doubled up in bedrooms or slept on living room floors at the homes of friends or family. now they are struggling to find long-term housing. the bay area was already dealing with a rental shortage before the fires destroyed

more than six-thousand homes. in an effort to help fire victims-- local officials voted to temporarily block new vacation rental permits. and trailers are now permitted to function on homes on residential lots. wildfires. we did it right after hurricane harvey... and we are doing it tomorrow... to raise money for the north bay fire victims. the donation lines will be open during the kron four morning news from 6 a-m until 10 a-m. they will open up again in the evening... from 5:00 until 10:00. season, rock springs will have a bit more protection against flooding. earth movers like these are building a kind of levy here between coyote creek and the homes and apartment buildings that make up the low lying rock springs neighborhood. thousands of tons of earth are being turned into a 300 foot long berm from roughly phelan avene south to rock springs park.mary grimes/santa clara valley water district".....we were able to do this on a very short term basis to get a temporary fix in place, it doesn't provide 100 percent protection against a 100-year flood type situation but it is an improvement over what we had last year..." more than 37 million kidde (kidd-ah) fire extinguishers. the consumer product safety commission says the extinguishers can become clogged or require excessive force to discharge....bas ically they could not work. at least one death has been blamed on the faulty extinguishers. the recall involves more than 140 different models of the extinguishers made between 19-73 and this past september. if you have one of these extinguishers you can contact the company for a replacement. we have a list of the affected modes on our website at kron-4 dot com. (vicki) new tonight at five-- if you have a membership at 24-hour fitness-- you could get some money soon. the san ramon company is being fined one- point-two million dollars for misleading custers about membership fees. they reached a settlement after a lawsuit acsed them of falsely promising low guaranteed renewal rates, but charging large up-front fees. the gym is then accused of not honoring the promised lower renewal rates. 24-hour fitness must also pay 100-thousand dollars to contra

costa county, and restitution to the members who were misled by the fees. the members affected joined the gym between 2006 and 2009. (vicki) a woman says she contracted herpes from a lipstick sample while trying on a "common use" sampler at sephora. and now she's suing the make-up chain. the woman says she used the tester lipstick at a los angeles location october of 20- 15. she was diagnosed with oral herpes shortly after that. claiming she never had herpes or cold sores prior to going to the sephora store. the woman is asking for 25 thousand dollars from the company. saying sephora does not have "adequate practices in place to avoid herpes exposure." sephora denies the allegations. (catherine) jeremiah teaches subjects at st. mary's ranging from religion to social studies.. but in many of his classes - he also shares a talent for singing and acting.. it's all part of his belief in keeping students engaged and happy... applause as he takes stage jeremiah clauss - a teacher who loves to perform.whether it's singing at school fairs.. entertaining at parties and eventsacting in local theatre there was a time when he tried to take it farther. jeremiah - i tried out for american idol one time. tried out for the voice. but it just wasn't god's calling for me.turns out his calling is the classroom...where jeremiah welcomes his 6th graders before language arts class.and later...reads to them......acting out the characters. student he's creative. and he's funny. and he's great at story-telling. student he's been here for 9 years and i think he's made a big difference. he even does the school play.he wants his students to puzzle things out

video shows a kidnapped woman... escaping from the trunk of a car.(grant) police in alabama say a man broke into the woman's home... and abducted her. when the suspect went into the gas station... the victim waited a few seconds -- popped the trunk and ran inside for help. the suspect apparently saw her and quickly left the store -- speeding off in the car. police later arrested the man during a traffic stop. video shows the moments a santa clara officer opened fire... killing a mentally ill suspect. the shooting happened back in march on deborah drive in santa clara. police responded to five different calls at 24- year-old jesus montes' home the day of the shooting. the final call came around 5-pm, when the man's mother said he had stabbed himself and escaped out the bedroom window. in the video-- you can see montes walking away from officers during a standoff. the officers attempted to get him to surrender peacefully-- when he charged at them. one officer then opened fire, saying he was defending himself. today, the officer was cleared of any wrongdoing. (vicki) new at five... a north bay cook is facing child molestation charges... after san rafael police say he alleged sexually assaulted an eight-year-old girl.(grant)

kron four's philippe djegal reports from san anselmo... where the suspect was taken into custody. (philippe) 33-year-old jesus balam, of greenbrae... was arrested at around 11-15 wednesday morning at m-h bread and butter in san anselmo. it's where the san rafael police department says he works as a cook. lieutenant dan fink says balam has been the focus of a criminal investigation since september 20th. when the mother of an eight-year-old girl reported to police... that, balam, a family friend, allegedly sexually assaulted and exposed himself to her daughter somewhere in san rafael... sometime in august.lt. dan fink/srpd- "he was charged with, uh, one count of annoying and molesting and molesting a minor under the age of 18. and, also the lewd and lascivious acts by force of a minor, under 14." those are felonies. lieutenant fink says it doesn't appear any of the crimes happened at the restaurant. the owner of m-h bread anbutter declined to speak on-camera for this story... but tells us she is cooperating

(vicki) in bay area news... a refrigerator malfunction caused a "lucky" supermarket to catch fire. it happened last night at the store on bicentennial way in santa rosa. it's been closed since october 8th because of the north bay wildfires. the manager had just left the store when the fire was reported just before 6:00 last night. the fire destroyed a refrigeration unit in the deli section and caused an estimated 600-thousand dollars in damage. the store is set to re-open as scheduled on friday. (grant) construction crews have finished the first phase of repairs on the oroville dam spillway. officials say the spillway is now capable of handling a massive release of water. back in february... both the primary and emergency spillways failed... forcing nearly 200-thousand people to evacuate. crews also say that the water level in the reservoir is low enough that they will be able to work through the rainy season. the next step on the project is to build a wall to prevent erosion on the emergency

(vicki) take a look these photos -- they were taken of a salon in south dakota -- illustrating what a health and safety violation looks like.. tonight reporter casey wonnenberg shows us the five things to watch out for when going to a salon. when it comes to getting your hair done, do you ever think about how combs brush through dozens of people's hair every day? "there's lots of different people that we're seeing," atoley salon cosmetologist chelsea munson said.that's why it's not a bad idea to "brush up" on salon sanitation. first off, cosmetologists should clean all combs, scissors and hair clips before each use. "if someone did have lice, it could get on the comb," munson said.number two on the list? your cosmetologist or barber should clean capes and towels in between every customer.

approach of the winter rainy season finds crews at work on some new flood protection ... along coyote creek in san jose. (( áá steve áá )) kron four's rob fladeboe reports now on the construction of a temporary flood wall it's hoped will keep the creek from floodinglow lying neighborhoods like it did last winter. earth movers like these are building a kind of levee here between coyote creek and the homes and apartment buildings that make up the low lying rock springs neighborhood. thousands of tons of earth are being turned into a 300 foot long berm from roughly phelan avene south to rock springs park.mary grimes/santa clara valley water district".....we were able to do this on a very short term basis to get a temporary fix in place, it doesn't provide 100 percent protection against a 100-year flood type situation but it is an improvement over what we had last year..." loss...dodgers outfielder yasiel puig came home to find out his home had been burglarized. the l-a-p-d confirms that the incident happened overnight during the game. police say a window was broken in and items were stolen from his san fernando valley area home. the value of those items wasn't immediately available. it's actually the second time this year that puig has been burglarized. 170-thousand dollars worth of jewelry was stolen from a home owned by puig in march. (steve) california's new gas tax is now in place and we are learning more about how that money will be used to improve bart. bart officials say they are expecting about 20-million dollars more for next years budget. some of that money will allow them to hire more police officers and station cleaners to do maintenance on train cars. caltrans says the new gas tax will raise more than 50-billion dollars over the next 10 years. all of that money will go to transportation across the state. here in san jose crews are installing some new flood protectionalong coyote creek. they are building a kind of earthen levy. it's a 300 foot long berm between the creek and the ow lying rock springs neighborhood which was devastated when the creek jumped it's banksfollowing heavy rains last february. to go along with the berm, there will also be a vinyl wall constructed from roughly phelan avenue to rock springs park. it's a temporary fix but should be enough to protect the area from another flood. in san jose rob fladeboe kron 4 news
