(grant) now to the south bay for an update on the two inmates who escaped from custody monday in palo alto. sheriff's deputies have been saying all along it was a well orchestrated escape and that the two escape and that the two help from the outside. (vicki) now it appears they have their proof. kron four's rob fladeboe is live in san jose tonight with details about the arrest of an alleged accomplice. rob? significant development in the case, an aquaintance of one of the fugitives, a woman identified as marquita kirk, has been arrested on suspicion of being an accomplice. arrested and booked into the county jail tuesday morning is a woman identified as 44 year old marquita kirk, of asunnyvale. she is suspected of renting and providing the u-haul cargo van that was waiting for the two inmates after their daring escape from custody on monday.deputies their relationship is not clear but that kirk is affiliated with 46 year old tramel mclough, who escaped from the courthouse in palo alto along with 47 year old john bivins.both men are from east palo alto. deputies could not of kirk is connected to the first getaway vehicle that was abandoned before the two men switched into the u-haul van. it's also not clear whether kirk was present during the escape and what

role she might have played in helping to orchestrate the plan.sgt. rich glennon/santa clara county sheriff's office as they were being escorted through a courthouse hallway by a bailiff after a hearing, bivins and mclough somehow got free of their handcuffs and ankle chains, possibly using this key, which deputies say was found on a path near the courthouse.

(vicki) a victim of a sexting ring at a brentwood middle school wins a two million dollar settlement from the school district.(grant) the girl's lawyers filed the suit... claiming school administrators ignored warnings about the main perpetrator... who is now behind bars. kron4's maureen kelly talked exclusively with the mother of the victim after the settlement was approved by a federal judge.(take pkg) it was horrible what happened to her she was a baby this started when these kids were 12 or 13 years oldit was a crime that shocked the parents at adams middle school in brentwood when it was first reported back in 2014....at the time investigators saying at least 20 kids used cell phones to exchange partially nude photos of their female classmates....but it didn't

stop there.....after some students gave them photographs they were threatened and blackmailed to perform some sex acts.these sex acts happening in the school's campus bathroom. one teen was charged with multiple counts of forcible sex acts on a minor, eventually pleaded guilty to acts invovling two students and was sentenced to 12 years in a youth correctional facility.once released he'll be required to register as a sex offender for life.that perpatrator's name was redacted in these emails obtained by the plaintiff's lawyers.....dated from before news of the sexting ring came to light they show other incidents of bullying, and one from the district psycholigist stating that the student past records indicate tremendous amount of impulse control and anger issues....that he considered "most likely of a clinical nature."and rather than give him any services in middle school, they ignore those problems and the students behavior escalatedthe plantiff's lawyers also say that administrators violate district policy requiring them to report all instances of sexual harrassment and bullying. something the victim's mother hopes changes because of this 2 million dollar settlement.a settlement of the size hopefully will bring awareness and people need to realize this is just delete hollywood this is an college campuses this isn't just high school this is happening in elementary and junior high school outside the courtroom a lawyer representing the brentwood union school district had no comment on the settlement. maureen kelly kron4 news.

shooting in september, everyone was shocked that the gunman had no history of violence .... well, that was 'not' the case with the man accused of murdering 26 churchgoers and wounding 20 more in texas last sunday. "the pastor did know the man." "he did know him?" "he did know him. he did not want him at his church." why not?" "he said because he just thought he was not a good person.""good person" .... those words were not used by the u=s air force, after kelley enlisted in 2010. at holloman air force base in new mexico, he got in trouble for threatening superiors and trying to smuggle a weapon onto the base,he was confined to a mental hospital, but escaped in 2012.picked up in el paso, he was returned to holloman and court-martialled for domestic abuse, he pled guilty to choking and striking his wife, and reportedly fractured the skull of his 11=month old stepson.in 2014, the air force kicked him out with a bad discharge, but failed to alert civilian law enforcement to his conviction.

"i can tell you that he is not in any fbi database."in 2016, kelley bought a ruger semiautomatic rifle at a sporting good store in san antonio.he failed to check the box asking about any previous convictions.kelley was living in colorado springs at the time, where he was cited for animal abuse.this year he and his new wife moved in with his parents in new braunfels. "nothing abnormal. regular guy. i mean the only thing unusual across the street is we hear a lot of gunfire, a lot of times at night."kelley posted a picture of his assault rifle online. last weekend, police say he brought it and several other guns to the baptist church in sutherland springs.he died of a self=inflicted wound after being shot twice by a civilian. the air force says it's conducting a review of its policies. "somebody really dropped he ball in this case and there's 26 dead people now." (catherine) doctors say ten of the

20 people wounded in the shooting are still in critical condition.many of them were shot several times.. grant, and vicki? (grant) new at five... san jose police are looking for three people they say robbed a willow glen sporting goods store over the weekend. it happened friday at "athletic performance" on lincoln avenue at willow street. take a look at the woman wearing the gray sweatshirt and braids... she browses around the store for a while. during this time... her accomplice in the black shirt walks in and out of the store several times. after about ten minutes... a blonde woman comes in the store and says something to the woman in the grey sweatshirt. she then holds the door open and the women in grey walks out of the store with several items in hand. the store owners say they took more than 15-hundred dollars worth of merchandise. new twist in the already bizarre story of sherri papini. surveillance video shows a woman believed to be papini.... running along a highway on the day she says her abductors released her. the shasta county mother of two says she was kidnapped by two hispanic women while jogging near her home outside redding. they held her for 22 days before releasing her on thanksgiving day.... 150 miles away, the video from a jehovah's witness church in yolo county shows her running toward the church, then running in the other direction to interstate five, that's where she was spotted at four=22 in the morning, shackled, branded, bruised and emaciated.the case remains unsolved. shasta county sheriff's deputies discovered the video last year. there's no explanation as to why they relased it today. tonight we are tracking some of the key races. this is video of a polling place in pacifica (grant) on two bay area ballots are measures dealing with marijuana. here's a closer look... in the sonoma county city of cotati...measure g is a tax on marijuana businesses. a yes vote would tax up to 25 dollars per square foot of a business' cultivation area... or impose a 8% tax on sales. it is estimated to generate three-hundred thousand dollars in tax revenue each year. the money would be used to help pay for city services impacted by the pot business. and measure "g" in pacifica would create a six percent tax on marijuana operations. after two years that tax could be decreased or increased up to 10 percent. it is estimated to create three hundred and sixty thousand dollars in tax revenue each year. (vicki) in pacifica... "measure c" will establish a regulatory board to oversee rent control. if the

measure passes... the board would protect tenants from excessive rent increases and no-fault evictions. it would also make sure rent prices are reasonable to landlords. (grant) besides san mateo and sonoma counties... here are all the bay area counties holding elections tonight. marin... santa clara... and solano. polls close at 8 p.m. polling places are not open in sonoma county due to the north bay wildfires. that election is only a mail-in ballot. we are covering the key races all night-- and will have results on air and online. kron four is your local election headquarters. (vicki) the san francisco police union is considering a ballot measure that would help determine the department's policy on the use of tasers. last friday the police commission approved the use of tasers for the department. officers will not be armed with tasers until december of next year. if a ballot initiative is approved it would be on the ballot next november. (grant) new at five... california's state treasurer is getting ready for the

influx of cash that is expected to come with the legalization of recreational marijuana. the treasurer is recommending using armored cars to transport hundreds of millions of dollars in cash tax payments expected next year. most marijuana companies do business only in cash, including paying taxes. most banks don't want anything to do with marijuana money... that's because the plant remains illegal under federal law. the state will get a 15 percent cut on retail pot purchases next year. (grant) the santa clara county judge who has come under fire for sentencing a convicted rapist to just six months in jail is now being reassigned. judge aaron persky sentenced former stanford swimmer brock turner to just 6 months in jail... sparking a recall campaign against him. persky will now serve as a night judge beginning next year. that means he will work from home and be on call overnight. the judge requested the change in assignment. (catherine) congresswoman eshoo says she believed that after the school shooting at sandy hook in 2012 - that resulted in what she describes as 'babies being massacred' --- that congress would 'have' to do something radical about gun control. it didn't happen. and now - in the aftermath of the shooting in sutherland springs texas - she's more frustrated than ever.. rep. anna eshoo - i think shame on congress. shame on congress. you know what congress does every time this happens? when we come to the floor to vote, and one of these massacres has taken place, the speaker says we're going to have a moment of silence. everyone bows their head. you don't even have time to say an 'our father' to yourself silently. the gavel goes down - the house is dismissed. i think you can hear my frustration and even a form of disgust. because we can do something about this. we can really bring the

the ski season in the sierra is about to being as resorts plan to open this week. (grant) but there is a warning about how much those resorts are doing to make sure you are safe on the slopes. reporter drew bollea has the story.

one group wants visitors to know california resorts could do better to keep them safe "they are very inconsistent in the way they mark hazards," said richard penniman, the lead researcher for the snow sport safety foundation.he authored a report card that shows a lack of uniform safety plans, speed controls, and injury data collection by more than a dozen sierra resorts. "the signing and control of traffic and slowing people down needs to be improved a lot," explained penniman.the overall score for all of california resorts was a "c." kirkwood, dodge ridge, and soda springs have some of the highest scores.boreal, china peak, and donner ski have some of the lowest."they're businesses, and they don't want to be held to standards if they don't have to be," said penniman."we really don't frankly even really recognize or acknowledge the legitimacy of the report card," said michael reitzell.he is the head of ski california, which represents nearly every mountain resort in the state. "it's truly just one person's view on snow sports safety," said reitzell.he says the criteria in the report isn't accepted in the industry or

(grant) a suspected car thief leads police on a high-speed chase in los angeles. take a look at the video... officers began chasing the reported stolen ford mustang late last night. the driver sped through streets at speeds of more than 100 miles-per-hour... the chase continued for more than an hour before chp officers performed a "pit" maneuver that made the mustang stop. the driver then climbed out of the car with his hands up. police took him into custody. a wanted parolee is hospitalized after an attempt to flee from the police falls apart. the chase started yesterday afternoon when police saw the man get into a car. a short chase ensued.....and the suspect fired shots at officers as they were in pursuit. the chase ended...with a crash...right into a house. the suspect tried to run away...but didn't get far...he was shot at by officers and arrested. (vicki) there is a 25- thousand dollar reward for information about a series of robberies in blackhawk... which is just east of danville. these are surveillance pictures from the most recent break-in. it happened last friday night. police say three thieves entered the home... grabbed some of the valuable property and left. police say the description of the burglars matches those who have committed previous burglaries in the area. clara city supervisor is calling for action, saying the

county needs to step up efforts to crack down on drones. (vicki) this comes as there is growing concern that drones could be used to smuggle contraband, including drugs, into jails. kron 4 charles clifford has details. standupright behind me here is the elmwood correctional facility in milptias. it covers 62 acres and there's mounting evidence that drones have been used to carry things over the fencesotwhat we are seeing is things like methamphetamines being smuggled into the jail so we want to make sure drones aren't being used for that. santa clara county supervisor cindy chavez says that during a recent tour of elmwood she saw evidence of contraband being smuggled into the facility using drones. she says the santa clara county sheriff's office, which operates the jail, is also worried about the problem.sot they let us know that they were concerned about drones and as a matter of fact recovered a crashed drone inside the permiter.chavez now wants the county to implement drone-related air restrictions over detention facilities like elmwood and to then enforce those restrictions.sotto makes sure that punishment is pretty swift. that we are aggressive in pursuing people who are flying drones over our jail facilities.she also want to launch a public outreach campaign to help people

south bay... investigators say suspected accomplices are under arrest in the daring escape by two inmates as they were headed to court. ( steve ) good evening... i'm steve aveson.( pam ) and i'm pam moore. we start with the arrests in the killing of a concord high school student. the announcement came just minutes ago.( steve ) kpon 4's terisa estacio has been following this story for us today.. she joins us live from police headquarters with the new information. terisa. police have just released these names of x suspects - they have all been arrested on charges of x the shooting took place monday afternoon in front of olympic high school in concord. police were called quickly to the scene - lawrence janson was found at the school, he had been shot reportedly multiple times. he was later pronounced dead at the hospital. throughout the day, a memorial grew. so many friends and faculty members wrote notes and set out flowers and candles. the

( pam ) happening tonight: san francisco police are holding a town hall meeting ... following a shootout with a suspect last week. the meeting is taking place at the eureka valley recreation center on collingwood street. the shooting happened last wednesday... near 18th and diamond streets in the castro district. officers were checking out reports of a suspicious vehicle. investigators say, when they approached the car... there was an exchange of gunfire. the officer was wounded but is expected to recover. the suspect was also hit and at last check was in the hospital. the cover-up is almost as horrific as the crime(steve) the victim of sexting ring at a brentwood middle

school wins a 2-million dollar settlement today from the school district.(steve) now her legal team is releasing evidence they say proves that school administrators and their lawyers tried to cover it up. (pam) kron 4's maureen kelly has the story .... you'll see only on four. adams middle school administrators went under oath to testify in depostions about the case that shocked the community when it was first reported in 2014. at the time investigators said at least 20 kids used cell phones to exchange partially nude photos of their female classmates....but it didn't stop there.....some of those girls in the pictures were then threatened and blackmailed to perform sex acts in the campus bathroom. one student....identified only in court docutments as j.l. later pleaded guilty and was sentenced to 12 years in a youth correctional facility. i'm very mad yes i'm mad knowing what i know now for the district i'm very mad today.. the mother of one of the victims left the federal courthouse with her legal team

story tonight: there is some new video that adds another twist to the bizarre disappearance of sherri papini. ( pam ) the shasta county sheriff's office released it today... it is surveillance video from near a church. grant lodes is here with the pictures. grant. ( grant ) does this answer the question as to what happened to sherri papini last year... no. but it does help with the timeline investigators are working with. her husband reported her missing at the beginning of november... she was found on thanksgiving day along i-5 in yolo county... the day she said her kidnappers let her go. so here is the video we received today. it is black and white and a little grainy... so we have put a red circle

over papini. she can be seen dashing across the screen. the video was taken near a church in woodland at 4-15 in the morning. seven minutes later the yolo county sheriff's office received a phone call about a woman being found along the freeway... which turned out to papini. this would matchup with the timeline of events from that day. papini reportedly still had some restraints on at the time...he left shoulder was branded and she was battered and bruised. last month the fbi released sketches of the two women who papini says abducted her. papini also had male dna on her clothes when she was found. ( grant ) the shasta county sheriff's office is handling the investigation since that is where papini was reprotedly taken... while out for a run. investigators have received hundreds of tips and there is a 10-thousand dollar reward being offered for information leading to arrests in the case. pam and steve.
