to them, why did they kill my son, that's the question for me and my family, it's not easy....."nats (police body cam video)police body cam video from march 9th, shows santa clara police confronting geney-montez, whom they thought was armed and suicidal after he had stabbed himself. the 10 minute-long video ends when geney-montez tries to flee and is pursued by officer colin stewart, who then fatally shoots geney-montez. kron4news freezes the video here due to it's graphic nature.(graphic)the district attorney's office found that the shooting was "legally justified." the reportsays geny-montez turned toward officer stewart and charged toward him while raising his right hand.." and that..."officer stewart reasonably believed he had no other means to neutralize the threat than to fire his gun..." it turns out that geney-montez was not armed and the video shows there was a fence between him and officer stewart when he fired.

looking to rebuild after the devastating north bay fires. contactors could offer their help-- without having a proper license. protection agency is now warning north bay fire victims about fake callers pretending to work for the agency. today, a man who lost his home in the fire received a call from someone offering him an e-p-a grant. that fake caller used western union to receive the grant. the e-p-a says the callers also asked for social security numbers and bank account numbers. the agency says it is only contacting fire victims about hazardous debris from what is left of their homes. if you receive a fake e-p-a call...you can call the e-p-a inspector general's hotline or the california attorney's office (grant) new at five-- the santa clara county d-a's office is warning people about a 'car wrap' scam....(vicki) prosecutors say a senior citizen in the south bay has already been targeted.. catherine heenan is here with more.. but now there's a warning of a "predatory" advanced payment scheme.a woman in san jose got an email offer to be paid $400 a week....and was sent a check for19-hundred dollars. she was told to keep $400 for the first week...and then send the remainder to the supposed company -- which would then use the money to create the shrink-wrap ad. she eventually realized it was suspicious. it 'was' a scam and the check was forged. prosecutors say a bank generally wouldn't be able to verify that before the scammers had taken their money. they're warning people tonight that the red flags include anyone asking you to cash a check and send money elsewhere... grant and vicki? (grant) twelve people in san jose are without homes tonight after a fire ripped through a townhouse. the fire broke out before six this morning at a townhouse on don seville court. firefighters found heavy smoke and fire on two levels of the building. they were able

(vicki) danville police are asking for the public's help with identifying three people connected to a car burglary. the burglary happened on october 20th but police have just released a picture of them. the car burglary happened in the fountain springs area of danville. they were last seen on surveillance camera walking into a nordstrom rack in concord. doctors are now saying that even one alcoholic drink a day... may increase a person's chances of cancer.(vicki) experts say that drinking... even a little bit... can increase a woman's risk of breast cancer. alcohol can cause an increase of estrogen... the essential hormone connected to the development of breast tissue which could affect the risk of breast cancer.(grant) people who consume roughly three-and-a-half drinks or more a day... are two to three times more likely to develop certain head and neck cancers and liver cancer. tonight at 5:30-- east bay mud officials began testing for lead in the water at all schools in the oakland unified school district this morning.(grant) this follows the school district's own tests that found lead contamination at 10 schools... earlier this year. kron4's maureen kelly reports from oakland. water coming from some drinking fountains and faucets at mccymond's high school is being tested for the second time this year. that's after elevated lead levels were found at this location and 9 other schools by tests conducted by the school district.a district spokesperson says the good news is , the containmentation has been isolated to the fixtures themselves.so the exposure to students was limited.it's not in the pipes which so would it means is that when you run the water for even a few seconds out of what it one of these water fountain heads or possibly a fossett basically all that lead is gone, it clears out that's how that works.most of the problem fixtures have been removed and replaced.and those that havent' been yet.like this cafeteria

(grant) california regulators have officially decided uber and lyft do not have to finger-print their drivers as part of their background checks. today, the california utilities commission made the rule official during a meeting in san francisco. the taxi industry had been pushing for uber and lyft drivers to be fingerprinted because it is required for taxi drivers. the commission reviewed the case for a year... and says that fingerprinting does not add a greater level of safety. people in the taxi industry are calling the decision a mistake. (tele vo) tonight, as kron four's rob fladeboe reports, the family of the manwho died is speaking out. matthew haley/family's attorney "....we are looking forward to an independent court proceeding, we believe that an independent set of eyes will look at what happened and the truth will come out..." attorney matthew haley is talking about this. about the recently released santa clara police body cam video that shows the march 9th fatal shooting of 24 year old jesus geney-montez. capping a long standoff with geney-montez, whom police believed to be suicidal after stabbing himself, geney-montez was fatally shot by officer colin stewart. an investigation by the districts attorney's office found that the use of force was legally justifiable and that geney-montez charged and threatened him even though the video shows there was a fence between the two. it turned out that geney-montez was not armed. his family, which picketed outside the district attorney's office on thursday, has filed a federal civil rights lawsuit against the city of santa clara and officer stewart. again, matthew haley,matthew haley/plaintiff's attorney
