bay.... it's the in the south (robin) (robin) in the south bay.... it's the video that sparked outrage. body-cam video of a fatal officer involved shooting in santa clara ... that happened in march of this year. the official investigation has cleared the officer of any wrong doing ... and as kron four's rob fladeboe reports, the family of the man who died

has now filed a lawsuit. matthew haley/family's attorney "....we are looking forward to an independent court proceeding, we believe that an independent set of eyes will look at what happened and the truth will come out..." attorney matthew haley is talking about this. about the recently released santa clara police body cam video that shows the march 9th fatal shooting of 24 year old jesus geney-montez. capping a long standoff with geney-montez, whom police believed to be suicidal after stabbing himself, geney-montez was fatally shot by officer colin stewart. an investigation by the districts attorney's office found that the use of force was legally justifiable and that geney-montez charged and threatened him even though the video shows there was a fence between the two. it turned out that geney-montez was not armed. his family, which picketed outside the district attorney's office on thursday, has filed a federal civil rights lawsuit against the city of santa clara and

officer stewart. again, matthew haley,matthew haley/plaintiff's attorney "...we believe the video shows a young scared man who runs into a fenced area and the officer discharges his weapon, we believe there was no threat to the officer...." rob fladeboe/san jose"....santa clara police said they agree with with the report's findings. a spokesman for the da's office said it stands by it's report, adding that any contact with law enforcement ends in death is a tragedy." (robin)now to the latest on a big story we are following. defense attorneys rested their case in the trial of the man accused of killing kate steinle in san francisco. jose garcia zarate is

accused of murdering steinle along pier- 14 back in 20-15. prosecutors have not presented a motive for the shooting... and are not required to prove that zarate 'meant' to kill steinle. however, prosecutors áareá required to prove that he fired the gun intentionally. defense attorneys argue that the shooting was an accident. they say, it happened after zarate found and picked up the gun on the pier. that weapon had been stolen from a u-s bureau of land management ranger, several days earlier. (robin) san francisco has suspended the entertainment permit of an excelsior district bar ... where a deadly shooting occured in may. the suspension will last 30 days ... at the request of the district supervisor. la oficina ... located on missions street ... was the scene of a shooting that killed 30-year-old alvaro palma. security guard david sanches ... was arrested and charged for the shooting. he remains behind bars on 10 million dollars bail. they're tired of side shows creating a bad name for them all. kron4's ali reid has more. everyone you see here are car enthusiasts.they take pride in building their vehicles, but now sideshows are making car shows hard for them.building cars is a hobby . and they say side shows take away from the reasoning behind building unique cars.they formed the bay area alliance tonight basically different car groups came together to try and combat the side show problem. the car scene has gotten a lot of bad publicity because of side shows.they're all now being targeted by police because of their modified cars they want to take attention away from destroying property and causing violenceworking with police and other local authorities to put a stop to the sideshows that are causing havoc on the city. utilites commission has ordered utility companies to give special protections to those impacted by the north bay firestorm. the c-p-u-c made the orders based on recommendations developed by its staff to help fire victims. communication companies now have to refund their customers during the times their area was devastated by the fire. water companies have to help fire victims resolve unpaid bills. p-g-&-e has been ordered to waive costs to fire victims as

(robin) some big name musicians with bay area roots came together at at a-t-and-t park ... all to help the victims of the north bay firestorm. metallica was the headlining act. 43 people were killed in the fires.. which caused more than seven billion dollars in damage. thousands showed up last night. ... supporting a cause to raise money for fire victims .... and to honor first responders.in between sets ... several big name athletes including joe montana and barry bonds honored some of those heroes ... and remembered those who lost their lives in the fires.

residential burglaries here on el patio court in cambell. burglaries are not unusual in the south bay town but the large number of possible suspects, seven, that is a bit of a surprise says campbell police captain gary bergsot the burglaries took place back on monday october 30th at around 10am. investigators say residential surveillance cameras in the area shows one of the teenagers holding a key piece of evidencesot campbell police say the teens are likely local, randomnly chose to burglarize the two homes, which sit side by side on the quiet block, investigators have limited descriptions of the possible

(robin)police are looking into the death of a man who was found lying in the middle of the street in union city. it happened yesterday morning ... just before eleven ... near the corner of allison and lisa drives. officers performed c-p-r ... but the man died at the scene. police believe the victim may

have been involved in a dispute with family members before they were called. police have not yet released the cause of death... and it is unknown whether foul play is involved. (robin) a man in the south bay was arrested ... accused of inappropriately touching a student at san jose state university. it allegedly happened yesterday around noon.... inside the m-l-k library. police identified the man as javiar coreas. the victim was not physically injured. university police are investigating the incident ... and are currently looking for any other potential victims and or witnesses. (robin)on the heels of veterans day tomorrow ... a new survey shows veterans across the country want a change in medical marijuana policy. kron 4-s washington correspondent drew petrimoulx reports many believe a new direction will save lives. boone cutler, combat veteran: "what woke me up is the day that i reached up in my closet and i grabbed my gun and i pit it to my head."during a recent press conference on capitol hill -- combat veterans told

"josh frey, combat veteran: "if it wasnt for medical marijuana i wouldnt be here today."it was organized by the american legion which released the results of a new survey of veterans. it found 92 percent support medical cannabis research -- 82 percent favor legalizing the drug for medical use. drew petrimoulx, reporting: "the american legion is calling on the federal government to reschedule marijuana to a lower classification of drugs. that would allow v-a doctors to talk to their patients about potential benefits and open the door to increased marijuana research. " tennessee congressman steve cohen is cosponsoring a bill aimed at accomplishing those goals. rep. steve cohen, d-tn: "we should be doing as much research as possible and we should be giving people the freedom to have medical marijuana where it's legalized."cohen says it may be difficult to convince the trump administration to agree. in fact -- earlier this year attorney general jeff sessions asked congress to crack down on medical marijuana.the combat veterans who spoke on capitol hill say marijuana eased the mental and physical scars of war. ex-marine boone butler spoke about the first time he tried it. boone cutler, combat veteran:"i

(robin) there is an ongoing hunt in the north bay .... for any 'fake contractors' - who might be trying to exploit fire victims... state authorities want to be sure that those who have lost homes and other property ... do not fall victim. they want people to realize that at a time like this - when theres a lot of money to be made after a disaster -- not everyone who

offers help is legitimate. to get the word out ...workers from the contractors state license board are putting up signs in the burned out neighborhoods of the north bay. (robin) stephens says people should always be suspicious and ask lots of questions.people should ask to get a contractor's license number - which can then be checked. practice was cold and wet and not on their home turf but no one here seemed to mindnikko player, lost his home. yeah, we don't mindsince the tubbs fire erupted burning down half of cardinal newman high school plus thousands of homes including those of 10 players on the football team - the 2018 season has not been an easy one.kyle. i watched my home burn down.and it wasn't just players, but coaches that lost everythinglynn meister, coach. it is gone, but you must have a good attitude. yet - with the team scoring a seat in the first round of the playoffs - come friday night, it has certainly boosted the spirits of everyone.paul , coach it has really helped. football and playing together has united us during this tough time. win or lose it doesn't take away the pain felt by many of the players. will player yeah, it has been tough, emotionalbut a win and an advance and even a chance at the state championship would certainly feel great. nikko. i am optimisticterisa estaciokick off for the game

schools are going to begin testing tap water for lead. schools in richmond will begin testing water next week. east bay mud spent the day yesterday testing water at schools in oakland. at least 7 schools in oakland tested positive for lead earlier this year. the school district says the problem has been fixed but they are having the water tested just to be safe. east bay mud is now offering to test the water at all schools in their service area. (robin) the next time you go to the grocery store... make sure you wipe down the shopping cart. police say it could save your life... but it is not because of the germs. police say drugs like fentanyl can be on the cart and enter your system just by touching your hands. a florida police department issued the warning after a 10-year-old boy in miami died after coming into contact with the drug on a shopping cart. other police departments across the country say the odds of this happening are very slim.. but it is better to be safe than sorry. hurricanes has ended.but a new report says, millions of americans are still at risk of losing their homes to flooding. as kron4's catherine heenan shows us, the east coast is in the greatest danger. sfxmiami, new york, tampa, fort myers and boston.zillow says those five metropolitan areas have the most to lose from a six=foot seal level rise.miami will suffer the worst, with nearly half a million homes underwater, including more than 80 percent of miami beach ... total loss more than 200=billion dollars. in the new york city area, including long island, 180=thousand homes, 123=billion dollar loss. nationwide, zillow estimates that one point nine million homes could be underwater

(robin) four women say alabama republican senate candidate roy moore pursued inappropriate relationships with them when they were teens and he was in his thirties. none of the women say moore forced them into sexual contact with him. but one accuser says she was just 14- years-old when moore, who was 32, initiated a sexual encounter. in a statement, moore's campaign denied the allegations. several senate republicans -- including majority leader mitch mcconnell and arizona senator john mccain -- say that moore must step aside if there is any truth to the allegations. parents this morning... after a new study reveals high levels of lead .. in 'fidget spinners'. a non-profit group tested two 'fidget spinners' sold at target stores. their lab results showed... the products contained lead levels more than 3- hundred times higher than the federal limit. the group says, it alerted target and the toy's manufacturer-- bull's eye toy. they responded by saying a 'fidget spinner' is technically 'not' a children's toy ... and therefore not subject to legal limits for lead. they cited the consumer product safety commission ... which reiterated that 'fidget spinners' are not classified as toys. (robin) california regulators have officially decided uber and lyft do not have to finger-print their drivers as part of their background checks. the california public utilities commission made the rule official during a meeting in san francisco yesterday. however... both ride-share companies will need to conduct annual screenings of drivers... and will have to use third- party agencies to run background checks. the

taxi industry had been pushing for uber and lyft drivers to be fingerprinted .... because it is required for taxi drivers. the commission reviewed the case for a year, and says.. fingerprinting does not add a greater level of safety. and how about this for a christmas gift.adidas has unveiled the official soccer ball for the world cup next summer. the ball will be called... telstar 18. the design is honoring homage to the classic white and black balls used in the 1970 and 1974 world cup finals. adidas is selling the ball for 165 dollars. the u-s men's national soccer team lost a qualifying match ... and will not be in russia for the world cup. ( darya ) in the north bay... police arrest a man with a gun near a middle school. police say the gun was not loaded. it happened at hall middle school in larkspur. district officials called police to report a man on campus who was not supposed to be there. police tracked the man down and found the gun in his backpack. there was no ammunition and the man was arrested and booked on charges of having a gun on school grounds. police say this case is not related to the recent shooting threats at

( darya ) happening now... police are looking for the man who robbed a bank in brentwood. it happened at the bank of agriculture and commerce on first street. a man walked into the bank with a gun... demanded the money and took off. he was last seen running on first street towards diablo alley. nobody was injured in the robbery. police do not have a detailed description of the thief. ( will ) police have released the body camera footage from the night of the shooting. it happened back on march 9th. according to the district attorney's investigation... jesus geney- montez charged toward the officer with his hand up. the d-a's office says that the officer had reason to use force. the officer originaly said that he thought that geney-montez was armed. it turned out he was not. the video also appears to show a fence between geney-montez and the officer. ( will ) the family has also filed a lawsuit against the officer. santa clara police said they agree with the d-a's findings. back to you.

( darya ) the defense rests in the trial of the man accused of killing kate steinle in san francisco. jose garcia zarate is accused of murdering steinle along pier- 14 back in 20-15. the defense has argued that the shooting was an accident. they say the gun went off when garcia zarate picked up. the prosecution is set to call a rebuttal witness on monday. closing arguments are set for a week later on november 20th. the case will then be turned over to the jury. you are looking at surveillance video of a group of teenagers suspected of being involved in a pair of residential burglaries here on el patio court in cambell. burglaries are not unusual in the south bay town but the large number of possible suspects, seven, that is a bit of a surprise says campbell police captain gary bergsot the burglaries took place back on monday october 30th at around 10am. investigators say residential surveillance cameras in the area shows one of the teenagers holding a key piece of evidencesot campbell police say the teens are likely local, randomnly chose to burglarize the two homes, which sit side by side

( james ) two bay area colleges top the list for people who make the most money after graduation. and the top school on the list is not one that you would expect. samuel merritt university in oakland came in at number one. the study found that 10 years after graduating former students made an average of more than 106-thousand dollars. stanford came in at number 2 on the list. graduates there made just over 85-thousand dollars. also in the top 5 were two southern california schools and the california state maritime university... which is located near vallejo. santa clara

( james ) in the east bay... more schools are going to begin testing tap water for lead. schools in richmond will begin testing water next week. east bay mud spent the day yesterday testing water at schools in oakland. at least 7 schools in oakland tested positive for lead earlier this year. the school district says the problem has been fixed but they are having the water tested just to be safe. east bay mud is now offering to test the water at all school in their service ( james ) also in the east bay... a man died after he was found lying in the middle of the street in union city... it happened yesterday morning near the corner of allison and lisa drives. officers performed c-p-r... but the man died at the scene. police believe the victim may have been involved in a dispute with family members before they were called. police have not yet released the cause of death... and it is unknown whether foul play

( darya ) in the south bay... a man is arrested... accused of inappropriately touching a student at san jose state university. it happened yesterday.... inside the m-l-k library. police identified the suspect as javiar coreas. the victim was not physically injured. university police are investigating the incident... and are currently looking for any other potential victims or witnesses. ( darya ) happening now in the north bay... police in novato are investigating a death that they are calling suspicious. the investigation started yesterday afternoon on holstrom circle. they have not released any other information on the victim or the investigation. they do ánot believe that there is a current threat to the community. ( darya ) and police in the south bay are investigating an armed robbery at a gas station. the thief is still on the loose. it happened the gas station on saratoga avenue and bucknell road in saratoga. police say the thief showed the clerk a gun. it is not

clear what the thief took. the person was last seen on bucknell road getting into a silver honda with no license plates. ( james ) another lawsuit has been filed against p-g- and-e in connection to the deadly north bay fire storm. the lawsuit was filed in san francisco for the family of a couple who died in the wildfire in mendocino county. the suit claims the p-g-and e failed to maintain equipment and that may have sparked the fire. so far 17 people have filed lawsuits against p-g-and-e for the fires. investigators have not determined what caused the fires. 43 people died in the fires... 23 of them were in sonoma county. ( james ) the california public utilites commission has now ordered utility companies to give special protections to customers affected by the north bay firestorm. the c-p-u-c made the orders based on recommendations developed by its staff. communication companies now have to refund their customers during the times their area was devastated by the fire. water companies have to help

report a man on campus who was not supposed to be there. police tracked the man down and found the gun in his backpack. there was no ammunition and the man was arrested and booked on charges of having a gun on school grounds. police say this case is not related to the recent shooting threats at redwood high school. ( darya ) happening now... police are looking for the man who robbed a bank in brentwood. it happened at the bank of agriculture and commerce on first street. a man walked into the bank with a gun... demanded the money and took off. he was last seen running on first street towards diablo alley. nobody was injured in the robbery. police do not have a detailed description of the thief. ( james ) san francisco... has suspended the entertainment permit of an excelsior district bar... where a deadly shooting happened in may. the suspension will last 30 days at the request of the district supervisor. la oficina...located on missions street... was the scene of a shooting that killed 30-year- old alvaro palma. security

guard david sanches ...was arrested and charged for the shooting. he is still behind bars this morning with bail set at 10 million dollars. ( james ) in the south bay... a family has filed a civil rights lawsuit against the city of santa clara after a man was shot and killed by an officer. police have released the body camera footage from the night of the shooting. it happened back on march 9th. according to the district attorney's investigation... jesus geney- montez charged toward the officer with his hand up. the d-a's office says that the officer had reason to use force. the officer originaly said that he thought that geney-montez was armed. it turned out he was not. the video also appears to show a fence between geney-montez and the officer. ( james ) the family has

also filed a lawsuit against the officer. santa clara police said they agree with the d-a's findings. back to you. ( darya ) the defense rests in the trial of the man accused of killing kate steinle in san francisco. jose garcia zarate is accused of murdering steinle along pier- 14 back in 20-15. the defense has argued that the shooting was an accident. they say the gun went off when garcia zarate picked up. the prosecution is set to call a rebuttal witness on monday. closing arguments are set for a week later on november 20th. the case will then be turned over to the jury. ( darya ) in the south bay... a group of car enthusiasts in the south bay say they are tired of the sideshows in san jose. now they are taking matters into their own hands. the group says the sideshows are making car shows harder for them.

police are looking for a group of teenagers ... who they say burglarize a home in the south bay.( james ) it happened in campbell and they were caught on camera. kron 4's haaziq madyun has the details. you are looking at surveillance video of a group of teenagers suspected of being involved in a pair of residential burglaries here on el patio court in cambell. burglaries are not unusual in the south bay town but the large number of possible suspects, seven, that is a bit of a surprise says campbell police captain gary bergsot

parts of the east bay. ( james ) two bay area colleges top the list for people who make the most money after graduation. and the top school on the list is not one that you would expect. samuel merritt university in oakland came in at number one. the study found that 10 years after graduating former students made an average of more than 106-thousand dollars. stanford came in at number 2 on the list. graduates there made just over 85-thousand dollars. also in the top 5 were two southern california schools and the california state maritime university... which is located near vallejo. santa clara university was number ten on the list. the study only included students who had federal student loans. ( darya ) the next time you go to the grocery store... make sure you wipe down the shopping cart. police say it could save your life... but it is not because of the germs. police say drugs like fentanyl an be on the cart and enter your system just by touching your hands. a

florida police department issued the warning after a 10-year-old boy in miami died after coming into contact with the drug on a shopping cart. other police departments across the country say the odds of this happening are very slim.. but it is better to be safe than sorry. ( darya ) amazon plans to sell more of its products at whole foods. the online retailer has announced it will start selling its kindles, fire tablets and other amazon products at whole foods. amazon has already been selling its voice-activated echoes there. you may remember amazon bought whole foods this summer. amazon has also been opening dozens of brick and mortar bookstores including businesses in san jose and walnut creek. ( james ) in the east bay... more schools are going to begin testing tap water for lead. schools in richmond will begin testing water next week. east bay mud spent the day yesterday testing water at schools in oakland. at least 7 schools in oakland tested positive for lead earlier this year. the school district says the problem has been fixed but they are having the water tested just to be safe. east bay mud is now offering to test the water at all school in their service area. ( james ) also in the east bay... a man died after he was found lying in the middle of the street in union city... it happened yesterday morning near the corner of allison and lisa drives. officers performed c-p-r... but the man died at the scene. police believe the victim may have been involved in a dispute with family members before they were called. police have not yet released the cause of death... and it is unknown whether foul play is involved. ( darya ) in the south

bay... a man is arrested... accused of inappropriately touching a student at san jose state university. it happened yesterday.... inside the m-l-k library. police identified the suspect as javiar coreas. the victim was not physically injured. university police are investigating the incident... and are currently any other potential victims or witnesses. ( darya ) happening now in the north bay... police in novato are investigating a death that they are calling suspicious. the investigation started yesterday afternoon on holstrom circle. they have not released any other information on the victim or the investigation. they do ánot believe that there is a current threat to the community. ( darya ) and police in the south bay are investigating an armed robbery at a gas station. the thief is still on the loose. it happened the gas station on saratoga avenue and bucknell road in saratoga. police say the thief showed the clerk a gun. it is not clear what the thief took.

the person was last seen on bucknell road getting into a silver honda with no license plates. ( james ) another lawsuit has been filed against p-g- and-e in connection to the deadly north bay fire storm. the lawsuit was filed in san francisco for the family of a couple who died in the wildfire in mendocino county. the suit claims the p-g-and e failed to maintain equipment and that may have sparked the fire. so far 17 people have filed lawsuits against p-g-and-e for the fires. investigators have not determined what caused the fires. 43 people died in the fires... 23 of them were in sonoma county. ( darya ) another big story we are following this morning... california regulators overnight adopted new safety rules for uber and lyft that will not require their drivers be fingerprinted. for students of one school that was seriously damaged by the fires. the cardinal newman high school football team is headed to the playoffs. several players on the team lost their homes in the north bay firestorm. and the school was badly damaged. on newman's campus...an enormous chain linked fence blocks out students and staff from certain parts of campus. practice now takes place at a nearby high school. students are attending classes at several other schools in the community. the time table for when these players will share classes again... is uncertain . but they're all together when it comes to football.

( james ) to bay area baseball... it was a rough year for the san francisco giants but buster posey is now the second player to be honored with an offseason award. posey was awarded his 4th silver slugger award... for being the best hitting catcher in the national league this year. the giants tweeted out this video to congratulate him. it is the second award for a giants player this year. earlier this week brandon crawford won a gold glove award. ( james ) we're learning more about the severe brain damage suffered by former new england patriots player aaron hernandez.( darya ) doctors are now saying hernandez's brain damage was the worst they'd ever seen in someone so young. they also say hernandez suffered severe damage to parts of the brain that play an important role in memory, impulse control and behavior.( james ) the researcher says she can't say whether his behavior was a result of what's known

alabama republican senate candidate roy moore pursued inappropriate relationships with them when they were teens and he was in his thirties. one of the accusers says she was just 14-years-old when moore... who was 32... initiated a sexual encounter. in a statement, moore's campaign denied the allegations. several senate republicans -- including majority leader mitch mcconnell and arizona senator john mccain -- say that moore must step aside if there is any truth to the allegations. alabama's special election to fill the senate seat vacated by atorney general jeff sessions is set for next month. rockefeller center christmas tree is headed out on a truck to the new york city.( darya ) the 75-foot, 13-ton spruce tree was chopped down yesterday moring. take a look. the giant tree was growing in a pennsylvania man's backyard. back in 2010, he found out he had a christmas gem growing in his yard.( james ) after seven years of caring for the tree it's living out its destiny. once in new york the tree will be covered with over 50- thousand multi-colored l-e-d lights. it will be officially lit on november 29th -- and stay on display until january seventh.
