( james ) bart has expanded it's carpooling program to two more stations. the scoop app will now allow carpool drivers to get guaranteed parking spots at bart's orinda and rockridge stations. the carpooling program is already operating at the concord dublin/pleasanton... pleasant hill... millbrae and san bruno stations. morning riders must be scheduled by nine p.m. the night before and by three thirty p.m. on the same day ...for evening rides.

( james ) the parents of a 10-year-old boy who was seriously injured at a dublin water park ... are seeking two and half million dollars in damages.they have filed a lawsuit against the water park owners ... and the city of dublin.the 10-year-old was injured after he was ejected from a water slide at the wave water park back in may. < as parents, we want nothing more than to watch our kids have fun and we saw jamie come down and we will never forget, we saw it happening, as it was happening i couldn't get to him fast enough. >( james ) officials with the city of dublin say they immediately closed the waterslide after the accident and that it will remain closed unitl state safety officials approve it being re-opened. ( darya ) p-g-and-e is hit with another round of lawsuits... blaming the utility for the northbay firestorm. one of the plantiffs is gregory wilson. he escaped the flames by jumping in his pool with his

wife. his house burned to the ground. wilson and his wife are one of three couples filing suit against p-g-and-e. they claim p-g-and-e put profit before public interest.... and didn't do enough to trim trees and other vegetation away from power lines. attorneys are calling for an independent audit of the utility. p-g-and-e released a statement saying... nothing is more important to us than the safety and well-being of our customers and communities we serve. ( darya ) wineries in the north bay are trying to make up losses after the wildfires. many of them are dealing with long-term effects-- including making up for the money lost from being closed at the busiest time of the year. vineyards are also assessing the impact of smoke and other damage on this year's vintage. wineries say they are now making a push to lure tourists back to sonoma, napa, and mendocino counties. together, those areas saw more than three-point-seven billion

( james ) happening now: a former tesla worker is suing the car company... calling the fremont car factory a "hotbed for racist behavior". the man who filed the suit was fired last month... the assembly line worker says supervisors and co- workers routinely used a racial slur against him and other black employees... he also says ánoá investigation was conducted, even after he made a written report to tesla human resources. the suit also claims tesla ceo wrote a memo

( james ) two women are suing uber... claiming inadequate driver background checks led to sexual assaults. the women were not identified in the federal lawsuit filed tuesday in san francisco. each victim claims... they were sexually assaulted by uber drivers.. who gave them rides home. the lawsuit says, uber markets to young women traveling alone putting its profits over their safety. the company says, it is reviewing the complaint and that the allegations will be taken seriously. homeless single adults on a permanent basis. each unit comes complete with shower... couch... kitchenette and closets. the next step would be to find a location for the units in the city of richmond. the micro-pads are stackable and can go up as high as 8- stories if necessary ( darya ) police in fremont are now cracking down on illegal sideshows. over the next couple of months they are vowing to crack down on participants... they say they will be adding more patrols... writing more citations and towing more cars. they are going to have a zero tolerance approach, not only for the drivers involved but for the spectators and event organizers as well. smart-9-1-1 is a free service that individuals can use to add specific personal information this includes information about pets in the home... special medical needs, and emergency contacts. the information provided helps first responders move quickly in an emergency situation the safety profile can link the user's cell phone to their work and home address. both san ramon and brentwood also use the smart 9-1-1 system. ( james ) the san jose police department is making big changes to their use of force policy. the new policy creates four tiers of classification. those are based on the type of force used or the resulting injury. higher categories will be scrutinized more by the department. also new --- police command staff will now review a police supervisor's report... to decide if the investigation on use of force was adequate. mayor sam liccardo says the new policies ensure that serious use of force cases get

( james ) across the country... more sexual harassment allegations are coming out. and now those allegations are extending to congress.( darya ) kron 4's washington correspondent alexandra limon explains how the bay area's own jackie spier is working to create change. during the house hearing on preventing sexual harrasment, california representative jackie speier testified about sexual harassment in congress. complaints ranged from inappropriate comments, members exposing themselves to staffers and groping women on the house floor rep. jackie speier / california (d-14th) there are two members of congress, republican and democrat right now who serve who have been subject to review. or not have been subject to review, but have engaged in sexual harassment. speier says she too was attacked in the 70's when she

( james ) three u-c-l-a basketball players are back in the u-s after being held in china, accused of shoplifting. liangelo ball, cody riley and jalen hill landed in los angeles tuesday. the three u-c-l-a basketball players were arrested in china last week. accused of stealing sunglasses from a luxury store in hangzhou. according to the commissioner of the pac-12, the three were allowed to leave after the situation was "resolved to the satisfaction of chinese authorities." u-c-l-a was in china for their season opener against georgia tech. a shooting in richmond. we first broke the story last night on the kron 4 news at 10. it happened around 7:30 last night on view drive. three other people were also injured in the shooting. there is no word on their condition this morning. the shooter is still on the loose. police have any about the gunman. ( darya ) new this morning... a sheriff's deputy involved in a shooting in the east bay. it happened at 6:00 last night but police have just released the details overnight. it happened on the 700 block of primrose lane in benicia. deputies were conducting a probation check. that is when they say 25- year-old chase wiley started shooting at the deputies. the deputies returned fire. wiley was shot and taken to a hospital. he is being charged with attempted murder. none of the deputies were ( darya ) happening now... a man hunt is underway in the south bay for a man who escaped a psychiatric hospital where he is serving a 30-year sentence for murder.( james ) will tran is here with the details.

( will ) 59-year-old randall saito escaped from a psychiatric hospital in hawaii and flew to san jose on sunday. he hasn't been seen since. saito had been in the hawaii state hospital since 1981 when he was found guilty for a brutal murder --- but acquitted for reasons of insanity. prosecutors in hawaii fear that he could commit another murder. ( will ) and this morning we have new video showing saito escaping from the facility. this is video showing him getting into a cab and heading for the airport on sunday. authorities in

hawaii say that saito would usually walk to a rehab facility near the hospital but was required to have an escort. this time he did not. back to you. ( darya ) a robbery attempt is caught on camera... at a jewelery store in pleasanton. now police are looking for the suspects. this happened at the "diamond ring company" in the stoneridge shopping center. surveillance video shows a group of at least six group of at least six people... rushing in to rob the place monday night. they used hammers to try and break open display cases full of rolex watches... but the glass was too strong. they then ran off with nothing. ( darya ) one person is dead after a head on crash along highway 12 in sonoma.

the crash happened yesterday morning just before 8 just west of agua caliente. a witness told police a truck was trying to pass several cars when they crossed over the double yellow lines and hit an oncoming car. the woman driving the other car died at the scene. a young child is in hospital. there condiditon is unknown. the man driving the truck was charged with a d-u-i. ( james ) another big story we are following this morning... we have new information about the man who shot and killed 4 people in a shooting rampage in northern california.( darya ) the gunman... identified as kevin jansen neal was killed in a shootout with police in tehama county. 10 other people were injured in the rampage including children. it all started when neal killed his neighbor and then went around town shooting and killing three other people.( james ) then he went to tehama elementary school and opened

fire injuring two students. both are expected to be okay. now we have learned that one of the women killed had gotten into a fight with neal back in january. in that incident neal stabbed the woman and robbed another woman. he was out on bail for that assault. the trial in that case was set to begin next year. and it turns out he had been the subject of a domestic violence call the day before the attack. ( james ) this morning there is a growing debate over a proposed day care facility in the east bay. it would be located on boyd road... near pleasant hill road... in pleasant hill. the planning commission held a meeting last night to hear from the community about the new school parents say they are looking forward to another option after sitting on wait lists at other schools for years. but people who live in the area say that adding the day care to an already busy street will be a safety issue. there are also concerns over increased traffic. it is not clear when the planning commission will make its final decision. people in the east bay... police in san leandro are investigating a string of car burglaries. the burglaries happened in three different neighborhoods. police did not say excatly where. a total of 12 cars were targeted. all of them had broken windows. and here is a description of a car police say is connected to the burglaries, it is described as a black honda civic with angled tail lights. it also had paper plates with the word "victory" ( darya ) bay area cities getting ready for recreational marijuana which can be sold legally beginning in january. the san jose city council passed an ordinacne yesterday that will allow dispensaries to sell pot to adults over 21.... starting january first. that ordinance only covers 16- current locations which already provide medical marijuana. and in san francisco... supevisors postponed a vote on establishing marijuana

regulations. that means -- sales of marijuana in san francisco... may not start on january first when the new state law kicks in.. ( darya ) oakland a's catcher bruce maxwell pleaded not guilty to charges of aggravated assault with a deadly weapon and disorderly conduct. maxwell was arrested in late october. he is accused of pointing a gun at a woman delivering food to his scottsdale home. the oakland a's released a statement saying,"we take this situation and ongoing investigation seriously." he was released on a $10,000 dollar bail. maxwell is scheduled to be back in court next month. ( james ) happening now... the clothing store forever 21 is investigating a possible credit card breach. the store says that credit card readers at several locations may have been compromised. they have not yet determined which stores were affected. but they say the breach happened between march and october of this year. they are warning customers to monitor their credit card and bank statements to make sure

( darya ) wineries in the north bay are trying to make up losses after the wildfires. many of them are dealing with long-term effects-- including making up for the money lost from being closed at the busiest time of the year. vineyards are also assessing the impact of smoke and other damage on this year's vintage. wineries say they are now making a push to lure tourists back to sonoma, napa, and mendocino counties. together, those areas saw more than three-point-seven billion dollars in tourism spending in 2016. the state's tourism commission says they are spending two-million dollars on an advertising campaign to encourage visitors to return. arrested... after police say he entered a high school classroom with a 13 inch machete.. it happened at natural bridges high school in santa cruz. luckily no one was hurt. police released these pictures of the suspect -- and the knife he was carrying. police say this is ánotá the first they've arrested this man because of a knife. ( james ) happening now: a former tesla worker is suing the car company... calling the fremont car factory a "hotbed for racist behavior". the man who filed the suit was fired last month... the assembly line worker says supervisors and co- workers routinely used a racial slur against him and other black employees... he also says ánoá investigation was conducted, even after he made a written report to tesla human resources. the suit also claims tesla ceo wrote a memo earlier this year urging people to be "thick-skinned" about insults if an apology is delivered. tesla has not commented on the lawsuit. ( james ) two women are suing uber... claiming inadequate driver background checks led to sexual assaults.

celebration across australia... after the nation made a major step towards legalizing same-sex marriage. the results of a national survey by the australian bureau of statistics released wednesday show that 61-percent of australians voted to allow same sex marriage....with 38-percent voting against. more than 12 million australians participated in the survey. prime minister malcolm turnbull called on lawmakers to legalize same-sex marriage before christmas. ( will ) the gunman... identified as kevin jansen neal was killed in a shootout with police in tehama county.... 30 minutes north of chico. now we are learning more about his violent criminal past. 10 other people were injured in the rampage including children. it all started when neal killed his neighbor and then went around town shooting and killing three other people. then he went to tehama elementary school and opened fire injuring two students. authorities say as sad as it was... it could have been worse had school administrators not acted quickly by locking school doors after hearing gunfire so he could not enter the school. both students expected to be okay. now we have learned that one of the women killed had gotten into a fight with neal back in january. in that incident neal stabbed

the woman and robbed another woman. he was out on bail for that assault. the trial in that case was set to begin next year. and it turns out he had been the subject of a domestic violence call the day before the attack. back to you. the victim also tells us that a bart official who responded to emergency calls said the antagonist is known to bart police. ( james ) and san jose police are recruiting more officers this year. this time last year... there were just 7 new recruits. but now san jose's police chief says two academies are underway...one class will be sworn in as officers in december .... the other will be sworn-in in april. officials believe pay hikes and better morale have led to the increase in the number of recruits. ( darya ) in the east bay... a berkeley city councilwoman says the city should be given the power to review and aprrove any surplus military hardware that the city's police department wants from the u.s. department of defense. the council woman says berkeley citizens have expressed concerns about the use of military equipment such as armored and weaponized vehicles grenade launchers and camoflaged uniforms at the local law enforcement level.
