(robin) new this morning... we are learning more about the people arrested and accused of killing a concord high school student earlier this month. we have now learned that a 5th person has been arrested fore the murder and police believe that they are also connected to another shooting back in october. lawrence janson was shot and killed outside of

olympic high school. the shooting happened just after school got out on october 6th. police have arrested five people including 20-year-old kristhiam uceda and 18- year-old bryan chachagua. the other three are all minors and police are not releasing their names. during the investigation detectives discovered that the group was also responsible for shooting a woman back in october. that woman was shot in the leg but has since recovered. (robin)(boxes)police have identified a father killed in san leandro over the weekend. his name is daniel carlos ... and police say he was trying to sell a used smartphone ... instead of meeting a buyer ... he was robbed, shot and killed. kron4's justine waldman spoke with the victims family. the family of 32 year old daniel carlos is stunned and sadden by his sudden death.sot he was the light of the family danny as those closet to his called him worked on the production line with tesla.he lived in redwood city with his wife and 5 year old daughter. his family asked we blur their

faces because they are afraid since the suspects have not been caught.neighbors knew danny as a devoted dfamily man sot it is so traumatic he was such a nice guy the alameda county sheriff's office tells kron 4 news, on saturday at 1 in the afternoon danny went with his brother to gas station in san leandro near the bayfair center - to sell a used cell phone.but the buyer shot and killed him, then drove off.sot it is sad that his brother prob watched him diethe sale happening in a public spot during the day time and was arranged through the app letgo..danny's family believes the company should do more to protect sellers from violence.letgo tells kron 4 news.."nothing will ever be more important to us than our users' trust and safety. that's why letgo includes things like user profiles, ratings, reviews and in-app messaging, which let you see who you're talking to and what

transactions to a "safe exchange zone" at a police station.the idea is that you have a built-in security blanket of law enforcement. they also say you should be wary of anyone who won't agree to meet you there. (robin) closing arguments in the trial for the murder of kate steinle continue this morning.(áááboxesááá) the prosecution told the jury, the accused -- jose garcia zarate -- went to pier- 14 and played his own secret version of russian roulette. the defense attorney called that a wild narrative ... saying, garcia zarate did not know what he found on the pier that day ... wrapped in a rag ... was a gun. when garcia zarate picked it up ... it went off. after the defense completes making its final arguments today ... the prosecution will have a chance to make a rebuttle argument. (robin) the case on the killing of kate steinle ... opened a nation-wide debate about sanctuary cities. yesterday ... a federal judge in san francisco permanently blocked president donald trump's executive order to cut money from cities that do not cooperate with u.s. immigration officials. the

lawsuits were brought by the cities of san francisco and santa clara. the judge ruled that president trump cannot set new conditions on spending approved by congress. (robin)(boxes)only on kron 4. a neighborhood in san jose on edge ... after a big fire breaks out at a homeless encampment ... right behind their homes on herald avenue. kron 4's ali reid spoke with the families who say they've had enough. live introthis latest fire was a close call. neighbors fear someone will get hurt.pkgi was really worried about my baby. we got her after 9 years of struggle and she's really precious for us.inderjeet singh , his family and neighbors are concerned about the homeless encampment behind their homes.when they closed down the jungle on story road, they went all over the city. singh says sunday night, a homeless person came banging

on his door while he was feeding his newborn baby.i tried to put water on the fence but almost like 3 sections gone.this wasn't an accident. you can see someone lighting the propane on fire. within minutes, the entire fence was blazing. everyone inside had to run out and find shelter in their vehicles.we just left and stayed in the car for about 2-3 hours. it was a scary time for us. firefighters were able to get the fire under control, but now most of the fence is gone and the singh family will have to pay out of pocket to fix it. they tell me at least half dozen other fires have happened within the last couple of months.i work at night and one time my wife called me to come home because there was a fire, so i had to run over here.neighbors tell me the land behind their homes is private property, but no one can get in touch with the

(robin)speaking of traffic this morning ... a plan to relieve commute traffic along the peninsula ... is getting closer to being a reality. cal-trans has released new details on an effort to add a travel lane and a toll lane... along highway- 101 through san mateo county. kron 4's charles clifford has details .. and reaction from commuters. well, caltrans has just released a draft environmental report on a plan to reconfigure the lanes of highway 101 in san mateo county and hopefully bring some relief to commuters.it's no secret that 101 traffic along the pennisual has gotten worse in recent years. just

ask anyone.sotit takes me like 45 minutes to get 101 san mateo to redwood city.sot bumper to bumper.sotit's really frustrating. i hate sitting in traffic.hoping to relieve the congestion, caltrans has expedited an effort to reconfigure the lanes of north and southbound 101 between the 380 interchange near sfo and matadero creek in palo alto. the plan is to add a travel lane on the far right by connecting existing access lanes and turning them into a dedicated travel lane. caltrans would also turn the far left lane into an express toll lane. between 5 am and 8 pm. drivers would have to pay variable rates to use toll lane. caltrans has said they want to add the toll lane to encourage people to carpool or ride on busses. a new toll lane would also be another step toward creating a toll lane network all across the bay area, something that has been in the works for years. monday evening in redwood city, caltrans plan was met with approval and some skepticism.soti would have to think about it but it sounds like a good idea.soti think it's a bad idea. it's overcrowded as it is now. i'm not sure what a better

solution would be but that would not be one of the solutions.soti'm old school. leave it like it is.if all goes well, caltrans will hopes to begin construction on the new lanes starting in 2019 and have them finished two years later.caltrans has also scheduled two public meetings on the plan in december. one in redwood city and another in san mateo. in san mateo county, charles clifford kron 4 news. (robin)after a plane crashed into a san jose home sunday ... people who live in the area are raising concerns for their safety. the small plane crashed into a home on evelyn avenue... after reporting engine troubles. no one on the ground was hurt... but three people in the plane were injured. this crash stirred up debate among neighbors ... about the risks of having a busy airport surrounded by housing, schools and a shopping mall.

that's a large number which shows that this does not happen that often.">(robin) reid hillview airport officials say they try to be a good neighbor ... by restricting certain flights and times.the f-a-a continues to investigate what caused the plane to crash into the home. (robin)we are learning more about a suspicious death at a best western hotel in concord. the woman who died has been identified as 24-year-old guadalupe riggi is from fresno. she was found unresponsive in a room late sunday night ... at the hotel on clayton road. police say, they found her after responding to a call reporting a physical assault. it is not clear what led to her death. police have arrested the man who called 9-1-1, but say they are still investigating his possible involvement in the death. (robin)a settlement has been reached with the families of victims in a deadly balcony collapse in berkeley. that collapse killed six people back in june of 20-15. for the second time -- the attorney for the families says

they have a partial settlement. this time it involves the apartment complex owners and property managers. lawyers say the settlement amount is confidential. earlier this year -- a settlement was reached with several companies behind the balcony's construction. however -- the victims' attorney says more work needs to be done. and says they are still fighting for changes to california's building codes and regulations. (robin) happening now... marin county is issuing a warning of possible flooding between november 30th and december 7th. the county's public works department says high tides during that week could result in flooding at the manzanita park and ride. caltrans says they may have to close the parking lot. caltrans is warning people to plan their commutes accordingly. (robin) the daly city police officer who was injured while chasing after car burglary suspects in daly city is out of the hospital. we first told you about the story yesterday on the kron 4 morning news. the officer has been identified as 29-year veteran rich woodworth.

officer woodworth had to receive several stitches after crashing his motorcycle while chasing the burglars on interstate 280. he is expected to make a full recovery. (robin)the san jose area requires the highest income in the country to buy a home... that's according to a new report by h-s-h-dot-com... take a look at the map released by the website.it shows the income needed to afford the principal, interest, tax and insurance payments on a median priced home ... with a 20-percent down payment.san jose requires a househole income of just over 216-thousand dollars. san francisco is number two requiring 171-thousand dollars..sacramento comes in, in the top 15 -- requring a household salary of 71- thousand dollars. (robin) this holiday season, the alameda county community food bank is asking that you help those less fortunate by donating.the food bank will provide 31 million meals this year.

they're able to do that because of generous donations. but its what they collect now ... for the holiday season ... that will make a big difference into next year.if you would like to help ... the food bank has donation barrels set up across alameda county. from 37 to the toll plaza. richmond bridge drive less than 20 min from the toll to 101 (robin)a big story we are following ... abouta massive bust in the hells angels motorcycle club. 11 members have been arrested and are now facing charges that include murder and sexual assault ... and most of the arrests were made here in the bay area. the investigation dates back three years ago ... and on saturday ... an army of federal state and local police descended upon 13 different locations ... to make the arrests. one location ... was the wagon wheel saloon in santa rosa.

a church in san jose is being accused of illegally dispensing marijuana. kron 4's dan kerman reports. among the 12 businesses operating out of this meridian avenue location is onac, oklevueha native america church. but the city of san jose says what goes on behind the doors of unit 9 is in fact an illegal medical marijuana dispensary. and on monday a judge ordered those who operate this place to shutdown the pot selling operation within 10 dayssot rick doyle/san jose city attorney 40-50we're not saying people cant smoke marijuana for religious reasons but you cant sell it you can distribute it like they do.rick doyle is san jose's city attorney. he says right now the city has permitted 16 pot dispensaries and this isn't one of them.sot they may call it a religious instution but it's a dispensary, we have very strict rules both land use rules and police permitting rules where you locate and how you operate and they don't meet the test.sot q-gonna be

(robin) another big story we are following this morning... months after two high profile incidents involving air canada planes... the n-t-s-b is looking into two more incidents at s-f- o where planes ácouldá have wound up on the same runway. according to a safety board report... a skywest plane in december 2016 crossed a line that it was supposed to stay behind while another plane was taking off. the report also says that a compass airlines plane in february was forced to abort a landing because a virgin america jet was lined up and waiting to take off on the same runway. air traffic controllers received a warning about the potential conflict from an automated system and were able to redirect the compass plane in time. all this comes after two air canada incidents.. these are photos from back in july - a plane almost landed on a crowded taxiway instead of a runway. in other incident -- an air canada flight did not respond to repeated requests to abort a

landing... the crew reported a radio problem after landing safely. (robin) new this morning... another mountain lion is spotted in the east bay... this time near u-c berkeley. it was seen near the lawrence berkeley national laboratory. police say it was seen near a parking lot. they believe it was looking for food. police are warning people to avoid hiking or jogging alone... especially at dusk and dawn. coming upis it a case of be careful what you wish for? the city of pittsburg, has a permit process to legally allow for the placement of clothing donation bins these are not them i'll explain in the next edition of people behaving badly

as the holiday season gets underway ... clothing donation bins have been popping up around the bay

area.they come with restrictions ... but as stanley roberts reports ... people are not following the rules. this is a clothing bin sitting in the street on el dorado drive in the city of pittsburg nats ambiance it used to sit behind amigos market on railroad ave. until recently. please allow me to explain why it's sitting on the street. but first let's look at these three bins about a mile away nats: ambiance they are sitting in the parking lot of the mi pueblo food store also on railroad ave there are clothes hanging out the bin and trash all around it in fact, in the general vicinity there is quite a large number of household goods illegally dumped within a 100 yards of the donation bins. in this case, someone removed these telephone poles just so they could dump here nats: ambiance not to mention the bins have had all the openings cut out but what really caught my attention is this notice of violation . stapled to one of the plastic donation bins in the city of pittsburg the property owner must get a permit to have any donations

bin with-in city limits and the bins cannot be made of plastic.so owners of the bins have 15 days to remove them or the city may impound the bins nats: ambiance which brings us back to this single green bin on el dorado drive you see according to the city of pittsburg; the owner went through the permit process to allow the bin. however, according to one of the workers at amigos, the bin came with an unwanted side effect illegal dumping . ok here is where it gets trickey . once you agree to have a donation bin on your property and get the permit .you also agree to keep the area clean nats: ambiance the store called the donation company to have the bin removed. but no one returned their calls . then one day the bin was dragged onto city streets where now it sits residents on el dorado watched as illegally dumped items also ended up on the street it was cleaned up about a hour before i arrived.according to the city of pittsburg, there are only 5 locations permitted to house donation bins ... i dropped by two of them . this one behind super taco is experiencing the same problems

reaction this morning ...after president trump took to twitter... calling for the n-f-l to punish raiders running back marshawn lynch... his call comes after photographs showing lynch standing during the mexican national anthem ... and sitting during the u-s national anthem .. at a game against the new england patriots in mexico city. oakland mayor libby schaaf sent out a tweet supporting marshawn lynch ... and calling out for the suspension of donald trump instead.when she stopped by the kron4 studio yesterday ... we asked her about her tweet.

(robin)(boxes)and this morning ... we also have reaction from raiders head coach jack del rio.kron 4's mark carpenter reports. monday is an off day for the players, but jack del rio addresses the media. he usually prefers to stay away from political topics, however, he couldn't avoid being asked about a developing situation between his running back and the president of the united states. earlier this morning, president trump called the move a sign of 'great disrespect! and that the nfl should suspend him for the remainder of the season.' this afternoon-coach del riosaid he didn't really want to get into the politics of it all, but he did say that his stance on the anthem hasn't changed jack del rio/raiders head coach: "i've told them how i feel. i love this country. i think it's a great honor to be able to play football, coach football for a living. my thought is that everybody should pay respect to the flag and stand at attention. that's how i feel about it. but it is america, and everybody can make their choice, and i've made that clear too. so anyway, that's that." del rio also added that he didn't want to get into the topic of whether or not lynch should be suspended. those close to lynch have come to his defenseincluding his mother and chiefs cornerback marcus peters, who said that he, marshawn and the

president should sit down to talk about this entire situation.. (robin)c-b-s has suspended television journalist charlie rose... the move comes after thirteen women came forward accusing him of sexual harassment. rose is a co- host of "60 minutes" and "c- b-s this morning." he is also the host of his own long running interview show on p-b-s. the accusations against him include inappropriate phone calls, unwanted sexual advances, and groping. the washington post first broke the news, publishing the women's stories. in a statement to the post, rose apologized. (robin) in a few years...you'll need more than your current drivers license or i-d card to get through airport security. that's because of the "real i-d" act. starting october of 20- 20... the federal government will require your drivers license or i-d card to be what's known as "real i-d"

compliant... if you want to board an airplane, enter military bases, and most federal facilities. the d-m-v will start offering applications for the "real i- d" on january 22nd. t-s-a agents will still accept passports when going through airport security. (robin) people who lost their homes in last month's wildfires will have 24 months to collect insurance payments. that's according to california's insurance commissioner-- dave jones. jones say some insurance adjusters wrongly told homeowners they have between six and 12 months. when a state of emergency is declared in california... homeowners have up to 24 months to claim those benefits. the wildfires destroyed nearly nine-thousand homes and buildings. (robin) another big story we are following this morning... president trump will ánot be getting a "thank you" from lavar ball. ball is the very outspoken father of liangelo... who was one of three u-c-l-a players accused of shoplifting in china. this all started last week... when the president questioned whether he would get any thanks for his role in the players' release. on sunday... president trump tweeted that he "should have left them in jail." now... ball is responding.. and he's minimizing president trump's involvement in the ordeal. 'n fly' lot at the airport. this will let those car sharing drivers park in any of those spaces at the airport without a fee... travelers flying out of s-f-o will also be able to reserve a 'gig' after landing at s-f-o. this comes after 'gig' debuted in april in berkeley and oakland. (robin) and uber is trying to make it easier for customers to find their drivers... the ride- sharing giant is introducing new ways to improve customer pick-ups, particularly in crowded areas. a new device called the "beacon", can be found on an uber vehicle's windshield. customers can look for their driver by selecting a color via the uber app. once a color is selected, the beacon will glow accordingly. the feature will be available in san francisco. ( terisa ) our top story this morning... a 14-year-old boy is arrested for bringing a loaded gun to an east bay school. ( james ) kron 4's lydia pantazes is live at de anza high school in richmond with the details. lydia. ( lydia )(lydia)this is where it happened at de anza high school in richmond.on thursday, a school resource officer received information that a student here may have been in possession of a loaded gun. but school had already let out for the day...(take pic)let's take a look at a map of where the school is located, on 5-thousand valley view road. the next day school staff detained the student and found the loaded handgun you see in this picture. the 357 magnum revolver was hidden inside his backpack.the student was arrested.no one was hurt and so far police haven't given a reason why the student was carrying that gun or what he intended to do with the gun.reporting live in richmond, lydia pantazes kron4 news.

( james ) new this morning... we are learning more about the gunmen accused of killing a concord high school student earlier this month. a 5th person has been arrested for the murder and police believe that they are also connected to another shooting in october. lawrence janson was shot and killed outside of olympic high school. the shooting happened just after school got out on october 6th. police have arrested five people including 20-year-old kristhiam uceda and 18- year-old bryan chachagua. the other three are all minors and police are not releasing their names. during the investigation detectives discovered that the group was also linked to a shooting a woman back in october. that woman was shot in the leg but has since recovered. ( terisa ) police have identified a father killed in san leandro over the weekend. police say daniel carlos was trying to sell a used cell phone. he met the buyer at a gas station near bayfair

mall. the buyer shot and killed him. neighbors say carlos was a devoted family man. he lived with his wife and 5-year-old daughter in redwood city. ( terisa ) daniel carlos's family has set up a "go-fund-me" page... to help with funeral costs and to care for his young daughter. meanwhile, the killer is still on the loose. ( james ) and new this morning... another warning in the east bay after a woman is robbed of her laptop while sitting at a coffee shop. it happened at the starbucks on san pablo avenue. the victim says she was working on her computer when two men came by and snatched it. they then took off a silver dodge charger that was being driven by a woman. this is just the latest in a string of laptops being stolen from coffee shops all across the east bay.

( james ) now to a story you will see only on kron 4... a neighborhood in san jose on edge this morning after a fire breaks out at a homeless encampment áright behind their homes. it happened in an alleyway on herald avenue. one home had part of its fence destroyed. it was caught on camera. people in the neighborhood say there have been at least half dozen other fires at the camp within the last couple of months. neighbors say the camp is on private property... but can not get in touch with the owner so the camp continues to grow. ( james ) happening today... the defense team for the man accused of killing kate steinle in san francisco are expected to wrap-up their closing arguments. the prosecution told the jury yesterday that jose garcia zarate went to pier 14 and played his own secret version of russian roulette. but the defense attorney says garcia zarate did not know that it was a gun wrapped in a rag when he picked it up. and that when garcia zarate picked it up ... it went off. after the defense ends its case, the prosecution will have a chance to make a rebuttle argument. in san francisco has permanently blocked president donald trump's executive order to take money from cities that do not cooperate with u-s immigration officials. the lawsuits were brought by the cities of san francisco and santa clara. the judge ruled that president trump cannot set new conditions on spending that has already been approved by congress. ( terisa ) new this morning... another mountain lion is spotted in the east bay... this time near u-c berkeley. it was seen near the lawrence berkeley national laboratory. police say it was seen near a parking lot. they believe it was looking for food. police are warning people to avoid hiking or jogging alone... especially at dusk and dawn. ( terisa ) happening now... marin county is issuing a warning of possible flooding between november 30th and december 7th. the county's public works department says high tides during that week could result in flooding at the manzanita park and ride. caltrans says they may have to close the parking lot. police officer who was injured while chasing after car burglars is out of the hospital. the officer is 29-year veteran rich woodworth. officer woodworth had to receive several stitches after crashing his motorcycle while chasing the burglars on interstate 280. he is expected to make a full recovery. the burglars were later arrested in san francisco. a new plan to try and relieve traffic congestion along the peninsula is getting closer to becoming a reality.( james ) cal-trans has released new details on an effort to add a travel lane and a toll lane along highway- 101. kron 4's charles clifford has the details. well, caltrans has just released a draft environmental report on a plan to reconfigure the lanes of highway 101 in san mateo county and hopefully bring some relief to commuters.it's no secret that 101 traffic along the pennisual has gotten worse in recent years. just ask anyone.sotit takes me like 45 minutes to get 101 san mateo to redwood city.sot bumper to bumper.sotit's really frustrating. i hate sitting in traffic.hoping to relieve the congestion, caltrans has expedited an effort to reconfigure the lanes of north and southbound 101 between the 380 interchange near sfo and matadero creek in palo alto. the plan is to add a travel lane on the far right by connecting existing access lanes and turning them into a

dedicated travel lane. caltrans would also turn the far left lane into an express toll lane. between 5 am and 8 pm. drivers would have to pay variable rates to use toll lane. caltrans has said they want to add the toll lane to encourage people to carpool or ride on busses. a new toll lane would also be another step toward creating a toll lane network all across the bay area, something that has been in the works for years. monday evening in redwood city, caltrans plan was met with approval and some skepticism.soti would have to think about it but it sounds like a good idea.soti think it's a bad idea. it's overcrowded as it is now. i'm not sure what a better solution would be but that would not be one of the solutions.soti'm old school. leave it like it is.if all goes well, caltrans will hopes to begin construction on the new lanes starting in 2019 and have them finished two years later.caltrans has also scheduled two public meetings on the plan in december. one in redwood city and another in san mateo. in san mateo county, charles clifford kron 4 news. asks for money for a loved one who they say was in an accident. police then say other scammers threaten violence against the victims. police say if you believe that you are a victim of one of these phone scams... you should give them a call. ( terisa ) happening now... a rash of robberies are being investigated in oakland. the first robbery happened early sunday morning on b street near 86th avenue. police say the thief approached a woman at gunpoint and took her purse. then on sunday evening... another armed robbery happened. this one was on macarthur boulevard near green acre road... police say the person stole money from the victim and took off. an hour and a half later... a man robbed a person on fruitvale avenue near brookdale avenue... also taking money. police say the victim suffered a minor injury and was taken to the hospital. ( will )months after two high profile incidents involving air canada planes... the n-t-s-b is looking into two more incidents at s-f-o where planes ácouldá have wound up on the same runway. according to a safety board report... a skywest plane in december 2016 crossed a line that it was supposed to stay behind while another plane was taking off. the report also says that a compass airlines plane in february was forced to abort a landing because a virgin america jet was lined up and waiting to take off on the same runway. air traffic controllers received a warning

( terisa ) in the south bay... a church in san jose is being accused of illegally dispensing marijuana. among the 12 businesses operating out of the meridian avenue location is a native america church. according to city attorney rick doyle -- the church is an illegal medical marijuana dispensary. a judge ordered the church to shutdown the pot selling operation within ten days. doyle says right now the city has permitted 16 pot dispensaries and this isn't one of them. ( terisa ) city officials say they will also be filing a lawsuit in efforts to shutdown an illegal marijuana dispensary at coachella valley church. ( james ) in the east bay... a settlement has

been reached with the families of victims in a deadly balcony collapse in berkeley. that collapse killed six people in june of 20-15. for the second time -- the attorney for the families says they have a partial settlement. this time it involves the apartment complex owners and property managers. lawyers say the settlement amount is confidential. earlier this year -- a settlement was reached with several companies behind the balcony's construction. however -- the victims' attorney says more work needs to be done. and says they are still fighting for changes to california's building codes and regulations. ( james ) this morning we know the name of the woman who died at a concord hotel. the woman has been identified as 24-year-old guadalupe riggi from fresno. she was found unresponsive in a room late sunday night ... at the hotel on clayton road. it is not clear how she died. police have arrested the man who called 9-1-1 and say they are still investigating his possible involvement in the woman's death. ( terisa ) the coast guard has called off its search for a boater who went missing near

half moon bay. a boat was reported spinning out of control just south of pillar point harbor on sunday evening. one man was found dead near the boat. a second man who is believed to be on board has still not been found. he is identified as tom tran. the boat was eventually recovered after it stopped spinning hours later. ( terisa ) people who lost their homes in last month's wildfires will have 24 months to collect insurance payments. that's according to california's insurance commissioner-- dave jones. jones say some insurance adjusters wrongly told homeowners they have between six and 12 months. when a state of emergency is declared in california... homeowners have up to 24 months to claim those benefits. the wildfires destroyed nearly nine-thousand homes and buildings. public works unveiled the new portable toilets yesterday as part of the "pit stop public toilet" program. ( james ) it's an effort to encourage people to use the bathrooms... and keep the streets of san francisco clean. it started in the tenderloin in 20-14 to help address the problem of people using sidewalks as toilets. ( terisa ) police have identified a father killed in san leandro over the weekend. police say daniel carlos was trying to sell a used cell phone. he met the buyer at a gas station near the bayfair center. the buyer shot and killed him. neighbors say carlos was a devoted family man. he lived with his wife and 5-year-old daughter in redwood city.

( terisa ) the daly city police officer who was injured while chasing after car burglars is out of the hospital. the officer is 29-year veteran rich woodworth. officer woodworth had to receive several stitches after crashing his motorcycle while chasing the burglars on interstate 280. he is expected to make a full recovery. the burglars were later arrested in san francisco. ( james ) happening today... the defense team for the man accused of killing kate steinle in san francisco are expected to wrap-up their closing arguments. the prosecution told the jury yesterday that jose garcia zarate went to pier 14 and played his own secret version of russian roulette. but the defense attorney says garcia zarate did not know that it was a gun wrapped in a

( james ) a federal judge in san francisco has permanently blocked president donald trump's executive order to take money from cities that do not cooperate with u-s immigration officials. the lawsuits were brought by the cities of san francisco and santa clara. the judge ruled that president trump cannot set new conditions on spending that has already been approved by congress. (terisa) a big story this morning... as a new plan to try and relieve traffic congestion along the peninsula is getting closer to becoming a reality. cal-trans has released new details on an effort to add a travel lane and a toll lane along highway- 101. it would reconfigure lanes of northbound and southbound 101 between the 380 interchange near sfo and matadero creek in palo alto. a dedicated travel lane

( will )months after two high profile incidents involving air canada planes... the n-t-s-b is looking into two more incidents at s-f-o where planes ácouldá have wound up on the same runway. according to a safety board report... a skywest plane in december 2016 crossed a line that it was supposed to stay behind while another plane was taking off. the report also says that a compass airlines plane in february was forced to abort a landing because a virgin america jet was lined up and waiting to take off on the same runway. air traffic controllers received a warning about the potential conflict

( james ) a big story we are following this morning. the f-b-i is going after nearly a dozen members of the hells angles motorcycle club... and most of the arrests were made here in the bay area. 11 members were arrested and are facing charges that include murder and sexual assault. the investigation started three years ago... but it all came to a head on saturday when authorities made arrests at locations including the wagon wheel saloon in santa rosa.

( terisa ) in the south bay... a church in san jose is being accused of illegally dispensing marijuana. among the 12 businesses operating out of the meridian avenue location is a native america church. according to city attorney rick doyle -- the church is an illegal medical marijuana dispensary. a judge ordered the church to shutdown

the pot selling operation within ten days. doyle says right now the city has permitted 16 pot dispensaries and this isn't one of them. ( terisa ) city officials say they will also be filing a lawsuit in efforts to shutdown an illegal marijuana dispensary at coachella valley church. ( james ) in the east bay... a settlement has been reached with the families of victims in a deadly balcony collapse in berkeley. that collapse killed six people in june of 20-15. for the second time -- the attorney for the families says they have a partial settlement. this time it involves the apartment complex owners and property managers. lawyers say the settlement amount is confidential. earlier this year -- a settlement was reached with several companies behind the balcony's

construction. however -- the victims' attorney says more work needs to be done. and says they are still fighting for changes to california's building codes and regulations. ( james ) this morning we know the name of the woman who died at a concord hotel. the woman has been identified as 24-year-old guadalupe riggi from fresno. she was found unresponsive in a room late sunday night ... at the hotel on clayton road. it is not clear how she died. police have arrested the man who called 9-1-1 and say they are still investigating his possible involvement in the woman's death. ( terisa ) the coast guard has called off its search for a boater who went missing near half moon bay. a boat was reported spinning out of control just south of pillar point harbor on sunday evening. one man was found dead near the boat. a second man who is believed to be on board has still not been found. he is identified as tom tran. the boat was eventually recovered after it stopped spinning hours later. ( terisa ) people who lost their homes in last month's wildfires will have 24

months to collect insurance payments. that's according to california's insurance commissioner-- dave jones. jones say some insurance adjusters wrongly told homeowners they have between six and 12 months. when a state of emergency is declared in california... homeowners have up to 24 months to claim those benefits. the wildfires destroyed nearly nine-thousand homes and buildings. (terisa) with the holiday season upon us ... clothing donation bins have been popping up around the bay area. they come with some restrictions ... but as stanley roberts reports ... not everyone is following the rules. this is a clothing bin sitting in the street on el dorado drive in the city of pittsburg nats ambiance it used to sit behind amigos market on railroad ave. until recently. please allow me to explain why it's sitting on the street. but first let's look at these three bins about a mile away nats: ambiance they are sitting in the parking lot of the mi pueblo food store also on railroad ave there are clothes hanging out the bin and trash all around it in fact, in the general vicinity there is quite a large number of household goods illegally

dumped within a 100 yards of the donation bins. in this case, someone removed these telephone poles just so they could dump here nats: ambiance not to mention the bins have had all the openings cut out but what really caught my attention is this notice of violation . stapled to one of the plastic donation bins in the city of pittsburg the property owner must get a permit to have any donations bin with-in city limits and the bins cannot be made of plastic.so owners of the bins have 15 days to remove them or the city may impound the bins nats: ambiance which brings us back to this single green bin on el dorado drive you see according to the city of pittsburg; the owner went through the permit process to allow the bin. however, according to one of the workers at amigos, the bin came with an unwanted side effect illegal dumping . ok here is where it gets trickey . once you agree to have a donation bin on your property and get the permit .you also agree to keep the area clean nats: ambiance the store called the donation company to have the bin removed. but no one returned their calls . then one day
