two of jose garcia zarate's family members were in the courtroom as they listened to the chief attorney of the public defender's office attempt to poke holes in the proscecutor's case. garcia zarate, seen here in an eariler court appearance is charged with murder, but they jury has the option of first degree or second degree murder, as well as involuntary manslaughter. he's also charged with being a felon in possession of a gun, and assault with the semi automatic pistol. his lawyer says garcia zarate should be found not guilty on all counts since he says the shooting of kate steinle was an accident. his theory is that garcia zarate didn't know that he was holding a gun when he found a rag covered object on the pier that day. he says the weapon went off when his client picked it up. calling the gun an accident waiting to happen,

he reminded the jury that his ballistics expert said the trigger pull on the gun stolen from the parked car of a federal agent four days before the shooting was similar to a child's water pistol when it's in what's called single action mode.he told the jury that it's not an even playing field and the law has protections in itone of them is the presumption of innocence, saying the ultimate act of kate steinle's death is awful and nothing they do is going to fix that. the public defender said he's pleased with the case his team put forward. everyone who worked on this case gave 1000%in her rebuttal argument diana garcia called the defense's theory that he found the gun fiction. and asked if the gun was so entangled in a rag, why was it never found? she also disputes that the gun would have gone of it's own, saying it needed a finger to pull the trigger, noting that the gun had been fired once four months before and had recently been inspected by a federal armorer before it was stolen.she says the accused took the life of a vibrant, young, beautiful, cherished woman and asked the jury to find garcia zarate responsible. outside the courtroom, a spokesperson for the da had this to say. make no mistake about it our office is committed to doing everything we can to bring the steinle family justice.

(grant) new tonight at five-- we are learning more about the past of the gunman who went on a shooting rampage in tehama county. sheriff's deputies responded to calls involving kevin neal 21 times in the last year. the information was just released today. the public records detail a quickly escalating feud between neal and his neighbors. the neighbors called the sheriff's department at least six times

to report that neal had been firing a gun-- sometimes at their homes and cars. five people were killed in the shooting-- including neal's wife and two neighbors. (grant) we are learning more about the gunmen accused of killing a concord high school student earlier this month. the suspects who are in custody... have now been charged with gang enhancement. detectives believe they are a part of the ms-13 gang. lawrence janson was shot and killed outside of olympic high school...just after school let out on november 6th. police have arrested five people including 20-year-old kristhiam uceda and 18- year-old bryan chachagua. the other three are all minors and police are not releasing their names. during the investigation... detectives discovered that the group was also linked to the shooting of a woman back in october at a park in concord. the five suspects in jansen's murder have been charged with attempted murder in that shooting. one additional person was also arrested in that october

(vicki) a san jose state university police officer is recovering tonight after authorities say he was punched just a few blocks from campus. it happened overnight at the campus- run hammer theatre on paseo de san antonio. there two officers responded to two disturbances involving the same group of suspects. one of the officers was " caught off-guard" by a punch from one of the suspects. police then tasered the suspect...who was arrested on suspicion of assault on a peace officer. two other suspects were also arrested...both for resisting arrest. the officer...who has more than 20 years of law enforcement experience... is being treated for minor injuries...however...he will not be on duty tonight. nabbed the driver's license numbers of 600-thousand uber drivers. the revelation marks the latest stain on uber's reputation. travis kalanick was ousted as ceo in june after an internal investigation revealed he had built a culture that allowed female workers to be sexually harassed. uber's current ceo, dara khosrowshahi, criticized the company's handling of the data theft in a blog post today... that said there's no evidence the stolen information has been misused. uber paid the hackers 100-thousand dollars to keep the hack uder wraps. the company's chief security officer and one of his deputies have been fired. there two officers responded to two disturbances involving the same group of suspects. one of the officers was " caught off-guard" by a punch from one of the suspects. police then tasered the suspect...who was arrested on suspicion of assault on a peace officer. two other suspects were also arrested...both for resisting arrest. the officer...who has more than 20 years of law enforcement experience... is being treated for minor injuries...however...he will not be on duty tonight.
