(steve) new tonight at five... jurors have still not reached a verdict in the murder trial of the man accused of killing kate steinle on a pier in san francisco two years ago. the jury wrapped up a second day of deliberations this afternoon. jose garcia zarate is charged with murder. but the jury has the option of first degree or second degree murder... as well as involuntary

manslaughter. his lawyer says garcia zarate should be found not guilty on all counts since he says the shooting of kate steinle was an accident. he argues that garcia zarate found the gun and it went off when he picked it up. the prosecutor called the defense's theory fiction and argued that the shots were fired on purpose. the jury will resume their deliberations on monday after the long thanksgiving holiday weekend. (vicki) the jury ultimately has four options in this case. they can find jose garcia zarate guilty of first degree murder, second-degree murder, or of involuntary manslaughter or they can find him not guilty. (steve) kron 4's spencer blake spoke with a defense attorney-- to explain what all of that means. jose garcia zarate could face 25 years to life if he's convicted of first degree murder, or 15 to life for second degree.but criminal defense attorney brian ford, who's been following the case, thinks either an involuntary manslaughter conviction or an acquital are more likely, because the jury has so many factual questions they have to answer amongst themselves."and

that's gonna involve answering questions such as whether he knew the gun was there; whether he knew, in fact, it was a gun; and whether or not he accidentally dropped it as is contended."keep in mind, they have to be unanimous in their decision, so ford says the jurors can throw the murder convictions out the window if they don't agree on the answers to all of those questions.this defense attorney thinks matt garcia, garcia zarate's attorney, did everything he could, and that the prosecution faces an uphill battle.ford says both sides' interpretations of the evidence shows very extreme polarity, which isn't all that uncommon."when you've got these disparate stories it absolutely i think evidences the integrity of the evidence." one thing ford thinks did a disservice to garcia zarate in this case, was the national exposure it got, even and especially as part of donald trump's presidential campaign. "when it was politicized it was about the immigration issue, and it was largely based in supporting trump's notion that immigrants are criminals or are likely to be criminals. the problem with that is that this case has nothing to do with

(steve) authorities are confirming that one of two inmates who escaped two weeks ago from a courthouse in palo alto - has been recaptured. (vicki) catherine heenan is here with the latest on the men......and the ongoing investigation. (catherine) the c-h-p arrested tramel mcclough in stockton last night...but the second man - john bivens - managed to get away.. it all played out after a car chase...when c-h-p officers tried to stop a car on northbound i-5 last night in stockton. they say mcclough eventually stopped but then ran into a walmart where he was detained. that's when bivens took the wheel of the car and escaped for a second time. as officers went after him - one of them fired at bivens. the c-h-p didn't say if he was hit... detectives had tracked the men to stockton after getting

tips. november 6th - the men managed to slip out of their restraints and run through an unmonitored door at the courthouse in palo also.. the inmate still on the run was last seen in a ford explorer.....and authorities have released this license number.the search for both men has spanned the state..... they went on the run as they were being prosecuted for the armed robbery of a sunnyvale verizon store in february.. vicki? green 1999 ford explorerlicese plate (vicki) new tonight at 5.... a teen is recovering after being stabbed at a park in san francisco. it happened near the crocker amazon playground just after 2 p-m. the 15-year old boy was kicking a ball around with friends near the corner of moscow street and france avenue. they boy went to retreive the ball that was kicked into an area where a 45-year old man was sitting. the man became angry the ball landed near him and

stabbed the teen with a pair of scissors. the suspect was arrested by police at the scene. the boy was taken to the hospital and is expected to survive (steve) three people in san leandro have a lot to be thankful for this thanksgiving... a person driving a car crashed into an amtrak train-- and walked away with only minor injuries. (vicki) it happened just before 7:00 this morning at the railroad crossing between the coliseum and hayward stations. the vehicle flew in the air and landed on another car that was parked and occupied. the force of the collision blasted car parts into the air, injuring a passerby. all three people injured were taken to the hospital as precaution. however it appears all injuries are minor. at the oakmont of villa capri senior living facility in santa rosa are suing following the north bay firestorm. they claim staff members abandoned them while the facility burned to the ground. it was located in the fountaingrove area which is one of the three neighborhoods destroyed in the tubbs fire. the families who filed the suit claim the facility claimed to facility claimed to evacuate four elderly residents between 82 and 92 years old. they say they only survived because families of other people living in the facility helped them. company says once the managment company flipped a breaker.. all residents would have electricity back. (steve) new at 5... fiat chrysler is telling owners of certain jeep models not to use the front passenger seat. that's because the airbag can come loose. the company is recalling about eight-thousand 2018 compass s-u-v's. if the passenger airbag goes off in a crash, the fasteners of the airbag could shoot off. no injuries have been reported from the problem. dealers say they will replace the airbags when parts become available. fiat chrysler says it provides loaner cars depending on the circumstances. players from detention inchina - after they shop-lifted. lavar ball - the father of one of the players - blasted president trump. suggesting he hadn't done much and that shoplifting wasn't a big deal. today president trump tweeted that shoplifting "is' a big deal, especially in china...calling lavar ball an "ungrateful fool." he also said ball was a 'poor man's version of don king.' the three u-c-la players were in china for a game this month when they were arrested... the team later said they had stolen from 'three' different stores - not just one as originally reported. vicki and steve? (vicki) ubercould now face legal claims after a data breach that saw hackers steal the personal information of over 57 million people around the world. that's according to the british law firm leigh day. they say the ride sharing company urgently needs to answer questions about it's failure to secure personal informationto report the breach to authorities... and to notify those affected.

names, email addresses, and phone numbers of millions were taken in data breach. the hackers.... also nabbed the driver's license numbers of 600-thousand uber drivers. and there are reports tonight that uber paid the hackers a 100-thousand dollar ransom to destroy the information. uber has not commented on those reports. here's something many of us will be thankful for! a new report says eating on thanksgiving will be a little cheaper this year.(vicki) the american farm bureau federation says the estimated average price of a traditional thanksgiving dinner is at a five-year low-- beating last year's price by 75-cents. (steve) it says for a group of ten, dinner will cost around $49 dollars this year.

(steve) and i'm steve aveson. kron four's rob fladeboe reports on charges leveled by a formerstudent against the all-girls catholic presentation high school in san jose. . katherine leehane/presentation high school graduate "....the administration had notice going back to the mid 1980's that the teacher who abused me was a problem....tragically i was not his first victim or his last...." 1991 presentation high school graduate kathryn leehane says she was sexually abused by a teacher in the late 1980's and that the administration failed to fully investigate.katherine leehane".....there is no indication that my report was ever acted upon or that my abuser was ever held accountably...""....when i sent my first letter reporting that he had groped me and shown me pictures of a naked woman, the administration didn't even respond..."the teacher, who is now deceased, was not named. about the same time, says lehane classmate

gymnastics doctor larry nassar pleaded guilty today to criminal sexual conduct... catherine heenan is here with more - including what some of his victims told reporters... (catherine) nassar is accused of sexually assaulting more than 120 former patients while he served as team doctor for team u-s-a, michigan state university....and a gymnastics center. today's plea deal though, focused on a few victims.in court today he said that he is "horribly sorry" and that he prays for forgiveness. nassar was the doctor for the u-s-a gymnastics team for nearly 20 years, beginning in 1996. the team fired him in the summer of 2015, today -

a new report by a bay area law firm points to what it saysare the most dangerous intersections for pedestrians in san francisco... catherine heenan is here with some of the findings - and the numbers. 'lot'of pedestrian injuries and deaths.. and they break down what's described as the most dangerous intersections. the top five - market and 5th streets... 7th and market... third and market.. 6th and market.. and 16th and mission street... the law firm and a local data visualization firm created maps showing hot spots... obviously many of them ---- clustered on and around market street.. they show 63 high risk spots in all. from 20-10 to 2016, there were more than 58- hundred pedestrian collisions in san francisco...leaving 130 dead and more than 6-thousand injured. and there's even a breakdown of neighborhoods..in the same time frame - from 2010 to 20-16 - there have been 376 pedestrian collisions inthe tenderloin.. 614 in the soma area.. and 407 in the mission district.
