bridge. happening today... the jury will resume deliberations in the murder trial for the man accused of killing kate steinle in san francisco. jurors wrapped up deliberations on wednesday before taking a break for the holidays. jose garcia zarate is charged for the murder. the jury could convict hom of first or second degree murder ... as well as involuntary manslaughter. the defense attorney for garcia- zarate says he should be found not guilty on all counts. he argued during the trial that the shooting was an accident. the prosecutor called the defense's theory fiction ... and argued that the shots were fired on purpose. some deadly crashes to tell you about this morning ... first ... a child died in a crash on eastbound 80 in emeryville. police say a green ford pickup lost control on the berkeley curve just west of the emeryville exit shortly before 10 yesterday morning. the pick-up spun

out and came to a stop... blocking a lane. a white ford s-u-v then lost control and collided with the pick-up. the crash killed one of the passengers, who is a minor, in the s-u-v. the victims name and age have not been released. and at least one person died after a car rolled over along a highway in marin county. it happened around 9-30 yesterday morning on southbound 101 near spencer avenue.this is a picture of the crash. officers have not said how many people or cars were involved in the crash. one person died in a car crash in mountain view. it happened yesterday along highway 101 near the ellis street off-ramp. c-h-p says a car cut off a black honda. the driver of the black honda lost control of his car ... then hit a fence and rolled over. c-h-p says drugs and alcohol are not a factor in the crash. officers with the california highway patrol have arrested a suspected drunk driver that caused a wreck that killed four people over

the weekend. this was what that accident scene looked like in san pablo saturday night along i-80. sacramento resident and 47-year old fred lowe is the man who was arrested in connection with the hit and run. he is in the contra costa county jail this morning. the accident left four people dead and sent six others to the hospital. none of the victims have been identified. officers say lowe was driving on a suspended license. he faces felony charges. a man is dead after his van plunged off the street into the waters of the oakland estuary. the victim has been identified as 68-year-old paul scherer from alameda. kron 4's camila bernal has more for us this morning. witnesses told authorities they saw a car driving on derby boulevard and into the water2:24:20 the vehicle started floating north into the estuary, came in contact with a boat at a dock, became inverted and pretty quickly ended up sinking out of sight

rescue swimmers arrived to the estuary between alameda and oakland just before 8:30 on sunday but it was difficult to find the car2:25:13:12 the vehicle was located in about 30 feet of water, underwater, zero visibility on the estuary so everything is by touch down there you can't see anything they used sonar devices and magnets to try to find the car but eventually had to request the help of different dive teams from around the bay area 2:31:26 we took our best shot at it and it happened the very first dive we found the car then it became about getting the man out of the car and out of the water2:25:59 the victim was brought back to the shoreline and resuscitation was immediately startedthe man was taken to the hospital and now oakland police is investigating why and how this happened.in oakland, camila bernal kron 4 news. the second of two santa clara county fugitives is

back in custody. john bivins and tramel mcclough (mc- cloo) escaped almost three weeks ago while at court in palo alto. police arrested mcclough last tuesday, but bivins got away a second time. kron four's spencer blake has more on where u-s marshals were finally able to capture bivins. an undercover operation by u-s marshals at fairmont inn in san leandro finally put john bivins back into custody three weeks after he slipped out of the palo alto courthouse.the lease owner here didn't want to talk on camera, but told me somebody áother than bivins checked into room 204 saturday afternoon.marshals must have been keeping tabs on that person, because they came to the motel a few hours later asking about him.marshals spent the night in two other rooms as lookouts, keeping watch for any sign of bivins. "people over there told me, 'oh, there's two cops outside,' and i was like, 'okay,' and then i came back and i realized there was one in my parking lot but they were undercover."then, sunday morning, they saw bivins leave the motel room, and ordered him to surrender.he didn't come willingly, but marshals

managed to force him into compliance."when someone told me that it was the dude that escaped from jail i was like, 'oooh, wow! i wonder how he got caught.'"this arrest was five days after bivins' original co-conspirator, tramel mc-cloo, got picked up at a walmart over in stockton. bivins was there, too, but managed to get away, trying to run over two law enforcement officers while doing so.u-s marshals and the santa clara county sheriff's office had been working together around the clock, even over thanksgiving, keeping tabs on bivins.sunday afternoon a tow truck picked up the car that had been left at room 204."he wasn't harassing nobody and the dude kept to himself so i didn't know nothing of it." marshals say bivins is getting treated at a hospital for injuries, and once he's out, they'll take him back to santa clara county.(reporter)the santa clara county sheriff says she's grateful for the continued interagency collaboration, citing unwavering determination by her deputies and by u-s marshalsfor recapturing bivins and mc-cloo.in san leandro, spencer blake, kron four news.

federal officials are investating a package that exploded at an alameda home. it happened friday at a home on bay farms island. the a-t-f and the bomb squad responded to the explosion. postal officials say the package was sent to the home through the u-s postal service. according to authorities... this is a federal offense. authorites and postal service officials have not released any futher information. sparks were flying in oakland at the coliseum ... as the raiders were taking on the rival broncos. a fight in the first quarter of play led to three ejections.(áááboxesááá) raiders wide receiver michael crabtree and broncos cornerback aqib talib got into a scuffle. it started as crabtree was blocking talib during a running play but kept holding on after the play was over. you can see the two go into the broncos bench area after the play. on the

possession prior to this ... the broncos other cornerback chris harris was helped off the field after a confrontation with crabtree. there was yelling as if crabtree had hit him in the groin. it appears talib ripped off the necklace that crabtree was wearing and that's what led to this scuffle. even punches were thrown at one point. crabtree and talib came close to a fight in two games last year. both were yesterday another player official. coming up on the kron 4 coming up on the kron 4 morning news ... a young boy in central california dies in a freak accident while sleeping in his bed. we'll tell you what happened. and everyone's a little competitive when it comes to holiday shopping, but some get a little too edgy. we'll show you on people behaving badly. and a man bit by a shark in monterey county is undergoing surgery today. hear about the moments leading up the attack after the break.

county. the fire broke out around 6:30 yesterday morning ... at an apartment complex in the town of ceres. many of the residents say it started outside ... but it quickly engulfed the complex.on neighbor says he raced from his home nearby... making sure everyone made it out safely. four people were trapped in the apartment... but were all rescued. the cause of the fire is still under investigation. sonoma county fire victims can now get free passes to ride the smart train. the tickets come in two forms ... one for individuals and one for businesses. people who lost their home or rental in the fire are eligible for an individual pass. the individual relief passes will be loaded on clipper cards and will allow individuals to ride an unlimited number of times for free. each business relief pass is good for a free

one-way trip. the passes are good until december 31st. a 11-year old boy died after a truck crashed into his house. on saturday morning in madera, the truck driven by a 36-year old man lost control. the truck then hit a propane tank which launched the truck into the room where two boys were sleeping. and landed on their bunk bed. the 11-year old boy was pinned under the truck. witnesses describe the chaotic scene of trying to free the trapped kids. a 9 year old boy was rescued by the fire department. chp says the driver had a medical emergency causing him to lose control. he also died in the accident. happening today ... a man attacked by a great white shark in pebble beach isgoing into surgery.he's expected to

make a full recovery. reporter christopher salas spoke to his father .... who was there when the shark attacked. this is video friday afternoon just moments after grigor azatian was bitten by a shark while spearfishing with his father.friday night at natividad medical center, grigors father described the moments leading up to the attack.armen azatian: "he jumped to the boat grabbed his spear gun, went down and saw the shark. great white. from his description it was about 15 feet."then that shark attacked.armen azatian: "it was actually two or three bites. not just once."grigor somehow managed to get free and swim to the boat with his father.armen azatian: "in that moment it was just shock for me. it was a horrifying scene. my thought was just to try and help him to stop the bleeding." in a moment that would send many into shock.. armen says his son was amazingly calm under pressure. armen azatian: "i don't know, to be honest, it was so difficult for me to even

imagine because the damage... the scale of the damage, if they would see that, i would say a lot of people they would just faint."once on shore...luckily two off-duty sheriff's deputies were on the scene to assist with the wounds."there were in the right place at the right time." this is arial footage from the monterey county sheriff's helicopter arriving on scene.. he would then be rushed by ambulance t o natividad medical center. armen azatian: "it was probably the longest waiting time of my life." doctors not only stabilized grigor.. but they believe he'll make a full recovery. armen azatian: "big artery, i talked to the surgeon, is not damaged, big nerves are not damaged but there's massive damage to the muscle. so it's going to be a long recovery." cyber monday shopping is expected to hit a new record for a sixth year in a row. shoppers are expected to spend as much as six-point-six

a warning this morning if you ride bart. four people's cellphones were stolen in separate incidents and one man was knocked to the floor of a train in an attempted theft. police say the thief tried to steal a person's phone at fruitvalle station saturday and that victim was knocked to the floor during the robbery. a victim's cellphone was snatched at the union city station. a man's cellphone was taken while walking up the steps of the 16th street station in san francisco. and at the coliseum station police say a large group of teens stole cellphones from two people. a 14-year-old was arrested in that incident. the other attackers are still on the loose. seven teenagers were injured in a single car crash in redwood city. three of them - who were not wearing

seatbelts - were ejected from the car... including a 15-year old who was riding in the trunk. it happened saturday night. c-h-p says the teens were in a toyota 4 runner when the driver lost control and overturned on eastbound highway 92 at de anza boulevard. the driver suffered minor injuries... and the rest of the teens have major injuries. in the north bay... at least one person is dead after a car crash in napa county. the crash was reported at around 3:45 saturday afternoon on spring mountain road just outside of saint helena. the c-h-p says a subaru hit a guard rail. police have not released the cause of the crash or the name of the person killed. over the weekend, shoppers visited local mom and pop stores to lend support to small businesses. and it was very important for stores in sonoma and napa that were affected by the recent fires. kron 4's camila bernal has the story. pkg:heidi geffen has owned this store in the sonoma square for more than a decade and as the fires spread

( james ) officers with the california highway patrol have arrested a suspected drunk driver who caused a wreck that killed four people saturday night in the east bay. this is video of the scene in san pablo saturday night along i-80. sacramento resident fred lowe was arrested in connection with the hit- and-run. he is in the contra costa county jail this morning. the accident left four people dead and sent six others to the hospital. officers say lowe was driving on a suspended license. ( james ) in the east bay... federal officials are investigating a package that exploded at an alameda home. it happened at a home on bay farms island. the a-t-f and the bomb squad responded to the explosion. postal officials say the package was sent to the home through the u-s postal service. that is a federal offense. authorities have not said where the package came from. ( james ) a warning this morning for drivers in the east bay.after recent carjackings in oakland. friday morning police say a

man had his car stolen by three people on acalanes drive. all three of the carjackers were arrested. then yesterday morning officers say two people robbed a man at knifepoint on grand avenue. they took his money and his car. the victim was not injured. the thieves are still on ( darya ) another side show in the east bay... this time in emeryville. it happened early yesterday morning on 40th street... in the target parking lot. officers spotted over 100 cars and 500 people. police say there was a hit-and-run on shellmond street related to the sideshow. no arrest have been made. ( darya ) now to bay area football... sparks were flying in oakland at the coliseum ... as the raiders were taking on the rival broncos. ( james ) a fight in the first quarter led to three ejections. raiders wide receiver michael crabtree and broncos cornerback aqib talib got into a scuffle. it started as

crabtree was blocking talib during a running play but kept holding on after the play was over. you can see the two go into the broncos bench area after the play. there was yelling as if crabtree had hit him in the groin. it appears talib ripped off the necklace that crabtree was wearing and that's what led to this scuffle. punches were even thrown at one point. in the end crabtree and talib were both ejected along with raiders guard gabe jackson. jackson was ejected for pushing an official. here is what head coach jack del rio had to say about the fight after the game. ( james ) the raiders went on to win the game by a final of 21 to 14. oakland will host the new york giants next sunday. kick off is set for 1:25 at the coliseum.

were injured in a single car crash in redwood city. three of them - who were not wearing seatbelts - were ejected from the car... including a 15-year old who was riding in the trunk. it happened saturday night. c-h-p says the teens were in a toyota 4 runner when the driver lost control and overturned on eastbound highway 92 at de anza boulevard. the driver suffered minor injuries... and the rest of the teens have major injuries. ( james ) in the north bay... a man is accused of kidnapping and assaulting a woman in a petaluma shopping center. it started as a reported kidnapping in a parking lot on north mcdowell boulevard and old redwood highway. moments later... the victim called 9-1-1 from a house on western avenue... about 5 miles away. police say that's where accused kidnapperr benjiman sher... crashed his car into a tree...

( darya ) happening today... a jury will resume deliberations in the murder trial for the man accused of killing kate steinle in san francisco. jurors wrapped up deliberations on wednesday before taking a break for thanksgiving. jose garcia zarate is charged for the murder. the jury could convict hom of first or second degree murder ... as well as involuntary manslaughter. the defense attorney for garcia- zarate says he should be found not guilty on all counts. he argued during the trial that the shooting was an accident. the prosecutor called the defense's theory fiction ... and argued that the shots were fired on purpose. ( darya ) a man is dead after his van fell into the waters of the oakland estuary. the victim has been identified as 68-year-old paul scherer from alameda. rescue crews got to the estuary -- between alameda and oakland -- sunday morning. but they had a tough time

bivins. an undercover operation by u-s marshals at fairmont inn in san leandro finally put john bivins back into custody three weeks after he slipped out of the palo alto courthouse.the lease owner here didn't want to talk on camera, but told me somebody áother than bivins checked into room 204 saturday afternoon.marshals must have been keeping tabs on that person, because they came to the motel a few hours later asking about him.marshals spent the night in two other rooms as lookouts, keeping watch for any sign of bivins. ( james ) a warning this morning if you ride bart. four people's cellphones were stolen in separate incidents and one man was knocked to the floor of a train in an attempted theft. police say the thief tried to steal a person's phone at fruitvalle station saturday and that victim was knocked to the floor during the robbery. a victim's cellphone was snatched at the union city station. a man's cellphone was taken while walking up the steps of the 16th street station in san francisco. and at the coliseum station police say a large group of teens stole cellphones from two people. a 14-year-old was arrested in that incident. the other attackers are still on the loose. ( james ) in the east bay... police are searching for a man who punched a bart passenger in the head and stole his wallet in oakland. it happened at the fruitvale station. police say the victim was trying to pay for his ridewhen the man punched him in the head and snatched his wallet. the thief then ran from the station with a pitbull. ( darya ) seven teenagers

were injured in a single car crash in redwood city. three of them - who were not wearing seatbelts - were ejected from the car... including a 15-year old who was riding in the trunk. it happened saturday night. c-h-p says the teens were in a toyota 4 runner when the driver lost control and overturned on eastbound highway 92 at de anza boulevard. the driver suffered minor injuries... and the rest of the teens have major injuries. ( darya ) in the south bay... an elderly woman was killed in a collision in santa clara. it happened at the intersection of the lawrence expressway and monroe street. officers found an 89- year-old woman at the crash. she died at the hospital. police say the driver of one of the three cars involved in the collision was under the

influence alcohol he was arrested on suspicion of manslaughter and d-u-i. ( james ) in the north bay... a man is accused of kidnapping and assaulting a woman in a petaluma shopping center. it started as a reported kidnapping in a parking lot on north mcdowell boulevard and old redwood highway. moments later... the victim called 9-1-1 from a house on western avenue... about 5 miles away. police say that's where accused kidnapperr benjiman sher... crashed his car into a tree... allowing the victim to get away. sher was found a short time later near helen putnam park. he was booked into jail. ( james ) happening now...two thieves who stole dozens of thermostats from a hardware store are on the loose. it happened early saturday morning on the 700-block of dubuque avenue in south san francisco. the thieves forced their way into the store... took the thermostats and got away in a in a white 4-door car that may have been a dodge intrepid.
