reading, not guilty of murder in the first-degree murder. not guilty sec degree. not guilty involuntary manslaughter. not guilty in a semiautomatic weapon the one charge he was guilty of being in possession of a firearm. that is because of his re- entries into the united states without documentation. now, i will tell you this jury has been deliberating for six days now. i would say they came to this verdict under 30 hours. there was a lot of speculation in the hallway that they were g this was a unanimous decision by the jury. they declined -- both sides in the courtroom declined to poll them. we're waiting to see if in a of those jury members will be interested to speak to the media to tell us what it was that may have changed their mind or turned the tides to bring this verdict the way it

came out. now, we do know today, one thing that happened is that the jury requested to see the gun in this case, a sig sauer. this is one of the items -- points in the trial that was a point of contention. there was conflicting testimony from witnesses on both sides. the prosecutor saying it was a reliable handgun and stolen days before the killing. the prosecutor said this brand was reliable which is why it was a backup weapon. the officer in question kept it on his chest. she said this is not a gun that would go off with a hair pull trigger. it had been inspected recently by a federal armor before this happened, but the defense

attorney matt gonzalez argued that this was a very light trigger pull when it was in the single action mode and it had an equivalent trigger pull, that of a child's water pistol, so we understand that one of the things the jury did today was test the trigger on that gun so that may be one of the things that clinched this decision for them today. again, after six days of deliberation, and under 30 hours, so we know that at this point the one charge that garcia zarate has been found guilty of, the minimum sentence on that is six months and the maximum would be three years. now he has served two years in jail because while waiting for trial, so it is possible that he has already served his time and could be released and given time served but we do know in

this case, the federal government has issued a federal criminal warrant for him so he will be turned over to the u.s. marshal once he is released from custody here. i have been told by the sheriff's department that crim hall warrant signed by a federal judge will mean they could turn him over to the federal government and still be within the sanctuary city guidelines. back to you in the studio. bottom line, effectively the defense did a good job in arguing. this was a freak accident. the fact that the bullet rick shared before hitting kate steinle in the back, that played into the hands of the defense. >> reporter: absolutely. i talked to the defense attorney earlier this week who said that rick shea, the fact the bullet hit the ground on pier 13 and then about 12 feet in front of where he had been sitting and flew over 70 feet

before hitting her in the back had doubt written all over it. the expert witnesses said it was miss shape pebbed after hitting the concrete and the fact it hit kate steinle was basically a random act. >> reporter: no motive right n that was another big issue here, we think? >> reporter: absolutely. they have no connection between these two people. jose garcia-zarate a homeless man sitting on a bench on pier 14. he had no connection to kate steinle whatsoever. she was just on the pier with her father and a family friend walking along that day just minding their own business taking in the view with so many other people. i think this is one of the reasons why this case because it really captured the national attention because it could have been anyone walking on the pier that day. now that was the one thing the defense attorney kept hammering home, there was no motive here

which stripped away premeditation in his eyes and that he said this case really should never have been charged, that it was an accident. the other thing at the really probably hampered the prosecutor, no one saw him pull that trigger. no one saw that gun go off. people-- witnesses saw him before the shooting, spinning around in the chair and laughing some said. people said they saw him after the fact walking away from the scene, some saying he hurry the. some say he ran. it was obvious to them that he was leaving the scene in a hurry. everyone else was rushing into help. his lawyer has always -- the defense has been that that gun, he found that gun wrapped in a rag on the pier that day. he picked it up and it went off when he picked it up and it was an accident and that he threw it into the water, because he wanted it to go off or to stop

firing i should say, so his -- this is obviously a story that the jury believed he painted a picture of a homeless man who had nothing but cracker crumbs and cigarette butts in his pocket, just the kind of person who might scavage along the pier looking for things of value. that is the story he told. coun tirr that with what the prosecutor has been saying that garcia zarate was going there to intentionally shoot that gun, that she believed he smuggled the gun onto the pier in his clothing. that no one saw it because he was keeping it hidden. she referred to it as his secret power. her theory was he was playing a secret game of russian roulette but obviously the jury didn't buy that. they really went with what the narrative that matt gonzalez was painting. so just to clarify for people, the jury obviously,

they had several options here on the verdict. >> reporter: absolutely. so they had three options for count one. they had the option of murder in the first-degree, that it was premeditated or murder in the second degree, that there may have been malice or intention to kill someone, and then there was the involuntary manslaughter, just negligence of holding a loaded gun or playing with a loaded gun on a pier full of people would have come to harm. but the jury, they didn't see it that way and so they voted not guilty on all three of those counts. >> maureen, i know you have been in the courtroom throughout this process. for a second i will ask you to take off your reporter hat and pretend you were a member of the jury. how would you have seen this case? do you buy the fact that garcia zarate didn't shoot the gun

intentionally? do you buy the fact he should get off on all murder charges? >> reporter: so i didn't cover this gavel to gavel so i didn't hear every single day of testimony. i wasn't there, but i felt that matt gonzalez painted a very believable narrative of that homeless man who might have just been wandering around. he didn't know this woman. he saw this gun on the ground. he might have picked it up. that-- other than what the prosecutor was saying of somebody going in looking to basically kill someone, there was no motive and no one saw the shooting take place. now, earlier today we have matt gonzalez reacting right after the court let out and let's hear what he had to say. for those who might criticize this verdict, there are a number of people who have

commented on this case in the last couple of years, the attorney general of the united states, the president and vice president of the united states, and let me just remind them that they are themselves under investigation by special prosecutor in washington, d.c. and they may themselves soon a veil themselves of the presumption of innocence and beyond a reasonable doubt of standard and i want them to reflect on that before they disparage something in this case. >> reporter: obviously he is referring to the fact the president has made this an issue. he made this an issue during his presidential campaign after he became a president, he tried to punish san francisco for being a sanctuary city. this whole case capped off a firestorm of discussion over illegal immigration, so

obviously this will continue to play out in the days ahead. >> i know politics politics not allowed to be brought up during the trial. >> it was not discussed whatsoever. it was not brought up by the prosecutor any of the days i was there. matt gonzalez may have mentioned it one or two times about how his client had been released from jail without anything in his pockets but no one mentioned sanctuary city. i never heard anyone discuss the fact that he had basically immigrated to this country illegally five times by the time of the killing and they were looking to deport him for a sixth time. it was -- that was never what the prosecutor said the case was about. he said time and time again that that was not part of this

case, it was only about that they believe jose garcia- zarate's intentions to pull that trigger. >> any sign of people outside the courtroom protesting or folks upset at this decision? >> reporter: no. i didn't see anyone. there was -- the only real reaction i saw was matt gonzalez, the defense attorney smiling once that not guilty on second-degree murder was read and his client, i thought, looked sort of shellshocked a little bit. he hasn't been reacting much during this trial at all. i was expecting a smile of relief. today was the first day i noticed him looking nervous at all. he has been very mild mannered would be the best way to describe it looking around the courtroom with a very benign expression. today he looked tense, it seemed like he was a little maybe even jittery as it were,

the man accused of killing four family members, including the father and son of a cal baseball player in a dui accident over the thanksgiving holiday hid behind a glass wall as he faced a judge. contra costa county -contra costa deputy district attorney derek butts - on this case last saturday when these four family members, daryl horn, son, joe horn and troy and baden biddle died - when prosecutors say fred lowe driving under the influence crashed into the white nissan they were traveling in and sent it careening out of control - eventually landing upside down. butts. mr. lowe is facing four counts of murder, dui, causing ingury with 2 priors, fleeing the scene of an accident. prosecutor butts revealed lowe has 2 prior dui's from 2011 and 2012, plus on 5 separate occasions, his license had been suspended.butts. he had recently been told not to drive back in august.lowe, whose picture has not been released - now faces a 4.2 million dollar bail. video from vigil -this is video shared with kron four news of a recent candle light vigil for the horn and biddle family. friends gathered at a nearby park and walked to sing in front of the horn's napa home. the biddle's - from washington are family members. the crash occurred after the two families played in a father and son basketball game. jerod horn was driving when lowe struck him, spinning the car and sending it over the concrete divider. jerod is a pitcher at cal, he was injured, but released from the hospital. (grant) happening now--- police are looking for more victims after a san bruno school employee is arrested for inappropriate contact with children. kron 4's will tran has the details. parents dropping off their kids at parkside intermediate made sure to first to tell their kids to be careful after learning that an after school program employee was arrested at his millbrae home on tuesday night(debbie germenis/mom-i told her about it and she always walks from school with friends so, i told her to be aware(reporter- but she doesn't know this man?)(no she doesn't)san bruno arrested 25 year old anthony pellouchoud.. accusing him of inappropriate contact with a 12 year old girl.very scary for the childrenssan bruno

(grant) democratic congressman john conyers, who is under fire for accusations of sexual harassment, is in the hospital. and it's reportedly because of stress. the 88-year old is the longest current serving member in the house. the house ethics committee announced last week it has opened an investigation into allegations against conyers after buzzfeed reported that he settled a wrongful dismissal complaint in 20-15...when he was accused of sexually harassing a staffer. conyers denied wrongdoing in that case. ( grant ) and house minority leader nancy pelosi is now asking for conyers to resign. this is the first time pelosi has asked anyone to do this. several women have come forward accusing the congressman of sexual harassment. congressman conyers has denied the allegations. but says he is reaching a settlement in one of those cases.

( catherine ) another woman is coming forward accusing senator al franken of sexual harassment. an army veteran who says he touched her inappropriately. she's been identified as 41- year-old stephanie kemplin of ohio. kemplin says she met the senator when he was on a u-s-o tour in december of 2003. she says she posed alongside him for a photo....and he groped her breast. kemplin is the fifth woman within the last two weeks to accuse franken of sexual harassment.

(grant) during the campaign...president trump repeadetly referenced the kate steinle killing when building his case for wiping out sanctuary cities like san franicsco. garcia zarate had been deported... back to mexico... five times. before the shooting...offic ials in san francisco released him from custody instead of turning him over to immigration authorities. president trump used steinle's death to help build a case for building a border wall along the mexican border. mister trump also mentioned steinle in his acceptance speech after winning the republican presidential nomination. and during a speech on immigration during the campaign...president trump said he will pass a bill called "kate's law." that bill would have harsher penalities for people who are repeatedly caught entering the u-s illegally .

(pam) in the east bay police are looking for three suspects in connection with a piedmont home invasion. the scene.. caputured on video surveillance cameras. it happened october 10th at a home on oakland avenue. one of the homeowners was approached by an armed suspect .. who snatched his cellphone. two additional suspects entered the home and confronted the other homeowner at gunpoint and demanded valuables. both victims sustained minor injuries but will be ok. the suspects

(steve) a homeowners packages were returned to them after being stolen from outside their home in castro valley. this came less than a week after cyber monday...as we are already seeing an increase in package thefts across the bay area. this is video courtesy of castro valley news. you can see a group teenagers caught on surveillance camera...accused of stealing more than 300 dollars worth of packages. the homeowner even had a sign saying their home was protected by surveillance. a castro valley high school resource officer recognized the teens...and this led to the recovery of the stolen packages. and we also told you yesterday about a package theft in hayward that a viewer told us about. you can report any crime in your neighborhood to us using the kron four mobile app and the report it button. libby schaaf has announced the city's first "tuff shed shelters" .... designed to help provide housing to the homeless. about twenty sheds are expected to provide temporary housing to forty people. the site is located at 6th and castro streets ... just beneath the interstate- 880 and - 980 split. it will have twenty -four hour security. the oakland builders alliance paved and prepared the site for free. earlier today, the mayor discussed the benefits of having the site. the oakland city alliance donated the sheds after raising money toward the effort. let's take a look outside right now...(pam) chief

to complete its draining system by the end of the year. water officials met today to provide an update on the emergency recovery project. this is video of some of the construction going on at the nation's tallest dam. water officials say they are expecting to finish part of the underground wall by january of 20-18. earlier this week we told you about cracks appearing in the new concrete spillway on the dam. crews say those cracks were anticipated. the spillway failed last winter forcing the evacuation of nearly 200- thousand people. (steve) in san jose... 11 kids have been arrested after a violent crime spree. all of them are between 11 and 17 years old. and police say the group could be responsible for more than a dozen crimes. the first incident happened last friday. a woman was carjacked and beaten. four of the kids were arrested for that crime including three girls ages 13 to 14. then on saturday morning... another driver was carjacked at gunpoint. six boys and girls between the ages of 13 and 15 were
