(catherine) bad news today for the oakland a's. their hopes of building a new stadium in oakland at the peralta site have been refused - at leastfor now... the announcement was made early today by the board of trustees. kron4's haaziq madyun has the story.. haaziq on camcutting off talks for a proposed new oakland a's baseball ball stadium. that is the word here from the chancellor of the peralta community college districtsot but it is a response to this september 12th letter from the oakland a's organization to chancellor jowel lagurre stating the team's desire to build a new stadium on the peralta community colleges site. on tuesday the peralta college board of trustees came to a decision not to move forward with the new ballpark proposal sot

kardashian to elvis.(catherine) tonight - it's the latest battleground in southern california's desperate fight against a string of wildfires. steve aveson is in the newsroom with the situation as it stands now. steve? (steve) they are calling it the skirball fire, and it broke out before dawn in the hills near bel air. firefighters were already struggling to contain the thomas, rye and creek wildfires.none of them is even close to being controlled. a wall of flames along the 405 freeway closed one of l=a's busiest commute routes for hoursthe fire broke out near the getty center, home of some of the world's art treasures. it was surrounded by smoke.not far away, the flames devoured huge hilltop villas.natfrom the air and on the ground, fire crews struggled in vain to save homes... as the flames kept coming.natfrom above, you can see the challenge ... the fire line extends for mile after mile.buckets of water rained down from helicopters.

today...the two defendents in the ghost ship fire case...heard some of the evidence being used against them...in day one of the preliminary hearing. (catherine) derick al- menna and max harris face 36 counts of manslaughter in the deadly fire at the oakland warehouse. as kron four's terisa estacio reports, the first person on the stand today talked about seeing the flames erupt inside the ghost ship that fatal night. this is aaron marin entering into an alameda county courtroom to take the stand as the first witness in the preliminary hearing against derick almena and max harris - the two defendents charged in the ghost ship fire on 36 counts of involuntary manslaughter. marin also testified that earlier before the party started on dec. 2 2016 - dj's had put up equipment including a big bubbly contraption that was used to show video during the music party. that contraption - he said blocked the staircase and when the flames intensified, it

prevented party goers from escaping down the stairwell. some family members of those who lost loved ones fought back tears during marin's testimony. defense attorney tony serra outside of court says the prosecutors' witness helps their case - that their clients are not guilty in causing the deaths of all of the victims. tony serra, atty for derick almena. "the testimony was about that bubbly thing that was in the way and that had nothing to do with my client or the co-defendant. tyler smith. how do you think the case is going? we are pleased so far. however, after the lunch break, maran went back on the stand and changed course, saying instead the bubbly contraption was further away from the stairs then he initially stated. (catherine) the m-t-a has approved a demand-based parking plan in san francisco. it means drivers will see parking rates go up in some of the city's busiest areas. (grant) the program will use "smart meters" to regularly adjust the parking price based on demand. transportation officials say this will reduce the time people spend looking for parking... by opening up more spots. the new program takes effect next month in different parts of the city. train is about to get more expensive. fares will go up by two -point- seven percent starting january first. (grant) that also includes discounted fares. the minimum fare will increase by two- dollars for adults, one- dollar for children and 75- cents for seniors and disabled clipper users. this is a standard inflation- based increase that was re- authorized by bart's board of directors in 20-13. they're also increasing the age for a youth discount to 18. before dawn today in sepulveda pass, a major commuter route between the west side of l-a and the san fernando valley to the north. the fire burned up hillsides into expensive neighborhoods that have now been evacuated.word - at least 150 acres burned - with no fire crews planes and helicopters to drop water and fire retardent. the dangerous santa ana winds have been fanning wildfires across southern california this week. they've eased somewhat - but conditions are very dry, with just 9 percent relative humidity. steinle.. now - an alternate juror is coming to their defense, arguing that they made the right call. kron4's maureen kelly sat down with him this afternoon for a one on one interview. take pkgthe murder charges i think didn't hold water the evidence just wasn't there to show he intended to kill kate steinlephilip van stockum sat thru every moment that jose garcia zarate was on trial.but because he was an alternate.he did not sit thru the deliberations that ultimately resulted in not guilty verdicts for the charges related to kate steinle's death. he has heard the national outcry in the media firestorm following the verdict. even the president of the united states has tweeted that it was a travesty of justice. which is why van stockum felt the need to come forward.case it's clear to me that the jury did the right thing the elk whole book they upheld law as they were ups supposed to do and the reaction of many people in the public including as high up as the president of united states seems to indicate a misunderstanding of that and i hope to be able to correct the recordhe says the fact that the gun was fired from a low angle, and richocheted off the concrete of pier 14 more than 70 feet away from kate steinle

(grant) san francisco is one step closer to green lighting recreational weed sales in january. today-- mayor ed lee signed legislation creating regulations and permiting requirements for commercial pot retail, distribution, and production. supervisors approved marijuana regulations in a mandatory second vote yesterday. this will allow the city's 45 existing marijuana dispensaries and delivery services to move ahead with retail sales in early january. san francisco will not be ready for recreational weed sales

injured dog spent seven months at the east bay s-p-c-a. kron 4's jeff pierce tells us about how she now has a home. this is the medical care unit at the east bay spca in oakland where the sick and injured animals are cared for when they arrive. most like tetly here will stay just a few weeks but a dog named carrie had injuries so serious her stay was seven months.when she was brought in we guessed that she was probably hit by a car, she had abrasions all over her face, she was limping or her back leg i believe and she could hardly open her eyes she was so cut up.there were moments when we weren't sure she could keep both of her eyes, there was talk about surgery and whether or not we would have to remove one of them.it was really sad, when she first came in it was pretty awful she was in really bad condition.this is carrie since she has found a new home. she loves to play, she really loves to snuggle, she's just a super loving dog.jane kissler and her husband looked for more than a year to find a dog that would be compatible with their great dane. they were

images out of southern california tonight...where firefighters are battling steep terrain, fierce winds and tinder dry conditions...whi ch are fueling several wildfires burning right now. ((catherine/live))tonight tens of thousands have been evacuated from their homes...and the fires are showing no signs of slowing down.((2shot/steve))thanks for joining us at six..i'm steve aveson.((catherine))and i'm catherine heenan in for pam moore.more than 83-thousand acres have burned -- and officials say it will only get worse before it gets better. the big concern tonight...the notorious santa ana winds. officials fear the feisty winds could hit 80 miles per hour...which means those fires could continue to burn uncontrollably.so far the fires have destroyed at least 200 structures.residents there say it looks like a war zone.

probably the most alarming event was there is a deep deep thicket of brush that didn't burn in our 2015 fire two years ago. when the flames hit. that it went off like a gas bomb. i had never seen you know five foot in diameter or six foot diameter tumbleweeds get airborne but we had tumbleweeds 300 feet in the air on fire and wherever they landed it immediately spread the fire and that's when we witnessed the fire jumped the 101 freeway. we will have a live report from ventura county coming up in about 12 minutes. (steve) and now to the other big story tonight.... the workers strike in oakland. this is day two of the strike.. and union leaders say it will contnue tomorrow. almost 3 thousand workers will be on strike tomorrow in oakland.there was no agreement made between the union and city hall this afternoon.voit is quite at city hall tonight. but earlier union members protested outside.they chanted and played music just under the window where as a special, closed door meeting, was underway this afternooninside city council members, the mayor discussing the labor dispute and trying to authorize a contract, but they did not.the city and union have agreed on a 4% salary increase for the 1st year, but cannot agree on terms for the 2nd year of the contract.with no agreement reached today. most city run departments will be closed no libraries open, no street sweeping or parking meter enforcement tomorrow. mayor libby schaaf said it is disappointing no agreement could be reached today.sot mayor libby schaaf / oakland "we struggle to provide the valuable services the libraries the senior centers head start these are incredible assets that service our most vulnerable families i cant just think about these 3 days i have to think about the long term we cannot spend money we don't have"voa representative for seiu said this workers are prepared for

two of the conversation... on kron four news at 8. (catherine)(on cam/vo) back to the east bay now for an update on tuesday night's fatal hit and run accident in fremont. a man was hit and killed as he was crossing warren avenue - just east of bradley street. he was apparently not in the crosswalk....and the driver did not stop. police caught up with the driver and say that she showed no signs of being under the influence.the woman has been released pending further investigation. now neighbors are circulating a petition.. they want city leaders in fremont to put in a stop light or stop sign on east warren, a downhill grade between i-680 and 880. residents say it's very dangerous, especially at night. "....when i take my boys to school in the morning the drivers just wont stop, they are going too fast..." "....it's a downhill grade and they're going too fast, we need either a stop sign or a signal or something..." "....yeah, i think a stop sign here would probably solve the problem...." the alameda county coroner's

office identified the victim as 65 year old joseph lynch, of fremont. the name of the driver, a 58 year old woman from san leandro, was not released. (catherine) police are investigating a car crash that killed a 74-year-old vacaville man tuesday... it happened at the intersection of marshall road and alamo drive... police say a driver hit the man's car....and they're investigating whether he'd suffered some kind of medical emergency just before it happened.. they say the woman driving the other car had a green light.. (steve) mulitiple officials in different cities and counties are warning of phone scams happening in the bay area. the san mateo county sheriff's officials are warning the public about a phone scam involving people posing as sheriff's office

employees. victims are told they must pay a fee for failure to appear for jurt duty. the concord police put out a similar phone scam warning... victims are receiving calls with the caller i-d of the concord police main telephone line. they are being told that they owe money to the police department. the alameda municipal power is also warning its customers that scammers are impersonating a-m-p employees. they are demanding immediate payment from the customers, or tell them to go to c-v-s to make the payment. if you believe you have been contacted by any scammers, contact your local police department. (catherine) the f-b-i is creating a task force to check for fraudulent activity related to the north bay fire recovery effort. the team will be comprised of local, state and federal agencies in the north bay counties. they will collaborate and share information to streamline the vetting process. the task force will also use information from previous disasters including this year's devastating hurricanes. members of the task force

(catherine) a national firestorm was whipped up after the acquittal of the man on trial for killing kate steinle. he was found not guilty of murder or involuntary manslaughter. tonight an alternate juror is speaking out. kron4's maureen kelly sat down with the man -- who says the jurors in the case made the right call. i'd like to point out that the jury was under a lot of pressure in this caseand that's putting it mildly. the death of kate steinle, shot by a gun handled by an undocumented immigrant deported five times before that tragic day on pier 14, not only became national news, then presidental candidate trump made it part of his campaign.alternate juror philip van stockum says the high profile nature of the case was impossible to ignore. it's hard to say didn't have any effect it was obvious to

us that this was a very popular case they were cameras outside the courtroom every day we saw. it's hard to completely ignore that but i think the jury actually did an excellent job under pressure setting aside their biases if they had any bias is all about things that weren't pertinent to the case into the law and making that judgment per the jury instructions they were given i think they were get done and arable job of that i don't think anyone cracked under the pressurehe says there was key evidence that created reasonable doubt.including the fact that the bullet ricoheted off the concrete of pier 14. he also points out that a pillar of us justice system if presumption of innocence.and part of the juror's instructions were that if they can draw one or more conclusions from the circumstantial evidence and one of those interpretations points to innocence and one points to guilt, you must accept the one that points to innocence. i think they did something that was really difficult which was to set aside their personal feelings about the case whatever they may have been and uphold the law as it was given to them and i think we should be respectful of them and even admire them for what they did garcia zarate is expected to be back in court to schedule his sentencing date next week. he's also been indicited by a federal grand jury on new charges related to steinle's death.one count of being a felon in possession of a firearm and one count of being an immigrant in possession of a firearm. maureen kelly kron4 news.

following tonight... the u-s will now recognize jerusalem as the capital of isreal.(catherine) president trump made the announcement... signaling the beginning of moving the u-s embassy there... from tel aviv. he made the declaration despite widespread criticism from allies in the middle east and europe. but israeli prime minister benjamin netanyahu called it an important step. congress passed a law to move the embassy in 19-95... but presidents clinton, bush and obama all halted the move. the process of moving the u-s embassy could take years. (catherine) but for customers -- there could be a silver lining... from our partners at c-n-n... maribel aber explains. it's a mega merger that will shake up healthcare.and c-v-s' $69 billion deal to buy aetna may end up benefitting consumers.it's what economists call a vertical merger, in this case a supplier and a customer getting together. the new york times outlined the possible ways it may benefit consumers --aetna for example could leverage c-v-s' pharmacies and clinics to help patients stick to their medications.down the road, that might even lead to better care and lower premiums.and other reports speculate that
