(robin) breaking news from overnight ...a child is in stable condition at the hospital ... after getting shot in oakland. the child was shot on simson street... that's not far from 580 and seminary avenue.it happened just before 9 o'clock. the child was hit in the forearm ... and is expected to survive. the child was actually brought to the hospital by the mother. it's not clear how old the child is .... and there's no word if a shooter has been arrested. (robin) our other big story this morning ... a city-wide strike in oakland will continue for a third straight day.this after city leaders and union workers were unable to come to a deal. the main issue right now: how much union employees are paid. the strike is affecting many oakland city services... including many that are relied

on by families with children. kron4's hermela aregawi has more on the strike from both sides. a historic strike.. 3000 oakland city workers won't show up to work for the third day in a row . they say because of the city's unfair labor practices.felipe cuevas/seiu local 1021 chapter presidentthe city may say they're valuing us but they're not showing us they value us. the understaffing has created problems not only in police and fire but other agencies as well. folks are not being allowed to take the time they have accrued lina hernandez/oakland public library employeewe continue to point out to the city that we need to be able to have more workers. we need to be able to have more full time and permanent workers. 50 percent of our labor force is made up of people like me who are temporary part time workers who have no protection, who could be fired at any moment. we don't have health care benefits.the union says.. the offer they have put on the table costs the same as what they city is proposing but eases the load on overworked staff. but they city says it's

trying to give employees what they need.. without it leading to future job cuts. mayor libby schaff/oaklandit's dissappointing that families have been impacted for what will be right now three days but it would be more disappointing more horrific if families were permanently damaged because we had to permanently reduce city services. as well as potentially lay off city workers. (robin) here is a look at some of the city services impacted by the strike. there is no parking enforcement... but keep in mind police are still working and are able to write tickets. there is no street sweeping.. no restrooms at city facilities - like parks. these are just a few of the unavailable city services. visit kron-4- dot-com .. and we have a complete list. (robin)in the north bay ...the f-b-i is teaming up with local police to help fight scams targeting north bay firestorm victims. kron4's ali reid has details on the disaster fraud task force.

4:18 am
an alternate juror is coming to the jury's defense, arguing that they made the right call. kron4's maureen kelly sat down with him for a one on one interview. the murder charges i think didn't hold water the evidence just wasn't there to show he intended to kill kate steinle philip van stockum sat thru every moment that jose garcia zarate was on trial.but because he was an alternate.he did not sit thru the deliberations that ultimately resulted in not guilty verdicts for the charges related to kate steinle's death. he has heard the national outcry in the media firestorm following the verdict. even the president of the united states has tweeted that it was a travesty of justice. which is why van stockum felt the need to come forward.case it's clear to me that the jury did the right thing the elk whole book they upheld law as they were ups supposed to do and the reaction of many people in the public including as high up as the president of united states seems to indicate a misunderstanding of that and i hope to be able to correct the recordhe says the fact that

the gun was fired from a low angle, and richocheted off the concrete of pier 14 more than 70 feet away from kate steinle was a key piece of evidence that created reasonable doubt that it was an intentional shooting.but as to why he believes the jury made the right call in terms of involuntary manslaughter is more complex. he says to find garcia zarate guilty of that charge it would needed to be proven that he acted with criminal negligence by brandishing the weapon. no one ever saw him at the gun no one ever saw him fire shot no one certainly saw him brandishing a weaponthe undocumented immigrant was only found guilty of being a felon in posession of a firearm. van stockum says he's spoken to some of the jurors from courtroom 13 and says they were shaken by the national outcry over their decision. he also says he has sympathy for the steinle family.i'd like to say that i'm terribly sorry for what they've gone through, i can't imagine what they would like especially being in the national spotlight with something so personal and so tragic, i was happy to see in their statement but they don't have a desire for vengeance, because of jury's role is not to provide vengeance it's to a provide justicethe alternate had no strong opinion on the

,$8drw (robin) crosswalks are

designed to give pedestrians and sometimes bicyclists a safe way to cross a busy street.but sometimes ... they don't use common sense.stanley roberts explains in this edition of people behaving badly. i've lived here for 15 year and every day i hear tires screeching people yelling, there's been car accidents numerous times because the cars not stopping to see the people in the crosswalk that was jessica she is crossing putman blvd. in walnut creek but not in the crosswalk why because she says she feels safer outside the crosswalkin fact here is a woman and a child who also preferred to not use the crosswalk this is
4:41 am
an interesting crosswalk and to some residents it's also a very dangerous one .. i'll let jessica fill in more of the blanks a lot of the bikers don't even stop for the crosswalk they kind of keep going there are actually stop signs one on both sides for bike riders at the as the cross over from the contra costa canal trail so to prove a prove a point this rider has stopped and is waiting to make sure its safe before crossing then the rider goes but most of the riders simply throw caution into the wind and roll across sometimes with out even looking nats: ambiance as it relates to pedestrians the cars drive too fast and they don't stop for the people in fact i did a quick radar survey and despite the speed being 30 miles per hour i had cars doing 38 and 39 miles per hour and one was caught at 43 jessica had a brilliant idea the get flashing lights at the crosswalk but there is a small problem . you see on the left of the screen is walnut creek and the right is pleasant hill when i email pleasant hill to see if we can have something done about the crosswalk they
4:42 am
informed me that contacted walnut creek to fund the other half crosswalk and they say they do not have the funds to do so a lighted crosswalk would be an bright idea, since at night the crosswalk is invisible at night it atrocious i live here and i know these people are crossing i've seen how they just jet in front of you they don't lights on they don't have reflectors you can't see them you can tell if someone is in the crosswalk based on my observations . i think it's safe to say this crosswalk and the driving, walking and biking habits makes it dangerous on putman blvd. between pleasant hill and walnut creek stanley roberts kron 4 news (robin) coming up on the kron four morning news... there is a new push to ease traffic congestion around the bay area.. and it involves

4:51 am
mark desaulnier and. senator diane feinstein lay out their case for building a new bridge across san francisco bay.they note that "the traffic demands on our streets and transit systems have become intolerable." and conclude that "a new bay crossing would alleviate this traffic through san francisco and the east bay, would better connect the entire bay area, and would provide significant benefits for toll payers."sotwe agree with the congressman and the senator.randy rentschler is a spokesperson with the mtc. sot we need to build significant infrastructure if we want to support the economy we have here in the bay area.but building a new bridge is no easy task. the mtc studied the idea in 1991, 2002 and then again in 2012. each of these previous studies looked at putting a new bridge across the bay that would connect interstate 380 near sfo to interstate 238 in hayward. over time the cost of such a project has skyrocketed with the 2012 report estimating the bridge and supporting infrastructure would cost over 12 billion dollars it's also unclear where that money would
4:52 am
come from or if there's even the political will to attempt such a massive undertaking.sot in this state we have folks who want to repeal basic infrastructure money to repair streets and roads. so getting a consensus to do more is a big challenge.but despite the challenges rentschler says that the need for a new bridge is real and the process has to start somewhere so this letter could be the push that gets the ball rolling.sotthe most important thing is that we have a senator and a congressman who want us to think big and that's a good thing.
