(grant) new tonight at 5... the sentencing date for jose garcia zarate is set for january fifth...and his attorney's are looking for a new trial. he was aquitted of all murder charges in the death of kate steinle in san francisco. though he was convicted of being a felon in posession of a firearm. that state conviction carries a maximum sentence of three years in jail. but now his lawyers say he didn't hold the gun long enough to warrant a firearm possession conviction and they are now looking for a

new trial. since the jury's ruling earlier this month, federal authorities have charged zarate. (vicki) schools in the east bay are now facing a 9-million-dollar budget cut.. the oakland unified school district approved the cuts... despite parents and teachers voicing their anger at a heated school board meeting. kron 4's will tran explains how the budget cuts are going to affect students. parents and teachers showing up to school frustrated this morning... after realizing that the oakland unified school district's decision to slash 9 million dollars from the budget could end up hurting their kids(trina burton/parent-i'm baffled. i don't understand the decision that they made. i don't know where the money is going to come from. so what i was told by my son is get materials for the classrooms, that i can support as a parent because my son is in special education) the school district says they had no choice.they are required to have reserve money and if they didn't make the cuts... the state would come in and do it for them without any input from the board or the communitythe parents accuse the school district of mismanaging the budget throughout the years(max orozco/parent-don't like it. i think the money is going to stay with the superintendents, the higher people. it should come down to the teachers and to the students. we need money)oakland unified school district says they are still working out the details on

(vicki) the man convicted of killing sierra lamar is going to jail for the rest of his life... and today the f-b-i announced they are still searching for the morgan hill teenager. today the f-b-i tweeted out this flyer... saying they are continuing to ask for help in finding sierra lamar. antolin garcia torres has been convicted of her murder... but it is still not clear exactly what

happened, and her body has not been found. sierra went missing on her way to school in march of 20-12. (vicki) happening now... police are looking for a suspect...in connection with raping, kidnapping and robbing a victim in oakland. it happened around three-30 this morning on east 31st street near highland hospital. there officers say the victim was raped...kidnapped..then robbed at gunpoint of her personal items. she then took herself to a hospital. the suspect...who was armed with a handgun...remains at large tonight. (grant) california's attorney general is suing the trump administrationover debt relief claims from thousands of students..(vicki) catherine heenan is here with more on the lawsuit affecting studentswho attended corinthian colleges.. (catherine) the complaint -- federal education authorities are refusingto process debt relief claims.. the claims are from students who had federal loans to attend corinthian colleges.... which included heald, everest, and wyotech.

the lawsuit says the students are eligible for help after courts ruled that theywere defrauded by corinthian - in violation of consumer protection laws. corinthian colleges were sued in 20-13 over illegal practices that left thousands of students with large debts....and later filed for bankruptcy. more than 50-thousand claims are pending -- including 13- thousand from california. authorities in illinois, massachusetts and new york are filing a separate similar lawsuit. this is just the latest in a series of lawsuits by california and other states challenging trump administration policies. vicki and grant? (vicki) and for the 13th straight year... students are continuing to apply to the university of california system...in record numbers. preliminary data released today by the u.c system shows nearly 220 thousand prospective undergraduates applied for at least one u.c. school for the fall of 20-18.

the figures include about 181- thousand applications to become freshman...and about 40 thousand from transfer students. that's an increse of nearly six percent from last year's stack of applications. (grant) new at 5... a firefighter has been killed while battling the massive wildfires in southern california. today we learned the firefighter from san diego was helping battle the thomas fire in ventura county when he died. the cause of death has not yet been released. the thomas fire is now the fourth largest wildfire in california history with more than eigh it thousand firefighters still working it. the fire is only 30 percent contained tonight... and has burned more than 379- square miles. (grant) california is ordering utility companies to do more to keep power lines from sparking wildfires. today the state public utilities comission toughened its rules requiring power companies to keep trees and brush away from lines in high risk areas. this is at least partially in response to

the two east palo alto women...found dead in an apparent murder-suicide. 50-year-old heather lauren downs... and 57-year-old selene kalista makarios...were found by officers at an apartment on tuscany court yesterday. both women had suffered gunshot wounds ....the duo was pronounced dead at the scene. officers say the case...is an apparent- murder suicide...they do not believe there are any suspects at large. it is unknown which woman ...was slain by the other. every year around this time... you're encouraged to get a flu shot.(grant) but there are signs that this year's vaccine may not be as effective as hoped. kron 4's charles clifford spoke to an infectious disease specialist. a recent report in the new england journal of medicine notes that in australia, this year's flu vaccine appears to be only about 10 percent effective. that's important for us, because what happens in australia is usually a pretty good indicator of how well this year's flu shot will work here in the u.s.dr alex evens is an infectious diseases expert at marin general in kentfield.sotoften times we have the same sort of reponse rate during the next 6-8 months so there is concern. in good years, the flu vaccine is about 40-60 percent effective. it's not entirely clear why this year's shot is lagging. dr. evens says it could have something to do with the way the vaccine is being manufactured. he also notes that even if the shot isn't working well in australia, it could still be effective here.sotthis is all just pure science and speculation. we don't know how this flu vaccine will be this year it could be fantastic.but even if the vaccine is only ten percent effective, health experts still strongly recommend getting a shot anyway. basically, any protection against the flu is better than nothing. getting the shot will also help prevent the virus from spreading.sotwe want to make sure that everyone gets a shot. therefore we can have some sort of heard immunity. that's where everyone gets the vaccine you protect each other. you want to at least try to do that.dr evens also says that right now, just before the holidays, is the best time to get a flu shot. the virus tends to spread

(grant) a swimmer had to be rescued out of the bay after being attacked by a sea lion let's check in with pam moore... in the newsroom where we are getting more details... across the country today are remembering the victims of the sandy hook massacre...(grant) catherine heenan is here with more on the five year anniversary of the tragedy in newton, connecticut... (catherine) it was five years ago today when 20-year-old adam lanza first shot and killed his mother... then went to the sandy hook elementary school.... that's where he opened fire and killed 20 children and six staff members before killing himself.. the victims ranged in age from 6 to 56 years old.. connecticut's governor ordered flags at half staff statewide.... and people in new-town said they'd mostly be honoring the day in private reflection,after years of activism. in the nation's capital, california congresswoman nancy pelosi was talking about the victims...but also venting frustration over the lack of progress in passing tougher gun laws. rep. nancy pelosi - in their name and the name of the 90 americans who lose their lives to gun violence every day and the 120,00 americans who have been killed by guns since

shooting at sandy hook elementary school in newton connicut.the children of durham elementary school in fremont got to see their gift to the families. a song of peace is a gift from the people of fremont california to the families, friends and citizens of newtown conniticut another day of morning, another day of sadness. george avila is not a song writer but he was inspired to pen lyrics to a piece of music he heard on a drive home after the sandy hook shootings. listening to music by marco marangeli, a grammy nominated composer on the day of the sandy hook tragedy. george hunted down the composer who generously gave him the rights to use the music for this tribute to those lost at sandy hook. he took his song to the children of durham elementary and enlisted them in his video. nat sound i felt happy that i was in the video it help show that all the people felt about the tragedy and about how everyone felt about peace. i was devastated about all those kids were so very young. we need to stop bad stuff like this from happening. nat sound george avila sees that hope in the children who watched their part in his video. we can do so much better and the hope is the children, the next generation will do better then we've done. in fremont jeff pierce kron four news.
