(vicki) the man acquitted in the murder of kate steinle was sentenced today to three years in state prison for the one gun possession charge he was convicted of. but jose garcia zarate is expected to be released from the county jail in the coming days because he has credit for time served.(grant) kron4's maureen kelly reports, that doesn't mean the undocumented felon will be walking the streets anytime soon, because he's due to be transferred into federal custody to face new charges . this is retaliatoryjose garcia zarate, seen here in an eariler court appearnce could face a federal judge as early as next week on new gun possession charges. this.after it was determined he had already served enough time in jail to satify the maximum sentence for his conviction of being a felon

in possesion of gun. the gun who's bullet ricocheted off pier 14, strikng and killing 32 kate steinle as she was sightseeing with her father back in 2015. before the sentencing the judge denied the defense team's motion that the undocumented immigrant be granted a new trial. their argument is that the judge improperly barred the jury from considering garcia zarate's claim that he didn't know he was holding a gun when it fired. he's holding objects, he does not know whatit is it fires, and at that moment for a split second it's in his hands before he throws it. and that's literally what he was convicted of.the district attorney says while they are disappointed that the jury acquitted the defendant of the murder involuntary manslaughter and assault charges, they believe the judge made the right call today.we want to express our sorrow and how bad we feel for the steinle family, there will be some closure at least in terms of the local casebut a new chapter in this saga is just begining.the jury's decision reignited the national firestorm.....stirred up by president trump, who while on the campaign trial, used steinle case as part of his argument to strenghten our borders. garcia zarate, an undocumented immigrant, had already been deported five times before steinle's death. within a week of verdict, us attorney jeff sessions filed the new charges. garcia zarate has a new attorney, tony serra, to go to bat for

him in the federal arena. there's gonna be a motion made right at the beginning for dismissal predicated on vindictive prosecution which is this allowed under federal and state lawwe're going to ascertain whether or not there was collusion between the federal authorities and the state authorities and if so we can bring a motion to dismiss on double jeopardy groundsthe steinle family did not attend today's sentencing. they have no comment on today's court proceedings or on the new charges garcia zarate now faces. their spokesperson says they are retiring from the public eye will not being in attendence as the case goes federal. maureen kelly kron4 news

(vicki) the man accused of plotting a christmas day attack at san francisco's pier 39 in the name of isis pleaded not guilty in court today. the f-b-i says 26-year-old everitt jameson told undercover agents he planned to set off explosives then shoot people. the former marine from modesto ... is charged with attempting to aid a terrorist organization. he was arrested three days before christmas. jameson's attorney says that day he was placed on a "51-50" hold for two days.... because authorities believed he could cause harm on himself. (vicki) jameson will remain in custody until his next court appearance in april. (vicki) new details are

emerging tonight about what exactly the widow of the orlando night club shooter knew before he carried out the attack. during a hearing today... investigators say noor salman knew her husband -- omar mateen-- was going to do something bad. that's according to a statement written by an f-b-i agent... and signed by salman. the statement says she was in denial that her husband could hurt other people when he left their home with guns and ammunition. mateen killed 49 people and wounded at least 68 others during the mass shooting at pulse nightclub. salman is facing charges of aiding a terrorist organization and obstruction of justice... and will stand trial in march. she had been living in the east bay with family members when she was arrested. (grant) an update to a story we told you about earlier this week... the man seen in a santa hat... shooting a gun in a busy san francisco intersection... has been arrested. 27-year-old xavier watson from fairfield is now in police custody. police say this is watson in the surveillance video...

stopping in front of a car parked on eddy street... and opening fire. it happened christmas morning in the tenderloin... near mason street. he's been booked on multiple felony charges. no one was injured in the shooting. (grant) a man is taken into custody today after an hours long standoff in san francisco. it started last night when a man barricaded himself inside a home in the area of moraga street and 29th avenue... in the city's sunset district. kron 4's lydia pantazes explains what happened. police negotiated with a man who was barricaded inside this home behind me for more than 8- hours.(take vo)the home is located on 29th street near moraga.m in san francisco. police say at about 11 last night a man verbally threatened a passerby.that passerby called 911.when police arrived, they say the suspect barricaded himself inside his home, refusing to come out.negotiators came to the home, attempting to get the suspect out.the suspect was taken into custody at about 7:30 this morning. captain robert yick/san francisco police "and the subject did attempt to assault one of the negotiators

health officials say all of those people who died were under the age of 65. (grant) and in santa clara county... four people have died from the flu since november. county officials say the number of people visiting emergency rooms for flu like symptoms is up 60-percent. one of those who died had not received this year's vaccine and suffered from other health problems that placed them at greater risk. regardless of it's overall effectiveness, health officials say the h-3 vaccine should render the flu less severe. it's also not too late to get a flu shot to protect yourself for this current flu season. (grant) a federal panel blames the near=catastrophe on faulty design, sloppy construction ... and decades of second-rate repairs.steve aveson is in the newsroom with the details.steve? (steve) this is the government's final report on the oroville dam ... it runs almost 600=pages long.the investigators say their findings should be a wake=up call for everyone involved in dam safety. february seventh of last year .. a giant hole is discovered in the spillway ... 200 feet wide and deep enough to swallow a three=story builsing. the heavy winter rains filled the state's second largest reservoir to the brim ... they couldn't stop the outflow to make repairs ... and eventually had to use an emergency spillway.downstream,

as much as 18 inches of snow and now, freezing tempertures created icey conditions for runways. flights were suspended at jfk, and air traffic halted at laguardia airport that was all thursday .on friday, some better news both of those major airports trying to get back to normal today. operations pushing forward but with all of those cancelations, it is going to be rough for quite some time. the airlines all scrambling - issuing warnings to passengers to call ahead, or go online to check the status of their flighthere at sfo - it could get worse as the day rolls out - i have talked with some passengers who just rolled their eyes frustrated about the delays, yet others just taking it all in realizing they can't do much about it all.liz sot - going to dc, i am ok, hoping for the best. guianan - sot - i think it is going to be alright, i will stay with friends if i get stuck.(estacio)and take a look at the board here at sfo - some cancelations to tell you about again, 22 cancelations so far this morning, 71 delays. the duty manager also tells me that as far as boston, newark, and jfk - they are on a delay path so they are up and running but with the conditions the way they are it is a bit slow going. as always check before you head out. here at sfo.

report on last month's deadly amtrak incident in washington state. according to the report.... the train was going 78 miles per hour before it flew off an overpass onto a highway....killing three people and injuring dozens. the train had been traveling through a 30-mile-per-hour zone. the engineer and another crew member haven't been interviewed by the n-t-s-b yet because of their considerable injuries. (grant) authorities say a man from india sexually assaulted a 22-year-old woman while she was sleeping on a flight from las vegas to detroit wednesday. the detroit free press reports that the woman....who cited a federal complaint... immediately notified a flight attendant about what happened. the victim says when she woke up....her shirt was unbuttoned and the man had his hand down her pants. authorities later arrested the suspect who was in court wednesday on charges of aggravated sexual abuse.... he spoke to an f-b-i

building inspectors have issued a citation against the sinking and leaning millennium tower. they say the 58-story tower is an apparent fire safety risk.( vicki ) consultants found the tilting building was exacerbating gaps between the facade and the

core of the concrete and steel tower. experts claim smoke and flames can shoot through those gaps... making it easier for a fire to jump to different floors.( grant ) the fire safety hazard warning was part of a 20-16 report commissioned by the millennium homeowners association. that came after a condo owner complained of a mysterious odor. new at five... in custody tonight -- a 23- year-old man accused of sexually assaulting and robbing a middle school teacher in her classroom in san jose.(grant) police say andrew bracamonte was arrested last night in san francisco. kron four's philippe djegal explains how police tracked the suspect down. (philippe) san jose police chief eddie garcia says this surveillance video helped identify 23-year-old andrew bracamante. he was spotted on camera at harker middle school before and after garcia says bracamonte robbed and

sexually assaulted a teacher in her classroom at around 6-30 tuesday morning. garcia says the teacher was alone when bracamonte stepped inside, locked the door, turned off the lights. assaulted the woman, then left. chief eddie garcia/sjpd- "in addition, the suspect threatened to shoot the victim if she did not stay inside the classroom." garcia says k-9's then tracked the suspect's scent to his house about a half mile away. but he wasn't there. he was later seen on camera at a liquor store in santa clara. thursday night, police eventually trailed bracamonte as he drove up to san francisco... where he was arrested. garcia says the attack appears to have been random. he was booked into the santa clara county jail on several felony charges, including robbery, false imprisonment and forced oral copulation.chief eddie garcia/sjpd- "he has been arrested in the past for carrying a concealed dagger, assault with a deadly weapon, sex with a minor. probation violation and possession of concentrated cannabis." garcia says extra patrols have monitored the harker middle school campus throughout the investigation... adding that neither the victim or school did anything wrong. chief eddie garcia/sjpd- "we

gruden...is coming back to oakland.(grant) espn reporting the current analyst will be paid roughly 100 million dollars over the next 10 years. sports director gary radnich jon gruden is expected to sign a ten-year deal worth 100-millions dollars it's believed to be the richest contract in nfl history. the raiders will introduce gruden as the team's next coach on tuesday. gruden will join jimmy johnson and

tom landry as the the third coach in history to get a ten-year deal. the nfl says the raiders fulfilled the rooney rule. earlier this week they interviewed two minority candidates, including tight ends coach, bobby johnson. at this time... no word on wether gruden will have ownership stake in the team. nfl owners still have vote on it. gruden will need all 32 owners to approve it. chucky will become the 12th head coach since 1960 to have multiple stints with one team.

administration's new years' goals may be in jeopardy. president trump ignored reporter's questions as he left the white house for camp david.it's there the president will huddle with gop leaders to plot the administration's next steps."we want to have a unified republican agenda for 2018"deputy white house press secretary raj shah says the meeting is vital for developing a comprehensive, conservative agenda for the new year. dozens of coaches and professional baseball players put on a baseball clinic for young players in santa rosa on friday afternoon.but it was more than just a baseball clinic, it was a fund raiser to help those ball players who lost everything in the north bay fires replace their equipment before the season starts.little league tryouts and spring training around the corner, it's the perfect time to do it.we have a list of a hundred and eighty six players, young players that were displaced by the fires. every kid that was displaced is going to walk away with gloves, bats, helmets, shoes, an unbelievable amount of gear they can walk away with.but more than replacing gear they got to recieve tips from no less a player than oakland a's marcus semian.a lot of families who may have lost their homes, lost their equipment, wed just raising money to help these families

in the south bay... a 23-year-old man accused of sexually assaulting and robbing a middle school teacher in her classroom in san jose is in custody tonight. (pam) police say, andrew bracamonte was arrested last night in san francisco. kron four's philippe djegal explains how police tracked the suspect down. (philippe) since tuesday morning... parents of students at harker middle school in san jose have been uneasy. after word of a teacher being sexually assaulted and robbed in her classroom spread through campus. some parents became alarmed by the increased police patrols at

probation when this latest crime was reported. in san jose, philippe djegal, kron four news (pam) a berkeley middle school teacher and activist.... is ordered to pay more than 11-thousand dollars in legal fees to the former head of the berkeley college republicans. yvette felarca got a temporary restraining order against troy worden, in september. she is a leader of the activist group called - "any means necessary." felarca accused him of stalkng and harassing her for her political activities on the u-c berkeley campus. a judge dismissed the order... and ruled that she failed to prove her case. worden and felarca have both been involved in rallies in berkeley, in support of and against president trump. felarca was charged in july with assault during a rally in sacramento in 2016.

(steve) a san francisco man is sentenced to 27 years in prison for burning his girlfriend during an argument at a laundry mat. 27-year-old dexter oliver was sentenced to state prison for the attack in 20-13. the 30-year-old victim told oliver that he turned her world upside down and made her children afraid of her because of her injuries. prosecutors say oliver filled two baby bottles with gas and squirted them on the victim's face and body before igniting her with a lighter. police found her in the street with life-threatening injuries to her face and upper body. (pam) new tonight at six... a u-c berkeley student is being held by immigration authorities in san diego county... federal officials say... he violated the conditions of his visa. activists have organized a social media campaign... calling for the release of 20- year-old luis mora.... under the hashtag #freeluis. mora's lawyer says, he made a wrong turn.. ended up at a border checkpoint .... and was arrested on december 30th.
