( robin ) happening now... it is day three of the government shutdown. this is a live look at the capitol where the senate is expected to vote on a plan to reopen the government later this morning. that vote is expected to happen at 9:00 our time but not everybody is optimistic that the bill will pass. omar jimenez is in washington with the latest. with the sound of the gavel -- senators left the floor -- unable to compromise on a measure to fund the government. sen. jeff flake / -r- arizona: "there's enough blame to go around."sen. bob corker/ -r- tennessee: "i think both leaders, at this point, have to want a solution."at issue -- illegal immigration. democrats want to extend daca protections for the so-called dreamers -- undocumented immigrants who entered the country as children.sen. chuck schumer / -d- new york: "we have yet to reach an agreement on a path forward that would be acceptable for both sides." sen. mitch mcconnell / -r- kentucky: "on february 8th,

in the south bay... police are looking for a gunman after a man was shot and killed last night in san jose. it happened on charlotte drive near charlotte commons park. the victim died at the scene. police do not have a description of the shooter and are still trying to figure out what motivated the attack. ( robin ) also new this morning... a school employee in san mateo county is being charged with lewd acts with a minor. ian whiteman turned himself in after the victim's parents found evidence of inappropriate communication between whiteman and their child. the victim was just 14 years old. police do not believe there are any other victims. whiteman worked at the san mateo and hillsborough campuses of nueva school. ( robin ) the two-year-old girl who was injured in a crash involving a stolen truck in antioch...has been declared brain dead. her four- year-old sister died shortly after the crash last wednesday. loved ones came together to remember the two sisters at a vigil sunday night...

their uncle who lives with the family, spoke on behalf of the parents... ( robin ) the 2-year-old is still on life support... but her parents have already signed documents to have her organs donated. they will likely turn off life support sometime today. ( robin ) a 70-year old man is now charged with attempted murder after he drove his car up on the curb in the castro district. he is also being charged with hit-and-run and d-u-i. this was the scene at 18th and castro streets saturday afternoon. police say the suspect... kenneth rotter... lives in his car with his dog. he is accused of hitting parking meters and trees. then backing into a deli and then driving away on the wrong side of the street. ( robin ) a man is in jail this morning... in connection with a hit-and-run

in san pablo. it happened saturday morning on brookside drive near 23rd street. once at the scene officers found a 33-year-old man suffering from multiple injuries . police then found an unoccupied sedan in the area that had front-end damage authorities say 19-year-old corell hackett was the driver hackett was arrested... and booked for felony hit and run. the victim is currently in critical but stable condition. ( robin ) happening today... two schools damaged by the north bay fire storm will reopen. st. rose catholic school and cardinal newman high school have been closed since the fire storm back in october. this is video of the damage done to cardinal newman during the fire storm. 22 portable classrooms have been brought to the campus and prepared for classes. first responders and community members will be on campus to provide lunch for the students. home... after spending weeks in a southern california prison for overstaying his visa. kron 4's ella sogomonian reports from the oakland international airport where luis mora was welcomed back last night. sot: ella sogomonian, oakland international airport// "after about three weeks of uncertainty luis mora is now finally joined by his friends from uc berkeley here in the bay area as they greeted him at the oakland international airport chanting 'this is what

(nats) sot: luis mora, freed from ice detention//"it's good to be back. i'm a little bit nervous but i'm excited to show this country what dreamers are made of."uc berkeley student luis mora is back in the bay area. he was in jail for nearly three weeks after he was detained by customs and border protection officers in san diego county on new year's eve coming back from a party.sot: luis mora, freed from ice detention//"the overwhelming part was seeing people like me being criminalized for almost nothing. people like me that needed help."the undocumented immigrant was arrested for overstaying his visa. mora didn't qualify for protection for childhood arrivals called daca because he was brought to the us in 2009 and the qualifying year was cut off at 2007. his attorney calls his detention harsh and unusual for someone without a criminal history.sot: prerna lal, immigration attorney// "we are in an era of increasing immigration enforcement whereby even people with the slightest violation of the law are being treated like they

are criminals and in a very punitive manner so yes i think it was pretty heavy handed and it cost tax payers so much money."mora says at the otay mesa prison he was made to work translating for agents who addressed detainees with vulgar language using expletives.work he was happy, but not paid to do.with the help of his attorney mora got in front of a judge and was granted permission to pay the lowest bond possible of 1500 dollars - money that was donated in an online campaign with a hashtag free luis.sot: luis mora, freed from ice detention//"this has given me a hope that the system will be able to change not next year but as soon as possible and get fixed right now and take action."mora will now walk a free man through the halls of uc berkeley and continue his studies while awaiting an immigration hearing that his lawyer says due to backlogs may be more than a year down the road.the cal student says he plans on using the uncomfortable experience as motivation to get into politics and help what he calls a broken immigration

( robin ) another big story we are following this morning... recovery efforts are underway in southern california following the major mudslides that killed 21 people. john lawrence has the latest. for the first time in nearly two weeks, u-s highway 101 in santa barbara county is back open.it was shut down after major mudslides blanketed the montecito area earlier this

( robin ) a big story we're following this morning ... the s-p-c-a says the dog flu is spreading to san francisco. kron 4's ella sogomonian has the latest. the veterinary team at the sf- scpa confirmed cases of the dog flu in san francisco.the non profit explains dog flu is similar to human influenza- in that most recover without any treatment.but there has been a reported death in the south bay caused by the canine flu. so some symptoms to look out for are coughing, nasal discharge, lack of appetitie fever and fatigue.one dog owner we spoke with heard about the flu spreading from her friend in the south bay and got the first round of two shots for her furry friend.sot stephany lai, dog owner: "so in some ways i'm more concerned about her getting the flu than i am by myself. and i've heard cases where the flu can be deadly so it's a

lot more severe for some other dogs so i'd rather just not take the risk."another dog owner who panicked when she heard about the flu but was frustrated she couldn't schedule her dog for the shot at the sf-spca soon enough.sot johanna arias, dog owner: "and they wanted to book an appointment with a doctor but i just needed a flu shot with a technician. and the closest appointment was in february and i was a bit stressed out because the dog flu is now. so i thought i would find somewhere else then i went online and it seems like it may be a marketing campaign from pharmaceuticals."

prides itself as being a bike friendly city ... in 20-12... the port of san francisco constructed a - safe bike lane- but it is not being used by riders. stanley roberts explains in this edition of people behaving badly. you are looking at a class one bike lane in san francisco, it is completely protected from trafficnats: ambiance it has if own traffic signal it even has a stop sign. but it appears to missing two . or make that three things it's missing, bicyclists i say that only because i haven't seen one on the bike path entire time i was here. it's also

missing parts of the fence. in random locations so you walk through here a lot? i walk through here fairly regularly, i just noticed they are missing part of the fences you come through here more than i do so what did you notice well i definitely noticed pieces of the fence are missing apparently someone borrowed close to a quarter mile of fence and not many people noticed.. now it looks like some of the fence was run over, you can tell that by the bent poles sticking out of the concrete barriers however in some cases it appears as if the poles were sawed off . which makes this protected bike lane not so protected this is a really nice bike path i usually just walk on the sidewalk or the bike path but it feels a little vulnerable when you're walking down and they're huge trucks coming in right at you i definitely move over to the side,( and the fence is gone) the fence feels it's a protective shield this project belongs to the port of san francisco, but it's almost like it was built in 2012 and the port forgot about it ..i noticed this because i was looking into complaints of illegal dumping in india basin . and noticed a bike lane in need of repair also some of the signage could be upgraded, this one says no parking between 1201 to 6am . when really there is not parking every day and this old fire box which looks like it been through a fire .this looks more like a boondoggle than it

( robin ) in the north bay... one man is in jail... accused of starting a fire in santa rosa. it destroyed multiple storage units and caused major damage to the building. it started saturday afternoon at the roseland self storage on roseland avenue. crews quickly put out the fire. police arrested eric chait. they say he was smoking a cigarette while extracting hash oil from marijuana . police say the cigarette fell to the ground and started the fire. officials say the fire caused about 300-thousand dollars in damage. ( robin ) also in the north bay... police arrested five juveniles after an armed robbery at a park. it happened saturday afternoon at los robles park near highway 1-0-1 in windsor. police tell us two young men were robbed at gunpoint by a group of at least five juveniles. the thieves then took off in a black acura... that belonged to one of the victims. officers later spotted the car

at a gas station and arrested the group. ( robin ) the so-called serial stowaway is accused of sneaking on to another flight. here's a look at marilyn hartman's latest mug shot. chicago police say she got past security at o'hare airport ... and made it all the way to london. the 66-year old is accused of boarding a british airways flight and hiding in a bathroom. after the plane took off, she emerged and found a seat. hartman wasn't caught until she was asked to produce a passport at london's heathrow airport. when she couldn't, she was taken into custody and returned to the u-s. she's been charged with a misdemeanor count of criminal trespass. in august of 2014, she got past security at san jose's airport and boarded a plane headed to los ( robin ) take a look at this. sheep are on the loose... on state route 37 and state route 121 in marin county. kron four received dozens of calls from

( james ) a man is in jail this morning... in connection with a hit-and-run in san pablo. it happened saturday morning on brookside drive near 23rd street. officers found a 33-year-old man suffering from multiple injuries. police then found an unoccupied sedan in the area that had front-end damage authorities say 19-year-old corell hackett was the driver. hackett was arrested... and booked for felony hit and run. the victim is in critical condition.. ( james ) new this morning... a school employee in san mateo county is charged with lewd acts with a minor. ian whiteman turned himself in after the victim's parents found evidence of inappropriate communication between whiteman and their child. the victim is 14 years old. police do not believe there are any other victims. whiteman worked at the san mateo and hillsborough campuses of nueva school. ( darya ) a u-c berkeley student is now back home... after spending weeks in a

southern california detention center for overstaying his visa. supporters greeted him at the oakland airport yesterday.( darya ) luis mora was in jail for nearly three weeks. he was detained by officers in san on new year's but with help from his mora got in judge and was ( darya ) mora says he will continue his studies while awaiting an immigration hearing. ( darya ) the remains of a u-s solder missing since the korean war have been identified as belonging to a san francisco man. now... those remains are in the bay area. private first class james leonard was killed in action while defending a south korean village. that was

( james ) breaking news this morning... a person has barricaded themselves inside the wyndham garden hotel in san jose. we're told this has been a situation that has gone in since last night. witnesses tell us the fbi is also on hand trying to deal with the sitaution. kron 4's will tran on the the way to the scene. ( darya ) solano county sheriff's deputies arrested a man accused of attacking another man with a machete. this is the suspect....44- year-old brandon foster of woodland. it happened at abernathy road and rockville road near fairfield. police say the foster was messing with the victim's breaker box....attempting to turn off the power to the victim's home. when the victim confronted him... police say foster attacked him

( darya) a big story we're following this morning ... the s-p-c-a says the dog flu is spreading to san francisco. kron 4's ella sogomonian has the latest. the veterinary team at the sf- scpa confirmed cases of the dog flu in san francisco.the non profit explains dog flu is similar to human influenza- in that most recover without any treatment.but there has been a reported death in the south bay caused by the canine flu.

so some symptoms to look out for are coughing, nasal discharge, lack of appetitie fever and fatigue.one dog owner we spoke with heard about the flu spreading from her friend in the south bay and got the first round of two shots for her furry friend.sot stephany lai, dog owner: "so in some ways i'm more concerned about her getting the flu than i am by myself. and i've heard cases where the flu can be deadly so it's a lot more severe for some other dogs so i'd rather just not take the risk."another dog owner who panicked when she heard about the flu but was frustrated she couldn't schedule her dog for the shot at the sf-spca soon enough.sot johanna arias, dog owner: "and they wanted to book an appointment with a doctor but i just needed a flu shot with a technician. and the closest appointment was in february and i was a bit stressed out because the dog flu is now. so i thought i would find somewhere else then i went online and it seems like it may be a marketing campaign from pharmaceuticals." police are looking for the thieves who targeted a toys-r-us in santa cruz. this is time lapse video of the theft. police say the crooks were well orchestrated. you can see one person sneak behind a counter and break into a cabinet and start tossing the stolen items to other people who look like they are shopping. police believe that this group has targeted other stores in the area. ( darya ) san francisco prides itself as being a bike friendly city ... in 20-12... the port of san francisco constructed a - safe bike lane- but it is not being used by riders. stanley roberts explains in this edition of people behaving badly.

you are looking at a class one bike lane in san francisco, it is completely protected from trafficnats: ambiance it has if own traffic signal it even has a stop sign. but it appears to missing two . or make that three things it's missing, bicyclists i say that only because i haven't seen one on the bike path entire time i was here. it's also missing parts of the fence. in random locations so you walk through here a lot? i walk through here fairly regularly, i just noticed they are missing part of the fences you come through here more than i do so what did you notice well i definitely noticed pieces of the fence are missing apparently someone borrowed close to a quarter mile of fence and not many people noticed.. now it looks like some of the fence was run over, you can tell that by the bent poles sticking out of the concrete barriers however in some cases it appears as if the poles were sawed off . which makes this protected bike lane not so protected this is a really nice bike path i usually just walk on the sidewalk or the bike path
