quality management district has cited a richmond scrap metal facility in connection with last weeks enourmous fire that prompted a big shelter in place. kron 4's dan kerman tells us -this is not the first time the company has violated air district regulations. it was last tuesday when fire broke out at this richmond metal recycling plant, sending toxic smoke into the air and forcing road closures, evacuations and residents to shelter in place.sotwe have

issued two notices of violation to sims metal in richmondthe bay area air quality management district has cited the company for a public nuisance violation and for the fire itself.sot tom flannigan/bay area air quality management district 26-33the open burn violation was due to the fact they were illegally burning at the facilitythis is not sims metal managements first run in with the air district in november and december of 2013 fires broke out at their redwood city facility violations were issued for both fires. while the cause of last week's blaze has yet to be determined, the investigation is continuing and if the company is found to have violated any regulations , additional violations and penalties could follow.sotthey have a permit to operate here in the bay area and we make sure they are following the permit appropriately that includes techniques to contain a fire and making sure emission from any kind of

activity there are going to be controlled in the best way possible . we'll be looking closely at that permit to make sure the facility followed it to a tea and to make sure they were doing everything they could to prevent this fire from happening.air samples collected from last weeks fire have already found hi levels of particulates and the cancer causing chemical benzene which was 3 times over the safe limit in point richmond and 40 times over the safe limit across the street from the facility standup dan kerman/sf 141-151if the recycling firm is found not to have followed proper procedures either before the fire or during the fire, the air district can also institute a list of corrective actions to prevent this from happening again. dan kerman kron 4 news. (robin@landing) a volunteer tutor with an afterschool program in mountain view is set to be arraigned today ... after being arrested for allegedly sexually assaulting two male students. as kron4's maureen kelly reports ... there could be more victims . moutain view police received a complaint friday from a parent at the sanyu learning center

that their son had reported being touched inappropriately by a volunteer at the school over the course of several months. during that investigation a second alleged victim came forward with a simular complaint.now yizhuang liu, faces two counts of lewd and lascivious acts with a child under 14 with force, and one count of continous sexual assault.the sunyu learning center is an private after school program....which is located behind but is not associated with this church on south springer road. their website says they teach chinese language to kids ranging from kindergarten to 6th grade, as well as math and other electives. (maureen)the operator of the school declined to be interviewed but a teacher who did not want to go on camera says lui had been with the school about two years. she told me she doesn't want to believe the accusations against lui....saying he was good with the students and that she trusts him.detectives are

concerned that they are other victims out there because lui was also on the board of directors of the sanyu learning center, and a volunteer at several other communtiy organizations, including a church and had opportunity to be alone with young boys. detective marco garcia says lui also was in contact with potenital victims using an social media ap.with the app he's communicating with some of these young boys. the app is called discord. it's a gamers app we are gamers communicate and he was able to commit connect with these young boyslui is being held at the santa clara jail without bail, he set to be arraigned tomorrow.maureen kelly kron4 news (robin) in the north bay... we are learning new information about the mother and son who are accused of running a prostitution ring. police say, david rome- sburg and his mother fay, were operating the prostitution ring in rohnert park for more than 10- years. during that time-- police say, they employed about 150 women. police spoke to

eight of the women who worked for the mother and son. one of them said, she was underage when they recruited her -- and another says, she was sexually assaulted during her interview. the rome- sburgs were arrested last month ... and now face multiple charges. one of their main focuses for improving traffic flow around the bay area is to improve existing roadways. because there's very little space left to build new roads and highways, they want to upgrade existing routes to handle the growing number of vehicles. along the pennissula, caltarns is planning to alter highway 101 between san francisco and santa clara county by adding an hov lane and converting right hand merge lanes into a dedicated travel lane. that project is still in the public comments phase.in the north bay, caltarns hopes to relieve east bound evening congestion out of marin by adding a third lane over the richmond san rafael bridge. if all goes well, that lane is scheduled to open this coming april.while caltrans works on these large projects they are also encouraging commuters to help out anyway the can by car pooling, taking public transportation, riding bikes to work , or possible.that they are starting to give large scale. . long such as building a across san francisco bay. an endeavor of that scale will take years . maybe decades. . to study, develop and build. and new bridges or

road and southwood drive near the pittsburg/bay point bart station. officers responded to a call about a car crashing into a pole. once on scene ...they found a man unconscious in the driver's seat suffering from a gunshot wound to the chest. he was taken to a local hospital where he's in critical but stable condition. (robin) two men are behind bars... on suspicion of auto burglary in the east bay. it happened monday on 45th street in emeryville. a security guard at pixar animation studios says he spotted two suspects looking into parked vehicles with flashlights. once at the scene officers spotted 20-year-old andrew tyler holle ... and 22-year-old hasani malik-inari venson. police found two tablet computers and someone else's credit card on holle . officers say venson ... had insurance information for a nearby car. the duo were arrested. police also found two vehicles with broken windows nearby. hurries to pass stopgap measures to prevent another government shutdown, immigration is one of the key issues attached to the budget deal that has the left and the right butting heads.president trump has offered a path to citienship for one point eight million immigrants, but in exchange wants 25 billion dollars for border security - including his proposed border wall."if we don't change it let's have a shutdown,we'll do a shutdown, it's worth it for our country, i'd love to see a shutdown if we don't get this stuff taken care of."because democrats oppose limiting legal immigration, the president's proposal hasn't gotten much traction.chief of staff john kelly says the one point eight million immigrants mentioned in trump's proposal include those who were, quote, "too lazy" to ever sign up for daca protection.democrats were quick to pounce, saying they doubt the administration's promise not to start deporting illegal daca recipients without a criminal record. senate majority leader mitch mcconnell thinks the president's proposal should gain traction."i'm honestly shocked that the other side didn't say sign me up."leading

(robin) illegal dumping has become all too common in the bay area.most of the time we hear about it in urban main streets and side streets.but as stanley roberts points out ... we are seeing more problems on our bay area back roads. along port chicago highway in contra costa county is this adopt a road sign with the 834th transportation battalion's name attached yes the highway was adopted... but that was then and this is now all up and down port chicago highway has become a huge dumping ground to give you an example this green mercury was abandoned or should i say dumped along with all the items stuffed inside including an air conditioner .. this i near the intersection of lake view and port chicago nats:

ambiance in some areas there are piles of gravel which has been dumped on the side of the road and lots of tree trimmings this is just one of many this is the community of shore acres, an area i just learned about because a viewer sent me an email asking for help while in the area i noticed the open fields with cows roaming freely and there was no shortage of wildlife but one can't help but notice all the illegal dumping nats: ambiance over at driftwood and port chicago there is even more trash and debris but look at this . its a camera . and according to the sign it was put there there by contra costa county public works to record any illegal dumping i called the number and was told they were not aware of any cameras in this area .. further down on nichols road it's get worse . and this is all with in an stones throw from the contra costa water district public water supply if i had a trophy to give away . oh wait not to mention a whole refrigerator not to mention other things this whole area needs a serious cleaning up but my only fear once that happens more stuff

affordable housing in the bay area . federal housing statistics estimate ... 12 - million renters and homeowners ... now pay more than 50- percent of their annual income for housing. bay area cities know this crisis all too well ... and in emeryville ... there's a brand new development where rents are a bargain. but as kron 4's philipp djegal explains ... you have to qualify to get in. welton jordan/nats- "87 units. you'll probably have four to five hundred people living here." four years... and countless hours of tough negotiations between more than a dozen agencies later... and, now desperately needed affordable housing is coming to the city of emeryville construction on estrella vista on san pablo avenue began in june... a 64-million dollar project.

and, the apartment complez should be ready to start housing families the summer of 20-19.welton jordan/nats- "for this building, we'll probably have thousands of applicants, of which we can only house 87." welton jordan is vice president of real estate development for e-a-h housing. a non-profit affordable housing developer... managing more than 100- properties in the bay area... estrella vista is their latest project. and, the best part of this project when it's all finished... is that all of the units inside -- will be considered 100- percent affordable housing. ally medina/vice mayor- "that means that people making 30 to 60-percent of the area median income will be able to afford to live here, and the rent will be based on their salary and income." the area median income for a family of four in alameda county is 97,400 dolllars. emeryville vice mayor ally medina says 70-percent of her city is made up of renters -- and she's one of them.ally medina/vice mayor- "even though the city of emeryville was able to give the land and a loan of four and a half million dollars, we would not be able to make this project happen by ourselves. we were really appreciative of our partners." one of those partners -- being the city of

oakland... a fitting collaboration since the new development sits on the border of both cities.michele byrd/dir. oak housing/comm. dev.- "the city of oakland provided about pretty much four to five million dollars, and that way, we'll have 30 units dedicated to oakland residents." michele byrd is director of housing and community development for the city of oakland. she says in addition to the estrella vista project... the city has received 16 new applications from developers to build more affordable housing.michele byrd/dir. oak housing/comm. dev.- "and, we're looking at hopefully over the next three to five years, with those 16 applications, to build about 15-hundred units of affordable housing." in 20-11, a state supreme court ruling resulted in the elimination of all 400 california redevelopment agencies... which typically funded affordable housing projects. losing r-d-a's puts more of a burden on developers like e-a-h housing to secure funding for these projects. often developers rely on the state density bonus law to expand projects and build more units. the density bonus law is a state housing mandate that allows developers who

bay... police are cracking down on sideshows....which seem to be getting more and more dangerous. we are now seeing sideshows across the bay area. recently, an officer was been hit by a car... and guns have been fired into the air. in response to the chaos... multiple law enforcement agencies have formed a special task force to address the situation. ( terisa ) police say they believe they will be able to reduce the number of sideshows with the combined law enforcement effort. ( terisa ) police in vallejo are increasing their effort to track down the hit-and-run driver who killed a woman. this happened on january 26th on sonoma boulevard. officers say 27-year-old lori walker died at the scene. they say the

car that hit her is a 2006 to 2008 grey honda. ( terisa ) a gas leak forced people out of their homes in san francisco. the leak was reported around 4-30 yesterday afternoon. this happened near the victorian houses near alamo square park... after a contractor hit a gas line. firefighters had to go door-to- door... evacuating people. 16 people had to get out. but less than an hour later... the leak was stopped. ( terisa ) police in berkeley are investigating an armed robbery. it happened early monday morning near the cal campus. police say the victim -- a student -- was approached by a group of 4 people. one of them

pointed a gun and robbed him of his belongings. the suspects then ran off west on channing way before turning south on telegraph avenue. campus police reported seeing a group jump into a black sedan. the student was not hurt. ( james ) national news... the u-s government is still operating without a comprehensive budget. and last night... the house approved another short-term fix. this is the fifth short-term spending bill passed since october. from here... the bill will go to the senate and it must be approved before thursday night. republicans are blaming democrats for the failure to reach a long-term agreement. the big sticking point is immigration... specifically an agreement to protect so- called "dreamers" from possible deportation. court today. the guatemalan citizen is accused of killing edwin jackson -- a linebacker for the indianapolis colts and uber driver -- jeffrey monroe. u-s immigration officials say orrego-savala has been deported twice before -- in 2007 and 2009. he was also convicted of a dui in redwood city. (lydia) protesters will gather here at 11:30 to speak out against the arrest of david cole... a uc berkeley employee. let's take a look at the video of coles arrest. david cole is 51-years old and works as a cook at uc berkeley employee. he was detained during a protest where he and about 100 other employees were picketing for the fair treatment of campus employees. a video circled online shows three uc police officers wrestling cole to the ground. he sustained a cut on his forehead during the arrest and was treated by the berkeley fire department before being transported to highland hospital. cole was then booked at the berkeley jail, cited for vandalism and resisting arrest. witnesses say the arrest stemmed from a car than had began to "push through the crowd and make contact with the picketers, who were occupying the

( terisa ) in santa clara county... voters have four months to consider a controversial effort to recall superior court judge aaron persky. the board of supervisors is sending the recall effort... which collected some 95-thousand signatures... to the june ballot. judge persky is under fire for handing down what ácritics feel was a far too lenient sentence.. to a former stanford swimmer.... who sexually assaulted an intoxicated, unconscious woman after a party in 2015.

pixar animation studios says he saw two people looking into parked cars with flashlights. once at the scene officers spotted andrew tyler holle... and hasani venson. police found two tablet computers and someone else's credit card on holle. officers say venson had insurance information for a nearby car. the two were arrested. police also found two cars with broken windows nearby. ( james ) a kern county judge ruled in favor of a baker who refused to bake a cake for a same-sex wedding. the judge says he believes the issue is a matter of free speech...and that a cake is a form of artistic expression. he argued if the owner refused to sell anything at all to same-sex couples... then that would be considered discrimination. the owner of tastries bakery says she will sell a cake to anyone. < i am very happy to serve anyone who walks through that door anything in my case, make a birthday cake for anyone, i just cannot be a part of something that's not ordained

according to a new study from u-c berkeley. (terisa) researchers say up to one in 20 kids fall somewhere on the spectrum of disorders... caused by maternal drinking. a previous study found that up to one in 100 american children were affected by drinking during pregnancy. (james) some disorders caused by maternal drinking... include abnormal growth and facial features... intellectual disabilities and behavioral problems. ( james ) new video this morning showing some good timing on the part of the contra costa county sheriff's rescue unit.( terisa ) while training -- a helicopter pilot spotted a cow with its head stuck in a tree near los vaqueros two air crew members sprang into action... breaking a stump away and setting the calf free.( james ) it's not known how long the animal had been stuck. after being freed the cow ran away and is expected to be okay.

(james) oakland international airport is now offering non stop flights to rome. the norwegian air flight takes a little over 12 hours. the service will operate two times per week on a boeing 787 dreamliner. this is the first nonstop bay area service to rome... since 2001.
