edgardo ortiz... is facing 50 years in prison...when he returns to court for sentencing in march. ortiz was arrested in september 20- 16... after a chp officer spotted him on interstate highway 280. prosecutors say when that officer checked inside the vehicle....he found ortiz sexually assaulting a teenage boy. ortiz...met the teen when he was coaching baseball at a redwood city elementary school. he remains in custody on $four million bail. (steve) happening tonight... a community meeting is being held in santa clara to discuss the future of smoking in that city. the proposal being presented would limit or ban people from smoking cigars, cigarettes, e- cigarettes, and any other tobacco or marijuana products. the proposed ban would only be in outdoor public spaces and multi-family housing units. the meeting tonight is at 6:00 (vicki) more bay area law enforcement agencies are adding text messaging 9-1-1 service in 2018. text message technology has been around for quite a while...but it is a new concept for most police department's here in

(steve) developing tonight: senate leaders say they've reached a deal to avoid a government shutdown. the deal would fund the government for the next two years. but as white house correspondent mark meredith reports, the threat of a shutdown is still very much alive. senate majority leader mitch mcconnell says for the first time, in a long time, senate leaders have agreed to pass a federal budget."this bill represents a significant bi- partisan step forward"if approved, the deal would fund the government for the next two years.in it, the senate adds 300 billion additional dollars for military and domestic programs, extends the children's health insurance program, or chip, for ten years, and boosts spending to fight the opioid epidemic. senate minority leader chuck schumer says the deal isn't perfect, but it's better than no deal at all."the budget doesn't have everything republicans want, or what democrats want, but it has a great deal of what the american people want"but not every senator is ready to vote yes.republican senator john kennedy says most lawmakers need to read the details of the deal first. (catherine) the house minority leader first announced that she was opposed to the budget deal...and then began to talk....and talk....for hours. more than '8' hours in fact.. even some of her most fervent supporters began to fidget and play with their phones. pelosi told stories about the dreamers....also touching on topics ranging from the pope to the need for more nurses. this was her way of demanding a vote on legislative protection for the dreamers.....undocumented immigrants who were brought to the u.s. when they were children. house minority leader nancy pelosi - why are we here if not to protect the patriotic young people who are determined to contribute and to strengthen america. so i'm going to go on as long as my leadership minute allows. this wasn't technically a filibuster. that's a move used in the senate to delay or block legislation and there isn't an official house equivalent. the status of dreamers has been in jeopardy... with president trump giving congress until marchto come up with a solution. vicki and steve?

(steve) new tonight at five..we've learned major flooding at the dmv near the oakland coliseum.. was caused by copper wire thieves.. we've also learned that dmv will not reopen before monday. police say someone reportedly stole copper wire last night after getting on the roof. they only took about 50 dollars worth of copper...but it caused tens of thousands of dollars worth of damage. people will now have to go to other bay area d-m-vs. "yeah it's probably even more packed over there. daaaamn.""i can't get my car registered now. i guess i gotta go to the other one now."(steve) local bay area d-m-v offices are honoring appointments scheduled for the coliseum d-m-v. again, monday is the earliest the coliseum d-m-v will reopen. teenager putting a raw egg in the mouth of her aunt's golden retriever...testing her obedience. this is 'sookie' - a sweet-natured dog who played along and gently held the egg in her mouth without breaking it. the problem - it's still basically a stupid idea. the video went viral and now veterinarians are warning that it's putting pets at risk. one doctor told 'buzz feed' that the potential problems include choking, and getting sick from the bacteria that's on the outside of the eggshell..... the sharp shards of the shell can also cut a dog's mouth if it bites into the egg. lots of people have been repeating the challenge with their own dogs -- and things don'talways end as well as they did with sookie. vicki and steve? berkeley... police are searching for a suspect in an armed robbery. it happened early monday morning near the cal campus. police say a student was approached by a group of 4 people. one of them pointed a gun and robbed him of his belongings. the student was not hurt. (vicki) in the south bay... the number of flu cases is on the rise. health officials say the south bay is putting northern california high on the list for flu severity. the bay area ranked number 11 nation wide with the most severe cases of one strain of the flu. and it was particularly bad in the south bay. (steve) in the north bay... a church in vallejo has been damaged in a fire. it happened this morning at the church of the living god on sonoma boulevard. firefighters said one person was inside when the fire broke out, but nobody was injured. crews were able to put the fire out quickly. (vicki) on the peninsula... two people are arrested on suspicion of identity theft. police found the two suspects sitting in a parked car on bayhill drive near interstate highway 380 in san bruno. officers searched the duo from florida... and found fraudulent credit cards and

(steve) in the east bay... police are looking for two gunmen after separate deadly shootings in oakland. and the happened just hours apart. the first shooting happened around 10 last night... on edes avenue. once at the scene...officers found a woman suffering from at least one gunshot wound. she was taken to the hospital...where she died. then around two a.m. today... shots were fired near chapman street. officers arrived and spotted a man laying in the street with a gunshot wound. he died at the scene. the suspects involed in both cases...are at large tonight. 65-thousand dollars after he sued vocational instructor silvia pulido. cordoba says pulido pressured him into trading sex acts after promising him a lawyer to help him get out of prison. the 57-year-old cordoba says the abuse began in 2010 when he became her clerk. and when he attempted to escape the sex deal...pulido accused him of disciplinary violations that put him in solitary confinement for nine months. (vicki) happening now... the marine mammal center is monitoring a sick sea lion. the lethargic animal was found in the waters near san francisco's aquatic park this afternoon. this is video of the sea lion at the hyde street harbor. the mammal center says the sea lion is also suffering from some injuries-- possibly due to a shark bite. the sea lion swam back out into the waters-- and right now a veterinarian is waiting to see if the lion needs to be rescued. (steve) also happening now... a warning about a hepatitis outbreak in monterey. city officials announced the outbreak affecting their homeless population today. this

comes as santa cruz county is celebrating the end of their hepatitis-a outbreak that began in april of last year. there were 76 cases there... and at least one lead to death. in monterey county... nine people with a history of homelessness have been diagnosed with hepatitis- a since october. health officials are asking the community to increase efforts to stop the transmission of the virus. (steve) san francisco city leaders are celebrating $10 million in state funding for two new navigation centers...to help the homeless. the two new facilities will be locted at bayshore blvd and division circle ...and will serve people living in encampments...who have been unable to access services like intensive case management. city officials say centers have a proven track record of getting people into stable housing. there are currently five navigation centers throughout san francisco. (steve) the government recognizes that if you pay 30-percent of your income on housing... you need may need help finding something affordable. bay area cities know this crisis all too well... and in emeryville... (steve) on the peninsula tonight: a 77-year-old woman was arrested after police say she pulled a gun on a family member. it happened around five pm tuesday on maxine avenue near south norfolk street in san mateo. police say they we able to persuade the woman to leave the home without the gun. she was taken into protective custody and transported to a hospital for a medical evaluation. authorities say the incident all started with argument. (steve) in the east bay... police in oakland are looking for two gunmen after two deadly shootings. the crimes happened just hours apart. the first -- around 10 last night... on edes avenue... a woman was shot... and later died. then around two a.m. today...

(pam) in the north bay - this man has been arrested - accused of burglarizing five businesses in fairfield last monnth. this is the suspect --- john scharff in each crime - police say, he used a pellet gun to shoot out a window ... to get into the business. detectives identified the suspect by using video surveillance footage from each of the victim businesses. they also discovered evidence related to a pair of similar burglaries .. that west sacramento police are investigating. (steve) new at six... san francisco is getting two new navigation centers. san francisco city leaders voted to accept the ten-million dollars in state funding yesterday. the two facilities will service homeless people living in encampments. the navigation centers help people unable to get health care, drug treatment and other services at traditional homeless shelters. according to city officials, the centers have proven successful at getting people into stable housing. estimates suggest there are nearly 7,000 homeless people in san francisco. (steve) pleasanton has approved the development of a residental community for individuals with special needs. sunflower hill will house people with mild to moderate developmental disabilitles. the sunflower hill will be co- located with another development project-- homestead at irby ranch. the developer donated more than one-and-a-half acres of land to sunflower hill... and donated one million dollars. in total... the pleasanton is contributing more than two million dollars to this project.

details about a jail riot near bakersfield.. it involved 120- inmates..(steve) investigators say it started last with a fight between inmates in a housing unit who refused to go on lockdown. it all lasted about two hours... at the lerdo jail. bakersfield police and the california highway patrol were called in to help get a handle on the situation. the violence left housing units damaged.... and inmates were placed elsewhere in the large facility so that repairs could be made. there are more than 12-hundred inmates at the facility... the jail remains on lockdown and visits are suspended. (pam ) a convicted murderer at san quentin state prison was turned into a sex slave and is now being compensated for the abuse..

a federal jury is giving william cordoba... 65- thousand dollars... after he sued vocational instructor silvia pulido. cordoba says... pulido pressured him into trading sex acts, after promising him a lawyer to help him get out of prison. the 57-year-old cordoba says, the abuse began in 2010 when he became her clerk. when he attempted to escape the sex deal ... pulido accused him of disciplinary violations... that put him in solitary confinement for nine- months. the employee no longer works at the rison. (steve) reform groups are asking the state to end the use of pepper spray in juvenile jails. california is one of only six states that allows employees to carry pepper spray in youth detention centers. the board of state and community corrections is meeting tomorrow to consider regulatory changes. the changes would allow employees to carry the chemicals but document its use. a bill introduced by a southern california assemblymember would prohibit employees from carrying pepper spray.

massive car pile-up in iowa. this is time lapse video of the collision... released by the iowa department of transportation. the department says one person was killed and another severly injured in the collision. the department says about seventy cars were involved in the pile-up. lawrence karnow: our stretch of beautiful weather with above normal temperatures continue today. several more records feel again. it is a gorgeous evening outside but i'm beginning to see some changes in the weather coming our way. if you're looking for rain you have to look all the way to our border with canada. but high pressure is showing some signs of weakening. on the satellite you can see that high pressure has begun to flatten out. even though it will be another warm day tomorrow we may begin to see a few patches of fog develope along the coast especially late in the day. highs tomorrow will again soar into the 60s and 70s near the coast with some mid to upper 70s inland. it will still be warm but cooler on friday with 60s and patchy fog at the coast and 70s and sunshine inland. it will be partly cloudy and windy on saturday with cooler temps generally in the 60s. it will mostly sunny on sunday but there is at least a slight chance of a few widely scattered showers on monday. sunshine and mild weather will return on tuesday and wednesday. a full hour of entertainment news is on the way. at 7:00 it's inside
