(robin@landing) in our top story this morning ... a man caught on camera ... lurking on several properties in martinez. this is video of the man with a flashlight and a knife outside one home.the homeowner says his wife and kids were home at the time. kron 4's j.r. stone caught up with the victim and has his story. this is all new motion activated surveillance video showing a man with a knife rummaging through someone's carport. maybe not too shocking until you hear more details. the husband that lives at this home was in germany at the time and got the update showing what was happening on his phone while he was at work. his wife was inside that house in the distance with their kids sleeping.i see this stranger coming in the front gate.this guy is a burglarwearing a mask and everythingstephen maris who was in germany working in the afternoon immediately called martinez police but because he witnessed the man leaving, and

because it was 4 am california time, he told them not to rush over to the house until his wife got up at 6.sot"i mean it would have been worse if he was trying to gain entrance into the house. i would have totally freaked out. i don't know what i would have done. all you can do is hope the cops are there quick enough." the man took a 450 dollar chainsaw and was caught on another martinez residents surveillance video that night too. stephen says he wants the picture out there in case someone recognizes the man. he has the nest surveillance system set up all over his property so that if his chickens fall victim to a coyote he'll know where that coyote's coming from. this man wasn't preying on chickens though.sot"i kinda question what i would have done if i was home. i don't know if i would, i would have definitely called 911 right away but would i have confronted the guy? you know. everybody out here in the country is kinda armed. there are guns everywhere. the guy is really risking his life walking around here at night in farm country ha ha ha."

(robin @ landing ) another big story this morning ... new video was leaked ... showing a deadly shooting involving a bart police officer. shaleem tindle was killed january third when a bart police officer shot the 28-year-old across the street from the west oakland bart station. the leaked video is from the officer's body camera ... and we want to warn you ... it's graphic. an officer initially say raise your hands. then gunshots. then more gunshots ... then he says raise your hands now. we froze the video because of the graphic nature of what happened. tindle's family has filed a civil claim against bart ... a gun was found on the ground at the scene. the family admits that it was tindle's gun but say he was not holding the gun when the officer opened fire. bart released a statement last week saying that they are conducting multiple investigations into the shooting and that they will release all relevant information once the investigations are complete. they have not commented on the leak of this video. stay warm ... but that is threatening homes. kron 4's ali reid has more. this has been an ongoing issue for years.no one seems to know who's responsible for conducting homeless sweeps .... but it's really starting to affect families living here. setting fires on this property has become the norm.this is ridiculous. it's not safe for them or for ussince the jungle closed down, the homeless have been finding shelter wherever they can. some of them have flocked to this property near herald avenue. back in november, a huge fire took down the singh's backyard fence. since then he says the department has been back.they start fire under the tree and the tree was burning it's frustrating for homeowners who've been calling the city non stop. it's been a cat and mouse game trying to figure out who's responsible for the land. the city says it's private property, but no one knows who the owner is ... everybody's pissed off. everybody's unhappy.the city did a sweep in november, soon after the last fire. but then the homeless returned and started rebuilding the next day.every week they start

increasing i numbers. first there were 2, then 4, then 6, now if you look there are about 15-20 camps. once they clear them from our side, san jose city side, then they go to caltrans side. once they clear them from caltrans they come back to this side.i reached out to the city ... and a rep from the homeless concerns team forwarded me to the code enforcement department. but families here are looing for a long term fix. we don't want to be like clear them out or kick them out. they're going to come back again. we want the city to find a permanent solution. standupi spoke with the inspector assigned to the this case and he tells me he will be here tomorrow to figure out if they can make any type of enforcement.if not it'll go back to the homeless response team.reporting live in san jose ... ali reid ... kron 4 news.

(robin) when voters legalized recreational marijuana ... proposition- 64 also allowed those with marijuana convictions ... to have them reduced or even dismissed. alameda county has been doing that for more than a year now. kron 4's dan kerman has more. it wasn't too long ago when possessing and selling marijuana was illegal in california. but voters changed all that and now alameda county's da is reminding people that law also allows those convicted or marijuana related crimes to get them wiped off the books. sot nancy o'malley/alameda county district attorney 17-27 people that 15 years ago who were possessing a joint of marijuana could have been convicted of that crime and that could be part of the conviction that we have here since the law passed in november of 2016, the da's office has dismissed 609 prior convictions but they still have 5900 cases review and bring to the courtsotif somebody does notify us then we will move it to the top of the list and get it in the courtroomo'malley says dismissing marijuana crimes can make all the difference for some, because having a felony conviction on your record can come with significant drawbacks sotfor

how police used social media to catch the suspects. well, the assault back in december. an elderly woman who lives here in pleasanton was retunring home from shopping when she was attacked by three young men. fortuantly, police say they believe they have arrested her attackers.the pleasanton police depatment says that last friday an east county tactical team, along with the city's criminal investigation unit, arrested three juvenile suspects in oakland. they are accused of assaulting and robbing an elderly woman in pleasanton last december.according to police, back on december 7th, the victim left this target in livermore and the suspects followed her to her home here along chardonnay drive in pleasanton. two of the suspects then allegedly assaulted the victim, while a the third boy stole her purse. all three suspects were described as black males with thin builds wearing hooded sweatshirts.during the alleged assault, a neighbor along chardonnnay saw what was happening and confronted the boys, who then fled the scene. upon further investigation, police discoverd two juvenile females near the crime scene who were familiar with suspects. the girls admitted to being with the boys, but denyed knowing their names.

they claimed to have connected with the boys through instagram and confirmed that the suspects had followed the victim from livermore.after interviwing the gilrs, investigators served search warrants on several instagram accounts and were able to identify one of the suspects as a 17-year-old from oakland. that led to the identification of the other two boys. all 3 suspects are now facing charges of robbery and elderly abuse. as they are still juveniles, their identities have not been made public. pleasanton pd says this still an active investigation and they are asking that anyone with information to please give them a call.in pleasanton, charles clifford kron 4 news. the pleasanton police depatment says that last friday an east county tactical team, along with the city's criminal investigation unit, arrested three juvenile suspects in oakland. they are accused of assaulting and robbing an elderly woman in december.according to police, back on december 7th, the victim left this target in (robin) police are searching for three people accused of robbing a man at a san francisco bart station. it happened around one monday afternoon ... at the 16th street bart station ... in the city's mission district. we're told the three robbers approached a victim on the platform and took his wallet from him. the robbers then ran off... and remain at large this morning. happened in concord back in january.surveillance video shows the man buying a bag of chips. he then grabs the money out of the register and takes off. the police department has not said which convenience store was robbed ... only that they are looking for the man seen in the video. in the south bay... what was described as a routine check of a suspicious vehicle... led to the recovery of a truck load of stolen property. melissa vincent was arrested for being under the influence of drugs as she sat behind the wheel of a u-haul truck parked in mountain view. the arresting officers looked in the back of the truck... and found tons of stolen property... as well as a pair of bolt cutters. possession"> vincent is charged with

(robin) an update on a big story we continue to follow. two men facing multiple charges for oakland's deadly ghostship warehouse fire ... entered ánot guilty pleas yesterday. the trial date was also set for this coming summer. both derek almena and max harris pleaded not guilty to 36-counts of involuntary manslaughter in the 20-16 fire... which killed 36 people. almena's defense attorney ... says he plans to get the charges against both men dismissed ... alleging that city and county officials did nothing to alert them ... about the dangerous conditions at the ghostship.

(robin) however, the prosecution maintains the behavior of both defendants rose to the level of criminally negligent on the night of the deadly fire. the next court appearance to revisit bail is scheduled for in march. fire in oakland ... where marijuana was found growing. it happened around eight yesterday morning on east 32nd street ... near highland hospital. firefighters searched the structure and no one was inside ... but they found about 200 marijuana plants. the fire started by a floor heater. no one was hurt. (robin) a follow up now on the swarm of earthquakes that hit the east bay yesterday morning. kron4's maureen kelly talked to a seismologist from u-s-g-s who says there's been quite a bit of activity in that area over the past several days. here's a list of this morning's quakes that hit around mt diablo.starting with a 2-point-8 quake just after 130 am.followed by three others three hours later....measuring 2-point-6, 3-point-0 and 2 point 9, all within seconds.but that's not all.....the usgs website shows that there's been more than 2 dozen small quakes in this same area since friday.but usgs seismologist brian kilgore says this is not considered unusal seismic activity for this area.there been a series of swarms there was one in 1970 and most

recently in 2015 in san ramon they're all very close together they're all kind of similar but there's one interesting thing to note. tover the years the small swarms have thus far not resulted in a large earthquake following people are always interested in that it is not happened yet that does not mean that it can't or won't happen in the futureso far, the largest were a pair of quakes measuring 4-point-4 during a swarm near alamo in 1990. but be prepared....beca use the bay area is due for a big shaker. the sit in the san francisco bay area the probability of a large magnitude 6.7 or larger earthquake in the next 30 years is about 70%. the hayward fault has the highest probability of that large earthquake, mostly because the hayward fault has been well studied and large earthquakes tend to occur there every 150 years and we're overdue for that large earthquakeso what made for a fitful night sleep for those living around danville should act as a wake up call for us all. maureen kelly kron4 news.

morning ... there may be new hope for the millions of children with peanut allergies.... a locally based company has come up with a potential new treatment.. the company "aimmune therapeutics" is in brisbane and doctors there have been testing daily doses of peanut flour - contained in a capsule and sprinkled on food. 500 children in the study got daily doses that gradually increased over 6 months. at the end of the study ... 67 percent of the kids were able to tolerate roughly two peanuts. the treatment is not cheap however ... the c-e-o says the first six months of treatment cost between five-thousand and 10-thousand dollars. then $300 to $400 a month after that. ( darya ) happening today it is the one year anniversary of the flooding at coyote creek in san jose.( james ) that flooding forced thousands of people from their homes. today there will be ceremonies to honor the first responders.( darya ) will tran is live in san jose with the details. ( will ) a year ago on february 21, 2018, shirakawa school was shaken by a tragedy that impacted close to 100 students and their families. the rock springs floods left many students and families displaced. it was during this time the school community came together in support of those students and families impacted, raising funds, providing basic resources such as food & clothing, and extending counseling services to those in need. we will be hosting a special recognition of our community heroes who lead the efforts at shirakawa school to show our gratitude for their dedication and

he was in germany. he says he got an alert sent to his phone from his security system showing what was happening. he said his wife and kids were asleep inside the home so he immediately called martinez police. ( darya ) the man took a 450 dollar chainsaw from a carport and was caught on another surveillance camera at another home later that night. the man is still on the loose and the homeowner is hoping that somebody will recognize the man and call police. ( james ) two people charged with murdering an alameda county sheriff's explorer will stand trial. laura rodgers and curtys taylor are accused of stabbing and burning 21-year-old karla ramirez to death back in 2016. yesterday a judge ruled that there is enough evidence to send the case to trial. ramirez's body was found at the arroyo viejo recreation center in east oakland. she was a volunteer with the sheriff's explorer program. rodgers and taylor are due back in court next month.

( james ) new this morning... a south bay high school has announced a committee to look into ways to better prevent sexual assault against students. this comes after a number of sexual assault accusations were made against teachers at presentation high school in san jose. the accusations were made against at least 8 different teachers. parents say the problem stems from the way that presentation high... handles these accusations. the new committee is meeting to discuss student and faculty policies regarding sexual assault. the committee will then make recommendations on how best to improve those policies. ( darya ) we are learning more information about san francisco giants legend orlando cepeda who remains in the hospital this morning. t-m-z is reporting that cepeda hit his head after falling down in the parking lot of his gym on monday. according to reports in pouerto rican newspapers... which is where cepeda is from... the all of famer is unconscious and not breathing on his own.

we will keep you updated as we learn more about his condition this morning. ( darya ) in the east bay... an elderly woman ... followed home, attacked and robbed. it happened in pleasanton. the woman... was returning home from shopping when three teens attacked her. the attack happened back in december but police say they now believe that they have the attackers in custody. the arrests happened last friday. all three of the teens are from oakland. police say two of them attacked the woman while the third stole her purse. they say the boys had followed the woman from livermore to her home in pleasanton. all three are now facing charges of robbery and elder abuse. ( james ) a san jose neighborhood continues to deal with a homeless encampment in their backyards... and they say it is threatening their safety. we spoke to a family back in november after a large fire burned down a fence and threatened their home. now other people in the neighborhood fear their homes could also be in danger. the homeless have been finding shelter wherever they can since the jungle closed

( darya ) as the national gun control debate continues follwing the massacre at a florida high school the supreme court decided it will not hear two gun cases out of california. one - challenged 10 day waiting periods for all firearm purchases in the state. california's attorney general argued the waiting period gives law encforcement time to conduct proper background checks... and the gun purchaser time to cool off if they're considering suicide or gun violence. in the second case the supreme court turned away - gun owners and the n-r-a who were challenging

12-year-old in texas had a routine tonsilectomy... and her parents were concerned she was prescribed such a large amount of hydrocodene. they said after just 3 days of taking the medication... the middle-schooler prefered it. she told her parents that it worked better than the tylenol they suggested. a doctor at the american acadamy of pediatrics says that prescribing opiods to children can be extremely dangerous. ( will ) a year ago on february 21, 2018, shirakawa school was shaken by a tragedy that impacted close to 100 students and their families. the rock springs floods left many students and families displaced. it was during this time the school community came together in support of those students and families impacted, raising funds, providing basic resources such as food & clothing, and extending counseling services to those in need. we will be hosting a special recognition of our community heroes who lead the efforts at shirakawa school to show our gratitude for their dedication and support.

( darya ) happening now... police are searching for three people who robbed a man at a san francisco bart station. it happened at the 16th street bart station...in the city's mission district. police say the three robbers approached the victim on the platform and took his wallet before running off. police do not have a description of the robbers this morning. ( darya ) in the east bay... a man is caught on camera lurking on several properties in martinez. this is video of the man with a flashlight and a knife outside one home. the homeowner says his wife and kids were home at the time. he was in germany. he says he got an alert sent to his phone from his security system showing what was happening. he said his wife and kids were asleep inside the home so he immediately called martinez police. from a carport and was caught on another surveillance camera at another home later that night. the man is still on the loose. ( james ) two people charged with murdering an alameda county sheriff's explorer will stand trial. laura rodgers and curtys taylor are accused of stabbing and burning 21-year-old karla ramirez to death back in 2016. yesterday a judge ruled that there is enough evidence to send the case to trial. ramirez's body was found at the arroyo viejo recreation center in east oakland. she was a volunteer with the sheriff's explorer program. rodgers and taylor are due back in court next month. ( james ) new this morning... a south bay high school has announced a committee to look into ways to better prevent sexual assault against students. this comes after a number of sexual assault accusations were made against teachers at presentation high school in san jose. the accusations were made against at least 8 different teachers. parents say the problem stems from the way that presentation high... handles these accusations. the new

followed home, attacked and robbed. it happened in pleasanton. the woman... was returning home from shopping when three teens attacked her. the attack happened back in december but police say they now believe that they have the attackers in custody. the arrests happened last friday. all three of the teens are from oakland. police say two of them attacked the woman while the third stole her purse. they say the boys had followed the woman from livermore to her home in pleasanton. all three are now facing charges of robbery and elder abuse. x launch cancellation again ( james ) scientists with the u-s-g-s say the recent earthquakes near danville are not a cause for concern. we first told you about the earthquake swarm yesterday on the kron 4 morning news. the u-s-g-s website shows ... there have been more than two- dozen small quakes in this same area since friday. this activity is happening near the calaveras fault .. which runs thru the san ramon valley. seismologists believe ... there is a more than 70- percent probability

of a six- point-seven quake or greater ... hititng the bay area in the next 30- years. they say the hayward fault... which runs through the east bay, is the most likely candidate for that kind of activity.. ( james ) police in southern california say they have stopped a high school shooting plot. a security guard at the high school in whittier... told police he heard a student threaten to shoot up the school. when police went to the teenager's home they found several guns and ammunition. police are expected to reveal more information about the plot at a news conference later this morning. ( darya ) as the national gun control debate continues follwing the massacre at a florida high school the supreme court decided it will not hear two gun cases out of california. one - challenged 10 day waiting periods for all firearm purchases in the state. california's attorney general argued the waiting period gives law encforcement time to conduct proper background checks... and the gun purchaser time to cool off if

legalized recreational marijuana ... it allowed those with pot convictions ... to have them reduced or even dismissed.(james) alameda county has been leading that effort. kron 4's dan kerman has the story. it wasn't too long ago when possessing and selling marijuana was illegal in california. but voters changed all that and now alameda county's da is reminding people that law also allows those convicted or marijuana related crimes to get them wiped off the books. sot nancy o'malley/alameda county district attorney 17-27 people that 15 years ago who were possessing a joint of marijuana could have been convicted of that crime and that could be part of the conviction that we have here since the law passed in november of 2016, the da's office has dismissed 609 prior

( james ) this morning california is facing the threat of another drought. state water managres say this winter is on track to be one of the driest ever in california. according the the state department of water resources: about 80 percent of the state is abnormally dry or in a drought. three months ago it was just over 25 percent. state officials say the one encouraging sign is that state reservoirs are at about average capacity for this time of year. but in

the south bay... coyote reservoir is 21- percent full... lexington reservoir is 31- percent full... and stevens creek reservoir is 33 -percent full. reservoirs in the east bay are in a better position. briones reservoir is 88 - percent full... san pablo reservoir is 85- percent full... and lafayette reservior is 74- percent full. . ( darya ) police in san pablo have arrested this man in connection with several burglaries dating back to last september. police say andre conner from richmond was identified as the possible suspect for two robberies at two different autozone stores on san pablo avenue. conner was on parole. he was booked on into the county jail for robbery. ( darya ) two men are behind bars in connection with an explosion outside a house in suisun city. we first told you about this explosion yesterday on the kron 4 morning news. over the weekend ... a pipe bomb caused major damage to the front door area of a home but the people inside were not injured.

thomas capenhurst of dixon, and robert mcgraw of fairfield were arrested on suspicion of using a destructive device with the intent to commit murder. authorities say additional pipebombs were recovered at mcgraw's home. (james) people in sausalito are fed up with the constant buzzing in their backyards from drones... and say it's becoming an invasion of their privacy. sausalito's mayor is now backing a proposed a list of drone use regulations within the city. the list includes: drones not be flown at night....operators must be able to see their drones....and people cannot harrass or annoy residents with drone use. complaints had poured in for two years until a line was crossed that pushed the city council to take action.
