( robin ) new this ( robin ) ( robin )new this morning... a police shooting left one person shot in the mission district.san francisco police tweeted about the officer involved shooting at 21st and capp street last night. san francisco police say no officers were injured. ( robin )the department of jusitce is suing california. attorney general jeff sessions will hold a news conference today in sacramento...to announce the lawsuit. kron 4's charles clifford has the details. the new lawsuit, filed in federal district court in sacramento, alleges that

california's so called sanctuary state laws violate the u.s. constitution by protecting undocumeted immigrants. the justice department is also claiming that the california laws obsruct enforcement of federal immigration policy. earier this year the california legislature, with the support of the governor, passed three laws meant to protect immigrants against workplace raids and to prevents police from asking people about their immigration status.sessions is scheduled to comment publicly on the lawsuit tomorrow in sacarmento at a meeting of the california police officers association. in a preview of his prepared remaks the attorney general says that "the department of justice and the trump administration are going to fight these unjust, unfair, and unconstitutional policies that have been imposed on you," governor jerry brown responded to the justice department's lawsuit saying in a statement that "at a time of unprecedented political turmoil, jeff sessions has come to california to further divide and polarize america. jeff, these political stunts may be the norm in washington, but they don't work here. sad!!!" tuesday afternoon, former sacramento sheriff john mcgninnis said that local law enforcment is feeling caught

in the middle between the state and federal governments. sotit' a bit like a child being sent off into public being told to behave one way by their mother and another way by their father. well, this needs to be clarified. ( robin )reaction to this lawsuit has been swift from people who support california's sanctuary status. kron 4's dan kerman spoke to one organization that helped create one of the laws...that the feds want overturned. standup dan kerman/sf 00-10sb 54, the state values act also known as the state sanctuary law was crafted here at the asian law caucus . they are not surprised by the federal lawsuit but say it doesn't have much weight sotwe feel we are ready for the fight the federal government is bringing with this lawsuitthe asian law caucus, which helped craft the states sanctuary law says the attorney general's lawsuit is trying to do an end run and force local law enforcement to

help federal ice agents.sot saira hussain/asian law caucus attorney 31-41the federal government has the ability to carry out immigration enforcement and what they are trying to do is use our local resources here our police officers and sheriffs to carry out these immigration policies and that's not the job of those entities.asian law caucus attorney cyra hussain says california was well within its right to pass these 3 laws which provide worker protections and allows local law enforcement to take a hands off immigration policysot the laws we have passed here in california pass constitutional muster . we believe they are very sound and legal policies . we are concerned the federal government is swooping in and trying to file a lawsuit when its clear the 10-th amendment allow states to decide how they are going to carry out their own policies. the federal government is the one that carries out immigration enforcement and if the state says this is your job and something we don't want to engage in that is completely within their rights to do that

standup dan kerman/sf 129-139 right now all three laws remain in effect unless the feds can convince a court to temporaily put a stop to them until a final decision is reached. either way the asian law caucus says its in it for the long haul even if the case goes as high as the u.s. supreme court. in sf dan kerman kron 4 news151/std ( robin )in the south bay... the santa clara county board of supervisors have approved plans to study a possible ban on gun shows. the proposed ban would affect gun sales at the county fairgrounds and other county-owned sites. the county attorney will draft an ordinance... prohibiting the possession or sale of guns on property owned or leased by the county. the counsel will also report to the board about other options for improving public safety by reducing gun violence. ( robin )a man is dead...after a hit-and-run accident in san jose.. it happened around seven pm monday night on southbound 2-80. police say the driver of a honda lost

control and hit a toyota sedan...driven by a man with three children in the backseat. the man driving the honda got out of the car -- and was hit by a vehicle. he died at the scene. the car that hit him... took off. the three children were not injured. ( robin )police are investigating a string of san jose attacks that happened in the last week. at least a dozen restaurants and store fronts have been sprayed with bullets. kron 4's ali reid reports. this rash of violent incidents is causing a scare.at least 3 businesses on this block in little portugal had their windows smashed overnight.pkg adega restaurant is open for business, but the front window has been boarded up. next door, the portugese bar and restaurant was also hit. the windows are still standing, but boards are holding them up from the inside. the photo shop across the street also had damage.lucy alvesi think it's sad. i think it;s sad the way people are coming out here shooting these businesses up. it's like a portugese

community, everyone gets along with each other, they're friendly and have a good time. it's sad.and that's not it. police are investigating a total of 12 incidents. wow, wow it's sadacross town, at the plant ... windows at applebees were first smashed last friday.then monday night, patrons that were eating at the time tell me they heard when pellets hit the windows. of course that caused quite a scare. but because they're double paned glasses, they shattered but didn't break. however, overnight, the culprits returned and broke a number of windows throughout the restaurant. it's believed that b-b guns were used to cause havoc.it's sad to see all these different businesses get hitalso nearby ... mcdonalds was hit ... both at the entrance and the drive through windows. taco bell, a tea shop, and a slew of other establishments were vandalized. business owners and their clientele are all concerned. hopefully they catch whoever did it.standupat

least one business owner tells me it will take some time to replace their boarded up windows.right now it isn't clear if this is gang related. reporting live in san jose ... ali reid ... kron 4 news. ( robin )on the peninsula... a former youth basketball coach in san mateo county could spend up to 50 years in prison. julio ortiz was sentenced for child molestation. he was arrested in september of 20-16 after c-h-p officers found him in a car performing sexual acts on a 14-year-old boy. police say ortiz met the victim two years earlier when he was coaching basketball at an elementary school. four more victims eventually came forward. ( robin )police in san mateo say a man exposed himself to a young girl monday night.they say cristian morales exposed himself to a 16-year-old near highway 1-0-1 and monte diablo avenue. the girl says she was walking alone when it happened. she called police - and san mateo authorities say that morales is a registered sex offender.

( robin )graffiti threatening to kill people at a bay area school has been found again... this time in santa rosa. ( robin )the willowside middle school was put on lockdown. no one was hurt. kron 4's ella sogomonian has the story. sot: ella sogomonian, @ellasogomonian// "the very serious message was found in a boy's bathroom threatening to kill teachers and students." willowside middle school students and teachers were locked in their classrooms for more than an hour as sonoma county sheriff's deputies canvassed the area.sot: lt. john molinari, sonoma county sheriff's office// "the kids stayed in their classrooms until their parents came by and picked them up. the sheriff's office decided to do a complete search of the campus deemed it safe. we actually called in our violent crime unit to come in and investigate the incident." there were two different incidents of graffiti found

within hours of each other. the first at 11am was the first at 11am was vague but the second found at 2 in the afternoon threatened to take lives.this is the third school in sonoma county in the past week to have discovered such threats. the other two were santa rosa and analy high.in the latest case oakgrove union school district superintendent alan vann gardner said he's proud of the students who found this and reported to staff immediately. and adding quote "it may be a copy cat move but you never know that one percent chance we want all of our families to feel confidant that we are taking the best care to do can to keep our chilren safe."sot: ella sogomonian, @ellasogomoni an// "although nothing happened both the school district and sheriff's office national events like the shooting they can't afford threats like these. in santa rosa ella sogomonian kron 4 news. ( robin )a 12-year old accused of stabbing another student... will face attempted murder charges.this is new video of the alleged attacker. this video you're seeing is reportedly from snapchat.

the stabbing set parents into a panic at the school... which did go into lockdown. the victim was flown to a nearby hospital with life-threatening injuries. the suspect is expected in court some time this week. ( robin )in the north bay... police are looking for a gunman after a drive by shooting injured a teenager. it happened in fairfield tuesday morning on clay bank road near sprig court. police say a 17-year-old girl was walking when someone drove by and shot her. the girl is expected to be okay. police say they do not believe the shooting is random. they do not have a detailed description of the gunman or the car. ( robin )san francisco police need your help catching a hit and run driver. the accident was so bad that it wedged one car under another car. kron 4's j.r. stone has that story. this is all new surveillance video showing a hit and run accident in san francisco. watch it again and you can see what appears to be a 90's model chevy tahoe or suburban

crashing into a car so hard that that car is pushed under the vehicle in front of it. there was a very loud bang and crash and car alarms going off. that was late monday night...moments later this is what neighbors saw. a toyota sitting on a late 80's model honda civic. and the cars stayed that way for several hours overnight.this morning i came down and had to do a double take i saw one car on top of the other and i kept walking and looked and it didn't seem possible. it looked like something out of a space move or so.but the survillance shows it was no space movie. just a driver with a total disregard for the road.sot it's just dangerous because someone could have been killed.police say they are investigating the case but as of right now it doesn't appear as though any arrests have been made. those who live here are hoping for

( robin )after a decade-long process... plans to make the new mission rock waterfront development is moving forward. san francisco's mayor signed new legislation tuesday... along with the giants and the port of san francisco. the old parking lot near a-t-and-t park will be converted into a mixed-use housing and commercial complex. the mayor says the new project will add thousands of jobs, create 15-hundred new homes and improve public transit. 40-percent of the new homes will become affordable housing. the raiders... aldon smith walks out of the san francisco county jail... after turning himself in. the former rising star was booked on several charges stemming from an alleged domestic violence incident this weekend. kron four's maureen kelly has the latest. (pkg) smith was silent and stonefaced after being released on 30 thousand dollars bail, walking out alone. do you have anything to say? your fans are worried about you.ignoring the media he ducked into a waiting suv and was driven away.shortly after he pulled away this mug shot was released.smith turned himself into police eariler today after an arrest warrant was issued for the former oakland raider and former 49er yesterday jail records show he was booked on four charges

related to this weekend's incident.....domestic violence, assault with force likely to produce great bodily injury, false imprisonment and vandalism. all misdeameanors. this stems from an incident this past saturday night where the linebacker allegedly assaulted his ex girlfriend in a residence on the 600 block of bush street. police responed to the scene after the victim called 9-11."the victim is calling us saying the suspect threw her around the room and bit her wrist. he climbed out of the window and may have gotten into a black range rover."smith allegedly fled the scene before police arrived. the victims injuries are considered non life threatening. the next day smith made a cryptic facebook post saying you are all wrong. this isn't the first time smith has been in trouble with the law. back in 2015 he was released from the 49ers after being arrested for a dui hit and run in santa clara. he was then picked up by the oakland raiders but suspended by the team in november of

that same year for violating the nfl's substance abuse policies. he has not played since. and after this most recent incident, the raiders announced monday smith has been cut from the team. ( robin )in the east bay.... a bomb scare in oakland caused the evacuation of a popular hotel monday. police ended up there... after a scary discovery during a traffic stop. c-h-p officers arrested jeremy guy of riverbank... stanislaus county... after they found bomb making materials in his car. during the trafic stop, c-h-p officers learned that guy and his father ronald guy, were guests at homewood suites on embarcadero near 8-80. oakland police and the u-c berkeley police bomb squad evacuated the hotel as they searched for more explosives. this hotel guest who asked us not to reveal her identity describes the frightening situation.

bad, with some people stuck in it for about an hour.(sot)"i was biking down fell street on my way back from work -- biking down the bike lane and saw a lot of backed up traffic. how backed up would you say?at least four or five blocks backed up with traffic. no one was going and no one could turn right onto broderick."(vo) tow trucks pulled the cars away one at a time.you can see shattered parts and sand to soak up leaked fluids. curtains in the wee hours of the night... and finding yourself face to face with not one... but two huge mountain lions. that's exactly happened to a couple in boulder creek. kron four's rob fladeboe reports. priscilla unti/close encounter with mountains lions "...they were magnificent, i had never seen one that close before..." boulder creek residents priscilla unti and ben slaughter were awakened about 2 a.m. monday by a noise they thought might be a prowler just outside their bedroom window.priscilla unti "....so we pulled back the curtains and ben's jaw dropped, he said no way because there were these two big mountain lions right there..."boulder creek firefighter ben slaughter then grabbed his cell phone and started shooting video of the two fully grown animals, who

made themselves at home on the patio for the next twenty minutes.priscilla unti "....the light was on and we think they saw us and they were just poking around and growling and pawing at each other...."priscilla is diligent about bringing in her food at night but suspects the mountain lions may have been attracted somehow by her dog chloe or her neighbors pets. she marveled at how the playful they were, suggesting that perhaps they are a couple. priscilla unti "....just because of the way that they were interacting, they were playful and we thought maybe they were a a couple and might have been trying to mate..." the mountain trying to mate..." the mountain lions were not intimidated by the people staring at them from behind the glassor by chloe's growling and wimpering. priscilla says the two big cats eventually tired of the

spotlight and wandered off into the redwoods.priscilla unti "....i was very nervous, my heart was pounding but i am am so glad ai got to see something like this...." priscilla says she has mountain lions in the wild before but just one mountain lion, not two and never like this. in boulder creek rob fladeboe kron 4 news ( robin )a robot stolen from a bay area high school team...has been found. tuesday night the monta vista high school robotics team told us the robot was found in someone's yard in west valley city utah. we're told the robot appears to be intact... but everything else like tools and spare parts were gone. the team from cupertino was in utah over the weekend for a robotics competition when the robot was stolen from the parking lot of their hotel room. ( robin )recreational marijuana became legal this year... but it's not stopping cities from cracking down on it. the state capitol is now taking on weed delivery services that are not legally permitted. reporter ben deci has the latest from

sacramento. ánatsáa car. a gps. and a bag of pot. lots of entrepreneurs out there thinking that's all you need to go into business. but the city of sacramento is taking a harder line on the 100 or so marijuana delivery services they figure are operating in town... reminding those services, they have to have something else.sot - joe devlin/sacramento cannabis policy and enforcement:"we have i think 10 business that have come forward that have applied for their business operations permit."unlike brick-and-mortar dispensaries, pot delivery services are tough to track. they can spring up and disappear just as quickly.sot - "their contact information is often just an email... or text that goes to a burner phone..."so the city is getting creative- targeting the places delivery services traditionally advertise... in letters to publications like the sacramento news and review, and the online service

( darya ) our top story this morning... the justice department is suing the state of california... over sanctuary laws.( james ) attorney general jeff session will announce the lawsuit this morning in sacramento. the d-o-j will ask a federal judge to block the state's sanctuary laws... which limit state and local cooperation with federal immigration authorities. earlier this year the state legislature... with the governor's support... passed three laws meant to protect immigrants against workplace raids and prevent police from asking people about their immigration status. california's attorney general -- xavier becerra -- tweeted that he will enforce the state's laws regardless of what happens in washington. governor brown called the lawsuit a political stunt and sad -- while san francisco's city attorney says the trump administration is overreaching. ( darya ) the asian law caucus in san francisco helped create the state's sanctuary laws. they don't believe the lawsuit against california holds any weight. and the group says they are ready to

fight. but some in law enforcement say they're willing to work with the federal government... to keep people safe. ( will )at approximately 10:36 pm, uniformed san francisco police department officers in a marked police car were flagged down at 20th and capp streets by two victims of an armed robbery. the victims provided the officers with a suspect vehicle description. shortly thereafter, officers located the suspect vehicle, a black honda civic, on capp street between 21st and 22nd streets and ordered the suspects out of the car. the driver complied and was detained.the officers noticed that the vehicle's trunk was

ajar and saw a second suspect in the trunk. while attempting to detain the second suspect, an officer involved shooting occurred.the officers ordered a third suspect from the vehicle and detained her. officers removed the suspect from the trunk, administered medical aid and summoned an ambulance. unfortunately, despite lifesaving efforts, the suspect was declared deceased on the scene.a handgun was located in the trunk of the vehicle.the two robbery victims were transported to mission station for interviews. thanks will. we will check back through out the morning. county deputy who shot and killed an elderly man in 2016 ... has been cleared of all charges. santa clara deputies responded to a welfare check at the home of 87-year-old eugene craig in saratoga back in september of 2016. deputies say they were unable to contact craig when they arrived. when they entered his home ... police say craig was holding a gun. he then pointed the gun at deputies ... and that's when one deputy shot him. craig died at a hospital. the deputy says he shot craig because he believed he was a threat. ( darya ) happening today... students are returning to class after threatening graffiti was found at a santa rosa school.( james ) the willowside middle school was placed on lockdown yesterday and students were sent home early. kron 4's lydia pantazes is live at the school this morning with the details. lydia. found again....this time in santa rosa.the very serious message was found in a boy's bathroom threatening to kill teachers and students." willowside middle school students and teachers were locked in their classrooms for more than an hour as sonoma county sheriff's deputies canvassed the area.there were two different incidents of graffiti found within hours of each other. the first at 11am was vague but the second found at 2 in the afternoon threatened to take lives.this is the third school in sonoma county in the past week to have discovered such threats. the other two were santa rosa and analy high.in the latest case oakgrove union school district superintendent alan vann gardner said he's proud of the students who found this and reported to staff immediately. and adding quote "it may be a copy cat move but you never know that one percent chance we want all of our families to feel confidant that we are taking the best care to do everything we can to keep our chilren safe."

clay bank road near sprig court. police say a 17-year-old girl was walking when someone drove by and shot her. the girl is expected to be okay. police say they do not believe the shooting is random. ( james ) in the south bay... a man is dead after a hit-and-run in san jose. it happened on southbound 280. police say the driver of a honda lost control... and hit a toyota sedan. when the honda driver got out of his car... he was hit by áanother car. the man died at the scene. the car that hit him took off. ( james ) san francisco police need your help catching a hit and run driver. surveillance video shows the crash. you can see an s-u-v crash so hard into a car... that the car gets pushed áunder the vehicle in front of it. this happened late monday night in glen park. ( darya ) at least a dozen businesses in san jose have had their windows smashed.

now police are trying to find the vandals. the windows at applebees were smashed last friday. then on monday night the restaurant was targeted again. people at the restaurant say they heard pellets hit the windows. in total, police are investigating 12 incidents. police think b-b guns were used to break the windows.

san francisco police. police issued a warrant for his arrest earlier this week. he was booked on a number of charges including domestic violence... assault... and false imprisonment. this all stems from an incident this past saturday night. smith is accused of assaulting his fiance at her bush street home in nob hill. smith is set to be arraigned on monday. ( james ) police in san mateo say a man exposed himself to a young girl. they say cristian morales exposed himself to a 16- year-old near highway 101 and monte diablo avenue. the girl says she was walking alone when it happened. she called police. san mateo police say that morales is a registered sex offender. he's been arrested and booked on indecent exposure charges. ( darya ) san francisco's interim mayor has signed new legislation -- paving the way for a new waterfront development. the city has been working on the mission bay project for the last decade. the old parking lot near a-t-and-t park will be turned into a mixed-use

pm, uniformed san francisco police department officers in a marked police car were flagged down at 20th and capp streets by two victims of an armed robbery. the victims provided the officers with a suspect vehicle description. shortly thereafter, officers located the suspect vehicle, a black honda civic, on capp street between 21st and 22nd streets and ordered the suspects out of the car. the driver complied and was detained.the officers noticed that the vehicle's trunk was ajar and saw a second suspect in the trunk. while attempting to detain the second suspect, an officer involved shooting occurred.the officers ordered a third suspect from the vehicle and detained her. officers removed the suspect from the trunk, administered medical aid and summoned an ambulance. unfortunately, despite lifesaving efforts, the suspect was declared deceased on the scene.a handgun was located in the trunk of the vehicle.the two
