autopsy, directly contradicting the official sacramento police accounts of stephon clark's death.good evening. i'm steve aveson for grant lodes..( vicki )i'm vicki liviakis..blockbuster new allegations on the shooting that has gained national attentioncatherine heenan is in the newsroom to tell us about the report released today,catherine? (catherine) stephon clark -- was facing 'away' from the officers who shot him. and he might have survived if he'd had immediate medical attention. the autopsy by noted pathologist bennet omalu provides a very different story from the official police version... natpolice helicopter video shows clark's death ... officers firing around the side of the house where clark had been living with his grandmother.more natbody cameras recorded the officer's viewpoint as they opened fire. "he kind of approached us, hands out."not true, says the patholigist hired by clark family attorneys,doctor bennett omalu calls the police

account "...inconsistent with the prevailing forensic evidence."the pathologist says his examination of the wounds indicated that clark was facing away from the officers when they opened fire.the first shot struck him in the side of the chest and spun him around.six more shots struck him in the arm, neck, back and abdomen. "each one of theses bullets, independently, possessed a fatal capacity. meaning, out of all these seven, all he needed to die was just one of the seven." nevertheless, the doctor said, "death was not instantaneous." officers waited more than fuve minutes before approaching clark.they said they believed he had a gun.but they found only a cell phone..the pathologist says clark might have been saved with prompt medical attention."every minute you wait decreases the probability of survival."

(catherine) the official autopsy hasn't been released.the sacramento county coroner says toxicology results are not in yet. and the report won't be released until there's a decision on whether to charge the officers. if there are no charges, the report will be released immediately. otherwise it will be withheld until their trial. steve and vicki? of justice.jurors found she did not mislead law enforcement - nor did she help her husband kill 49 people and injure more than 50 others - when he opened fire at the orlando pulse nightclub in june of 2016.susan adieh, cousin of noor salman: i feel so bad for them. and i lost a child, i know how that feels. so no matter what happens between noor being guilty and not guilty, it's not going to bring them back. but at the same time, we cannot commit another innocent person as well, part of all this.her family says they've always considered salman to be the first victim of her husband - omar mateen.al salman, uncle of noor salman: i don't know how we're going to make up for the last two years.almost two years of investigators and the public reviewing video of her in the weeks before the shooting - shopping with her husband and child in the orlando area.but her attorneys say evidence showed she didn't know what mateen was about to do - didn't drop him off at the club, did not scout locations with him, and did not browse extremist websites. charles swift, attorney for noor salman: the more we learned, the better noor salman looked.the orange county sheriff said in a statement that - "many may feel that justice has not prevailed; however, the system of justice has spoken and we should look to the continued healing for the families and our entire community so that this event will not define us." i'm natasha chen reporting.

nothing of her deceased husbands plans to go into a nightclub and kill people. her uncle maintained that noor was a simple person and that she was in an abusive relationahsip with omar mateen. and that he threatened to take their son away if she left him. noor salman exited a florida jail two hours after she was aquitted on all charges. she reportedly is planning on flying back sometime soon to the bay area. here in rodeo, terisa estacio kron four news. enforcement from providing release dates of people in jail to federal immigration authorities. the trump administration has sued the state block it. the sheriff's office released a statement today about the allegations that they are tipping off ice agents. officials say... "this information is public and can be helpful to other governmental organizations, crime victims, inmates' family members and others. additionally, organizations who provide services to persons released from custody have specifically asked for this information so they can start reentry transition assistance right away. releasing this public information is an important part of the county's reentry strategic plan." hall meeting last night-- police say leading up to the shooting... family members of jehad eid called 9-1-1. they said eid threatened them with a gun. by the time police got there... one teen and 2-barbers had already been shot. eid then shot at officers. here is more of that dramatic video-- and we want to warn you-- some might find it disturbing. (landing vo/steve) new tonight at five... there is good news, exciting news for the family of an undocumented south bay man who is facing deportation to mexico. as kron four's rob fladeboe reports now, a court ruling has been handed down in fernando carillo's favor. nats (family around breakfast table)lourdes barraza and two of her three children were all smiles at breakfast after receiving news that a federal court judge in san francisco has ruled againstdeporting barraza's undocumented husband, fernando carillo, who is in jail in richmond after being detained by ice back in octoberlourdes barraza/fernando carillo's husband "...we're happy with the judge's decision and we believe it's the right decision and that we are on the right side of history with this decision..."judge joseph park has ruled that were he to be deported to mexico, fernando carillowould be persecuted, based on his relationship with a relative who is involved in

fighting crime. the government has 30 days to appeal the granting of what's known as a "withholding of removal."lourdes barraza "....withholding of removal doesn't guarantee anything right now in terms of legal residency or citizenship because of the way immigration law is right now , what it means is he will be able to apply for a work permit and legally remain in the united states...." a cable tv installer, carillo was detained by ice because of prior deportations and a d.u.i. the "withholding of removal" order means he can stay in the u.s. so long as he commit's no more crimes. his family, who had been considering a move to canada because they too would be unsafe in mexico, say he has earned his freedom.lourdes barraza "..he paid the price for making the mistakes they say he made and he deserves to et on with his life now..." carillo's attorney says a government appeal is unlikely and that he could be free by early next week. in san jose rob fladeboe kron 4 news.

(steve) actor and former california governor arnold schwarzenegger is in stable condition after undergoing heart surgery yesterday. the 70-year-old had a valve replacement procedure in los angeles. schwarzennegger's spokesman said in a statement said the procedure was necessary because a heart valve placed in 1997 had outlived its life expectancy. the statement also said that an open-heart surgery team was ready to go in case the catheter could not be replaced. but during surgery doctors decided to utilize the open heart team to complete the surgery. (steve) the state of california is suing sutter health... the largest hospital system in northern california california attorney general-- xavier becerra-- announced the lawsuit today. according to california department of justice... sutter health engaged in anti-competitive

behavior . that resulting in higher prices for health car for northern californians. attorney general xavier becerra "there is no reason why someone would have to pay so much more for a service simply because they are located in a different geographical location than another family in california. that's not right." becerra is working to stop sutter health from unlawful conduct under state laws. he also wants to restore competition in the california healthcare market. we are always tracking local stories. here's a look at what's happening in your neighborhood. (steve) in the north bay... pg&e is continuing to make repairs-- and rebuild after the north bay firestorm. and on monday-- crews will start rebuilding in the coffey park neighborhood in santa rosa. officials say pg&e crews are going to build new underground electric and gas utilities. most of the underground electrical equipment was destroyed in coffey park during the fires-- due to the high temperatures. all of those cables and transformers will now be replaced. (steve) a benicia woman sexually assaulted 5 years ago now has justice. a man broke into her home and assaulted her in back in 20-13.

detectives found d-n-a evidence from a man... but did not have a match in their system. alexander haynes was arrested for burglary in washington earlier this month. his d-n-a was entered into the system and matched the d- n-a from the sexual assault. haynes was arrested and awaits extradition back to california. (vicki) in the south bay... emergency crews responded to mineta san jose international airport after passengers fell ill during a bumpy flight last night. firefighters responded to the flight around seven pm. according to fire officials, two people initially suffered motion sickness... then five more people fell sick. fire officials say no one needed to be treated. the incident did not impact airport operations. (vicki) palo alto high school students headed back to class today after yesterday's school wide threat that locked down campus. authorities told us extra police officers were on campus today to ensure there was no violence. the threat was called in yesterday afternoon -- and

students say it was about a shooting that would happen on campus. police later determined the threat a hoax. (steve) in the peninsula.... police are looking for the two teens who fled from a juvenile center in la honda last night. the two juveniles escaped from the log cabin correctional facility in unincorporated san mateo county. one is 18 years old , the other 17 years old. both are described as hispanic males around five feet tall. earlier this week, two inmates escpaed from a nearby camp. both those suspects are now back in custody. (steve) officials say 40 residents are displaced after a fire broke out at a four-story apartment complex last night. it happened on north delaware street near highway 101 in san mateo. firefighters were able to contain the blaze in less than an hour. no injuries were reported. the fire was contained to one unit but caused smoke and heat damage throughout the building. officials determined the cause of the fire was accidental. (vicki) after the parkland shooting more and more parents are downloading apps to keep watch on their kids from afar.(steve) apps like mamabear and life-360 allow parents to track and monitor their kids phones. jana jones looked into whether this is actually helpful, or not. many parents love to see what their kids are doing from their smart phone but a bay area psychiatrist says these appsmay not be the healthiest tool."i think technology is a wonderful thing and it allows parents to connect with their kids in ways our parents weren't able to connect with us and yes it is something you can use for safety."laura byrne is a mother of two.like most parentsshe wants the best for her kidsbut says she's realistic."i don't think that this technology is going to save lives. i think what is going to save lives is us as parents talking to our kids

"if parents are worrying too much and constantly making themselves upset and worried about things that are non events or beyond their control, that is a bad example for children and it will transmit some of that anxiety to the child."we all want to keep our kids safebut kaliebe says perhaps appsaren't the answer. (catherine) president trump could soon have a hand in determining the make-up of an important district court here in san francisco. a federal judge who was influential in rejecting california's same-sex marriage ban has died. judge stephen reinhardt, a liberal, served on the 9th circuit court of appeals. he was one of the last remaining federal judges appointed by then-president jimmy carter, nearly four decades ago. reinhardt emerged as a staunch critic of the trump administration's deportation policies and travel ban in his final years. he reportedly had a heart attack while at a dermatologist's office. he was 87..and his death leaves a vacancy the president would likely fill with a conservative. but slightly cooler day with numerous clouds above. highs still managed to sneak into the 70s and 80s around the bay and valleys with 60s at the coast. even with all of the clouds there's no rain showing up on doppler radar. if you're going out tonight you can expect partly to mostly cloudy skies with a few patches of fog moving in along the coast. temperatures will remain mild in the bay and the valleys to near midnight. on the satellite you can see the high clouds streaming over the top of the ridge of weakening high pressure. we are expecting changes for the weekend as temperatures move closer to normal. it will be cooler on saturday but still warm. highs under partly cloudy the 50s and 60s at the coast with 70s and a few low 80s inland. it will continue to sunday with the warmest temperatures the weather looks parlty cloudy early next week but there is a starting on into next weekend. weekend.into next weekend.
