moments ago-- a man walks out of prison after spending almost a quarter of a century on death row. the state supreme court ruled the evidence to convict 68- year-old vincente benavides of sexual assault and the murder of his girlfriend's 21- month-old daughter-- was false. good evening i'm vicki liviakis. (steve) and i'm steve aveson in for grant lodes tonight. benavides walked out of the prison gates at san quentin.. and into the arms of his friends a short time ago. kron 4's gabe slate is at san quentin tonight he joins us on the phone now with details on the emotional reunion. a man who spent nearly 25 years on california's death row has been freed after his conviction in the rape and killing of his girlfriend's dahter was overturned.the california departmentf corrections and rehabilitation says vicente benavides was

released from san quentin state prison on thursday afternoon.the 68-year-old had been on death row since june 1993. he was convicted of killing his girlfriend's 21- month-old daughter.the state supreme court overturned his conviction last month on grounds that medical testimony at his trial was false.kern county district attorney lisa green has said she won't retry benavides for first-degree murder and that without the medical testimony, a lesser conviction would be nearly impossible. following tonight... two florida deputies have been killed... it's after a gunman fired through a window

at a chinese restaurant.the deputies were inside that restuarnat in trenton florida.. 35 miles west of gainesville. the shooter was found dead outside the business.at this point investigators say there is no apparent reason for the shooting. (vicki) a developing story we are following tonight.. as the nation debates whether teachers in the classroom should be armed, a south bay city is considering whether park rangers should carry guns. (steve) kron four's rob fladebo joins us now live from san jose with more on the story. rob? (rob live) i'm here at guadalupe river park in downtown san jose. it's one of a handful of city parks that has a river running through it and the homeless sometime live or sleep here. nearby. some park rangers dont feel safe and they believe they should be armed. here's more. some but not all rangers have been tasked with patroling waterways like the guadlupe river and coyote creek that border city park land. details are scarce but there have been a handful of incidents of late where

rangers have had to interact with the homeless and and what some describe as a "criminal element," in these areas to the point where they do not feel safe. the vast majority of the more than 200 parks in the city of san jose are quiet neighborhood parks but some are now also surrounded by development. they're larg urn parks that are touched by crime says veteran supervising rar pam helmke. she couldn't say how many of her fellow rangers want to carry a gun but says the idea will be given serious consideration.pam helmke/san jose park ranger "...fire arms are not the answer in and of themselves, having guns can resolve some issues but it can bring new issues to the table, t;s not something the city should take lightly, we are going to need input from the community..." "... if push comes to shove, they can fall back on chemical spray, handcuffs and a nightstick and the have a radio to call for help. "governor jerry brown announced he will deploy "up

to 400 national guard troops" to do nothing. the crime rate in california is high enough, and the federal government will not be paying for governor brown's charade. we need border security and action, not words!" governor brown said the troops would focus on fighting gangs and human traffickers. he said the national guard will not enforce immigration laws or take part in the construction of the border wall. homeless encampment in santa rosa is being santa rosa is being dismantled tonight. the land was targeted for redevelopment by sonoma county nearly a decade ago, and today is the deadline for the 100 plus residents to fold up their tents and move on. kron4's maureen kelly talked to some of those residents and

local officials about what's being done for them. work crews and a bulldozer begin clearing out trash as residents fold up their tarps and tents and gather there belongings.the camp called rememberence village has been here behind a dollar tree store on sebastopol road for two years. it's estimated that between 75 and 130 people call it home. but the area is slated for a 175 housing development with a mix of market rate and affordable housing.santa rosa city councilman jack tibbetts isn't happy about evicting this camp but says new housing in this area is desperately needed. rents and housing prices in this county are rising precipitously. we need to get more housing units built so we can put downward pressure on those rising prices. and also we're trying to do initiatives with inclusionary housing. a lot of folks who might be in this camp may have some source of income would be able to have a ford in obtain very low income housing projects in these new projects catholic chartities have been out here working with the residents for over a month trying to get them into housing...some of those are temporary solutions, like shelter beds or hotel vouchers, but they say the goal is to get everyone here

making and today ground was officially broken in the east bay. much needed help is coming to drivers who use interstate 680. the sunol grade is among the worst commutes in the bay area. but as kron four's philippe djegal reports... a new express lane is expected to improve drive times. (philippe) the constant congestion along northbound i- 680 in alameda county, for years... has been a point of contention for drivers. and, now help is finally on the way.richard valle/actc- "this is gonna reduce your commute time, it's gonna get you to work, uh quickly." much like the express lane added to the southbound side of the sunol grade back in 20-10... alameda county tranportation commission executive director art dao (dow) says when the new lane is added to the northbound side... commutes will move faster, compared to what it's like now.art dao/actc- "you're inching along at 10, 15 miles per hour. once this process is comple in 2 yeable to travel 55 to 60 miles per hour." caltrans and the a-c-t-c celebrated the groundbreaking of the new project from the side of the freeway... joined by local leaders, who welcome the

corridor improvements with open arms.lily mei/mayor of fremont- "our city looks forward to this critical project to improve traffic flow and eleviate congestion." the a-c-t-c says this is the sixth most congested freeway in the bay area. the new express lane will stretch nine-miles. between highways 262 and 84. for people who choose to ride alone -- using the express lane will come at a cost... paid for by using a fastrak transponder.richard valle/actc- "carpools are free. two or more people riding can take this commute at no charge." the project is funded with money approved by alameda county voters in 2000 and 20-14. it's expected to be completed by 20-20. in alameda county, philippe djegal, kron four news. the shoulder in the eastbound direction will become a third traffic lane during peak traffic. the third lane will be open from 2 in the afternoon until 7 p-m seven days a week. (steve )one week after this video went viral, two philadelphia men are talking about their arrest for failing to make a purchase at a starbucks.the incident touched off widespread protests and promises of change, not only at starbucks but also in the philadelphia police department. a thief takes off with a trailer full of awards and mom the future farmers of america anal conference near sacramento. among the things stolen - 8-thousand disneyland tickets. surveillance video shows a truck driving into the parking lot early yesterday morning. the thief broke through a gate.. then spent about five minutes breaking the lock on a white cargo trailer. the disneyland tickets were for the group's leadership conference in anaheim. the tickets have been cancelled

(vicki) a preschool in massachusetts is preventing students from referring to one another as best friends. now a mother is speaking out saying the rule is ridiculous. gary brode has the story. -nats-julia hartwell loves her dolls in arts and crafts and like most four year olds she has a best friend.christine hartwell/mother of julia hartwell: "she said you know so-and-so you're my best buddy. the teacher told her that she couldn't say that there in school."at pentucket workshop preschool, that's not a term julie can use to describe her friendship. christine hartwell/mother of julia hartwell: "i think it's ridiculous. children who are four years old speak from their heart so they should be able to call kids anything loving me or my best friend you're my best pal."the georgetown preschool offered this explanation to julia's parents, saying "the term best friend can lead other children to feel excluded and it can ultimately lead to the formation of cliques and outsiders," encouraging their students to have a wider group of friends. dr. gregory young/pediatric psychologist:

escaped from her oakland salon yesterday afternoon. the shih tzu/toy poodle mix was last seen wearing a doggie t-shirt that says "no photos please" on jefferson street near 18th street. albert says she-she has been helping her family heal after losing her mother in 20-15. the family is offering a three-hundred dollar reward for her safe return. . (vicki) police in union city say a girl is found safe after she was reported missing yesterday. 12-year-old camila rodriguez was found this morning at school. police say she had left school with a friend yesterday-- and was not found until this morning. it's not clear where the girl was-- but police say her disappearance was voluntary. (steve) and in the south bay-- police are looking for a missing girl in mountain view. they say 11-year-old diana flors-leiva has been missing since yesterday morning. she was wearing a green sweatshirt with the word "pink" on it, jeans, black shoes, and a black backpack. diana is

five feet, five inches tall with brown hair and brown eyes. police believe she ran away from home. (steve) a burned out home in san jose has sold for 900- thousand dollars. located on th bird and minnesota in the willow glen neighborhood was originally listed for 800- thousand-dollars. today kron4 spoke with the realtor of the home-- and she says the home received six offers over asking. it is being sold to the buyer who offered 900- thousand dollars cash for the burned out home. (vicki) on the peninsula... a mountain lion causes two schools in san mateo to shelter-in-place. it happened right after 8:00 this morning near fernwood street and 26th avenue... that's near abbott middle school and hillsdale high school. the person who spotted the mountain lion said it did not appear to be aggressive. authorities told students and staff at those two schools to shelter in place while they cleared the campus. the mountain lion has not been found.

today the california assembly passed a bill that would classify conversion therapy as a fraudulent business practice in california.. assemblyman even low says medical experts agree that it's ineffective and harmful. he believes it's also inherently cruel and wrong. low says the bill doesn't impede freedom of speech or religion - and applies only to financial transactions. the bill now heads for the senate. steve and vicki?

(vicki) we are learning new details in the investigation into prince's death and... the possible charges related to the musicians accidental overdose. reporter reid binion has the latest. nearly two years after the death of prince at his paisley park ho in april 2016, the carver county attorney announced toy thatno criminal charges will be filed in connection to his accidental fentanyl overdose. sot mark metz, carver county attorney "without probable cause and no identified suspect, the carver county attorney's office can not file any criminal charges involving the death of prince."the county attorney stated there is no evidence that prince knew he was taking counterfeit vicodin pain pills that contained fentanyl..and there's no way to know how he obtained the pills.also....the minnesota physician who treated prince twice in the weeks before he died...has agreed to pay a thirty- thousand dollar fine, to settle allegations that he prescribed controlled substances in the name of one person, knowing that the controlled substances were intended to be used by prince. that doctor's attorney

happening now.... police say scammers have been calling people in santa clara...demanding them to purchase a popular pre-paid card. the moneypak or green dot cards are similar to the ones pictured here. police say the scammers are

asking victims to pay for nonexistent past due bills. authorities say these callers are posing as city or federal employees and demanding those fines be paid immediately. officials say legitimate businesses would never ask you toay an outstanding debt this way. (steve) there's a push to stop annoying robocalls. bay area congresswoman jackie speier introduced legislation today that would require phone companies to provide free technology to block robocalls. speier says the national do not call registry fails to protect people from scammers. she says 530-million dollars is lost every year to phone scammers. the new legislation would also authorize the creation of a nationwide "unblocking system" -- to help people control the calls and text massages they receive. if the legislation passes-- the f-c-c will implement the new rules for the phone companies. 'come on, bud.' students in this case - watching from santa ynez.while the programs aren't just for kids....it's the children michele really wants to inspire...calling them the next generation of stewards. michele - 'whether it's an animal that lives in our backyard or an animal from the opposite side of the world, each animal is part of this big picture. and if they don't feel that internally, it's not going to translate into their actions later.'she wants children to really care about the animals.. figuring if little ones can get this excited about seeing a porcupine...they're more likely to grow up feeling connected to wildlife...and the whole world around them..

(steve) up the peninsula... a mountain lion caused two schools in san mateo to shelter-in-place this morning. abbott middle school and hillsdale high school locked down around 8 oclock.. the person who spotted the mountain lion said it did not appear to be aggressi. the mountain lion has not been found. ( pam on cam) it's controversial.. but there is a call to arm park rangers in the city of san jose. as kron four's rob fladeboe reports now, some rangers feel they would be safer if they were carrying a gun ... when they investigate issues involving people who are homeless on park property. some but not all rangers have been tasked with patroling waterways like the guadlupe river and coyote creek that border city park land. details are scarce but there have been a handful of incidents of late where rangers have had to interact with the homeless and and what some describe as a "criminal element," in these areas to the point where they do not feel safe. the vast majority of the more than 200 parks in the city of san jose are quiet

boulevard in fremont. the winner has the option of spreading out payments over 30 years or getting a one-time payout of 16 and a half million. they have 180 days to claim the prize. lawrence karnow: there was plenty of sunshine today but the winds were gusty near the coast. tonight will be nice and clear and the winds will be breezy but decrease thoughout the night. you can see on doppler the snow showers over the sierra but the bay area is clear. on the satellite you can see the storm clouds moving east and high pressure is beginning to build toward the state. temperatures will continue to warm on friday with highs soaring into the 70s inland, 60s and 70s around the bay and 50s and 60s at the coast. it will be even warmer this weekend with some highs hitting the 80s. the warm weather will continue into monday but a few more clouds will return on tuesday with some cooler right now it looks dry for the next 7 days too.
