construction worker travis reinking, was wearing nothing but a green jacket. it was just really really bizarre. he had a tall thin kind of disheveled brownish blond hair and naked. he began firing in the parking lot and but when he came inside, this man, james shaw, decided to tackle him. we were kind of scuffling. i managed to get him with one hand on the gun. and then i grabbed it from him and threw it over the counter top. he's a hero. i mean four people died. and it could have been four times that many had not done what he did. nat following a tip this morning, officers converged on a wooded area only about one mile from the waffle house.reinking was taken into custody without resisting. (vicki) a startling new report says thousands of buildings in the bay area could collapse during a major earthquake. san francisco, oakland and san jose are all falling behind on efforts to make buildings safer. kron4's lydia pantazes explains. a newspaper analysis finds the san francisco bay area is falling behind on efforts to retrofit buildings that are vulnerable to collapse during a major earthquake.the los angeles times reports sunday that there are up to 3,000 brittle concrete buildings in san francisco, yet the city doesn't have a list of where they are located. the building type is one of the deadliest in quakes.across the bay in oakland, there are nearly 2,000 possibly vulnerable wood- frame apartment buildings at risk of collapse in a seismic event - and there is no law to require them to be fixed. and the newspaper says san jose

(rob live) i'm here on hostetter road about a mile from the berryessa station. from now on people between here and the warm springs station in fremont are going to start seeing and hearing a lot more trains as vta and bart have a long list of tests to complete before the system is ready for primetime later this year. new bart stations at berryessa and milpitas are all but complete. now, the sounds of construction are being replaced by the sounds of trains. from now on, two 3- car trains like this one will by making practice runs as vta puts the the new system to the test. brandi childress/vta "...once they take over the system will by run from

(grant) happening now... southwest continues to cancel and delay flights in the bay area as it inspect its plane's engines. mechanics are looking at engines similar to the one that failed on the southwest flight last week, which killed a woman. at least five flights have been cancelled today out of s-f-o, and and jose airports. sfo says 25 southwest sfo says 25 southwest flights have been delayed.. it's not clear if the delays are directly related to the engine inspections. there have been no cancelations in oakland. the faa has ordered the inspection of about 1-thousand plane engines across various airlines .. about 350 of which are in the u.s. southwest say they are working towards minimizing flight disruptions by performing inspections overnight. jose's evergreen school district are protesting their latest contract proposal. the picket lines started just before school this morning. kron 4's will tran is in san jose with more. the teachers are not on strike at least not yet. they're hoping to avoid it by sending a message to san jose's school district that for them a paycut is not an option(holly gonzalez/teach er-most of us can't afford to live here as it is, commuting. i've already spoken to other teachers who have already put in applications to other districts because they can't afford to live here anymore) there are 540 teachers within the ever green school district in san josethey have been working since last may without a contract.brian wheatley with the teachers union says a lot of their frustration revolves around health care.(brian wheatley/teachers union-the current proposal by the district asks us to fully cap our benefits which would mean 27-hundred less in take home pay for teachers)(charles crosby/evergreen school dist spokeman-we try to make the

working on a top-secret plan to build home robots. that's according to a new report from bloomberg. it's called the "vesta"... and the idea is it would accompany customers in their home. the report says that prototypes of the robots have advanced cameras and computer vision software... .allowing them to navigate through homes. industry experts say the consumer robot market will be worth about 15-billion dollars a year by 20-23. (vicki) the outspoken brother of a man shot and killed by sacramento police is out of jail. stevante clark was in court monday... where he was told he would be released. clark has been a vocal critic of the police since his brother, stephon, was shot and killed by police last month. thursday police arrested clark on several charges including assault with a deadly weapon and making a death threat. monday the sacramento county d-a's office downgraded those two counts from felonies to misdemeanors. the d-a also filed two other misdemeanors for abusing the 9-1-1 system and vandalism. clark was released on his own recognizance but he must avoid contact with a woman whom he allegedly threatened and not call 9-1-1. with energy upgrade california. of drinking and driving with her child in the back seat is behind bars tonight. petaluma police arrested collette burum yesterday after receiving reports of an erratic driver who was driving into the city on lakeville highway. police say she nearly caused a collison with a child in the back seat. petaluma officers went to burum's home and they say she appeared to be intoxicated. that's when burum admitted to driving with her six year old child. at the time of the arrest burum's blood alcohol contrent was nearly four times the legal limit. (vicki) and that includes him holding a gun. jay feely tweeted this photo saturday... with the comment-- "wishing my beautiful daughter and her date a great time at prom. hash-tag bad boys." some people thought the tweet played on a well-known joke about the cliched 'overprotective father' stereotype. others quickly criticized it for being in poor taste. feely tweeted sunday the photo "was obviously intended to be a joke." he went on to say he takes "gun safety seriously"... and "did not intend to be insensitive to that important issue." (vicki) the framed notice says the duchess of cambridge gave birth to a baby boy monday morning at 11:01 london time-- she and the baby are both doing well. the practice of posting a bulletin on the occasion of a royal birth goes back to at least 1837-- that's when buckingham palace became the british monarch's official residence. the bulletin will be on display

and low clouds look move futher inland tonight at least inside the bay and coast while the valleys should stay mostly clear. the breeze is up near the coast if you're going out this evening. high pressure continues over california but it is starting to weaken. you can see it on the satellite image keeping the storms headed north. as the ridge weakens we will see more fog moving onshore and cooler temperatures. things get unsettled as an area of low pressure spins along the coast bringing cooler weather and a chance of showers to the state. highs tomorrow will be a little cooler with 70s and 80s in the valleys, 60s and 70s inside the bay and 50s and 60s at the coast. it will be cooler on wednesday and into the weekend. there's also a
