(estacio) it was a very rough day for many of the students and staff here at this high school. behind me a growing memorial tonight we are learning much more about 15 year old ben curry. friends say he was kind, and they are overhwelmed with sadness about his untimely death (claire toodles, student) claire "they talked to me when i was upset " san ramon valley high school student claire toodle talking about ben curry and how counselors were on hand today, helping kids cope with curry's death. she was a teacher's assistant in one of his classes. claire. "they put a flower on his desk it was tough hearing everyone cry." "no one should feel that is the final step to deal with things. he would not have thought that was the only way to deal with things." on a vigil out in front of the pool where curry was discovered tuesday, a suicide prevention hotline number a cause of death is still formally underinvestigation. curry was found at the bottom of the deep end of the schools pool.

transit bus driver has been arrested... accused of carrying a loaded gun while on the job. this is the suspect stephen williams. he was taken into custody at the bayfair bart station in san leandro yesterday around 3:00 in the afternoon. investigators say his supervisor called police.. after the suspect sent an email saying he did not feel safe - and would be carry a gun on the bus. the crime

is a misdemeanor. (grant) it's easy to see why this video has gone viral. at first glance we see a man in the water next to his kayak. but look closely and you can see a dark shadow about 10 or 12 feet long... moving toward him. it's great white shark. so says the guy who lived to tell the tale. kron4's rob fladeboe met the man...heard his story... and joins us now live from sea cliff state beach near santa cruz. (vicki) another big story we are following tonight... what started as a driver needing assistance on the side of the road... turned into a shooting on an east bay highway. kron 4's lydia pantazes explains what happened. at approximately 2:15, a motorist received a flat tire while traveling on sr-24, through the caldecott tunnel. the motorist pulled over to the center median just west of the tunnels and awaited assistance. shortly after, a cal-trans tow truck driver arrived and made contact with the motorist. when the cal-trans worker attempted to get the motorist to drive his vehicle to the right shoulder, a verbal altercation occurred. at some point in the altercation the motorist drew a handgun and pointed it at

the cal-trans worker. the motorist then pointed the handgun up and discharged a few rounds into the air. a friend of the motorist arrived, and they both fled the scene. chp units arrived on scene and shut down all lanes of sr-24 wb, in order to process the scene. officers went to the suspect's residence and placed him into custody without incident. the cal-trans worker did not receive any injuries as a result of this incident. (vicki) happening now... hawaii's kilauea volcano continues to threaten the big island tonight. geologists say it could erupt explosively-- sending boulders, rocks, and ash into the air. marisa yamane is on hawaii island with the latest. hi we are in pahoa outside the evacuation zone but i want you to take a look behind me you can see billowing white smoke. that's coming out of the fissures. that latest from civil defense is that the lava is no longer coming out of the fissures, but the hazardous fumes, the sulfur dioxide, that remains a huge concern.

so far 14 fissures have opened up in just the past week. 36 structures destroyed by the lava, including a home just yesterday. we have spoken with many residents over the past week and it has been stressful and emotional. coni drewer - leilani estates resident: coni: we intially left and yeah. 80% of our house is still inside, couldn't take much stuff but we have a place to go. my kids are safe, and our dogs are safe and we have each other (crying). but we just wanna go home. it really just comes down to that we just wanna go home. coni says thankfully her home is okay and they are crossing their fingers. she and other leilani estates residents are being allowed to go back to their homes during daylight hours just to get things they left behind. but they are told they may have to evacuate at moment's notice because things are still very volatile and it's unpredictable when or where the next fissure will open up, reporting from pahoa on the big island. i'm marisa yamane.

(vicki) two bay area counties are joining a nationwide lawsuit against opioid manufacturers. contra costa and marin counties both filed separate lawsuits... accusing drug companies of encouraging the use of opioids. it says the companies misled people about the dangers of opioid addiction-- causing overdoses to rise. the companies are accused of claiming there was no risk of addiction to the pills when used for chronic pain. (vicki) u-c workers continue to strike for a 3rd day today... forcing thousands of surgeries and medical appointments to be rescheduled again. the hospital and the unions could not agree on a new contract. the union represents 25- thousand cooks, truck drivers, gardeners and other service workers. another 29- thousand nurses, pharmacists, radiologists and other medical

workers joined the strike in support today. university officials say service workers are already paid at or above market rates and that it cannot justify the nearly 20 percent pay raise over three years the unions is demanding. (grant) for your health tonight.... four more states are reporting illnesses in a national outbreak linked to romaine lettuce. the c-d-c reports 149 people in 29 states have gotten sick. at least 64 people have been hospitalized, including 17 with kidney failure. the first death was reported last week in california. the e-coli outbreak has been tied to romaine lettuce grown in yuma, arizona... an area that provides most of the romaine sold in the u-s during the winter. (vicki) the f-d-a has declared an 'epi-pen' shortage across much of the country.. executives are apologizing to three teens-- who say they were racially profiled at the company's nordstrom rack store in saint louis. roche madden reports. st. louis - nordstrom's top executives visited st. louis tuesday to apologize to three teens who say they were the victims of racial profiling at the company's brentwood store. the private meeting took place just after 3 p.m. at the hilton airport hotel. the executives met with the teens, their families, and adolphus pruitt ii, head of the st. louis naacp.before the

gettogether, the mood was different."i was nervous, embarrassed, and humiliated," said mekhi lee.lee and two friends were at the nordstrom rack last thursday. he said they were followed around the store and one customer was rude to them.lee said they made their purchases and left. however, someone in the store called brentwood police, who stopped the trio outside, checked them out and found they had done nothing wrong. the teens went back to the store to talk with the manager. that's when they said the employees became rude. for other recent chain snatch robberies. (grant) a woman is shaken up after a cyclist followed her and used his fists to break her windshield. chesaray banda says the attack happened on university avenue near jefferson in berkeley. she said the cyclist chased her down after she passed him... and he began punching and kicking. the cyclist told her that she drove dangerously close to him but banda says there was plenty of room. she did file a police report and wants anyone who may recognize her attacker to come forward. (vicki) in the south bay.. police say angelica rodriguez of san jose turned herself in after hitting a pedestrian with her car yesterday morning. the crash happened on duane avenue near kenneth street in santa clara. police say the victim has just stepped out of his parked car when rodriguez struck him. the victim was sent to the hospital in critical condition. rodriguez initially fled the scene but later turned herself in. she was arrested and booked on suspicion of hit-and-run resulting in

injury. (grant) in the north bay... state, local, and federal officials will update the efforts to clean debris from the north bay wildfire burn zones. several agencies are holding a news conference tomorrow to announce what they are calling a significant update on the debris removal progress. yesterday marked seven months since the wildfires broke out. (grant) a bathroom creeper in the north bay. students reported seeing a man with a camera in the women's bathroom with at santa rosa junior college's southwest campus... just before eight o'clock. police say the suspect held a cellphone underneath one stall and above another, taking photos and video of two women. police were unable to locate the suspect. he is being described only as a white man between 20 and 30 years old, about five-six.. (vicki) in the peninsula... a driver who hit several parked cars on monday afternoon was arrested on suspicion of drunk driving. it happened on cherry avenue near commodore drive around noon. police say bradley jones of hayward appeared to have been drinking. jones

"as an educator and father this is really difficult. kids are under so much pressure, it is really unfortunate. ed cloyed a music teacher in the district and father of two young girls talking about how the sudden death of ben curry is effecting so many here in the danville community. ed cloyed. working with so many students, it is difficult to imagine the pressure they are in and what puts them to this point. san ramon valley high school student claire toodle talking about ben curry and how counselors were on hand today, helping kids cope with curry's death. she was a teacher's assistant in one of his classes. claire. "they put a flower on his desk it was tough hearing everyone cry." "no one should feel that is the final step to deal with things. he would not have thought that was the only way to deal with things." on a vigil out in front of the pool where curry was discovered tuesday, a suicide prevention hotline number a cause of death is still formally underinvestigation. curry was found at the bottom of the deep end of the schools pool. students and teachers tried to save him, as well as emergency

police say, a gun was pulled on him. kron 4's grant lodes is here with what led up to this confrontation... and where this happened. grant? (grant) it happened at around 2:15 this morning. c-h-p says the driver got a flat tire on highway 24 near the caldecott tunnel. the driver pulled over near the center median and watited for a tow. police say a cal-trans worker showed up and told the driver to move his car to the right shoulder...which prompted an argument. during the altercation...the driver then allegedly pulled a gun... and pointed it at the cal-trans worker. police say he then shot a couple rounds up into the air. shortly after that...the driver had a friend come pick him up...and they took off. c-h-p units arrived on scene and shut down all lanes of west bound 24, in order to process the scene. officers went to the suspect's home and arrested him. the cal- trans worker was not injured.

(ken) students at santa rosa junior college are on edge tonight after a man was spotted taking pictures of women in a campus bathroom. it happened last night.two female students came forward about the man holding a cell phone underneath stalls. campus police responded and checked the area but did not locate the man.the suspect is described as a bald white man -- in his twenties -- around five feet six inches tall -- he was wearing no shoes and a striped tee shirt. (pam) today marks the third and final day of the university of california strike .... that is forciing medical centers to reschedule thousands of surgeries and medical appointments. the hospital and the unions could not agree on a new contract. the union represents 25- thousand cooks, truck drivers, gardeners and other service workers. and another 29-thousand nurses, pharmacists, radiologists and other medical workers joined their effort again today. university officials claim, service workers are already paid at or above market rates

... and that it cannot justify the nearly 20- percent pay raise over three- years, the union is demanding. (ken) a parking crunch in some areas of san mateo county has residents asking officials to step in and help.(pam) kron 4's maureen kelly went out to the unincorporated community of north fair oakes .. where a proposal to impose a residential parking permit program ... is now in the works. in san mateo county residents here in on glendale avenue says lots of cars crowding their streets makes it tough to find a spot.they point to different contributing factors to the lack of street parking in this the unincorpated area located between redwood city and atherton....working coming in from outside the area, and more people living in the homes here.the idea of instituting a residential parking permit program has been brought up by neighbors here....and in another area called menlo oakssouth of atherthon. .the department of public works plans to hold a study sessions with neighbors to talk about how the program might work next month.maureen

it is a three- year drone program where states, local communities and native american tribes can devise their own trials. president trump signed a directive last year to establish the "innovation zones" that allow exemptions to some drone regulations, such as flying over people, nighttime flights and flights where the aircraft can't be seen by the operator. the unmanned aircraft industry has pushed for relaxed restrictions in the past. officials say current regulations have limited drone use, forcing companies to test overseas. (pam) an internal investigation done by n-b-c news concludes, noone in a leadership position knew about the allegedly inappropriate behavior by former today show anchor matt lauer. the network released the results of its inquiry into lauer's behavior -- and its own response today. . the report says - quote - "no evidence" was found that anyone in a position of authority at n-b-c .... received a complaint about lauer before november 27, 2017. that is when a woman came forward claiming lauer had behaved inappropriately toward her. lauer was fired within two days. the report also says, that the four woman who eventually came forward confirmed .... they did not tell anyone in a position of authority... about lauer's behavior.
