( marty ) a big story out of the east bay, the secret service helped arrest a student, accused of hacking into ygnacio valley high school records and changing grades. he reportedly changed his own grades... and those of his classmate's too. police think he sent an e- mail to a teacher in the mount diablo school district. the teacher opened the "phishing e-mail" which released her credentials to the hacker. police say it appears the hacker changed grades for several students. an electronic detection k-9 helped locate a hidden s-d card in a tissue box that led to the arrest. ( marty ) also in the east bay-- a judge has denied a

motion to dismiss all 36 counts of involuntary manslaughter against derick almena and max harris. lawyers for the ghost ship master tenant and the creative director say they were given the impression there weren't any safety concerns at the warehouse. about 25 people lived there-- even though it didn't have a permit for residential use. almena and harris both remain in jail. the judge is expected to rule on their request to be released from custody while wearing a ankle monitor. each faces 39-years in prison if convicted. 36 people were killed when the warehouse burned in december of 20-16. their trial is scheduled to begin in july. condition of this house he's rented in south san jose. the one from which he's now being evicted. he lives here with two of his daughter's and a five-year-old grandson.jeffery koeing/tenant- 'the property owner doesn't do anything to for upkeep." koenig is on section eight... the federal government's largest program for assisting low- income families, elderly and the disabled afford safe and clean housing.jeffery koening/tenant- "everytime something happens in this house, i'm blamed and we get threatened for eviction." the santa clara county housing authority administers the section eight program in san jose. this house rents for 38-hundred-dollars a month. jeffery only contributes 500. the rest is paid out by the housing authority directly to the landlord -- making up the difference. but the program requires the housing authority to make annual inspections to ensure the home is up to code. if not, then either the landlord, tenant or both could be removed from the section eight program.jeffery koenig- "they failed three inspections, three different times. so, that's nine inspections total that they've failed." on

april fourth... the housing authority notified jeffrey that their most recent inspection revealed electrical and general health and safety violations. and, that the property owner is being held responsible.nats- "all this termite damage." the home is breaking down inside and out.jeffery koening/tenant- "oh, i shouldn't be touching this, but this is the black, some of the black mold that was left here from uh, black mold up here." the mold has affected jeffery's breathing.nats- he's been routinely hospitalized, suffering from hypersensativity pneumonitis (new-man-eye-tiss)... emphysema and c-o-p-d. and, he's still dealing with the physical pain that landed him on section eight in the first place.jeffery koening/tenant- "i went through the windshield of a big rig in 96. i was in a coma for six and a half weeks. i was in a hospital four and a half months. i had 24 surgeries. i'm disabled -- i'm not a low life." g-d properties in milpitas is listed as the property owner. they did not respond to our requests for a comment on this story. they were given 30 days by the housing authority

( marty ) in the south bay... police are searching for a gunman who shot a man in the face in sunnyvale. officers found the victim at a 7-eleven near spinosa and torrington drive on friday morning. officers discovered that the man ran to the store for help. neighbors told police the shooting victim was banging on doors looking for help... but no one answered. police have not released any details about the shooter. ( marty ) in southern california, a 14-year-old boy is in jail for shooting a

classmate at his high school. it happened friday morning in palmdale--- north of los angeles. police say, the boy shot a 15-year-old in the arm. they say, he then left the school-- and dumped the gun in the desert. he was eventually arrested at a nearby shopping center. several schools in the area were briefly placed on lockdown. police say, the boy called his dad right after the shooting. coming up on the kron 4 morning news... bay area dispensary owners say that their taxes are so high... it's drving their customers away! and it's so bad... people are turning to the marijuana black market. ( marty ) the fire department suspects dry rot is the cause of a deck collapse in the backyard of an oakland home. the collaspe sent two women to the hospital.kron 4's ella sogomonian is in oakland with the story. this wooden deck detached from the second floor of a two story home in oakland sometime before 3 friday afternoon. the fire department reports two women fell twenty feet down and were rushed to highland hospital.one hit her head, the other hurt her hip and back. neighbors near morcom and kingsland avenues were stunned by news of the accident.sot:

follows a recent incident in philadelphia... where two african-american men were arrested at starbucks. they asked to use the bathroom, but were turned away because they weren't paying customers. they then sat at a table to wait for an appointment. the starbucks manager called police... who arrested them for trespassing. starbucks and the city apologized to both men. ( marty ) a major decline in traditional mail use is hurting the u-s postal service. in fact, losses more than doubled in the first three months of the year -- totaling more than one billion dollars. the agency says a lot of people aren't using their service anymore. revenue from first class mail and junk mail dropped by 181- million dollars. he u-s postal service is a government agency, but operates as an independent business, and doesn't receive tax payer support . it has lost 65-billion dollars over the last 11 fiscal years. ( marty ) bad news for wells fargo bank.a federal judge has ordered wells fargo to pay more than 97-million

owner doesn't do anything to for upkeep." koenig is on section eight... the federal government's largest program for assisting low- income families, elderly and the disabled afford safe and clean housing.jeffery koening/tenant- "everytime something happens in this house, i'm blamed and we get threatened for eviction." the santa clara county housing authority administers the section eight program in san jose. this house rents for 38-hundred-dollars a month. jeffery only contributes 500. the rest is paid out by the housing authority directly to the landlord -- making up the difference. but the program requires the housing authority to make annual inspections to ensure the home is up to code. if not, then either the landlord, tenant or both could be removed from the section eight program.jeffery koenig- "they failed three inspections, three different times. so, that's nine inspections total that they've failed." on april fourth... the housing authority notified jeffrey that their most recent inspection revealed electrical and general health and safety violations. and, that the property owner is being held
