grant lodes. the father is defending himself in a jail house interview, saying the kids were brainwashed into thinking they were abused. 29-year-old jonathen allen has pleaded not guilty to torture charges... and the mother -- 31-year-old ina rogers will appear in court on those new charges tomorrow. kron 4's terisa estacio is in fairfield tonight with the latest on the investigation. the children's mother ina rogers has said she knew nothing about the alleged torture of her children including accusations that the father shot the children with a bb gun but that is not the case.. according to prosecutors, in fact, it is far from the truth. (take vo) these are the latest documents filed today here at the solano county court house. ina rogers, the fairfield 30 year mother of 11 children now facing 9 counts of felony child abuse, and one count of cruelty to a child by endanering health. chief assistant district attorney sharon henry about the new charges and the case. sharon henry, prosecutor solano county. it is causing great bodily harm." (rob live) the stage was set for a special session of the santa clara city councl tonigght to publicly air the complaints against dominic caserta. the meeting will go on as scheduled. caserta has resigned but insists he's not going down withouta fight. news mk kron 4 news (vicki) a push to add more police officers in the city of san francisco... but first it'll take investing millions of dollars towards public safety that budget proposal was announced today by san francisco mayor mark farrell. kron4's haaziq madyun reports. two hundred and fifty additional uniformed officers over the next four years. funding for those new officers is part of san francisco mayor mark farrell's two year budget proposal. it is a public safety investment of $34 million dollars announced by the mayor tuesday here at sfpd police academy sot

george gascon says this will help prosecutors identify convictions eligible for dismissal under california's revised marijuana laws. in january... gascon announced his office would dismiss and seal more than three-thousand misdemeanor pot convictions dating back to 1975. the algorithm will search through nearly five-thousand felony cases in san francisco. those eligible will then be reviewed by a prosecutor and submitted to the court. (grant) coming up... a dire need for affordable housing in the bay area. hear from a man who says he makes too much to qualify for cheaper housing-- but still can't afford the high rent prices. happening now... volcanic activity on hawaii's big island isn't easing up. every day for the past three-days, at least one fissure has pierced through the soil. and the lava flow is causing some roadways to be shut down....possibly trapping people in areas with limited access. john lorinc reports. a river of red hot lava rolls toward the pacific ocean. the

(vicki) and a story you will only see on kron4... we are getting a first look at the damage after a family with bay area roots-- lost everything in the lava. these are pictures showing how destructive the lava can be-- you see nothing but ash and rubble. marci and david nail started building their dream home in leilani estates 10 years ago-- but they just moved in... in march. david grew up in brentwood. the couple does have lava insurance. (grant) this week -- throughout the bay area -- city's are bringing attention to the dire need for affordable housing. kron four's philippe djegal reports from city hall in walnut creek. where, today, a panel discussed the benefits of housing affordabilty. changed for danny milks in the seven years since he moved to walnut creek. he's married now with two young kids.danny milks/resident- "i'm actually a stay at home dad now, and my wife works in oakland and takes the bart in everyday." the rent for his first two apartments in town jumped 50- percent in a short period of time... and, danny doesn't want that to happen a third time. living near public transportation is key for him. he and his wife earn too much to qualify for affordable housing -- but they desperately want to stay in this community -- especially since danny's wife is about to start a new job here.danny milks/resident- "it's not easy. we make a lot of choices, uh, you know, we don't have tv, we don't have cable. we almost never drive our car. we cook most of our food from a vegetable garden and do a lot of things to limit our consumption so that we can afford to be with our kids." danny was one of more than 40 people to attend walnut creek's panel discussion on housing affordability. the benefits of government- subisized housing and how to make housing more affordable. the chamber of commerce believes relaxing laws on building height limits, could bring more jobs to the area and increase wagesjay hoyer/chamber of commerce- "offices tend to to generate high income jobs. hospitals, and john muir is an example, bass medical, children's hospital, all generate the

kinds of wages that we really want to have as our base in walnut creek to help people afford the housing." but for some, living in walnut creek, can't be possible without government assistance. margot ernst/housing program- "walnut creek and the region do not have enough affordable housing, because housing costs are really, really high." city housing program manager margot ernst says there are 560 affordable housing units here now... with more than 140 others either currently being built or are in the pipeline. in walnut creek, philippe djegal, kron four news. patricia o'grady was paying in greenwich village until she died this year. o'grady moved into the new york apartment in 1955, between rent-control and her friendship with the landlords, her rent remained astonishingly low. o'grady's place had no hot water... and no tub or shower - she bathed at the local y-m-c-a everyday. she passed away in march at age 84. the landlord plans to renovate the apartment and rent it out... for about 5- thousand dollars a month! (catherine) uber is dropping a requirement that essentially kept a lid on allegations of sexual misconduct.. until now - customers have had to agree to resolve any legal claims in arbitration - rather than open court. settlements had to remain confidential. that's been changed - and now any claims 'can'be dealt with in court -- and the experiences shared. it's interesting that only a few hours afterthe uber announcement -- rival ride- sharing service lyft made the same change. uber is trying to move past a string of scandals over the past year.. including allegations ofinternal sexual harassment and a cover-up of a data breach. vicki and grant? karnow. lawrence karnow: there were plenty of clouds around today and it was slow to break up. as a result temperatures were cooler and below the average for most of the bay area. doppler radar is tracking some thunderstorms over northern california. clouds will once again be on the increase tonight with a few areas of drizzle. on the satellite you can see the low pressure area to the north spinning up those showers and thunderstorms. another low is just off the coast. that will move right over the bay area tomorrow. it will bring a slight chance of showers to the bay area. highs will remain cool with numbers in the 50s and 60s. thursday will be slightly warmer with partly cloudy skies and highs in the 60s and low 70s. the warming trend will continue into the weekend with mostly sunny skies. another cool low will move in on monday to bring more clouds and a slight chance of showers to start

(grant)(grant) a massive clean up effort is underway at the site of a former homeless encampment that had been growing in half moon bay for decades. kron4's maureen kelly reports that the people living in that camp were given until 7am today to get into a shelter or move along. a cleanup crew started to fill dumpsters with the massive amount of garbage left behind from the former campsite alongside pilarcitos creek. the half moon bay city council voted in the fall to shut this camp down and do something to protect this enviromentally sensitve area that's been littered with a growing amount of human waste, drug paraphanelia and other trash that's been piling up here. at it's height officials

believe 20-25 people had been living here every night. they city has been working with the people here for months trying to persuade them to get into shelters or other services. friday these signs were posted letting them know that they had to be out by 7am tuesday. well past that deadline people where still picking up their possesions. this man says he's found a better alternative to the shelter. my mother lives right down the road at the senior home and i'm better taking care of her wash a dish and hugging to grandma then get in free something from someone else ian adamson is with one of the many homeless outreach organizations that came out here today to see if they can persuade the last minute stragglers to get help. push come to shop push come to show of today people i'm moving their stuff away i want to make sure he be here to make sure that some options other than just hitting the streets. we got some folks out here who are physically disabled and mentally disabled so we just been trying to offer them some short term housing to get them through this difficult time one camp resident who did not want to appear on camera camera told me that told me that she never imagined yourself in this situation, she said she still trying to find a permanent place to live and is going to some of the organizations to try and get some help. she says all she can do now is move forward maureen kelly kron4 news

(grant) tonight at 5:30... kron4 is always tracking local stories. here's a look at what's going on in your neighborhood right now. (vicki) a muslim civil rights organization has sent san jose police chief eddie garcia a letter demanding changes. this comes after a lebanese-american police officer alleged racism within the department. nabil haidar is a 21-year veteran of the department. he said he was harassed by his fellow officers after the 9-11 terrorist attacks. today-- the council on american-islamic relations- or "cair"-- is calling for the san jose police department to investigate the alleged racial bias. the group also says the department needs to educate employees on cultural sensitivity. haidar's attorney has filed a six millon dollar claim for damages against the city of san jose.

(grant) in the east bay... a federal judge has struck down the city of oakland's ban on coal shipments through its port.. this is a major setback to city leaders who argue the coal operations would be unsafe and unhealthy. the judge ruled that there's not enough evidence to indicate that... and said oakland made mistakes in its report -- including the claim that tons of coal dust would be blowing around. a city councilmember says the fight will continue and the city is reviewing its options. (grant) the treasure island music festival is back on... but this time it will be in the east bay. the festival will now be held at middle harbor shoreline park in oakland. it was on hiatus last year as organizers tried to find another location. the festival was forced to relocate because of construction on treasure island. it's happening october 13th and 14th this year-- and the lineup will be announced soon. landing at san francisco international airport. the incident was reported just before 6:00 this morning. airport officials say the united airlines flight was coming from tel aviv, israel.... but the laser did not effect the plane's landing. it is not yet known who pointed the laser. "amazon go" is coming to san francisco. the company's first cashier-less store opened in seattle earlier this year. shoppers enter the stores by scanning a smartphone app. once inside.. they can take soda... salads or anything else off its shelves and just walk out. amazon's technology... including overhead cameras... keeps track of what they buy and charges customers after they leave. for now... amazon isn't saying when the stores will open. fissures continue to open on kilauea volcano. a river of lava more than a mile long is flowing toward the ocean from one of the fissures. more residents near the site have been ordered to evacuate. the lava is also forcing some roads to close. officials worry people in some areas with limited highway access could become trapped. the national guard is standing by to help get them out of harm's way. troops are also monitoring air quality as some of the fissures spew lava balls hundreds of feet into the air and emit plumes of toxic gas. there are currently 18 open fissures on kilauea and lava has scorched more than 117 acres. (catherine) a federal judge in california has struck down the city of oakland's ban on coal shipments through its port.. a major setback to city leaders who argue the coal operations would be unsafe and unhealthy... the judge ruled that there's not enough evidence to indicate that. and said oakland made mistakes in its report -- including the claim that tons of coal dust would be blowing around.. those coal cars would reportedly be covered. but one city councilman isn't impressed by that argument. councilman dan kalb - just because the proponent claim they're going to do something doesn't mean it's workable or they'll actually do it. in fact if you cover coal too tightly, there's a risk of combustion.the risk is there no matter what. the health and safety risk to people in oakland, especially in that area. we had evidence. what the judge is saying - we might have to go back and find even more evidence. the councilman says the fight will
