allegedly high on marijuana when it happened. hello i'm grant lodes. (vicki) and i'm vicki liviakis. today kron4 spoke with friends of the two girls and woman killed in the crash... but first-- the man behind bars tonight is 21-year-old dang tran of san jose. kron 4's will tran has the latest on the investigation. the crash scene horrific. debris from five vehicles scattered all over the freeway forcing investigators to shutdown northbound 880 between automall and stevenson boulevard in fremont.8 people were inside this white cadillac escalade when it overturned several times.. ejecting three people on to the freeway.they died at the scene.five others rushed to the hospital including a baby. chp says it all started at 9-30 on tuesday night . with this man 21 year old dang tran from san jose who did not

have any major injuries. he was arrested.. accused of driving under the influence of marijuana.(manuel leal/chp-the decision people make. the decision this person made, to drive under the influence changed these people lives forever. driving under the influence of marijuana is just as bad as driving under the influence of alcohol.) investigators say they got calls moments before the crash about a driving speeding.. driving erractically but they could not get to him to prevent the accident.the chp spent close to 9 hours on the freeway. forcing part of the morning commute to get off the freeway and reconnecting at another location.while the victims are in the hospital. tran is at santa rita jail.. charged with manslaughter and driving under the influence. he's expected to make his first court appearance tomorrow.in fremont will tran kron 4 news (vicki) and tonight-- friends and neighbors of the victims and survivors of the deadly crash are trying to come to terms with what happened. ruschelle tolbert is talking about her best friend, 39 year old noelle johnson. that's noelle on the left, ruschelle is on the right. noelle was killed in the crash that occurred on 880 in fremont tuesday night.ruschelle tolbert/friend of the victims "....noelle was just a beautiful person, always dressed to the tee, just a beautiful, beautiful girl..." also killed in the crash were two children, identified by the coronor as 14 year old christy limas and her 9 year old sister brook. ruschelle says their father, chris limas, was hurt in the crash and remains in the hospital. ruschelle tolbert/friend of the victims "...christy and brook were just the greatest kids, smart and kind and loving andthey belong to faa, just beautiful kids...." the limas-johnson family lives here on a quiet cul de sac in manteca. the entire neighborhood is grieving along wiith brock elliott elementary and sierra high school where christy and brook attended school. ruschelle tolbert/friend of the victims ".....noelle is going to be missed, she was one of a kind,a great mother and her girls meant everything to her and my heart goes out to chris. he just lost his daughters and the love of his life and his other daughters will go with their dad...." ruschelle says the limas- johnson clan was returning from the bay area where they had been to the san francisco zoo to celebrateanother daughter's birthday. in manteca rob fladeboe kron 4 news

(grant) a fairifield mother accused of child abuse and torture appeared in court today. the solano county district attorney's office filed a motion to add charges against 31-year-old ina rogers... and, as kron four's philippe djegal reports from fairfield... the judge granted that motion. (philippe) 31-year-old ina (eye-nuh) rogers arrived at solano county superior court

with family by her side... she would later leave with sheriff's deputies after being taken into custody.sharon henry/da's office- "nobody, um, should live in those conditions." on march 31st -- rogers was arrested and posted bail on a misdemeanor charge of child endangerment. this after police discovered her kids were living in unhealthy conditions. the children's father, 29-year-old jonathan allen was also arrested. on wednesday, rogers returned to court -- where prosecutors amended the criminal complaint. rogers is now charged with nine felony counts of child abuse in addition to the misdemeanor.sharon henry/da's office- "the children started to disclose just vicious and callous acts, um, that were committed against them by the father. and, the statements also indicated or proved, that the mother, miss rogers, had allowed this torturous acts to occur." rogers has denied the allegations in the past. after court -- her attorney declined to talk about the case. the district attorney's office says all ten children are safe now.sharon henry/da's office- "some of

the childrens are with their maternal grandmother and aunt." rogers is due back in court next week. in fairifield, philippe djegal, kron four news. (vicki) tonight - new details coming out about the conditions inside the children's fairfield home. and how prosecutors say the couple tried to cover up the physical and psychological abuse inflicted on the children. as kron four's terisa estacio reports, authorities say it took only a few minutes inside the home to see that something was terribly wrong. (terisa estacio reporting) sources tell kron four news that when officers first went into the home their shoes stepped onto urine soaked carpet feces animal and human were smeared on the floors, and the smells beyond horrendous. court documents obtained by kron four news further state quote "when officers arrived, they entered the defendant's home to find 9 children ranging in age from 6 months to 11 years old huddled on the living room floor." "as officers were in the home they found the home to be in deplorable condition. there were clothes, garbage and, feces scattered everywhere." "the children appeared to be skittish and spoke with speech impediments." this was march

31st. the police initially at the home because ina rogers had called because a 12 year old boy was missing. he was later found sleeping in a neighbors yard. as for the children inside the home child protective services were immediately called and all of them were removed and placed with a relative, the children's maternal grandmother. as the investigation unfolded, authorities say child abuse specialist were called in to talk with the children and according to court documents quote, "...the children thoroughly described the incidents of abuse. on a continuous basis the children were getting punched, strangled, bitten, shot with weapons such as crossbows and bb guns" "...hit with weapons such as sticks and bats, subjected to "waterboarding" and having scalding water poured on them." the childrens parents, johnathan allen and ina rogers now in custody facing collectively 26 counts of child abuse - with allen facing 7 counts of torture. johnathan allen. in a jailhouse interview has defended himself, saying he is a spiritual man -as far as the abuse his children suffered he blames the children's grandmother. (vicki) tonight we are getting our first look at a longtime south san francisco middle school teacher who is accused of lewd acts with students. police just released this mug shot of 39- year-old joseph toy. he has been a teacher at westborough middle school for 13-years. police started investigating toy last month before arresting him last week. toy has been

released from jail... but he is facing several charges. the school put toy on administrative leave. (grant/2) new at 5... the president's focus on california's sanctuary cities was front and center today at a roundtable meeting in washington...with several elected officials and law enforcement officers.(vicki/2) and he once again aimed his anger at oakland mayor libby schaaf saying she should be prosecuted for obstruction of justice. kron 4's dan kerman is live in the newsroom with details. (dan flash)the president who has already called the mayor of oakland a disgrace now is calling on the attorney general to investigate her for obstruction of justice.this all dates back to the february 24th announcement from oakland mayor libby schaaf to the people of oakland warning them that immigrations officials were preparing to conduct an operation in the bay area, including oakland, starting as soon as within the next 24 hours.during today's roundtable the president once again repeated that this warning allowed as many as 1000 people to avoid arrest. that number has been disputed by a former ice spokesman, who

vacaville says it plans to sue a school district after disturbing video surfaced showing a bus driver interacting with their daughter. they say the 64-year-old driver was taunting their eight-year-old

(grant) starting in the east bay tonight. two children and a woman are killed in a crash on 8-80 in fremont. this man man is accused of causing the crash. 21-year-old dang tran was arrested for allegedly being high on marijuana. the crash happened late last night on 8-80 in fremont. three people were killed and five others were injured. two of those people killed are young girls identified as 9- year-old brooke limas and 14- year-old christy limas. the woman killed has been identified as 39-year-old noelle johnson. all were from manteca. friends of

the family tell kron 4 that they were returning from the bay area where they had been celebrating a birthday at the san francisco zoo. we will have much more on this story coming up at 6:00 tonight. (vicki) in the south bay... an arrest has been made in connection to a 20-16 homicide in san jose. joseph miller was arrested in guadalajara, mexico where police say he fled. the u-s marshalls worked with mexican authorities to bring miller into custody. in 20-16 san jose police responded to a fight where they found the victim -- alfred perez -- dead. miller is currently being held in texas... where he will remain until he is handed over to police in san jose. (vicki) and all lanes of southbound interstate highway 280 in san jose are reopened tonight....after water flooded the roadway. chp officials say a blown fuse at a nearby pump house led to the flooding. it happened around four this morning. the flooding closed multiple lanes...as well as the connecting ramp. the fuse was replaced...but the incident caused major traffic going in the southbound

in oakland... an entrepreneur named luke iseman (eyes=man) is converting shipping containers into affordable housing. kron 4's gabe slate visited the box house factory... luke iseman lives in this shipping container in oakland. sound from luke iseman / boxouse - "fed up with rent i realized it would be cheaper to buy a shipping container and convert it into something i could live in" the living space is only 160 square feet but it offers all the basic necessities.nat sound - fawcett turn on running water there is plumbing, electricity, a shower, a full- size bed with storage built in, a desk, for entertainment.. this video projector and a remote controlled drop down

district attorney sharon henry explains the reasoning behind the arraignment.sharon henry/da's office- "we filed a motion to amend the complaint to add additional charges, which were felony child abuse -- nine counts." that's in addition to the misdemeanor count of child endangerment ina rogers was charged with back on march 31st... when police arrested her and 29-year-old jonathan allen after discovering the 10 kids living in her home were being abused.sharon henry/da's office- "biting and various other acts that were just horrendous." rogers' attorney fought to keep the bail under 60-thousand dollars... but that request was denied. she was taken into custody after court. her bail is set at 495-thousand dollars.sharon henry/da's office- "nobody, um, should live in those conditions." rogers has denied the allegations in the past. after court -- her attorney declined to talk about the case. the district attorney's office says all ten children are safe now. rogers is due back in court next week. in fairifield, philippe djegal, kron four news. as new details continue to emerge about the conditions inside the children's fairfield home. and how prosecutors say the couple tried to cover up the physical and psychological abuse inflicted on the children. (pam) as kron four's terisa estacio reports, authorities say, it took only a few minutes inside the home ... to see that something was terribly wrong. court documents obtained by kron four news state quote when officers entered the fairfield home "the children appeared to be skittish and spoke with speech impediments." sources tell kron four news that officers noticed a horrendous smell, and their shoes stepped onto urine soaked carpet feces animal and human were smeared on the floors. that was march 31st. the police initially at the home because ina rogers had called because a 12 year old boy was missing. he was later found sleeping in a neighbors yard. as for the children inside the home child protective services were immediately called and all of them were removed and placed

with a relative, the children's maternal grandmother. as the investigation unfolded, authorities say child abuse specialist were called in to talk with the children and according to court documents quote, "due to the continuous abuse the children have varying forms of scars, including broken arms." "the investigation has shown the defendant knew about these incidents and assisted with the abuse herself and also failed (to) protect the children from this harmful and violent environment." (johnathan) "further investigation has shown the defendant dissuaded the children from reporting these incidents to medical personnel to protect her partner." the childrens parents, johnathan allen and ina rogers now in custody facing collectively 26 counts of child abuse - with allen facing 7 counts of torture. johnathan allen. "you can't imagine how awful this is." we have her on tape, evidence speaks for itself." allen in a jailhouse interview blames the abuse on the children's maternal grandmother, saying she did it to get full custody of the children. (ken) new tonight at 6. an inmate who died at a south bay hospital last week has now been identified. this is video from johnny lozano's arraignment back in 20-13. lozano was facing a murder charge for the death of a san jose state student killed in a drive-by shooting. officials say lozano was being treated for a pre-existing health condition before he died. lozano was admitted to the hospital last month. he last appeared in court in march. new tonight at 6. a 24 year old lyft driver has been charged with three counts of sexual assault. the victim.... his female passenger. kron4's maureen kelly spoke to fremont police who fear that because his job involved driving around the bay area, there could be other victims out there. according to police this all started in oakland in the early morning hours of april 8th when the female victim ordered a lyft trying to catch up with friends. she got into this rented white hyundai elantra.....and asked her driver to take her to berkeley. when that friend wasn't home, police say that lyft driver 24 year old jaswanthreddy baireddy told her he was off duty and offered to take her home. fremont police detective calvin tang says the victim complained when she noticed that he missed her exit.he made comments to try to calm her down, basically to say that she was all right that he was in fact trying to take

care of her and ultimately was able to get all the way to fremont to his own residence and convince her to come inside his home as well at that residence on the 38- thousand block of camden street, police say the suspect offered her marijuana and told her he was too tired to drive her back and suggested she lay down. that's when police say he sexually assaulted her. the victim then demanded her assailant take her home, and once there, she called police. baireddy has been charged with three counts of sexual assault including rape of an unconscious person. fremont police fear because his job involved him driving all over the east, north and south bay.....there might be other victims out there. we want to get the information out because of the fact he had access to so many different cut types of customers, passengers possibly an additional victim or victims we wanna be able to assist them talk to them and advocate for them because they would be survivors of this as well baireddy who has no previous history entered a plea he's being held without bail and is back in 22nd for a preliminary hearing. maureen kelly kron4 news

(pam) new tonight at 6. the u.s. senate has passed legislation aimed at repealing the f-c-c's recent decision... to change the net neutrality rules. the measure was backed by all 49 democrats, as well as three republicans.the vote comes months after the republican - majority f-c-c .... voted to repeal obama - era protections .. approved just a few years earlier. the net neutrality rules prevented internet service providers.... from speeding up or slowing down traffic... for specific websites and apps. supporters of net neutrality say, the f-c- c's repeal decision .. gives too much power to service providers. the measure now goes to the house, where it is not expected to pass.
