( robin )union city business owners are concerned about a change coming to their community. they believe a proposed cannabis dispensary will disrupt the entire neighborhood. one of their main issues - many of the businesses there... cater to children. kron 4's ali reid has the story. these business owners don't oppose cannabis dispensaries, but they believe having one here would disrupt the entire area.ascend rehab caters to

special needs children with physical, mental, and behavioral conditions. the teachers, along with neighboring businesses that also cater to children are concerned a marijuana dispensary may be taking over this space soon.i know the law says they're not supposed to be within 600 feet of a school, but for some reason this preschool doesn't fall under that category they believe the dispensary will impact enrollment, and the business won't be able to continue the work they're doing in the community.swati shah/ ascend rehabi owe it to them to to make sure this is a safe secure neighborhood and that there isn't a dispensary less than 100 feet from here. there's also a batting cage for children nearby, a hospital, and a dental office that caters to young ones just feet away. no place for a dispensary ...marcus lin / kohoutek dentalat least not in this location. in fact another location has opened another mile up from here. why do they need 2 locations so close to each other.with limited street and lot parking, this is a potential parking nightmare. it's gonan be 7 days a week 13

killed were young girls .... now identified as 9-year-old brooke limas ... and 14-year- old christy limas. the woman killed... has been identified as 39-year-old noelle johnson. all were from manteca. the crash happened late tuesday night on interstate 8-80 in fremont. friends of the family tell kron 4... they were all returning home from the san francisco zoo.... where they had been celebrating a birthday. this moring... we are getting a look at the man who police say is responsible... 21-year-old dang tran was arrested for allegedly being high on marijuana. ( robin )this morning... relatives and friends who knew the family are grieving. kron four's j-r stone spoke with people who knew the victims. 21 year old dang tran of san jose is facing dui charges in a five car accident that left 3 people dead and many more injured. officials believe he was under the influence of marijuana and is to blame in the wreck.hope he gets the

book thrown at him.that from rochelle tolbert whose best friend noelle johnson was one of three killed in tuesday night's crash along 880 in fremontsot she was so sweet14 year old christy limas and her sister 9 year old brooke limas were killed in this wreck as well. friends have left flowers and teddy bears outside their manteca home. sot 2 kidsnoelle johnson leaves behind her own 4 kids who were in the suv as well. at least one of them is in critical condition.sot(j.r.) all three victims lived here in the small community of manteca. shortly after arriving i saw people hugging on the side of the road. i talked with a father who used to drive christy to and from basketball practice. he said this is a very difficult time for his daughters who are now

month period... there's been 60 arrest so far... compared to 183 for all of 20-17. < we know the law is over 21 to use rec marijuana but driving under the influence is not. never has been. never will be.>( robin )at this rate, the chp believes marijuana arrests in the bay area will be up 70% by the end of this year. ( robin )an inmate who died at a south bay hospital last week has now been identified. this is video from johnny lozano's arraignment back in 20-13. lozano was facing a murder charge for the death of a san jose state student killed in a drive-by shooting. officials say lozano was being treated for a pre- existing health condition before he died. lozano was admitted to the hospital last month. he last appeared in court in march. in one community say, their property owners are keeping them from rebuilding their homes. dozens of residents at the orchards mobile home park in santa rosa have filed a class action lawsuit against the owners of the park. kron 4's charles clifford has the story. yeah, well here at the orchards most of the residents are over 55 years of age. many lost their homes to last falls fires and they have are still not sure when they will be able to rebuild.at the orchards mobile home park in santa rosa, a large swath of land sits vacant behind a chain link fence. the tubbs fire swept through this area destroying dozens of homes in the park. since then, all of the debris has been removed and some restoration work is completed but neighbors here say the recovery is going to slowly.on monday a group of residents from the orchards filed a class action complaint against hometown america management corporation, which owns the park. the lawsuit claims, among other things, that "hometown america has delayed in allowing plantiffs to move back into the community, resulting in it being finacially infeasible for them

to do so"sotit's frustrating. carol spear lost her home to the fire. since then she's had to move around.sotfirst in hotel for three months and now i'm renting a room from someone at churchshe says that since last october, there has been very little communication with hometown america and she still doesn't know when she will be able to move back in. she also says management has told residents that they may need to start paying rent in september, even if the land is still vacant.sot a lot of people can't afford it because they can't afford to pay two rents. where they are staying and at the orchard even when theres nothing on the lot.we reached out to hometown america management corporation, which is based in chicago, but no one was available to comment for this story wednesday evening.carol she's ready to rebuild and hopes the lawsuit will encourage hometown america to work faster. sotjust need to get the process going quicker. in santa rosa, charles clifford kron 4 news. ( robin ) the fairfield mother accused of child abuse and torture... appeared in court again yesterday. the solano county district attorney's office filed a motion to add charges against 31-year-old ina rogers... and, as kron four's philippe djegal reports... the judge granted that motion. (philippe) 31-year-old ina (eye-nuh) rogers arrived at solano county superior court with family by her side... she would later leave with sheriff's deputies after being taken into custody.sharon henry/da's office- "nobody, um, should live in those conditions." on march 31st -- rogers was arrested and posted bail on a misdemeanor charge of child endangerment.

this after police discovered her kids were living in unhealthy conditions. the children's father, 29-year-old jonathan allen was also arrested. on wednesday, rogers returned to court -- where prosecutors amended the criminal complaint. rogers is now charged with nine felony counts of child abuse in addition to the misdemeanor.sharon henry/da's office- "the children started to disclose just vicious and callous acts, um, that were committed against them by the father. and, the statements also indicated or proved, that the mother, miss rogers, had allowed this torturous acts to occur." rogers has denied the allegations in the past. after court -- her attorney declined to talk about the case. the district attorney's office says all ten children are safe now.sharon henry/da's office- "some of the childrens are with their maternal grandmother and aunt." rogers is due back in court next week. in fairifield, philippe djegal, kron four news. also learning about the conditions inside the children's fairfield home. authorities say when officers entered the home march 31st...the children appeared to be skittish. officers say they stepped onto urine soaked carpet and human waste was smeared on the floors. the police went to the home because the children's mother... had called to report her 12 year old boy was missing. he was later found sleeping in a neighbor's ( robin )san francisco is suing a couple for allegedly turning their home.... into an illegal hotel... where a party ended in gunfire last year.we first told you about this back in october... now the owner are facing legal action. city attorney ádennis herreraá has sued the home's owners for unlawfully renting the bernal heights home. it was listed on a short-term website for over 300 nights during a 17 month period. in october... police say more than 100 bullets were fired during a party at the house. the shooting left a person wounded... and more than a

dozen homes and cars pierced by bullets in the quiet neighborhood. ( robin )a 24-year-old lyft driver... has been charged with three counts of sexual assault. the alleged victim.... his female passenger. kron4's maureen kelly spoke to fremont police... who say they're concerned there could be additional victims. according to police this all started in oakland in the early morning hours of april 8th when the female victim ordered a lyft trying to catch up with friends. she got into this rented white hyundai elantra.....and asked her

driver to take her to berkeley. when that friend wasn't home, police say that lyft driver 24 year old jaswanthreddy baireddy told her he was off duty and offered to take her home. fremont police detective calvin tang says the victim complained when she noticed that he missed her exit.he made comments to try to calm her down, basically to say that she was all right that he was in fact trying to take care of her and ultimately was able to get all the way to fremont to his own residence and convince her to come inside his home as well at that residence on the 38- thousand block of camden street, police say the suspect offered her marijuana and told her he was too tired to drive her back and suggested she lay down. that's when police say he sexually assaulted her. the victim then demanded her assailant take her home, and once there, she called police. baireddy has been charged with three counts of sexual assault including rape of an unconscious person. fremont police fear because his job involved him driving all over the east, north and south bay.....there might be other victims out there. we want to get the information out because of the fact he had access to so many different cut types of customers, passengers possibly an

additional victim or victims we wanna be able to assist them talk to them and advocate for them because they would be survivors of this as well baireddy who has no previous criminal history entered a plea of not guilty. he's being held without bail and is back in court may 22nd for a preliminary hearing. maureen kelly kron4 news ( robin )new information about a case involving a south san francisco middle school teacher... being charged of child molestation. joseph toy taught technology courses at westborough middle school in south san francisco for 13 years before he was arrested for allegedly molesting some of his students. toy is now being charged with 47 counts of child molestation involving four teenage boys. san mateo county district attorney.... steve wag- staffe... says before one of the male victims told school officials about the alleged molestation... the school warned toy about his behaviour

( robin ) president trump is once again saying oakland mayor libby schaaf... should be prosecuted for obstruction of justice. during a roundtable on california's sanctuary policies president trump renewed his attack on mayor schaff. this all dates back to her february 24th announcement... warning the people of oakland that immigration officials were preparing to conduct an operation in the bay area... including oakland... starting within 24 hours. the president says the warning allowed as many as 1-thousand people to avoid arrest.

( robin )also on capitol hill.... the senate passed legislation aimed at repealing the f-c-c's recent decision to change net neutrality rules wednesday. the measure was backed by all 49 democrats and three republicans. the vote comes months after the f-c-c voted to repeal obama- era protections. the net neutrality rules prevent internet service providers like comcast... from speeding up or slowing down traffic from specific websites and apps. supporters of net neutrality say the f-c-c's decision to repeal it... gives too much power to service providers. the measure now goes to the house... where it is not expected to pass. the houston rockets last night in game 2 of the nba playoff's. kron 4's hermela argawi was in oakland... where she talked to fans about the upset. the excitement could be heard and felt as this warriors watch party kicked offfans came in confident the dubs had a sure win against the houston rockets.. but they went home disappointed when the warriors took home a a 22 -point loss. greg hall/warriors fani thought that we were going to literally win. i thought we were going to sweep them. i'm going to keep it 100 with you. 100 means real. i thought we were going to sweep them and then we lost tonight. james harden i don't know who he thinks he is but uh he's not as good as he thinks he is marshaun marsh/warriors fan. and next game we gonna come it's gonna be at home, it's

person shot in the 3800 block of sierra rd. in san jose. arriving officers located an adult male and adult female victim suffering from at least one gunshot wound each. the victims were pronounced deceased at the scene. no suspects have been identified or apprehended.this is the city's 9th and 10th homicide of 2018. after being shot.as you can see the road is blocked here behind me...the crime scene is located about a mile up the road.... on sierra rd, north of sky view drive.police say last night shortly after 10pm they responded to a person shot in the 3800 block of sierra rd. in san jose.when they arrived, they found an adult male and adult female suffering from at least one gunshot wound each. the victims were pronounced dead at the scene. so far, no suspects have been identified. this is the city's 9th and 10th homicide of 2018. if you have any information your asked to call the san jose police department.reporting live in san jose, lydia pantazes kron 4 news. ina rogers was originally arrested back on march 31st. but she posted bail on a misdemeanor charge of child endangerment. this after police discovered her kids were living in filthy conditions. once the children were away from the parents... they told authorities about the abuse they say they suffered... including being áwaterboarded. the children's father, jonathan allen, was also arrested. rogers returned to court yesterday-- where prosecutors amended the criminal complaint. rogers is now charged with nine felony counts of child abuse. she denies the allegations against her. who fit the description... walking on a trail near by. he was arrested on suspicion of having stolen property, and for having a billy club in his bag. police say it does not appear he was intending to harm anyone at the school. ( darya ) san francisco is suing a couple for turning their home into an illegal hotel... where a party ended in gunfire. we first told you about this back in october. now the couple is facing legal action. city attorney dennis herrera is suing the homeowners for unlawfully renting the bernal heights home. it was listed on a rental site for more than 300 nights... over a 17 month period. in october... police say more than 100 bullets were fired during a party at the house. one person was hurt... and more than a dozen homes and cars were pierced by bullets. ( james ) in the north bay... the recovery efforts from the devasting wildfire continues. but residents at orchards mobile home park in santa rosa have filed a class action lawsuit against the owners of the

park. they say they are being kept from rebuilding their homes. the lawsuit says that hometown america has delayed people from being allowed to move back into the community. carol spear lost her home in the fire and she says management has told her that she will need to start paying rent in september... even if the land is still vacant. charged for the double murder of a couple visiting fish head beach. the killings happened in 2004 at the popular beach in jenner. police say the midwestern couple were sleeping when they were fatally shot with a rifle. shaun gallon has been charged for the murders... but did not enter a plea. gallon was also charged for the shooting death of his brother last year... and trying to kill a man with a package bomb in 2004. police say gallon did not know the couple. ( james ) in the east bay... a high school was on lock down after a suspicious person was reported on campus. it happened yesterday afternoon at northgate high school in walnut creek. a staff member called police about a man wearing camouflage clothes and carrying a bag in the school's parking lot. police found james nisleit.. who fit the description... walking on a trail near by. he was arrested on suspicion of having stolen property, and for having a billy club in his bag. police say it does not appear he was intending to harm anyone at the school. custody after an officer searched their car and found a weapon. it happened at a gas station on ashby avenue in berkeley. an officer noticed the car was missing a license plate and approached the men. he spotted a joint inside the car which prompted the search. the officer found a loaded gun under the passenger's seat. both men were arrested. ( james )( james ) in the race for california governor... lieutenant governor gavin newsom holds a double digit lead in a new bay area poll. the poll was done by "e-m-c research." if the election were held today... newsom would win with 31 percent of the vote. republicans travis allen and john cox are tied in second with seven percent. educator and youth advocate delaine eastin is in fourth place with five percent. former l-a mayor antonio villaraigosa and state treasurer john chiang are tied with four pecent. 36 percent of people polled say they're still undecided. recycling crisis. recyclables are piling up with nowhere to go and it is having a big impact here in the bay area. until recently california sold most its recyclable material to china. but now china says it doesn't want it any more. part of the problem is that much of the items that people recycle are contaminated. now recyclers are looking for new buyers but until then recycling centers in the bay area are filling up and some recyclables may end up in the landfill. experts say you should keep recycling but be more careful about what you recycle.

nment agencies have formed a task force... to look for solutions to the problem. ( james ) san francisco could become the first city in the country to have a safe injection site. it's a place drug users can safely shoot up... while under the care of medical staff. the department of public health says there are at least 22-thousand known i-v drug users in san francisco... some of whom are using in public places. we spoke to paramedics who have been cleaning the streets of needles since january... they say something needs to change. ( james )( james ) the city hopes to open the site by fall.. but have not chosen a location.

( james ) health officials say nearly two dozen more cases of food poisoning have been linked to romaine lettuce grown in arizona. the c-d-c released new numbers. 172 people across 32 states have been sickened by a strain of e-coli. at least 75 people have been hospitalized. including 20 with kidney failure. only one death in california has been reported. the affected romaine lettuce grown in yuma, arizona should no longer be in stores and restaurants. ( darya ) bay area baseball... and the giants' winning streak is over.
