(vicki) tonight-- the mayoral race in san francisco is still too close to call... and we just learned the top two candidates -- mark leno and london breed-- are separated by less than 12-hundred votes. good evening i'm vicki liviakis. (catherine) and i'm catherine heenan in for grant lodes. right now-- there are roughly 87-thousand uncounted ballots in san francisco. so it could be days before we find out who will be the city's next mayor. kron 4's michelle kingston is live in san francisco with the latest on the race. michelle? some reaction and explains what's next in the recall of judge aaron persky. judge aaron persky is only the 4th judge in california history to berecalled by voters and the first in 86 years. margaret russell/santa clara university law professor "....it's extremely unusual.....santa clara university law professor margeret russell says voters were mislead.margaret russell "....people who voted for the recall thought they were voting for the best ofreasons, it was a referendum on sexual assault instead of a careful examination of a judge's record..."rejecting persky's own plea that he followed the law when he sentenced brock turner to six months in jail for sexual assault,voters supported the recall by a margin of 60 to 40. margaret russell says voters sent a strong message.margaret russell "..they're getting a message on the back end that if they do somethingwrong they better watch out..."persky will remain in his position as a "night judge," for now, handling requests for warrants, restraining orders and other judcial matters. once the recall vote and election of replacement judge cindy hendrickson are certified and hendrickson is sworn in persky will be removed from office. margaret russell "...judge persky will

among the big sellers. the prop upholds the board of supervisors' unanimous vote to ban the products. critics argued - unsuccessfully - that a ban would hurt immigrant-owned businesses. and regional measure 3 has passed.it will raise tolls on most bay area bridges - the golden gate bridge 'not' included. the tolls would gradually increase by 3 dollars -- between 2019 and 2025. the money would pay for about 3 dozen transportation and public transit improvements. (catherine) the president of the bart board issued a statement...thanking bay area voters... saying in part it's an investment in public transit that supportskeeping the region mobile. robert raburn adding "the new revenue that bart received from regional measure 3 will help us purchase new train cars to increase capacity and comfort for our passengers." tran reports. will tran/san jose-the workers have been busy all night and will be busy in the days to come as so far they have received about 137-thousand mail in ballots back with a potential of up to 400 thousand by fridayand that's important because there is a close race involving santa clara county sheriff laurie smith who right now stands to have a run off with her opponent who is also her second in command john hirokawa here is shannon bushey with the registar of voters to talk about what's ahead(shannon bushey/santa clara county registrar of voters-we will be taking still thousands and thousands of ballots. they need to be taken out, straightened and then counted. it's going to be days before we are even through but the goal is to try and get a picture of what's to come.) (catherine) also -- brave transit workers rescue hundreds of people from the north bay wildfires-- and it was caught on camera. (vicki) plus after the break-- an east bay student dies after drowning in the pool at his high school. and tonight we are learning it was áánot a suicide. in the east bay - a critical update to a story about a high school student drowning in the schools' pool. a completed autopsy report is now claiming the students' death was áánot a suicide. as kron four's terisa estacio reports-- the family is now demanding answers to their son's tragic death. (estacio reporting) this is the sixteen page autopsy by the contra costa coroner's office... on benjamin curry. curry was a 9th grade student at san ramon valley high school. (take vo)curry was discovered by students and staff in the deep end at the schools pool back on may 8th. at a makeshift memorial at school following his death - posters on suicide prevention were put up. many students said on camera, they believed curry had commited suicide. now, in the autopsy a much different finding... in the

highly detailed report, the corner now states quote " the decedent was found under the water in the san ramon valley high school school swimming pool. althought the decedent suffered from depression, there is no indication the decedent intended to drown himslef." furthermore, this death will be classified as an accident." in addition, the report continues to include this revelation.... that during the investigation, a school resource officer reviewed surveillance video of the schools pool. he stated in the coroner's report it shows curry submerged in the water during a swim class. as the class ended, students were seen leaving, but it is unclear whether he left with others or remained. however, 10 minutes later as the next class appeared, they found curry underwater. they removed him and a teacher began cpr until paramedics arrived. the school district is not responding to the report directly, instead saying they are cooperating with the police department as it continues it's investigation. addditionally, in an email statement said their thoughts continue to be with the student's family and

loved ones, as well as our students and staff. (estacio) curry's parents now have an attorney - who has many questions, such as whether he was adqueately supervised during a swim class. we will have much more on this story coming up later on kron four news and online at kron four dot com. ##### (catherine) an east bay teacher is behind bars tonight... accused of committing sex acts with children. police arrested brandon genest at his home in walnut creek. the investigation started with accusations that he had children inappropriatey touch him... while working as a babysitter. genest is also a high school teacher at bentley school in lafayette. he's on administrative leave. (catherine) a teacher at a san jose high school is accused of intimidating a student - with a noose. the teacher is caucasian -- the student african american. it happened at santa teresa high school. and, as kron four's philippe djegal reports... the police department got involved -- but

no charges have been filed. (philippe) on april 30th... the organization the black leadership kitchen cabinet says an african american student at santa teresa high school in san jose was threated with a noose made from rope in the school gym. the person they say made the threat was a white teacher and coach.tiye garrett/activist- "and, this individual teacher told that student directly, stay away from me, blank student -- students name. and, he made a noose like, um , structure, around his own neck. (philippe) so, this was unprovocked? (tiye) unprovocked." community activists outraged by this organized a news conference at the african american community service agency in san jose to share their concerns. the student's parents filed a complaint with the east side union high school district, which did not return our requests for comment on this story. the police department was notified a few weeks after the incident about what happened. chief eddie garcia says members of the community alerted detectives

the school district did not. eddie garcia/sjpd- "the case was taken to the district attorney's office, it was deemed to be a hate incident and not a hate crime. so, there were no charges filed." meanwhile, friends of the boy involved say he's still shaken up by what happened. they say there have been numerous other racially charged incidents at the school and throughout the district... a pattern they find alarming -- and so does the chief -- especially regarding this most recent case.eddie garcia/sjpd- "it's not justifiable. uh, its sickening, uh, either way, uh, and so, that's when i heard about it i was appalled. when my detectives heard about it, they were appalled." as a result of what happened on april 30th... and, a few other incidents throughout the years... the black leadership kitchen cabinet says it is considering filing a class action lawsuit against the school district. in san jose, philippe djegal, kron four news. (vicki) another death investigation is underway after the body of a woman was found on the campus of san francisco general hospital monday. that the second time in as many weeks.

kron4's maureen kelly has the latest on what we know about the case. city's department of public health is calling the death of the female patient monday unexpected. they also say preliminary findings from the city's medical examiner autopsy on the body has not uncovered evidence of foul play.. the cause and manner of the death is still unknown and could be weeks away before that's determined. they say they could not provide more than that citing privacy laws. but it's been reported that the woman died while in a bed in the hallway of the hospital's psychiatric ward. and that the dead woman had been here on a involuntary 72 hour hold, which happens with when a person is considered dangerous , suicidal or gravely disabled due to mental illness. that death comes less than a week after the body of ruby andersen was discovered in the stairwell of the hospital's power plant. that gruesome discovery coming 10 days after the 76 year old was reported missing from the residential board and care facility for those over 60 with diagnosed mental issues. that case has sparked a number

of investigation and prompted more security changes. and has some asking how it could have happened again. back in 2013 lynne spalding, a hospital patient who had been missing for weeks was found dead of dehydration in an sf general stairwell. now after this most recent death i asked the city's current mayor is he has any plans to step in...his response...let's wait and see.. their investigations happening with both of those incidents we obviously take them very seriously, especially if they're on city property . but we need to let those investigations play out when the in results are in will evaluate wait what may or may not need to be done as a result as a result but right now we need to let those investigations play outthe woman who's body was found monday has not yet been identified, the medical examiner's office saying they have yet to locate her next of kin. maureen kelly kron4 news. transit workers evacuate hundreds of people as the north bay wildfires broke out back in october. this is video from a santa rosa city bus. transit officials say drivers helped rescue people from hospitals and care centers in the fire's path. one of the driverlost his home that night as he was helping others get to safety. around 400 seniors and people with disabilities were rescued by the transit workers that night. ... (catherine) in the south bay... one person was injured after crashing into a fire truck in san jose. it happened just before 3:30 this morning on capitol expressway at tuers road. a firefighter was setting up cones near a fire in a creekbed when the driver came speeding towards him. he missed the firefighter--- but crashed into the truck. the driver was taken to the hospital but is expected to be okay. to be okay. (vicki) concord police are looking for a determined burglar after he broke into a local convenient store and stole five thousand

dollars worth of lottery tickets. as you can see on surveillance footage - the suspect ripped off the door handle and then threw a rock into the glass door. he squeezed himself into the broken opening and went for the cash register. when he realized it was empty he snagged an armful of lottery tickets and ran out. anyone with information is asked to contact the concord police department. (vicki) fremont police were called to the grimmer neighborhood after a fight broke out... between two bulls. it happened this morning on castro lane. police say the bulls were fighting in the street...hitting cars and knocking over fences. but it wasn't surprising to see livestock roaming the streets. there are ranches along the fremont hills. and police say they get calls about horses and goats at least once a year. the owners were sited one hundred dollars and are responsible for repairing damaged property. little change is forecast into thursday with continued cool temperatures and overnight/morning low clouds

(catherine) more than a month after the first eruption, hawaii's kilauea volcano has unleashed a new tidal wave of lava, wiping out hundreds of homes overnight. number eight is the only one of the dozens of fissures that's still active.....and it's "very" active --- spewing enough lava to cover a thousand football fields three feet deep.... every day! the flow spread eastward at speeds up to 80 miles an hour. aerial videos over the weekend show it approaching the big island's picturesque kapoho bay. in a matter of hours, the bay was was gone. (vicki) nearly 200 people are still missing after the fuego volcano in guatemala suddenly erupted on sunday. at least seventy-five bodies have been found. rescue crews are working around the clock despite the risk of mudslides and more explosions. rainfall is now hardening the ash on the surface, making it harder to dig out bodies. locals believe many remains may never be recovered.

the death of the identifed female patient unexpected. they also say preliminary findings from the city's medical examiner autopsy on the body has not uncovered evidence of foul play.. the cause and manner of the death is still unknown and could be weeks away before that's determined. they say they could not provide more than that citing privacy laws. but it's been reported that the woman died while in a bed in the hallway of the hospital's psychiatric ward. and that the dead woman had been here on a involuntary 72 hour hold, which happens with when a person is considered dangerous , suicidal or gravely disabled due to mental illness. that death comes less than a week after the body of ruby andersen was discovered in the stairwell of the hospital's power plant. that gruesome discovery coming 10 days after the 76 year old was reported missing from the residential boarand care facility for those over 60 with diagnosed mental issues. that case has sparked a number of

(philippe) on april 30th... the organization the black leadership kitchen cabinet says an african american student at santa teresa high school in san jose was threated with a noose made from rope in the school gym. the person they say made the threat was a white teacher and

(philippe) so, this was unprovocked? (tiye) unprovocked." community activists outraged by this organized a news conference at the african american community service agency in san jose to share their concerns. the student's parents filed a complaint with the east side union high school district, which did not return our requests for comment on this story. the police department was notified a few weeks ter the incident about what happened. chief eddie garcia says members of the community alerted detectives the school district did not. eddie garcia/sjpd- "the case was taken to the district attorney's office, it was deemed to be a hate incident and not a hate crime. so, there were no charges filed." meanwhile, friends of the boy involved say he's still shaken up by what happened. they say there have been numerous other racially
