( robin )this morning... a santa clara county man is behind bars for attempting to kidnap his neighbor not once... but twice.deputies say 35 year old hi-po-lito martinez was arrested for attacking his neighbor and entering her home in unincorporated gilroy. the victim told deputies that martinez entered her home, attacked her and tried to remove her clothing. the victim said she defended herself and escaped the house. however- martinez chased her and attempted to drag her back inside.. but she fought him off again and ran away and called police. martinez is behind bars and is facing several felony charges including kidnapping and false imprisonment. ( robin )it's been almost 2

years since police began their search for two missing yolo county teenagers. four suspects are now facing murder charges for both teenagers... two of those suspects appeared in court yesterday. reporter ken deci has the latest. these are pictures of chandale shannon and jonathan froste in san francisco, posted to social media 5 days after police say enrique rios was killed. here are the two men today... in court, awaiting arraignment for murder, kidnapping and other charges related to the disappearance of rios and his friend, elijah moore.sot - alicia moore/mother "my daughter... that's her big brother. she says, 'mom where is my brother? he said he's always going to protect me.' but he's not here. how do you tell her that? so..."the mother of elijah moore, outside the courthouse in woodland where, in keeping with a case that has already taken a year and 8 months to file, things were delayed again today.a main suspect, jonathan froste's brother

david... couldn't be brought in time for the hearing from prison where he is serving a sentence on additional charges. sot - steven froste/brother of acsed men"well.. there is a lot of speculation and there is a lot of talk in the community. but i grew up with my brothers. and it has saddened me."steve froste said he wants to remind everyone that his brother must be considered innocent until proven guilty.meanwhile, about three miles away off county road 116b in yolo county... the sheriff's department has ending excavations along a stretch of the sacramento river where they had hoped to recovered the body of the two teen woodland student.sot ben : are your thoughts right now at the river and what's going on over there??alicia: no no not right now."yolo county sheriff ed prieto told fox 40 the search to recover remains of the boy's here is being called off... after days of digging, excavators found nothing. bizarre kidnapping and crash over the weekend. 40-year-old daphne bailey died, when the car she was riding in... burst into flames following a police chase that ended in emeryville. san francisco police said, bailey and a male suspect assaulted a woman in the city's tenderloin district sunday ... and then kidnapped her. the woman managed to escape unharmed. police say, the male suspect and bailey drove onto the bay bridge toward oakland, and collided with another vehicle in emeryville. bailey died at the scene. the male suspect who was driving the car, suffered major injuries and is still in the hospital. ( robin )in the east bay... police are searching for four women... in connection with the armed robbery of a group of exchange students from ireland. those students were held at gunpoint saturday morning near u.c. berkeley's clark kerr campus. the exchange students were walking on etna street... when a car pulled up next to them... and four female suspects got out. officers say the suspects pointed a gun at the group and demanded their property.

the students weren't injured.... and those suspects are still at large. ( robin )wildfires in the western u-s have been causing havoc. thousands of people have been forced to flee as the flames scorch tens of thousands of acres in several states. reporter john lorinc has the latest details. a brush fire in the benedict canyon area is posing a threat to the ritzy area in southern california.ines romero/resident "i hear all these fire engines and i'm thinking 'what's going on?' and then all of a sudden the helicopter's like right above and i'm thinking this is not good. so i looked out the window and there was a big black plume of smoke."the portola fire forced dozens of households to evacuate.deputy chief andy fox/los angeles fire dept."it's ve complex, heavy brush. these areas have not been burned for many many years, and we're fortunate that we don't have erratic wind and weather conditions." washington state is also dealing with a major blaze.the soap lake fire has burned about two-thousand acres.some residents who evacuated were allowed to return home....but

( robin )back here at home... residents in the east bay's pinole area... were forced out of their homes due to a brush fire. it started around 4 o' clock yesterday... and damaged at least one home. fire crews knocked it down within 15 minutes... but cleared the area for an hour to make sure it did not reignite. the battalion chief says the weather makes this area more vulnerable.

"we're champs again. it's great to be here again."chant "lets go warriors!"( robin )sharing the love in oakland as more than a million members of dub nation... cheered on the warriors as they brought home their third championship in four years. here's a look back at the golden day... from tuesdays parade. it was a day of it was a day of celebration for the golden state warriors, the washington capitals and their fans.hundreds of thousands of fans in gold and blue and holding signs that read "dynasty" and "back to back champions" waved from behind barriers set up along

the route in downtown oakland, california, as the warriors rode by in an open, double-decker bus.stephen curry, nba finals mvp kevin durant and the rest of the warriors took turns raising the larry o'brien trophy for the roaring crowd.hundreds of thousands of fans lined constitution avenue and filled the national mall on tuesday to celebrate the capitals' first stanley cup championship. the parade and rally midway between the u.s. capitol and washington monument commemorated the first d.c. title in the major four professional sports since the redskins in 1992 and the first cup in the capitals' 44-year history.fans clad in red were 20 deep on either side of constitution chanting "let's go caps!" as more than three dozen buses and convertibles made the trip along the mile- long route.the warriors wrapped up their third title in four years by completing a sweep of the cavaliers last friday, one day after the caps took out the golden knights in five games. to pay. the dubs will also give one -point- two million to pay for the police ... firefighters and clean up crews. ( robin )as everyone was getting to and from the parade using bart... officials say there were fewer riders than last years parade. bart put every available train into service to accommodate fans... however trains were still packed. by nine o'clock tuesday morning... there were more than 119- thousand passengers who had exited bart stations. that number is down by 12-thousand passengers from the day of last year's warriors parade. ( robin ) the race for san franciso's mayor is still on. and this morning... london breed is in the lead with about 18- hundred votes. kron 4's ali reid has the latest on this election that's getting closer and closer... as the days go by. it's still less than a one percent difference.at this

point either candidate can take the lead.pkgvotes continue to be counted ... we're feeling really hopeful. the gap is widening. supervisor london breed maintains the lead for mayor by just over 1800 votesi think this is a really good day for us, but there's still so many votes to count and statistically we can't say one way or the other who the winner will bethere's a system and everything here is done strategically. every day the machines at city hall are tested so they're tabulating as we expect them to.election personnel added provisonal ballots to the mix today ... and got through half of them. in addition to all the other votes, supervisor london breed now has a total of 111-446, at 50-point-42 percent. and former senator mark leno is right behind at 109-585 ... 49-point-58 percent.and then there are still some that need manual review. so we've got through friday to get through the provisional ballot cards.

some cards require a second or third run throughbreed's camp tells me, the supervisor is optimistic yet level headed. tara moriarty / london breed campaign spokeswomanshe's maintained a really clear frame of mind and has said what's meant to be will beleno is still out of town. in the meantime, his campaign spokesperson says there's no backing down now.zoe kleinfeld / mark leno campaign spokespersonwe're emboldened by the fact that there was such a strong voter turnout and such strong support in the city and for people that are looking for a new direction in city hallstandupelectronic counting should be done by friday, so we may be able to assume a winner by then.but officially, the board of elections will have to conduct manual counting before making a final decision.that will begin on monday.so an official announcement will come some time next week.reporting live from san francisco city hall .. ali reid ... kron 4 news.

investigating back to back crimes in hercules.... that happened in broad daylight. first police were called to starbucks on the 37-hundred block of san pablo avenue for a reported laptop theft. police say two males bought drinks... left... and came back. that's when they

grabbed the victim's computer, causing him to fall to the ground. suspects ran out of the store and drove away in a dark colored sedan. then police responded to an auto burglary on the 35-hundred block of franklin canyon road. someone broke a car door handle and stole the victim's golf clubs. at last check... those suspects remain at large in both cases. ( robin )sonoma county has settled a lawsuit by county jail inmates..... who claimed they were beaten in their cells by corrections officers during "yard counseling" back in 20-15. court documents say at least 20 inmates in the main adult detention facility in santa rosa were beaten over five hours back in may of 20-15. seven inmates were named as plaintiffs in the suit. sonoma county sheriff... rob gior-dano... disclosed the 1-point-7 million dollar settlement monday in a facebook video. he says they are still settling the case... and has also increased use of force training... and also purchased

more body cams for the facility. ( robin )on the peninsula... pacifica police are warning residents to lock their car doors. this comes after 30 unlocked vehicles were burglarized on reich-ling avenue sunday morning. police were called to the area around seven a.m... and determined it was connected to other car burglaries in san mateo county. police are urging people to lock their car doors and avoid leaving valuables inside of their cars. ( will ) in the east bay... people in pinole were forced out of their homes because of a brush fire. it started around 4 o' clock yesterday... and damaged at least one home. fire crews knocked it down within 15 minutes... but cleared the area for an hour to make sure

it did not reignite. the battalion chief says the weather makes this area more vulnerable. ( will ) the high in pinole yesterday was about 90 degrees. fire crews say it's crucial as the temperatures pick up... that people do what they can to avoid starting a fire. ( james ) the u.s. supreme court could soon decide to hear an appeal from a sheriff's deputy being sued for excessive force. deputy erick gelhaus shot and killed 13-year-old andy lopez in october of 2013 when he was carrying a b-b gun that looked like an a-k 47 assault rifle. deputy gelhaus says he was acting in self defense because the gun was pointed towards him. back in september the court of appeals rejected that claim and allowed the lawsuit to continue. morning... the santa clara county board of supervisors has unanimously approved 600-thousand dollars in funding... to process of a backlog of 200 rape kits. the goal is to have those kits tested by july 2019. supervisors also want to cut the time needed to process each kit from 94-days to 30- days. the county is also looking to hire 2 more people to process the kits. ( will ) pro-choice advocates are denoucing plans by the trump administration to severely restrict what can and cannot be said at family planning clinics... like planned parenthood. supporters of planned parenthood rallied outside san francisco city hall yesterday. the trump administration rule change impacts clinics that receive federal title-10 funding. the change would prohibit title-10 projects from performing or supporting abortion as a method of family planning -- or they risk losing funding.

( james ) back to back crimes in broad daylight in hercules. first... police were called to starbucks on san pablo avenue. that's where a laptop was stolen. police say 2 men bought drinks... left... and then came back. when the men returned... they grabbed a laptop and ran off. police also responded to a car burglary on the 35-hundred block of franklin canyon road. someone broke a car door handle.. and stole the golf clubs. police are looking for the thieves in both cases. ( will ) sonoma county has settled a lawsuit by jail inmates... who claimed they were beaten in their cells by corrections officers during "yard counseling." court

documents say at least 20 inmates in santa rosa were beaten back in may 2015. seven inmates were named as plaintiffs in the suit. the county settled for 1- point-7 million dollars. the sheriff says officers were re-trained and they are buying more body cameras for the jail. ( will ) a california bill that would declare gay conversion therapy a fraudulent practice ... has the votes to pass out of a senate committee. a majority of state senators on the judiciary committee voted to advance the bill. the bill aims to ban selling or advertising sexual orientation change therapy. those against the measure say they believe it would infringe on their religious freedom. but one senator says the bill does not harm freedom of religion because it only applies to businesses. the sheriff's department says a search for the teens along a stretch of the sacramento river is ending. people in pinole were forced out of their homes because of a brush fire. it started around 4 o' clock stery... and damaged at least one home. fire crews knocked it down within 15 minutes... but cleared the area for an hour to make sure it did not reignite. the battalion chief says the weather makes this area more vulnerable. ( will ) the high in pinole yesterday was about 90 degrees. fire crews say it's crucial as the temperatures pick up... that people do what they can to avoid starting a fire. ( james ) the u.s. supreme court could soon decide to hear an appeal from a sonoma county sheriff's deputy being sued for excessive force. deputy erick gelhaus shot and killed 13-year-old andy lopez in october of 2013 in santa rosa when he was carrying a

b-b gun that looked like an a-k 47 assault rifle. deputy gelhaus says he was acting in self defense because the gun was pointed towards him. back in september the court of appeals rejected that claim and allowed the lawsuit to continue. ( james ) new this morning... the santa clara county board of supervisors has unanimously approved 600-thousand dollars in funding... to process of a backlog of 200 rape kits. the goal is to have those kits tested by july 2019. supervisors also want to cut the time needed to process each kit from 94-days to 30- days. the county is also looking to hire 2 more people to process the kits. burning in the west.... are forcing thousand of people out of their homes. more than 13-hundred homes have been evacuated by a wildfire burning in colorado's mountains. the fire is burning in summit county... which is home to several ski resorts. and in southern california... los angeles fire officials say a power tool being used to clear brush sparked a wildfire. flames there led to evacuation orders for 86 homes in the wealthy hillside enclave of benedict canyon. and in washington state... the soap lake fire has burned about two-thousand acres. some people who

( james ) back to back crimes in broad daylight in hercules. first... police were called to starbucks on san pablo avenue. that's where a laptop was stolen. police say 2 men bought drinks... left... and then came back. when the men returned... they grabbed a laptop and ran off. police also responded to a car burglary on the 35-hundred block of franklin canyon road. someone broke a car door handle.. and stole the golf clubs. police are looking for the thieves in both cases. ( will ) sonoma county has settled a lawsuit by jail inmates... who claimed they were beaten in their cells by corrections officers during "yard counseling." court documents say at least 20 inmates in santa rosa were

beaten back in may 2015. seven inmates were named as plaintiffs in the suit. the county settled for 1- point-7 million dollars. the sheriff says officers were re-trained and they are buying more body cameras for the jail. ( will ) a california bill that would declare gay conversion therapy a fraudulent practice ... has the votes to pass out of a senate committee. a majority of state senators on the judiciary committee voted to advance the bill. the bill aims to ban selling or advertising sexual orientation change therapy. those against the measure say they believe it would infringe on their religious freedom. but one senator says the bill does not harm freedom of religion because it only applies to businesses. ( james ) california voters will decide this fall if the golden state should be split into three separate states. the proposal known as "cal 3" has gained enough signatures required to get on

the sheriff's department says a search for the teens along a stretch of the sacramento river is ending.
