two separate shootings in the east bay. the first shooting happened last night around 10-40 p-m on the 79-hundred block of ney avenue. these are pictures from the scene. police say 2 people were shot... but no further details were released. the second shooting happened early this morning around 1-30. that happened on the 11-hundred block of 65th avenue. one person was killed. no word on if any arrest were made in either of those shootings. ( robin )this morning loved ones of a slain 38-year-old mother of 4... are speaking out. kishana harley was brutally murdered just 6 days ago in her richmond apartment last thuray. police found her lying on the floor with traumatic injuries... after co-workers and friends grew worried when she did not show up to work for two days. harley's 4 children... ages 2 to 18... were not in the home when she was killed. her ex-fiance spoke to kron 4... and tells us he's devestated about what happened.

( robin ) happening today... the man accused of stabbing and killing 18-year-old nia wilson at the macarthur bart station will be in court. john lee cowell was caught while sitting on a bart train on monday. another passenger recognized him and called police. police say cowell attacked wilson and her sister sunday night. police believe they have the murder weapon... which was found at a nearby construction site. they're now running d-n-a tests. authorities revealed the details of cowell's arrest yesterday.

volunteered to get off, no use of force, and did not find any weapons. once we was in custody, and jail, he asked for a lawyer... pending charges from district attorney.">( robin ) cowell does have a criminal history in contra costa county. he's been brought up on charges at least 6 times. those charges included assault and battery. ( robin )and for the first time we are hearing from the family of john cowell.... and the mental illness they say he was diagnosed with. kron4's haziq maadyun has more.. in a story you'll see only here on kron4. a woman who described herself as john cowell's aunt told me by phone that she and her family has received multiple death threats since her nephew was identified as the murder suspect in sunday's deadly

bart stabbing. she did not want to speak on camera and declined recording her voice out of what she says is fear for herself and her family. instead she faxed us a statement that reads as follows..."first and foremost, we want the wilson family to know want the wilson foremost, we want the wilson family to know that our hearts go out to them...our prayers go out to everyone in their family."we don't know whether these words of condolence have reached the wilson family....in oakland haaziq madyun kron4news

( robin )it's been a violent week on bart ... with 3 people dead from separate incidents. one man who was attacked last year, when a mob of teenagers hopped on a bart train at the oakland coliseum and robbed a number of people ... is speaking out. kron 4's ali reid sat down with him and has the story. a year ago when rusty stapp was viciously attacked on a

bart train, he filed a lawsuit ... and with that, he stated that if there wasn't an overhaul in protocol, someone would eventually lose their life.unfortunately, within the last week, 3 people were killed from being attacked on bart.pkgthe latest attacks on bart trains that left 3 people dead isn't sitting well with rusty stapp. there's just some basic safety that you shouldn't be scared of when you get on public transportation.last april, while heading home from san francisco with his wife and teenage daughter, a mob of teenagers entered the train at the coliseum bart station and wreaked havoc. he was the first to be attacked and robbed.about 30 of them got on our car. it was terrifying for the whole car.since then he's filed million dollar claims against bart, alleging the transit agency did nothing to protect the public from that attack. since then he's heard of other instances. one of the reasons he no longer gets once the sun goes down.i wont get on past 830 at night. i've probably racked up a thousand

( robin )an investigation is underway after a man allegedly threatened to "blow up" san bruno city hall. officers arrested 38-year-old keith gillam believing he was the person who made the threat by telephone yesterday. after a search of gillam's home -- investigators found no explosive devices or materials to make explosives -- but they

did find two guns. gillam was booked into san mateo county jail for charges related to making criminalthreats. ( robin )the attorney for brock turner is arguing .. the jury's verdict against him should be overturned ... because of what the lawyer says, was a lack of evidence. the former stanford swimmer was sentenced to 6- months in jail back in march of 20-16 ... after he was convicted of sexually assaulting an unconscious woman. that sentence led to outrage and a recall effort against the judge in the case. turner was not in court yesterday ... but his lawyer argued, the members of the jury used their imagination... as to what had actually happened. the california appeal court judges now have 90 days to respond to the appeal. ( robin )a 63-year-old man has been convicted of molesting an 11-year-old girl. anthony mi-ron - a homeless man approached the child at a laundromat in south san francisco last summer and talked about sex. miron

kissed the little girl's hand and cheek. when the victim's 15-year-old sister found her she helped gather her clothing and they went home and told their parents... who called the police. because miron was already registered as a sex offender... prosecutors tried this as a second-strike case. he remains in jail without bail and faces 37 years in prison. he's due back in court for sentencing in september. ( robin )( robin )in the north bay... police found a man and a woman dead in a san rafael home. police went to the terra linda neighborhood around eight- thirty tuesday morning... after a man called them saying he had just shot his wife... and was ready to shoot himself. officials ordered a shelter-in- place in the area .. while a swat team investigated. we spoke to a neighbor about the incident. ( robin ) wilson said he did not hear any gunshots. but when police went inside the house...they found a dead man... woman... and a gun.

this is san rafael's first homicide since 20-11. ( robin )on the peninsula -- a man died while surfing in san mateo county. state park officials identified the man as 20-year-old malcom felix. he was an off-duty lifeguard ... surfing on pomponio state beach. felix was pulled out of the water by a good friend of his, who is also a lifeguard. officials are not announcing a cause of death, or what may have led up to his death. according to his facebook page... felix studied electrical engineering at california polytechnic state university in san luis obispo. ( robin )governor jerry brown is looking to soften the standard... that makes utility companies financially liable when their equipment causes wildfires. tuesday brown sent lawmakers legislation that would allow judges to decide how much utility companies should pay. currently those companies are held entirely liable for wildfire costs triggered by their power lines, transformers, or other infrastructures. many

critics say changing liability would raise insurance premiums... and remove incentives for utility companies to do everything they can do... to prevent fires. ( robin )the bay area may get an increase in our water supply in the next few years. the department of water resources just approved a project for several reservoirs... including one in pacheco. kron 4s rob fladeboe has the details. the california water commission is expected to approve committing a billion dollars to construct two large water projects in the bay rea. approved by voters in 2014, the water bond issue proposition one has earmarked $485 million-dollars for the santa clara valley water district, which would contribute close toanother half billion, to essentially expand the existing pacheco reservoir near pacheco pass.a new 319 foot tall dam would expand the reservoir's capacity from 6,000 acre to

robin ) ( robin ) for your health this morning.. a warning from a mother after she says her daughter had to get her gallbladder removed... the reason: she ate too many hot cheetos. the mother says her daughter ate about four bags of flaming hot cheetos and other hot chips about four times a week. she says the teen developed stomach pains... and had to get surgery to remove her gallbladder. doctors haven't tied the spicy snacks to gallbladder problems.. but they have been blamed for stomach issues. ( robin )right now... san francisco police are investigating a shooting that left one person dead and another injured. it happened near the corner of 16th and mission streets in san francisco's mission district. when police arrived to the scene, they found 34-year-old hubert coleman and another man suffering from gunshot wounds. the pair were taken to the hospital... where coleman was later pronounced dead. police have not released any suspect information.. and the fatal shooting remains under investigation. ( robin ) in the east bay... a 16-year-old hayward girl is now safe... after her disappearance triggered an amber alert. police found isabelle epps at the pleasant

hill bart station. the man accused of kidnapping h is now in custody. family members say they got a call from epps around 2 yesterday afternoon. they say she was screaming and feared for her life. four hours later... pittsburg police spotted the suspect -- in his black honda s-u-v and arrested him. but there was no sign of epps. she was found less an hour later by bart police. ( robin )a man escaped uninjured from an armed kidnapper. it happened monday night in san francisco... at crocker amazon playground. police say a man approached the 23-year-old victim demanding money. the victim did not have any cash... so he was then forced at gunpoint to get in his car and drive to a nearby a-t-m. on the way to the a-t-m...he crashed into another car near alemany boulevard and geneva avenue. that's when the kidnapper grabbed the victim's backpack and cellphone and hopped out of the car. the victim continued driving. police have not located the kidnapper. in three days... three suspects robbed a california lululemon. this is video from sunday, when police say, three woman entered the fresno store and got away with 17- thousand- dollars worth of items. officials say, the same suspects hit the store again yesterday. no word on how much they got away with this time. fresno police say, more than a dozen other lululemon locations have been hit recently. ( robin )a california congresswoman was the target of a threatening package. a package labeled anthrax was found at the los angeles office of representative maxine waters yesterday. police evacuated the scene as a precaution. hazmat crews with the los angeles fire department determined the package was not dangerous. investigators are trying to find out who left the package at the office. waters is a vocal critic of president trump, even calling for his impeachment. ( robin )starting in 20-20... you won't find plastic straws in san francisco eateries.

city supervisors unanimously approved a ban on plastic straws and takeout containers treated with fluorinated chemicals. there will be second vote next week. the legislation also makes napkins and utensils with takeout or delivery... available only on request unless tre is a self-serve station. food and drink vendors in must use carryout containers and food wrappers that are free of fluorinated chemicals. the chemicals ward against grease and water, but proponents of the ban say the chemicals are harmful... and do not break down in compost. shows new details about a deadly shootout at a trader joe's store saturday. one employee died ... and six others were injured. jasmine viel has the latest from los angeles. nat sound/sirens and gunshots police dashcam and gunshotsnat sound/sirens nat sound/sirens and gunshotspolice dashcam video captured the shootout saturday between the suspect, gene atkins, after he crashed into a pole outside a silver lake trader joe's, and two l-a-p-d officers. nat sound/sirens and gunshots another angle from police-worn body cameras shows those officers firing back a reported eight rounds at the suspect as he runs inside. he was hit in the left arm. it was in those moments that store manager melyda corado had come out and was also hit by one of the rounds fired by officers. michel moore/los angeles police chief: "it was a through and through wound to the left arm that moved then into her body. // as chief of police, i am sorry for the loss." police chief michel

moore says his officers had to make a split second decision to defend themselves against atkins, corado ran back inside and collapsed. when she was brought out to be treated by paramedics, it was too late. michel moore/los angeles police chief: "i recognize how they will forever go through their mind, debating whether that was what they had to do." the gunman continued to fire from inside the store at officers. you can hear the bullets hitting the wall that they were using as cover. nat sound: "watch out!" dozens of customers and employees were held hostage for hours. nat sound: "shots fired." those officers first chased 28- year-old atkins to the grocery store after learning he had shot his grandmother, mary madison, in her south la home, and kidnapped his 17-year-old girlfriend, who was also injured by a bullet. the police chief said the chase lasted 15 minutes as atkins fired atthose officers through his back window. nat sound: "shots fired, shots fired. officer needs help, west silver lake drive." atkins

tasty perk for tech workers. now, two bay area cities are taking steps to ban big companies from opening up those free in- house cafeterias. kron 4's maureen kelly has the story. i love itthis microsoft employee has a free coffee she got at her workplace cafeteria....she says she can get all her meals free there... it's less work for me i'm more focused i'm not worried about what i'm gonna eat even if i have to go to a restaurant downstairs i need to think about it what am i going to eat where should i go and the price is everything it's just a hasslebut that hassle free dining hurts local restaurants in the area.....the caddilac bar on 9th street has a few diners during what should be the busy lunch rush.....but there are plenty of empty tables.now san francisco supervisors asha safai and aaron peskin are introducing legislation that would pull

the plug on that perk....proposing to change the zoning laws to prohibit busineses from opening in house cafeteria's. they want to encourage those office workers to go out and buy their lunches outside. we want your employees to get out of the office, we want you to support our small businesses we want you to interact and add to the cultural vibrancy of our city and we want you to make san francisco that help he city moving into the future if passed it would only affect new companies....so companies like twitter that already have a cafeteria can keep it. the owner of a nearby restaurant says some companies like square have helped out by closing their cafeterias every other friday.... we saw our business increase significantly every other friday because they don't have that option to stay open stan so we're hoping that the leaders of these tech companies can actually take a step back and see that their brick vision is progressive but they need to adjust that vision now to keep up with how san francisco's operatingthis isn't an only in san francisco solution...mountain view recently tweaked their laws to keep facebook from opening up an inhouse cafeteria at it's campus opening this fall. i'll have more on that part of the story coming up at 6p. maureen kelly kron4 news.

( robin )for your health this morning... mosquitoes have tested positive for west nile virus in santa clara county. here are the zip codes where the mosquitoes have been confirmed to have the virus. they are 94085 ... 95051... and 95054. that includes parts of sunnyvale and santa clara. officials say, they will be doing mosquito control in those areas to prevent any human cases. the west nile virus treatments in those neighborhoods... will happen this thursday at 11 p-m. residents who are affected will be notified. ( robin )california's d-m-v has rolled out a new online option for customers to complete their driver license applications from home. as kron four's philippe djegal explains... it's an effort to decrease wait times. (philippe) by noon... on another hot day in the east bay... there was still a line outside the walnut creek office of the d-m-v...molly

morgan/customer- "it's not better -- it's worse." molly morgan dropped in to help her daughter krystal pick-up a driver license. they didn't set an appointment because the next one available was more than a month out. but they did use the new online system launched by the d-m-v last week... allowing customers to complete their driver license or identification card application before coming into the office.molly morgan/custom er- "and, i don't think its helping the situation. but we did it and here we are still waiting." the d-m-v calls the new electronic form a gamechanger... meant to shorten the amount of time customers stand in line here at the field offices.krystal paicos/customer- "hopefully, it's uh, quicker inside." customers are still required to eventually visit a d-m-v office to get their card. computers are also available in the office for customers to complete their applications, if they didn't do so from home.. all you need is an active phone number and e-mail address to verify your identity.mary locke/customer- "that didn't cross my mind that that might be available. so, i should have tried that."

( robin ) was one of the six founding members of the black panther party-- has died. his wife says howard died monday in santa rosa after a long illness. howard served as the party's first editor of its newspaper and deputy minister of information. he was responsible for the

social programs that made the black panther party famous. howard was born in chattanooga, tennessee but came out to california as part of the air force. he stayed in oakland after he was discharged. he was 80 years old. ( robin )it's been 49 years since the beatles walked together across abbey road for their famous album cover. paul mccartney strolled once again through the crosswalk of abbey road in london on monday. the 76-year-old legendary singer posted this video of it on his official instagram account. mccartney also held a secret show at abbey road studios. he played new music from his forthcoming "egypt station" album. ( james ) the former stanford swimmer convicted of sexual assault is looking to have that conviction overturned. brock turner's attorney was in court yesterday. he argued that turned never intended to rape anyone... because turner had his clothes on when he was found on top of an intoxicated woman. turner was sentenced to 6-months in jail back in march of 2016. that sentence led to outrage and the judge in the case was recalled. the court now has 90 days to respond to the appeal. ( james ) the former stanford swimmer convicted of sexual assault is looking to have that conviction overturned. brock turner's attorney was in court yesterday. he argued that turner never intended to rape anyone... because turner had his clothes on when he was found on top of an intoxicated woman. turner was sentenced to 6-months in jail back in march of 2016. that sentence led to outrage and the judge in the case was recalled. the court now has 90 days to respond to the appeal. ( james ) california's d-m-v has rolled out a new online option for customers to complete their driver's license applications from home. the applications are for the new real i-d which will be required starting in the year 2020. the online application is part of an effort to shorten wait times at d-m-v offices. customers can fill the application out from home then complete the application at a d-m-v location. customers are still required to eventually visit a d-m-v office to get their card. earlier this month... the d-m-v announced it will expand the number of field offices offering saturday hours to 60 locations starting august 4th.
