( robin )happening today, both men charged in the deadly ghost ship warehouse fire will be back in court this morning. kron 4's justine waldman explains... that a trial date is to be set soon ... on the 36 - counts of involuntary manslaughter.. facing derek almena and max harris. sot maybe an acquittal is in the future for derrick alemena the lawyers representing ghost ship wearhouse master tenant .. derrick alemena... do not think he caused the deadly fire that killed 36 people in 2016. and are now gearing up to prove it during a lenghty criminal trial.sot i think the evidence against him is not consistent for what is required for a guilty verdict for i think he

has an excellent chance of winning on these charges last week, the two men charged were expected to plead no contest. with almena taking a sentence of 9 years in jail. and max marris, the creative director, getting 6 years. but the plea deal collapsed when the judge stated that almena did not express remorse for what happened at the oakland warehouse. now the almeda county district attorney nancy omalley made it clear ... she will no longer entertain any more plea deals. with negotions hitting a dead-end... defense attorney brian getz, tells me... at a hearing on friday, he will ask for the case to be heard outside of alameda county.sot in this case where there has been so much negative publicity about our client i think a change of venue might be appropriate and is his client, almena prepared to go to trial?sot he thinks he will be exonerated. ( robin )in vacaville... c-h-p officers will hold a procession this morning at 7... to honor the late officer, kirk greiss. greiss made a traffic stop on west bound i-80 in fairfield when a chevy pick-up truck crashed into greiss and the driver he had stopped. both of them were taken to a nearby hospital where they later died. funeral service for griess begins at 11 a.m. at the father's house church on horse creek drive in vacaville. traffic is expected to be impacted after service as well. the end of watch procession included dozens of officers riding the same kind of motorcycle officer greiss rode to serve his community for 19 years.chp procession for greiss 7 a.m. vacaville traffic will be impacted and residents are expected to line route for the california patrol memorial

procession for officer kirk griess. griess is 11 a.m. house church, 4800 drive, traffic will be impacted after service as contact: lt. donaldson ( robin )( robin )also happening today... the family of nia wilson will hold a news conference.. announcing their lawsuit against bart. the 18-year-old was stabbed to death at the macarthur bart station back on july 22nd. her sister was also injured in the attack... which bart police say appears to be random. john cowell has been charged with murder and attempted murder. the wilson family attorney says bart failed to keep the sisters safe. the conference starts this moringing at 11. ( robin )in the north bay... police have arrested this woman ... 43 -year old iyesia james of woodland, in connection with the murder of a fairfield woman last week. police say, she knew the victim, 51 year old letha bell portis. they say, the two women had a fight immediately before portis was killed on august 6th. according to police, james may currently be a transient in fairfield. a shooting between two neighbors. it happened near seacliff state beach in aptos. kron four's rob fladeboe has the story. rob fladeboe/aptos "...im here on santa cruz avenue near seacliff state beach in aptos. crime scene investigators were still on the scene here latethursday afternoon gathering evidence.the drama began around 5 pm on wednesday when deputies were called here to investigate a reports of gunfire. they determined that a woman had been shot by a neighbor as a result of some kind of dispute. deputies sealed off the neighborhood and thus began a standoff that would continue through the night into this morning. eventually deputies were able to talk the man, identified as 57 year old ralph millar, into surrendering. here is more now from santa cruz county sheriff jim hart.jim hart/santa cruz county sheriff "... he came out with his "... he came out with his hands up,

vehicle early wednesday morning.it happened near chapman and terrace avenue in san bruno... just off el camino real.police say they're looking for a dark colored s-u-v -- possibly a jeep grand cherokee or patriot.no injuries were reported.if you have any information on the incident, contact san bruno p-d. ( robin )kidnapping and sexual assault. those are some of the charges a 30- year old rideshare driver now faces. kron-4's charles clifford explains.... the male suspect allegedly picked up the victim from san francscio... and drove to union city. well, the suspect in this case was aparently employed by uber but when the alleged assault occured july he wasn't actually on duty.according to the union city police department, this man 30 year old san francisco resident kevin barillos-saballos picked up an intoxicated female in san francisco and drove her to union city. during the trip, barillos-saballos is alleged to have sexually assaulted his passenger. lieutenant steve mendez is with the union city

police department.soti believe that either her or someone in her party called uber. he came along and picked her up. we don't if she was the person who was supposed to pick her up. he wasn't working so he shouldn't have been picking up fares.following several weeks of investigation, the union city police department was able to identify the suspect, an arrest warrant was issued and he was taken into custody on august 14th without incident at his job in south san francisco. barillos-saballos has been charged with false imprisonment, kidnapping, sexual assault, sexual battery and criminal threats. investigators are now reaching out to the public to see if there may be any additional victims.sottake a good look at the photograh to see if this subject did not perpatrate any other crimes on any other victims. if they did contact us so we can start an investigation here in union city or pass it along to the correct jurisdiction.the suspec in this case is currently being held at the

robber's bold move to get cash fast. and police say this isn't the only crime he's suspected in. i'm april kennedy and i'm an arborist with pg&e in the sierras. since the onset of the drought, more than 129 million trees have died in california. pg&e prunes and removes over a million trees every year to ensure that hazardous trees can't impact power lines. and since the onset of the drought we've doubled our efforts. i grew up in the forests out in this area and honestly it's heartbreaking to see all these trees dying.

( robin ) in the south bay... a teacher arrested and accused of communicating with a student for sex. christopher florio was a music teacher at the harker upper school in san jose. he is also currently a conductor for the california youth symphony in palo alto. back in june... police received a tip that florio may have had inappropriate sexual conversations with a minor at a school related event. he is also accused of using social meda to solicit sexually explicit images. 9 robin 0 a man is behind bars this morning... accused of murder. san jose police arrested joseph apodaca. they say apodaca and rene anthony morales got into a fight. morales' body was later found in an alley... on the 700 block of south second street. police say the two

( robin ) oakland wants to give you a place to dump your heavy trash. public works is announcing a bulky block party. there will be a series of three events to give you a place to bring large items you want to dispose of for free. it will also give people a chance to learn about a service that allows residents to get items picked up on their own curbside. oakland's bulky pickup service, is free... and can be arranged by appointment. this comes as a community group in oakland says the city needs to do more to stop the illegal dumping. ( robin )for your money this morning... there's a new scam targeting the state of california. a caller claimed to have kidnapped a woman's mother.. demanding 14- hundred-dollars. reporter anthony pura has the details. nat soundfrom the beginning it sounded like a ransom call. lauren kennedy/victim: "it was a man's voice telling me that he had abducted my mother and that he was going to kill her

if i didn't do exactly as he told me. i quickly told him, 'i'll do whatever you want me to do.'"lauren kennedy says the supposed kidnappers called from her mother's phone number. lauren kennedy/victim: "it was everybody's worst nightmare."a nightmare that became all too real when she heard her mother's voice on the other line.lauren kennedy:"i heard her in the background and i thought for sure that they had taken her."the man commanded lauren to put money into reloadable debit cards, demanded the card numbers over the phone, and ordered lauren to destroy the cards afterwards.lauren kennedy/victim: "he, at that time, hung up and never called me back. so, within a minute or so, i called my mom's phone again, and, at that time, she answered."that's when lauren realized she had fallen victim to an elaborate phone scam.the sheriff's office said the scammers used a spoofing

device to make it look like the phone call was made from lauren's mother's phone and to really sell it ...the scammers called lauren's mother in the middle of the fake ransom call.they got her mother worked up by saying they had lauren.lauren kennedy/victim: "they just wanted her to be scared and to sound scared, i'm sure. but, all i heard was her saying my name, and, yeah, i still can't believe it."can't believe it because lauren is as careful as anyone when it comes to scams.lauren kennedy/victim: "i don't answer phone calls that i don't recognize. i don't answer blocked numbers. i just feel like the public needs to know about this. if i can fall for this, anybody could fall for this." ( robin )authorities say people should hang up when they receive scam calls.they also advise caution when posting personal information online. ( robin )for your health... in its fight against the opioid crisis, the trump administration is proposing cuts to the amount of opioids drug companies can produce. the justice department and d-e-a are proposing an average decrease in the manufacturing of opioids next year.

( darya ) happening today... the two men charged in the deadly ghost ship warehouse fire will be in court. derick almena and max harris are charged with 36 counts of involuntary manslaughter. that's one count for each victim who died in the 2016 fire in oakland. a plea deal will no longer be considered for almena and harris. a judge rejected a deal between the defense and prosecutors... claiming almena showed áno remorse. today... defense attorneys will ask for the case to be heard áoutside of alameda county. ( james ) san francisco police are investigating a stabbing on a muni bus. the stabbing happened near market street and van ness avenue. a 37-year-old man was sitting on the bus when another man tried to take his bag. the attacker then pulled out a knife and stabed the victim in his stomach.. the victim is in the hospital. officers were unable to locate the attacker. ( james ) a former uber driver has been arrested and charged with assaulting a woman he picked up in san francisco. 30-year-old kevin barillos-saballos was employed by uber but when the assault occurred in july he was not on duty.. so he shouldn't have been picking up fares. according to police... barillos-saballos picked up an intoxicated female in san francisco and drive her to union city. during the trip barillos- saballos is accused of sexually assaulting his passenger. investigators are now reaching out to the public to see if there may be additional victims. barillos-

( james ) four stockton teens have been arrested for a man's death...the youngest was just 13. juan dominguez had just gotten off work when police say he was robbed and gunned down by four teens. the teens... whose ages range form 13 to 19 didn't get far.. they were caught in sacramento county in dominguez' car wednesday night. the only suspect that has been named is 19-year-old raymond williams. he is expected in court on
