(grant) nia wilson's family is still broken...still grieving...and they're sharing their pain publiclly. nia wilson was stabbed to death on bart last month... and now-- her family is taking legal action. hello i'm grant lodes. (catherine) and i'm catherine heenan in for vicki liviakis... nia wilson's family says bart has failed to ensure their riders are safe. kron 4's terisa estacio is live in the newsroom - with the changes the family is now demanding. wilson's family is distraught... arguing nia's death should never have happened and now they are fighting back with this lawsuit... saying they are taking this action on behalf of every passenger who rides bart... robert arns, attorney. "bart says on it's website that it cares about safety of passegers, but that is not true, the family wants this to be a turning point." swinging friday... announcinga sweeping lawsuit against bart in the murder of the 18 year old. wilson was killed at the macarthur bart station on july 22. she had been on the platform with her two other sisters, when police say, transient john lee cowell approached the three and fatally stabbed nia in the neck. police say he also injured nia's sister, who survived the attack. arns. "the violent crime against nia could have been prevented if bart would have stopped fare evaders." attorneys representying nia's family point to fare evasion as a major contributor in nia's death.... cowell, had been cited before as a fare evader on bart. they believe if bart had a better system in place to crack down on fare evaders, then nia would still be alive. they also dropped this bombshell, that cowell had threated others on bart. arns. since being involved, we have been approached by a 72 year old woman who said that cowell threatened her. besides seeking monetary compensation - the attorney's say the family is also hoping with this suit will increase safety on bart for all passengers. arns. we want better safety for everyone. hundreds gathered to remember officer kirk griss... including fellow c-h-p officers from all over the state. griss was a 19-year veteran who was killed by a passing driver who's been accused of being distracted... that suspect - sean walker of rocklin - has been arrestedand faces two counts of vehicular manslaughter. officer griss is being remembered as a "cop's cop"... and a wonderful father and husband. officer griss and jaime manuel of vallejo were both killed august 10th. griss had pulled manuel's s-u-v over on westbound 80 in fairfield. (grant) . a bay area music teacher is arrested and accused of asking a child for sexually explicit pictures. kron 4's will tran is working this story from palo alto. christopher florio is a conductor at california youth symphony but it wasn't palo alto police who arrested him but san jose police investigators accuse him of inappropriate sexual conversations with a minor while working as a music teacher at harker upper school in san josethey actually started investigating florio back in june but finally decided they had enough evidence to arrest him yesterday we haven't heard from harker upper school but typically in cases like these a district places a teacher on paid administrative leave while they conduct their investigation to protect the kidsno word also on what california youth symphony will do with florio now that he has been arrested

(catherine) a warning for parents whose children use epi-pens--there's still a widespread shortage across the country... there's now concern that it will lead to childrengoing back to school unprotected. the epi-pen shortage has been a problem for months...partly because of manufacturing problems. sales typically spike- during the back-to-school season.it's not clear how many children could be affected -- and the shortage can vary among pharmacies. nearly six-million children in the u-s have food allergies. (catherine) one positive note this week - the f-d-a has approveda new generic version of the emergency allergy medication.

it means more competition for a drug that's faced a lot of public anger over its price tag. the new generic version of the epi-pen will be sold by teva pharmaceuticals. they'll compete with 'mylan' - which has dominated the one-billion dollar market for two decades. the teva version is expected to be cheaper - althoughit's not quite ready for market yet. (grant) now to another big story we've been following tonight -- a california judge granted a temporary restraining order on the deportation of reunited families. the move stops the removal of both parent and child -- so parents can help their children with asylum hearings. the government says the childrens' rights to asylum hearings were waived when the parents signed paperwork for their children to be deported with them. however the plaintiffs say the documents were not "knowingly or volunarily" signed. (grant) tonight we're learning a number of computer outages is another reason for recent delays at the d-m-v.

and while we in long lines for service... we're hearing more about a secret d-m-v that only serves lawmakers and their staff. our capitol bureau reporter ashley zavala looked into when drivers might finally see some relief. long wait times linger at dmvs across the state.while the dmv says the new "real id" is the main problem - it admits system outages have contributed. (jessica gonzales) "i don't think they're a huge factor in our wait times. we have said our technology needs improvement." (ashley stand up) "since january of 2017, the dmv says its experienced 29 outages. those outages lasting 20 minutes up to nine hours." (assemblyman james patterson) "another example of the department of motor vehicles basically failing at every level, with management, with the systems put in place, with 40 year old technology that is now failing on a regular basis, we didn't know any of that."assemblyman james patterson was behind a failed push to try and investigate dmv wait times.his fellow lawmakers blocked his request

mother is demanding answers after she says a high scho cafeteria refused to give her daughter lunch on the first day of school. the woman says the controversy is over 15 cents. erik sandoval reports. kimberly aiken:"to think that this can happen to anybody's child kind of ... kind of infuriates me."kimberly aiken says this happened on her daughter's first day of school at university high school in orange city.kimberly aiken: "she puts her food on the tray, gets to the front, gives her number to the cashier and she says, well, you owe 15 cents. and she said she didn't have any money. so the cashier took her food."and aiken says her daughter went the school day without eating.kimberly aiken:"that's the big thing is eat breakfast and eat lunch so they can make sure that they're doing good on their work. but then you starve my child."aiken says she signed up for the free and reduced cost lunch program and it's not kicked in yet, and the 15- cent deficit in her account must have been carried over from the last school year.news six contacted volusia county schools to ask them if refusing lunches over 15 cents would be standard practice. spokesman roger edgcomb says

"did you guys get into an argument before she left?" "it wasn't an argument. we had an emotional conversation - but i'll leave it at that, but it's - i just want them back. i just want them to come back.

watts family> "we feel -- we feel stupid."nicholas thayer and his wife amanda say they believed watts at first and invited him to stay at theyr home.but something seemed off. "it was just, kind of ... i thought ... too easily ways of knowing ... where she could have been. and he didn't seem all that eager to look into it."they called detectives tuesday night. within 24 hours, watts was in custody and police had located the bodies of his wife, four year old bella and three year old celeste.all were on the grounds of a petroleum company where watts had been employed. he's being held without bail. "do you understand that?" "yes sir" "he just didn't seem like the type of guy to injure a fly - let along his entire family." "i look at my little girl and i don't know how anybody could do that - there's no reason." (catherine) (catherine) chris watts reportedly made a confession after he was arrested. he's due back in court on tuesday to face formal charges.

(grant) in the north bay -- sonoma-marin area rail transit is celebrating its first year of train service between the sonoma county airport and san rafael. to mark the occasion, there will be free train service saturday and sunday. there's also an event in novato...known as smart fest. that goes from 10 a-m to 3 pm at the hamilton station. (catherine) on the peninsula... three men are under arrest... accused of a string of lotto ticket thefts. police say shawn ray... michael walker... and alexander castillo... burglarized businesses after they closed - and stole lots of lottery scratcher tickets. three of the burglaries happened in belmont. police say the men would then drive to gas stations and convenience stores in san francisco and san jose - and cash in any winning tickets. police are also looking for a 4th suspect... identified as 21-year-old jose sotomayor from san jose.

(grant) replica weapons caused a flurry of police activity at a los angeles international airport checkpoint today. authorities stopped a man in a truck... believing he had a firearm. police searched the truck after they say the man made suspicious statements. the bomb squad was even called in to assist as traffic was re-routed. what appeared to be what appeared to be multiple weapons could be seen on the street. it turns out the items were not real guns -- but replicas. officials later determined the man is a world war two enthusiast. he was not arrested. is supporiting a maryland sixth-grader who says she was reprimanded for kneeling during the pledge of allegiance. 11-year-old mariana taylor says she was protesting racism and sexism. and says she was inspired by former 49er colin kaepernick, who began kneeling during the national anthem before football games in 2016. mariana says her teacher objected...and she was embarrassed by a public confrontation. the a-c-l-u says the supreme court has established first amendment rights are protected even when a child enters a school. mariana taylor / student: "i was sitting for about two weeks, and then i decided to kneel as opposed to sit. when i was sitting, my teacher came up and asked me 'why are you sitting' and i told her it was really complicated. personally i don't agree with some of the ideals of the president, his wall is just absurd to me. there is just so much racism, sexism, so many people have anti-gay thoughts."(catherine) (catherine) mariana says she intends to continue kneeling.

school officials say they support student rights and are unaware of any students being punished for not participating in the pledge of allegiance. they sell online at amazon, walmart, and ebay -- and are priced between 15 and 60 dollars. there have been nearly 200 reports of the dryers or the power cords overheating, melting, exploding, or catching fire. 18 people have reportedly been burned. the company is telling people to stop using the hair dryers immediately. a big story tonight... an investigation is underway ... into a fake kidnapping scam in california. it was so convincing, that one woman paid a caller 14-hundred dollars.(catherine) that woman says someone called her and claimed to have kidnapped her mother...and seemed to have proof to back it up. anthony pura reports that the incident shows that scammers have some disturbing new tricks.

nat soundfrom the beginning it sounded like a ransom call. lauren kennedy/victim: "it was a man's voice telling me that he had abducted my mother and that he was going to kill her if i didn't do exactly as he told me. i quickly told him, 'i'll do whatever you want me to do.'"lauren kennedy says the supposed kidnappers called from her mother's phone number. lauren kennedy/victim: "it was everybody's worst nightmare."a nightmare that became all too real when she heard her mother's voice on the other line.lauren kennedy:"i heard her in the background and i thought for sure that they had taken her."the man commanded lauren to put money into reloadable debit cards, demanded the card numbers over the phone, and ordered lauren to destroy the cards afterwards.lauren kennedy/victim: "he, at that time, hung up and never called me back. so, within a minute or so, i called my mom's phone again, and, at that time, she answered."that's when lauren realized she had fallen victim to an elaborate phone scam.the sheriff's office said the scammers used a spoofing device to make it look like the phone call was made from lauren's mother's phone and to really sell it ...the scammers called lauren's mother in the middle of the fake ransom call.they got her mother worked up by saying they had lauren.lauren kennedy/victim: "they just wanted her to be scared and to sound scared, i'm sure. but, all i heard was her saying my name, and, yeah, i still can't believe it."can't believe it because lauren is as careful as anyone when it comes to scams.lauren kennedy/victim: "i don't answer phone calls that i don't recognize. i don't answer blocked numbers. public needs to know about this. if i can fall for this,

"the violent crime against nia could have been prevented if bart would have stopped fare evaders." attorneys representying nia's family point to fare major contributor in nia's death.... cowell, had been cited before as a fare evader on bart. they believe if bart had a better system in place to crack down on fare evaders, then nia would still be alive. they also dropped this bombshell, that cowell had threated others on bart. arns. since being involved, we have been approached by a 72 year old woman who said that cowell threatened her. besides seeking monetary compensation - the attorney's say the family is also hoping with this suit will increase safety on bart for all passengers. arns. we want better safety for everyone.
