it's a move that a legal expert says could complicate the case... and even make it harder on the victim's family. hello i'm vicki liviakis. (grant) and i'm grant lodes. today prosecutors added the charge that ácould make john cowell eligible for the death penalty. kron 4's terisa estacio is live tonight to explain what this means as the case moves forward. ... james lee cowell was in court today to enter a plea... but with the da announcing it may now seek the death penalty... the case was continued.... numbers of ways. zimring has written two books on the death penalty - he says currently there are 750 people on death row in california. and that calfiornai ahs the largest death row in the world. we have not executed someone on death row in 10 years - because of legal issues and appeals around the matter. he says - although, putting it out there that the da may now seek the ultimate und profound. it actually can be quite negative for the victims loved ones... 24-year-old cristhian vera faces a charge of first-degree murder. a five million dollar bond was set in his case... and a preliminary hearing will be held august 31st. the 20-year-old went missing on july 18th after going for a jog... and yesterday we learned her body had been found. officials say rivera is undocumented-- but his lawyer says he had the proper papers to work in the u-s. immigration officials say they have no records indicating that rivera has any immigration status. " we're planning for the worse and hoping for the best." just a raging wildfire...in a declaration submitted to a federal judge, the county's fire chief says his firefighters internet service provider verizon wireless throttled down their internet speed.sot capt bill murphy/santa clara county fire it means a slow down, it means the speed that was expected was reduce to 1/200th of the speed they would have expected to be receiving. the chief says "throttling was actively impeding county fire's ability to provide crisis response and essential emergency services." the chief submitted emails sent to verizon asking that the speed be restored, but verizon said "to get the data speeds restored (the fire department would need to move to a higher cost plan... ) first suggesting an increase from $37.99 to $39.99 and later a plan costing $99.99 verizon now says it "this was a customer support mistake..... we have a practice to remove data speed restrictions when contacted in emergency situations.... we should have lifted the speed restriction when our customer reached out to us." but santa

(vicki) an update now on a story we've been following for you regarding thoselong lines and hours-long wait times at the department of motor vehicles across california. as kron four's rob fladeboe reports now live from san jose, those linesare getting shorter. rob? (rob live) there was plenty of grumbling to be heard from customers the last time i was here at the drivers license processing center in san jose as some people waited in line for three hours or more. today, though, complaints were few and far between as dmv's top official was here to explain what's been happening. every one of califoria's 172

dmv offices is different but many of them, like this one on senter road in san jose, are reporting shorter lines and considrably less waiting. on hand to check on that progress was dmv director jean shiomoto.jean shiomoto/director -dept of motor vehicles '....we are working hard to reduce wait times by hiring additional staff to triage the lines and make sure the customers are prepared and have the right documents and make sure they don't stand in line unnecessarily..."shiomoto says what are called "efficiency teams" are moving between offices gathering data and making changes with regard to those transactions that take the most time. it turns out the demands placed on dmv's computer system was more than it could handle but shiomoto says they are working on that too.jean shiomoto/dmv

".....we implemented real i.d. and a new queing system and electronic drivers license applications all period and we don't normally do that..." shiomoto says those issues have now been stablized and says a new sacramento-based command center is monitoring wait times and making adjustments on the fly that is helping to reduce those wait times and keep them that way. fight over territory. the 12-hour killing spree was between monday nightand tuesday...in different parts of town. two of the bodies had been dismembered. another two were found in the trunk of a taxi. the murders did not happen near any beach-side resorts. but tourists are being discouraged from going into town. the u.s. state department issued a travel advisory earlier this month.. and just last april - 14 murders were reported in cancun in 36 hours. vicki and grant? (vicki) safe injection sites are one step closer to becoming a reality in san francisco. the state senate has just passed a bill allowing the sites. kron 4's lydia pantazes explains what that means for the city. ab 186 would allow san francisco to establish locations where drug users can inject drugs under the supervision of staff trained to treat and prevent drug overdose. san francisco would be the first city to be allowed to implement a safe inject site under a 3-year

pilot program.those trained staff members can also link people to drug treatment, housing, healthcare, and other services. last year, the bill was passed by the assembly, making it the first legislative body in the u.s. to pass such a bill, but was two votes shy in the senate.ab 186 now heads back to the assembly for a concurrence vote. if the assembly votes to concur, the bill will be sent to the governor's desk for his signature. reporting in san francisco, lydia pantazes kron4 news. reports. theadora fuerstenberg/victim "he said, 'okay, now you're gonna tell me the real story or we're all gonna die,' and none of us knew what he was talking about, obviously." theadora fuerstenberg, angela o'neil and katherine vallaire were on their way home from a friday night book club in arden earlier this summer.it was a little before 9-45 when fuerstenerg ordered a ride through uber.theadora fuerstenberg/victim"it was just like any other ride."she says the driver -- mark filanov -- didn't say much as they got into car.but once they got onto interstate 80 -- she says things got uncomfortable...and then scary. theadora fuerstenberg/victim "and he pointed his car at the cement divider on the freeway and said, 'which way?' and he knew, we all said left. he made us basically all scream left at him."as they passed exit after exit -- the women say they began fearing the worst.theadora fuerstenberg/victim"katie just said 'we're three women who want to go home.' and he said, 'no, that's not it, we're all gonna die now.'"it was then -- angela o'neil dialed 9-1-1 from the backseat. angela o'neil/victim"shortly after i got on the phone with 911 is when he took that exit that was way past our exit." sacramento county deputies say the driver is facing

tonight at 5:30... the decision to eliminate money bail in the state justice system is now in the hands of the governor.(grant) sacramento bureau reporter ashley zavala joins us live from the capitol to explain why some are worried about not just their businesses, but the justice system ashley? ((ashley))bail bond agents i talked to say they never imagined the bill would make it this far, but lawmakers say the change is needed.. ((pkg))(nat pop)greg "topo" padilla's business bonds 125 people out of jail in sacramento every month. (topo padilla- president of golden state bail agents association) "what people don't understand about our industry is we weave a web with the people that are in jail, we bring their family and friends into this thing. that way when somebody does miss court, they're there to help us get them back." he says eliminating money bail will destroy jobs for the 4,000 licensed bail agents across the state(padilla) "getting rid of a private industry that has been in

existence for hundreds of years that has worked, that has a 98% effective rate to make sure people appear in court, is absolute foolishness." (rob bonta) "what ruins livelihoods and jobs is currently the money bail system,"assembly member rob bonta is one of the bill's sponors. he says the bill will replace cash bonds with a "risk assessment" of those arrested. "when individuals sit in jail, no risk to the public, they will show up for the next court appreance, but they have to languish, they lose their jobs and that's wrong, that's devastating." supporters of the bill say the system disproportionately affects minorities and suspects who are poor. opponents say lawmakers should have put their criminal justice reform focus elsewhere... (padilla) "if that bias exists, then what that legislature should be working on immediately is revamping and reforming our law enforcement, if they're arbitrarily picking up people based on race or ecomonic status."(bonta) "people are going to be treated as people, not a pocket book or an atm, or just a number." (vicki) starting in the east bay... where public health officials have confirmed a case of the measles. they are warning that people in contra costa county may have been exposed ... because the person with the measles visited several public areas while contagious. the places include john

muir medical center in walnut creek ... and chow restaurant in lafayette. measles is a serious, highly contagious disease that is spread through the air ... however it can be prevented through a vaccine. (grant) two men who were accused of kiddnapping and sexually assulting a woman from san francisco pleaded not guilty this morning. sonoma county detectives say back in april the 24 year old victim called a ride sharing company to take her home from bruno's in the mission district... and got into the wrong car. police say the driver... fredi lopez-flores.. and a man inside the car alejandro quintero... then took the woman to sonoma. she says she was beaten, choked and sexually assaulted by both the passenger and the driver. the woman eventually escaped the vehicle and was able to ore employee. lopez- flores and quintero have a preliminary hearing october 12th. both men are being held in the sonoma county jail. (vicki) in the south bay... san jose based orchard supply hardware will close its stores for good by

the end of this year. it's very first store... and headquarters... are in san jose. that's where we find kron 4's sara stinson with the details. the closure of all 99 orchard supply hardware stores is hitting hardest right here in san jose where it was founded 87 years ago and it looks it's not going to make it to year 88 as the doors will close for good by the end of the fiscal year.customers here say they're sad to see a store they've been going to for decades is closing for good. orchard supply hardware was first founded in 19-31 by a group of farmers as a co-op.in 1996 it was sold to sears - but when they went bankrupt lowes acquired the hardware chain in 2013.the company says they're closing down osh stores to focus on the "lowes brand".over four thousand employees work for the orchard supply hardware stores in california, oregon and florida. longtime employees i spoke with said they're too emotional to talk on camera.

an early morning burglar caught in the act in this la verne convenience store.the surveillance video from inside the inland dairy store on the corner of white avenue in first street shows a masked man running from police, knocking over snacks before crawling in between two refrigerators full of cold drinks.officers from the la verne police department responded to the location just after 4:00 a.m. last friday when the alarm went off.they looked around the store and noticed a hole inside one of the walls, wood chips on the ground, that's when they realized the burglar tunneled his way inside.the officers were able to surround the store and take the man into custody.an employee who did not want to show his face on camera says he was called store by the alarm company. that's when she apparently sees her chance to make a break for it as a healthcare worker is leaving. martinez - arington then runs to catch the door before it closes. (grant) a camera in the hallway catches what happens next - the áunsuspecting woman walking towards a door that leads outside. and martinez-arington was hiding around the corner, waiting until the woman makes it outside. martinez-arington then makes a run for it, but the woman fights back, trying to push her back in. martinez-arington breaks free, bolting out of the door and into the south alleyway. she was caught the next day. officers had to deploy tear gas to get her to surrender.
