the gunman as cold and methodical.three people dead, that includes the shooter. 24=year old david katz reportedly took is own life after killing two fellow gamers at a tournament in jacksonville florida.(vicki)we learned today that katz had two handguns and a history of mental illness.ken wayne is in the newsroom with more details. ken? clayton had no time to react. at first he got shot he didn't know what was going on and then he go shot repeatedly. outside, sharon found taylor robertson of west virginia.i think i witnessed him breathing his last breath. described as a 50-to 60 year old 220 pound african american man about 5-9 or 5-10 inches tall... sotit's getting progressively worse, it's very dangerous, people are getting on the trains who are not monitored properly, knives are exposed, they are wearing them on their belts.this latest round of violence on bart is not only disturbing to riders, but also those who run the transit agency.sot debora allen/bart directorit's troubling and i take it personally that i am a board member for a system that needs to get a handle on this.bart director debora allen says making bart safer is all about who gets into the system sot when that is all set and done and we have a new security fare gate system we will see reduction in criminal activytu, homeless activeity and panhandle activelty on the system. allen would also like to see bart police officers at every fare gate at every station but at this time, bart remains 21 officers below what's already budgeted... forcing mandatory overtime

suspects rushed a store in walnut creek making out with thousands of dollars of merchandise. as kron four's terisa estacio reports, thanks to video of the getaway car - police say they're closing in on some suspects.. (take pkg) walnut creek police say they are working on a substantial lead... thanks to this... this video showing a black suv leaving the scene of the crime. it was saturday afternoon around 5pm... police say at least four suspects blasted into the apple store on broadway and swipped iphones and mac computers. authorities say, the store is still tallying up the total, but add the thieves took off with thousands of dollars in stolen goods. the black suv has a license plate - a lt. told kron four news they are working with oakland lice on the case. this crime - comes on the heels of several other recent thiefs at apple stores... take a look at these pictures... at the corte madera apple store - police say 5 men rushed into and within one minute took 19 thousand dollars worth of items. the store has 2 security guards, but central marin police are now stepping

(vicki) to the south bay now where santa clara county is being called on to save a county-owned building from the wrecking ball. as kron four's rob fladeboe reports now, advocates for the homeless believe the old city-hall annex could become housing for the homeless. when it comes to finding housing for the homeless, there is no such thing as a bad idea say advocates for the homeless. which is why they are pushing an idea that would have the old san jose city hall annex here at north first and mission, be converted to housing for the homeless. it's a no brainer says homeless advocate shawnn cartwright.shawn cartwright/homeless advocate santa clara county, which owns the property, provided a tour of the building on monday.

(vicki) advocates for two ballot measures that try to tackle the state's homelessness and housing issues kicked off their campaign today. capitol bureau reporter ashley zavala is live in sacramento tonight... and explains who could be affected by proposition one and two. ashley? ((ashley))several groups rallied here at capitol park, encouraging voters to vote yes on those propositions. supporters say the initiatives will help veterans, the mentally ill, and many others who just can not afford housing in california ((pkg))(nats)in front of the veterans memorial.. lawmakers, city leaders, veterans and some who were at one point, homeless, rallied together for props one and two. highest home prices, highest rent prices, highest levels of homelessness. this should not be the case in the fifth largest economy in the world." proposition one is a 4 billion dollar bond measure for housing related programs to help those in need of affordable housing like working families, those with disabilities, and veterans. proposition two would authortize the state to use part of the 'millionare tax' to provide homlessness prevention services and programs to those with serious mental illness. (nats)the topic of homelessness was an emotional one for u.s. army veteran robert st. clair. he was part of california's large homeless veterans population before getting help from a veterans resource center in sacramento.. (grant) a big story we're following. a federal judge in seattle blocked a texas-based company from posting blue-prints online... for making 3-d printed guns the federal government reached a settlement with gun rights organization 'defense distributed' that allowed the release of those prints in july. several states argued the settlement could put un-traceable guns in the hands of criminals. and the u-s district judge in seattle agreed today... extending his previous injunction against the blueprint release until the case is resolved. 5:30... reaction is pouring in across the country... after the death of senator john mccain. he died saturday at age 81-- a llittle more than a year after being doagnosed with an aggressive form of brain cancer. (vicki) today was the senate's first say back in session since his death-- though mccain had not been back to washington since december. the senate draped mccain's desk in black fabric and placed a vase of white roses on top. he served in the senate for more than three decades. senator mccain wrote a final farewell letter-- offering words of wisdom to his fellow americans. rick davis-- who is mccain's former presidential campaign manager and family spokesman -- read the message at the arizona state capitol today. to be connected to america's causes - liberty, equal justice, respect for the dignity of all people - brings happiness more sublime than life's fleeting pleasures. our identities and sense of worth are not circumscribed but enlarged by serving good causes bigger than ourselves. (grant) in the east bay.. health officals are warning about the west nile virus after more insects and birds have tested positive. kron 4's lydia pantazes is in concord with the latest. .. byron is the latest area of contra costa county to be added to the list of places where mosquitoes have tested positive for west nile virus this year.so far this year, 13 groups of mosquitoes, eight dead birds and 13 chickens from around contra costa county have tested positive. mosquitoes with west nile have also been found this year in oakley, martinez, holland tract, discovery bay and quimby island. dead birds testing positive for west nile have been found in brentwood, discovery bay, antioch and concord.since 2005, 63 contra costa county residents have been diagnosed with west nile.

(vicki) two teenage boys are under arrest after leading police on a chase that ended in a crash near a south bay high school. the car was reported stolen early yesterday morning in santa clara. the 15-year-old driver lead police on a chase that ended near wilson high school. the driver lost control and drove through a chain link fence and crashed into a tree. the driver suffered a broken leg. the 16-year-old passenger was not injured. both are facing charges of grand theft auto and evading police. (grant) in the north bay.... a man is under arrest after two people were stabbed outside a mexican restaurant. it happened at la-perla on santa rosa avenue in santa rosa yesterday. police say jose lopez-mendoza stabbed two security guards after he and his friends were kicked out for being

(vicki) a big story tonight... the once powerful hurricane lane is drifting away from hawaii... but the people who live on the islands now have to deal with the mess left behind. in hilo, hawaii... a huge chunk of land more than 60 feet long slid down more than 25 feet... crumbling a large retaining wall. and crews are working to clear landslides, trees, and debris from a 30-mile stretch of a highway. and while lane is moving away from hawaii-- people on the islands are still experiencing a lot of heavy rain. (grant) for your money tonight. your luggage may cost you more money than you expect when you fly jetblue. it's the first major airline to increase its baggage fees in recent years. the current charges for most major airlines... 25- dollars for the first bag and 35 for the second one. jetblue says it will now charge customers buying its cheapest "blue" fares...

a big story tonight... video of an arrest in vallejo has sparked controversy here in the bay area and across the country. beyonce/jay-z concert in atlanta. he's the guy you see in the white shirt. 26-year-old anthony maxwell is accused of making physical contact with jay-z during the encounter. the couple was wrapping up the concert when police say he ran on stage and bolted after them. dancers and security guards sprinted into action and stopped him from further contact. maxwell was treated for minor injuries at the scene. he was initially cited for disorderly contact and released. upon further investigation, he was arrested last night for simple battery. beyonce and jay-z are doing fine after the incident. community is mourning the deaths of two gamers who were gunned down during a tournament. meanwhile-- we are learning new details about the man who fired a weapon .. inside that jacksonville, florida venue. police say, this man... david katz opened fire during a football video game tournament sunday - killing two gamers and injuring nine other people ... before killing himself. (ken) the potential effects are far deadlier, costlier, and more destructive than previously thought. grant lodes joins us with more on the report. (grant) the report states that by 21-hundred.... the average annual maximum daily temperature will increase by anywhere from 5 and a half to almost nine degrees... depending on steps taken to reduce emissions. that means by 20-50 -- the water supply from our snowpack could decline by two thirds... resulting in water shortages for agriculture. cities

five air tankers and four helicopters are tackling 'the holy fire' again. ground crews will also be used when it is safe to do so. the holy fire had been the holy fire had been fully contained during the weekend... after burning nearly 36- square miles. an area resident is accused of igniting the fire back on august 6th. (pam) today marks one month since the 'ranch fire' burning in lake, colusa, glenn, and mendocino counties broke out. it is now 67- percent contained. the wildfire is the biggest in state history-- having burned more than 402-thousand acres as part of the mendocino complex fires. fire officials expect full containment by saturday. the ranch fire -- along with the nearby river fire have together destroyed 157 homes. one firefighter was killed.. and three others were injured. (ken) the catholic diocese of san jose raised some eyebrows by purchasing a 2 point 3 million dollar home for its retiring bishop.
