movement to have a child kicked out of an east bay school district for making violent threats. that student has already been placed in another middle school in the district. the student's new school held a meeting last night to discuss the issue. kron 4's ali reid has reaction from parents. parents say they're nervous for their children.so right now they're putting pressure on the school district to remove one of its students.pkg a crowded room of parents ... demanding the mount diablo school district expel one student from sequoia middle school and the district.i don't think any child that makes a threat like that should be in public school without doing a thorough mental health evaluation parents say the student in question .. is the same 13 year old that was arrested for threatening to shoot 30 students at valley view middle school back in june.this is

not something to be taken lightly. gun violence and the culture is so persistent and constant that the way the district handled it seems duplicitousalthough this student was cleared ... before being moved to sequoia ... parents say their children are afraid to go to school. and they themselvves also have reservations.every single day. sometimes i can't sleep at night. it's difficult to think about itthe moment kim childers found out her son had classes with the teen, she removed him from sequoia. she started a petition last week to get the child expelled. they now have over a thousand signatures. just like my son is able to be drawn from the district and attend a charter school online and get an alternate education, so can this childfind him some mental health. there are other programs he can be in but he shouldn't be in the mainstream not everyone agrees with the ideai have a child and if the elcted da and the elected school district sent him down

last night on the 100 block of west view. the fire burned some fences and a hillside but no structures were damaged. no body was ( robin ) in the south bay... a vietnam war memorial in san jose is vandalized. 142 veterans' names are inscribed on that memorial that was dedicated five years ago... all of those veterans were from san jose. over the weekend someone spray painted some illegible writing on the corner with white paint that has been washed off but is still etched in the granite. ( robin ) the san jose vietnam war memorial foundation is calling on a

shooting himself. there is still no motive for the shooting... however we are learning that katz was once treated for psychological and emotional issues.... and according to his parents' divorce papers in 2006-- katz was treated with medication for schizophrenia. a man who survived the shooting...says he is still in disbelief this morning. just cleared the state assembly. currently... california allows minors to use medical marijuana with parental permission... but prohibits the drug on school campuses. bay area state senator jerry hill says it's disruptive for parents to take kids off campus for the medicine. he says the legislation was inspired by a student in his south san francisco district. under the proposal...the marijuana would have to be in non smoking form. school districts must also opt-in to the law... it is not a state mandate. ( robin ) a big story we are tracking this morning... a move from the defense team in the deadly ghost ship warehouse fire case. attorney's for one of the defendants... derek almena filed a motion regarding the plea agreement that was thrown out. attorney tony serra says a fill-in judge did not follow the plea agreement during sentencing because there was a conflict of interest.

( robin ) a new development this morning... in a theft at an apple store in the east bay. at least four suspects rushed a store in walnut creek .. making away with thousands of dollars worth of merchandise. as kron four's terisa estacio explains... police are closing in on some suspects... and now apple is making some security changes. walnut creek police say they are working on a substantial lead... thanks to this... this video showing a black suv leaving the scene of the crime. it was saturday afternoon around 5pm... police say at least four suspects blasted into the apple store on broadway and swipped iphones and mac computers. authorities say, the store is still tallying up the total, but add the thieves took off with thousands of dollars in

morning... the man convicted of killing a san francisco woman 20 years ago... will stay in prison. lisa valdez -- pictured on the right with her mother -- was stabbed to death in her diamond heights apartment in 1998. police arrested anthony hughes for her murder after getting a d-n-a match... 13 years later. hughes was convicted of second-degree murder 2 years ago. his attorneys had argued that a delay in prosecuting hughes... violated his constitutional rights to a fair trial. the appeals court rejected that argument. bloodstains on 2 pillows led police to hughes. hughes was also matched to a fingerprint in the victim's bathroom. ( james ) in san jose.... advocates for the homeless are trying to save a county- owned building from the wrecking ball. the old san jose city-hall annex at first and mission is slated for demolition to make way for parking. but homeless advocates say it could be converted into 100-150 units for people now living on the streets. the county says such a plan is far too expensive. the board of supervisors has is expected to take action on the proposal next month. there is a new bill that just cleared the state assembly. right now... california allows minors to use medical marijuana with parental permission... but prohibits the drug on school campuses. bay area state senator jerry hill says it's disruptive for parents to take kids off campus for the medicine. he says the legislation was inspired by a student in his south san francisco district. under the proposal...the marijuana would have to be in non smoking form. school districts must also opt-in to the law... it is not a state mandate. ( darya ) in the east bay... members of law enforcement throughout the state came to the bay area to focus on getting a message out to the public... about using marijuana and getting behind the wheel. they held a marijuana traffic safety summit in dublin. officers say the importance of informing the public about the dangers of driving while under the influence of marijuana was the primary subject of the summit.

development this morning... in a theft at an apple store in the east bay. at least four people rushed a store in walnut creek .. making away with thousands of dollars worth of merchandise.( james ) as kron four's terisa estacio explains... police are closing in on the thieves... and now apple is making some security changes. walnut creek police say they are working on a substantial lead... thanks to this... this video showing a black suv leaving the scene of the crime. it was saturday afternoon around 5pm... police say at least four suspects blasted into the apple store on broadway and swipped iphones and mac computers. authorities say, the store is still tallying up the total, but add the thieves took off

( darya ) new this morning... the man convicted of killing a san francisco woman 20 years ago... will stay in prison. lisa valdez -- pictured on the right with her mother -- was stabbed to death in her diamond heights apartment in anthony hughes for her murder after getting a d-n-a match... 13 years later. bloodstains on 2 pillows led police to hughes. hughes was also matched to a fingerprint in the victim's bathroom. hughes was convicted of second-degree murder 2 years ago. his attorneys had argued that a delay in prosecuting hughes... violated his constitutional

attorneys for one of the defendants... derek almena... filed a motion regarding the plea agreement that was thrown out. attorney tony serra says a fill-in judge did not follow the plea agreement during sentencing because there was a conflict of interest. ( darya ) a 20-month-old child is recovering this morning after being hit by a car in menlo park. it happened near willow road last night. police say the toddler was riding a toy car when a relative was backing his car on the driveway and did not see the child. the child is in critical condition at lucile packard children's hospital stanford but is expected to survive. the driver is cooperating with investigators, who do not believe drugs or alcohol were factors in the case. the manhunt is on for a northern california man believed to be on the run with a 16-year-old girl. the man... identified as phillip maglaya... was a volunteer wrestling coach at franklin high school in stockton. the 16-year-old girl has been missing since last wednesday. investigators believe the two are involved in a romantic relationship. the 16 year relationship. the 16 year oldús father says he found a note from his daughter saying she loved him and that she was safe. he says he had no idea she was seeing the wrestling coach and that he just wants his home. ( james ) in san jose.... a homeless advocacy group is trying to save a county-owned building from the wrecking ball. the old san jose city-hall annex, at first and mission, is slated for demolition to make way for a parking lot. but homeless advocates say it could be converted into 100-150 units for people now living on the streets. the county says such a plan is far too
