movement to have a child kicked out of an east bay school district for making violent threats. that student has already been placed in another middle school in the district. the student's new school held a meeting last night to discuss the issue. kron 4's ali reid has reaction from parents. parents say they're nervous for their children.so right now they're putting pressure on the school district to remove one of its students.pkg a crowded room of parents ... demanding the mount diablo school district expel one student from sequoia middle school and the district.i don't think any child that makes a threat like that should be in public school without doing a thorough mental health evaluation parents say the student in question .. is the same 13 year old that was arrested for threatening to shoot 30 students at valley view middle school back in june.this is

not something to be taken lightly. gun violence and the culture is so persistent and constant that the way the district handled it seems duplicitousalthough this student was cleared ... before being moved to sequoia ... parents say their children are afraid to go to school. and they themselvves also have reservations.every single day. sometimes i can't sleep at night. it's difficult to think about itthe moment kim childers found out her son had classes with the teen, she removed him from sequoia. she started a petition last week to get the child expelled. they now have over a thousand signatures. just like my son is able to be drawn from the district and attend a charter school online and get an alternate education, so can this childfind him some mental health. there are other programs he can be in but he shouldn't be in the mainstream not everyone agrees with the ideai have a child and if the elcted da and the elected school district sent him down

the street, who are we, the uninformed parents to judge him when we have none of the facts?standup this issue was not on tongiht's agenda. parents are pushing to get this item on the agenda for the next session in mid september.they're hoping to get answers.reporting live from concord ... ali reid ... kron 4 news. ( robin ) in the south bay a 15-year-old is recovering after being shot near a school in san jose... it happened on the 900 block of walnut woods drive... that is just two blocks from robert f kennedy elementary school. the teen is expected to be okay but the shooter is still on the loose. ( robin ) new this morning... firefighters spent the overnight hours mopping up a small grass fire. this is video from the scene tweeted out by firefighters. the fire broke out at 9:15

last night on the 100 block of west view. the fire burned some fences and a hillside but no structures were damaged. no body was ( robin ) in the south bay... a vietnam war memorial in san jose is vandalized. 142 veterans' names are inscribed on that memorial that was dedicated five years ago... all of those veterans were from san jose. over the weekend someone spray painted some illegible writing on the corner with white paint that has been washed off but is still etched in the granite. ( robin ) the san jose vietnam war memorial foundation is calling on a

granite expert to try and get the paint out and restore the memorial to its original state. ( robin ) a search is underway this morning for the man police believe stabbed another man on a bart train. we first brought you this story yesterday on the kron 4 morning news. and as kron 4's dan kerman explains.. the latest incident comes as bart tries to make trains and stations safer. bart police are on the hunt for this man. on the hunt bart police are bart police are on the hunt for this man. police say he's wanted for stabbing a man in the thumb aboard a train near the macarthur station saturday evening. the suspect is described as a 50-to 60 year old 220 pound african american man about 5-9 or 5-10 inches tall... sotit's getting progressively worse, it's very dangerous, people are getting on the trains who are not monitored properly, knives are exposed, they are wearing them on their belts.this latest round of violence on bart is not only disturbing to riders, but also those who run the transit agency.sot debora allen/bart directorit's troubling and i take it personally that i am a board member for a system that needs to get a handle on this.bart director debora allen says making bart safer is all about who gets into the system sot when that is all set and done and we have a new security fare gate system we will see reduction in criminal activytu, homeless activeity

( robin ) happening now... the manhunt is on for a norther california man believed to be on the run with a 16-year-old girl. the man... identified as phillip maglaya-- was a volunteer wrestling coach at franklin high school in stockton. the 16-year-old girl has been missing since last wednesday. investigators believe the two are involved in a romantic relationship. the 16 year oldús father says he found a note from his daughter saying she loved him and that she was safe. he says he had no idea she was seeing the wrestling coach and that he just wants his daughter home. ( robin ) a search and rescue team from menlo park is

still working in remote areas of hawaii's big island. these are pictures from the search and rescue team. fire officials say that the group has searched more than 50 square miles in the last two days. the task force was deployed to hawaii to help in the aftermath of hurricane lane... which later weakened to a tropical storm. (robin) plus... the attorney for one of the ghost ship suspects is now saying the judge has a conflict of interest and should not have rejected a plea deal. story... this morning we are learning that the three remaining madden classic gaming events ... have been canceled. this after the deadly shooting at a gaming tournament in jacksonville, florida. gunman david katz shot and killed two people and injured 10 others... before

shooting himself. there is still no motive for the shooting... however we are learning that katz was once treated for psychological and emotional issues.... and according to his parents' divorce papers in 2006-- katz was treated with medication for schizophrenia. a man who survived the shooting...says he is still in disbelief this morning. ( robin ) the two players who died... have been identified as 27-year old taylor robertson from west virginia who had won the national tournament two years ago.... and 22-year old eli clayton a former high school football player from woodland hills in southern california. the 10 other victims who were shot...are all expected to survive. ( robin ) in the east bay... members of law enforcement throughout the state came to the bay area to focus on getting a message out

to the public... about using marijuana and getting behind the wheel. they held a marijuana traffic safety summit in dublin. officers say the importance of informing the public about the dangers of driving while under the influence of marijuana was the primary subject of the summit. ( robin ) while the summit mainly focused on taking marijuana and driving...autho rities also discussed driving while other the influence of other drugs like painkillers and sleeping pills...all of which officers say...are also on the rise. ( robin ) some california parents may soon be allowed to give their children medical marijuana on school campuses. there is a nebill that

just cleared the state assembly. currently... california allows minors to use medical marijuana with parental permission... but prohibits the drug on school campuses. bay area state senator jerry hill says it's disruptive for parents to take kids off campus for the medicine. he says the legislation was inspired by a student in his south san francisco district. under the proposal...the marijuana would have to be in non smoking form. school districts must also opt-in to the law... it is not a state mandate. ( robin ) a big story we are tracking this morning... a move from the defense team in the deadly ghost ship warehouse fire case. attorney's for one of the defendants... derek almena filed a motion regarding the plea agreement that was thrown out. attorney tony serra says a fill-in judge did not follow the plea agreement during sentencing because there was a conflict of interest.

( robin ) serra went on to say... judge cramer had verbally agreed three times to follow the plea deal prior to the hearing. serra says if he knew the judge would change his mind... he would have waited until the original judge overseeing the case had returned to court after dealing with a personal matter. both sides will return to court next month to schedule a trial date. that will be followed by a november 2nd hearing of a motion to change venues. ( robin ) students at armijo high school in fairfield returned to class monday... just days after shots were fired a block away near a friday night football

game. a 16-year-old was killed in that shooting. after the shooting... police funneled the crowd into the high school gym... and put them on lockdown... but the scary sitution was made worse when students realized one of the shooting suspects... had slipped into the gym... and tried to hide among them. and as students returned to class yesterday...many of them say they were thinking about school safety. ( robin ) fairfield police have increased their patrols around the school and the district also brought six counselors onto campus... to provide support for students and staff. ( robin ) in the south bay... the catholic diocese of san jose is being criticized for buying a retiring bishop... a multi- million dollar home. but now we are leaning that the bishop will ánot be moving into the house. the house was purchased in the willow glenn neighborhood for 2-point-3 million dollars. the church bought the house for 73-year-old retiring

bishop patrick mcgrath to live in by heimself. that caused some to question weather one person needed such a big house. but yesterday the bishop issued a statement saying that he failed to consider the housing crisis and the struggles of families in the area. he also said he would be selling the house. people who live in the area say that is probably the right decision.

condition at lucile packard children's hospital stanford but is expected to survive. the driver is cooperating with investigators, who do not believe drugs or alcohol were factors in the case. ( robin ) a new development this morning... in a theft at an apple store in the east bay. at least four suspects rushed a store in walnut creek .. making away with thousands of dollars worth of merchandise. as kron four's terisa estacio explains... police are closing in on some suspects... and now apple is making some security changes. walnut creek police say they are working on a substantial lead... thanks to this... this video showing a black suv leaving the scene of the crime. it was saturday afternoon around 5pm... police say at least four suspects blasted into the apple store on broadway and swipped iphones and mac computers. authorities say, the store is still tallying up the total, but add the thieves took off with thousands of dollars in

stolen goods. the black suv has a license plate - a lt. told kron four news they are working with oakland police on the case. this crime - comes on the heels of several other recent thiefs at apple stores... take a look at these pictures... at the corte madera apple store - police say 5 men rushed into and within one minute took 19 thousand dollars worth of items. the store has 2 security guards, but central marin police are now stepping up patrols at the store. at the walnut creek store... two private security guards kept watch over those coming and going... apple employees are not alllowed to talk on record... but several off camera told me that they feel frustrated that apple is not doing more to stop these thefts... check out this video.... in southern calfiornia, cusomters tackled several thieves trying to rip off the store. kron four reached out to apple - but a spokesperson says they do not

talk about the recent rash of crimes... referring me to local police. as walnut creek detectives work on their crime... residents say it is far time for apple to do more to protect everyone. michelle chambers, east bay resident. i definitely feel they should do more to take care of the product and the customers, it is dangerous for people to be in there. dwayne lem, east bay resident. their products are just out in teh open, they need to beef up security. in walnut creek, terisa estacio kron four news ( robin ) 4 your money... the average price of gas in the u-s has dropped two cents a gallon over the past two weeks. that still leaves prices standing at more than 50 cents a gallon higher than at this time last year, an industry analyst says it is likely prices will continue to drop slightly. that's because refiners have increased capacity while current demand is weak.

the highest prices in the country remain right here in the bay area. in san francisco it costs around 3-69 per gallon. this morning... the bay area is desperate for housing... but construction projects in san francisco are now stalled. kron4's maureen kelly talked to a real estate expert who explains what's causing the slowdown. i'd say there are 20-thousand units that are stalled because of this.it's hard to imagine that in such a hot real estate market that condo and

residential housing projects are being stalled....but industry insiders say that's what's happening to projects like the one that had been slated to replace this dilapated buulding on folsom street in the mission. it was permited to be 117 units....after a lengthy battle that ended with an deal that would have made nearly 30 percent of the units affordable.....but now the project has stalled and the property up for sale. real estate investor chris foley says building all over.....and especially san francisco is just too expensive to build for the financing to pencil out.bitehe says there is also a shortage of construction workers that's persisted after the real estate bubble burst in the last decade.(standup) but the stalling of so many projects in san francsico could provide an opportunity for developers focused on affordable housing.the non profit mission housing development corporation has made an offer to buy this folsom street propery....and plan to make it 100 percent affordable housing.. their

executive director says the reason they can afford it when for profit developers can't.... because they have access to funding....from the city of san francsico, as well as state and federal dollars. maureen kelly kron4 news (robin) coming up on the kron four morning news... a six year old recovering from surgery after standing up to bullies landed him in the hospital... changes are ahead for california's climate... that's according to a new report by u-c davis. among the findings: the sacramento valley will see max temperatures rise by 10

degrees... by the end of the century. that means extreme heat days of 104 degrees or higher... will climb from an average of 4 times a year... to á40 times by 2100. right now... the state is fighting back against the increased risk of wildfires through more ntrolled burns. ( robin ) santa clara county is being called on to save a county owned building from the wrecking ball. as kron four's rob fladeboe explains... advocates for the homeless believe the old city hall annex could become housing for the homeless. when it comes to finding housing for the homeless, there is no such thing as a bad idea say advocates for the homeless. which is why they are pushing an idea that would have the old san jose city hall annex here at north first

and mission, be converted to housing for the homeless. it's a no brainer says homeless advocate shawnn cartwright.shawn cartwright/homeless advocate santa clara ess advocate santa clara county, which owns the property, provided a tour of the building on monday. mothballed years ago, the aging structure is in bad shape and slated for demolition. local contractor james salata claims to have financing available to convert the building into at least 100 units for the homeless. but he is under estimating what that would cost says county c.o.o. miguel marquez.miguel marquez/santa cara county marquez/santa cara county the county had planned on

convertig the site into a parking lot as part of a long- term master plan to developthe entire area. the board of supervisors will re-visit the housing idea on september 11th. in san jose rob fladeboe kron4news ( robin ) a six-year-old boy in washington state was assaulted after he says he stood up to a group of kids bullying his friend. he was left with serious injuries -- and had to have surgery to repair a cut to his eye. gabe cohen spoke to his mother about his long road to recovery. six-year-old carter and his mother dana emerge from harborview after a morning surgery to sew his eye back together.nats groanhe's upset and exhausted... as is his mom. dana english: "it's been hell, i haven't slept i haven't ate, i can't do anything. it's like, i can't even leave his side."carter says he was attacked by a group of kids in his olympia apartment complex

wednesday... when he confronted them for bullying his friend.carter: "they were just bullying him, like beating him up."/butted/"i told them to stop. and then they did it to me."reporter: "what did they do to you?" carter: "bullied me."they beat carter with rocks and sticks... and rubbed sawdust in his eyes.he ended up with a broken arm... and cuts and bruises across his face and head.dana english: "they pulled rocks and pieces of debris out of his eye today." olympia police are now investigating.they found the 5-year-old who they say started all of this... and they're planning to get social services involved.dana english: "it's heartbreaking and disgusting and it makes me wonder what they're going through in their everyday life."carter may need surgery on his arm... and definitely needs some rest.dana english: "are you scared this is gonna happen again?" investigating remains found inside a home on the 2oo block of clara street. police will only confirm that remians were found in the home but there are reports that a headless corpse was found in a fish tank. the remians may be that of a missing man who friends reported missing in july.

( james ) happening today... daniel gross -- the modesto man who killed an east bay woman -- tn left her on the side of the road will appear in court. lizette cuesta was killed back in feburary. before she died she led investigators to gross and melissa leonardo. gross pleaded guilty to charges of beating.. stabbing and killing cuesta. leonardo pleaded ánot guilty. today's hearing will set the location of future court dates. morning... the man convicted of killing a san francisco woman 20 years ago... will stay in prison. lisa valdez -- pictured on the right with her mother -- was stabbed to death in her diamond heights apartment in 1998. police arrested anthony hughes for her murder after getting a d-n-a match... 13 years later. hughes was convicted of second-degree murder 2 years ago. his attorneys had argued that a delay in prosecuting hughes... violated his constitutional rights to a fair trial. the appeals court rejected that argument. bloodstains on 2 pillows led police to hughes. hughes was also matched to a fingerprint in the victim's bathroom. ( james ) new this morning... san francisco may be allowed to pilot a program to let people inject heroin and other drugs under medical supervision. the goal is curb in an effort to curb overdose deaths. the state assembly passed the safe injection sites bill yesterday. it now goes to governor brown. the sites would provide sterile needles and people would be able to use

illegal drugs there without fear of arrest. ( darya ) the bay area is desperate for housing... construction projects in san francisco are now stalled.( james ) kron4's maureen kelly talked to a real estate expert who explains what's causing the slowdown. i'd say there are 20-thousand units that are stalled because of this.it's hard to imagine that in such a hot real estate market that condo and residential housing projects are being stalled....but industry insiders say that's what's happening to projects like the one that had been slated to replace this dilapated buulding on folsom street in the mission. it was permited to be 117 units....after a lengthy battle that ended with an deal that would have made nearly 30 percent of the units affordable.....but now the project has stalled and the property up for sale. real estate investor chris foley says building all over.....and

especially san francisco is just too expensive to build for the financing to pencil out.bitehe says there is also a shortage of construction workers that's persisted after the real estate bubble burst in the last decade.(standup) but the stalling of so many projects in san francsico could provide an opportunity for developers focused on affordable housing.e non profit mission housing development corporation has made an offer to buy this folsom street propery....and plan to make it 100 percent affordable housing.. their executive director says the reason they can afford it when for profit developers can't.... because they have access to funding....from the city of san francsico, as well as state and federal dollars. maureen kelly kron4 news ( darya ) students at armijo high

school in fairfield returned to class monday... just days after shots were fired a block away near a friday night football game. a 16-year- old was killed in that shooting. after the shooting... police funneled the crowd into the high school gym... and put them on lockdown... but the scary sitution was made worse when students realized one of the shooting suspects... had slipped into the gym... and tried to hide among them. and as students returned to class yesterday...many of them say they were thinking about school safety. ( darya ) fairfield police have increased their patrols around

the school and the district also brought six counselors onto campus... to provide support for students and staff. ( james ) another big story... this morning we are learning that the three remaining madden classic gaming events ... have been canceled. this after the deadly shooting at a gaming tournament in jacksonville, florida. gunman david katz shot and killed two people and injured 10 others... before shooting himself. there is still no motive for the shooting... however we are learning that katz was once treated for psychological and emotional issues.... and according to his parents' divorce papers in 2006-- katz was treated with medication for schizophrenia. a man who survived the shooting...says he is still in disbelief this morning. ( james ) the two players who died... have been identified as 27-year old taylor robertson from west virginia who had won the national tournament two years

ago... and 22-year old eli clayton a former high school football player from woodland hills in southern california. the 10 other victims who were shot are all expected to survive. ( james ) a federal judge is blocking a texas-based company from posting blueprints online for 3-d printed guns. the state department reached a settlement back in july... with the gun rights organization "defense distributed." that deal would have allowed the release of those blueprints . but several states argued that deal could put untraceable guns in the hands of criminals. a district judge agreed ... and extended his previous injunction against the release of the blueprints. ( darya ) happening now... the manhunt is on for a northern california man believed to be on the run with a 16-year-old girl. the man... identified as phillip maglaya... was a volunteer wrestling coach at franklin high school in stockton. the 16-year-old girl has been missing since last wednesday. investigators believe the two are involved in a romantic relationship. the 16 year oldús father says he found a note from his daughter saying she loved him and that she was safe. he says he had no idea she was seeing the wrestling coach and that he

just wants his daughter home. ( james ) in san jose.... advocates for the homeless are trying to save a county- owned building from the wrecking ball. the old san jose city-hall annex at first and mission is slated for demolition to make way for parking. but homeless advocates say it could be converted into 100-150 units for people now living on the streets. the county says such a plan is far too expensive. the board of supervisors has is expected to take action on the proposal next month. ( james ) new this morning... firefighters spent the overnight hours mopping up a small grass fire. this is video from the scene tweeted out by firefighters. the fire broke out at 9:15 last night on the 100 block of west view. the fire burned some fences and a hillside but no structures were damaged. no body was injured. ( james ) some california parents may soon be allowed to give their children medical marijuana on school campuses.

there is a new bill that just cleared the state assembly. right now... california allows minors to use medical marijuana with parental permission... but prohibits the drug on school campuses. bay area state senator jerry hill says it's disruptive for parents to take kids off campus for the medicine. he says the legislation was inspired by a student in his south san francisco district. under the proposal...the marijuana would have to be in non smoking form. school districts must also opt-in to the law... it is not a state mandate. ( darya ) in the east bay... members of law enforcement throughout the state came to the bay area to focus on getting a message out to the public... about using marijuana and getting behind the wheel. they held a marijuana traffic safety summit in dublin. officers say the importance of informing the public about the dangers of driving while under the influence of marijuana was the primary subject of the summit.

they are in their safe zone in their house but once you're in a car, you are in a deadly machine and you can hurt somebody, kill somebody, it is very similar to alcohol. you are under the influence of a drug that is affecting your judgement">( darya ) while the summit mainly focused on taking marijuana and driving... authorities also discussed driving while under the influence of other drugs like painkillers and sleeping pills... all of which officers say...are also on the rise. ( darya ) the driver of a wine country tour bus is arrested on suspicion of driving drunk. the incident happened in healdsburg. passengers on the bus convinced the driver to pull over while they called police. passengers had found 60-year-old eugene cremens passed out after they completed a wine tour and they said it took a while to wake him up. when he started driving he could not conrol the bus... cremens blood alcohol was three times higher than the legal limit. the average price of gas in the u-s has dropped two cents a gallon over the past two weeks. that still leaves prices standing at more than 50 cents a gallon higher than at this time last year, an industry analyst says it is likely prices will continue to drop slightly. that's because refiners have increased capacity while current demand is weak. the highest prices in the country remain right here in the bay area. in san francisco it costs around 3-69 per gallon. ( darya ) in the south bay... the catholic diocese of san jose is being criticized for buying a retiring bishop... a multi- million dollar home.( james ) but as kron 4's charles clifford explains... that bishop will ánot be moving into the house. well, earlier this year the catholic diocese of san jose purchased this home in the willion glenn neighborhood of san jose for 2.3 million dollars. the house has just

under 3300 square feet of space and 5 bedrooms. the church bought the house for 73- year-old retiring bishop patrick mcgrath to live in. presumably by himself. the purchase has raised question about the wisdom of the church buying such a large home for just one person. sotthey are really setting someone up with a lot of money and does he really need that?but on monday afternoon, the bishop released a statement saying that he will not being moving into the house after all. he explains, "i failed to consider adequately the housing crisis in this valley and the struggles of so many families and communities in light of that crisis."the bishop says that the church will now sell the property and donate any proceeds to charity. the bishop continues saying " i assume full responsiblity for this decision and i believe that the sale of the house is the appropriate actions. i thank those who have advised me."neighbors in willion glenn seemed to think that selling the house was probably the right desicion.sot it seems like it is. maye they succomed to some pressure and the math didn't look good and hopefully it wil lgo to a better causefinally,

development this morning... in a theft at an apple store in the east bay. at least four people rushed a store in walnut creek .. making away with thousands of dollars worth of merchandise.( james ) as kron four's terisa estacio explains... police are closing in on the thieves... and now apple is making some security changes. walnut creek police say they are working on a substantial lead... thanks to this... this video showing a black suv leaving the scene of the crime. it was saturday afternoon around 5pm... police say at least four suspects blasted into the apple store on broadway and swipped iphones and mac computers. authorities say, the store is still tallying up the total, but add the thieves took off

with thousands of dollars in stolen goods. the black suv has a license plate - a lt. told kron four news they are working with oakland police on the case. this crime - comes on the heels of several other recent thiefs at apple stores... take a look at these pictures... at the corte madera apple store - police say 5 men rushed into and within one minute took 19 thousand dollars worth of items. the store has 2 security guards, but central marin police are now stepping up patrols at the store. at the walnut creek store... two private security guards kept watch over those coming and going... apple employees are not alllowed to talk on record... but several off camera told me that they feel frustrated that apple is not doing more to stop these thefts... check out this video.... in southern calfiornia, cusomters tackled several thieves trying to rip off the store. kron four

( james ) happening today... daniel gross -- the modesto man who killed an east bay woman -- then left her on the side of the road will appear in court. lizette cuesta was killed back in feburary. before she died she led investigators to gross and melissa leonardo. gross pleaded guilty to

charges of beating.. stabbing and killing cuesta. leonardo pleaded ánot guilty. today's hearing will set the location of future court dates. ( james ) in the south bay... a 15-year-old is recovering after being shot near a school in san jose. it happened on the 900 block of walnut woods drive... that is just two blocks from robert f. kennedy elementary school. the teen is expected to be okay but the shooter is still on the loose. ( darya ) new this morning... the man convicted of killing a san francisco woman 20 years ago... will stay in prison. lisa valdez -- pictured on the right with her mother -- was stabbed to death in her diamond heights apartment in anthony hughes for her murder after getting a d-n-a match... 13 years later. bloodstains on 2 pillows led police to hughes. hughes was also matched to a fingerprint in the victim's bathroom. hughes was convicted of second-degree murder 2 years ago. his attorneys had argued that a delay in prosecuting hughes... violated his constitutional

rights to a fair trial. the appeals court rejected that argument. ( darya ) in the east bay... there's a growing movement to have a child kicked out of the mount diablo school district... for making violent threats. that student has already been placed in another middle school in the district. the student's new school -- sequoia middle school -- held a meeting last night to discuss the issue. the student was arrested back in june... for threatening to shoot 30 students at valley view middle school. the boy was never charged... but guns were found in his parents home. a petition to have the boy kicked out of the district has over a thousand signatures. ( darya ) parents are now pushing to get this issue on the school district's agenda for their next meeting. that meeting it set for mid- september. ( james ) a big story we are tracking this morning... a new move from the defense team in the deadly ghost ship warehouse fire case.

attorneys for one of the defendants... derek almena... filed a motion regarding the plea agreement that was thrown out. attorney tony serra says a fill-in judge did not follow the plea agreement during sentencing because there was a conflict of interest. ( james ) serra went on to say... judge cramer had verbally agreed three times to follow the plea deal prior to the hearing. serra says if he knew the judge would change his mind... he would have waited until the original judge overseeing the case had returned to court after dealing with a personal matter. both sides will return to court next month to schedule a trial date. that will be followed by a november 2nd

hearing of a motion to change venues. ( james ) new this morning... san francisco may be allowed to pilot a program to let people inject heroin and other drugs under medical supervision. the goal is curb overdose deaths. the state assembly passed the safe injection sites bill yesterday. it now goes to governor brown. the sites would provide sterile needles and people would be able to use illegal drugs there without fear of arrest. ( darya ) students at armijo high school in fairfield returned to class monday... just days after shots were fired a block away near a friday night football game. a 16-year-old was killed in that shooting. after the shooting... police funneled the crowd into the high school gym... and put them on lockdown... but the scary sitution was made worse when students realized

one of the shooters... had slipped into the gym... and tried to hide among them. but police were able to find him and the other gunman. and as students returned to class yesterday...many of them say they were thinking about school safety. ( darya ) fairfield police have increased their patrols around the school and the district also brought six counselors onto campus... to provide support for students and staff. ( james ) another big story... this morning we are learning that the three remaining madden classic gaming events ... have been canceled. this after the deadly shooting at a gaming tournament in jacksonville, florida. gunman david katz shot and killed two people and injured 10 others... before shooting himself. there is still no motive for the shooting... however we are

learning that katz was once treated for psychological and emotional issues.... and according to his parents' divorce papers in 2006-- katz was treated with medication for schizophrenia. a man who survived the shooting...says he is still in disbelief this morning. ( james ) the two players who died... have been identified as 27-year old taylor robertson from west virginia who had won the national tournament two years ago... and 22-year old eli clayton a former high school football player from woodland hills in southern california. the 10 other victims who were shot are all expected to survive. ( darya ) a 20-month-old child is recovering this morning after being hit by a car in menlo park. it happened near willow road last night. police say the toddler was riding a toy car when a relative was backing his car on the driveway and did not see the child. the child is in critical condition at lucile packard children's hospital stanford but is expected to survive. the driver is cooperating with investigators, who do not believe drugs or alcohol were factors in the case. the manhunt is on for a northern california man believed to be on the run with a 16-year-old girl. the man... identified as phillip maglaya... was a volunteer wrestling coach at franklin high school in stockton. the 16-year-old girl has been missing since last wednesday. investigators believe the two are involved in a romantic relationship. the 16 year relationship. the 16 year oldús father says he found a note from his daughter saying she loved him and that she was safe. he says he had no idea she was seeing the wrestling coach and that he just wants his home. ( james ) in san jose.... a homeless advocacy group is trying to save a county-owned building from the wrecking ball. the old san jose city-hall annex, at first and mission, is slated for demolition to make way for a parking lot. but homeless advocates say it could be converted into 100-150 units for people now living on the streets. the county says such a plan is far too

expensive. the board of supervisors has is expected to take action on the proposal next month. ( james ) new this morning... firefighters spent the overnight hours mopping up a small grass fire. this is video from the scene tweeted out by firefighters. the fire broke out at 9:15 last night on the 100 block of west view. the fire burned some fences and a hillside but no structures were damaged. no body was injured. ( james ) some california parents may soon be allowed to give their children medical marijuana on school campuses. there is a new bill that just cleared the state assembly. right now... california allows minors to use medical marijuana with parental permission... but prohibits the drug on school campuses. bay area state senator jerry hill says it's disruptive for parents to take kids off campus for the medicine. he says the legislation was inspired by a student in his south san francisco district. under the proposal...the marijuana would have to be in non smoking form. school districts must also opt-in to

the law... it is not a state mandate. ( darya ) in the east bay... members of law enforcement throughout the state came to the bay area to focus on getting a message out to the public... about using marijuana and getting behind the wheel. they held a marijuana traffisafety summit in dublin. officers say the importance of informing the public about the dangers of driving while under the influence of marijuana was the primary subject of the summit. authorities also discussed driving while under the influence of other drugs like painkillers and sleeping pills ... all of which officers say... are also on the rise. ( darya ) the driver of a wine country tour bus is arrested on suspicion of driving drunk. the incident happened in healdsburg. passengers on the bus convinced the driver to pull over while they called police. passengers had found 60-year-old eugene cremens passed out after they completed a wine tour and they said it took a while to wake

him up. when he started driving he could not conrol the bus... cremens blood alcohol was three times higher than the legal limit.
